1 Introduced by: Mayor Thompson Introduction Date: Public Hearing: Adoption Date: Land Use Amendment Approval, Resolution: Vote: HOUSTON, ALASKA ORDINANCE AN ORDINANCE OF THE HOUSTON CITY COUNCIL AUTHORIZING THE MAYOR TO NEGOTIATE THE SALE OF CITY OWNED PROPERTY, MSB TAX PARCEL #17N03W11, REFERING A LAND USE AMENDMENT QUESTION TO THE PLANNING AND ZONING COMMISSION FOR RECOMMENDATIONS AND APPROVING THE SALE CONTIGENT UPON A LAND USE AMENDMENT BE IT ORDAINED AND ENACTED BY THE CITY OF HOUSTON, ALASKA: WHEREAS; the Mayor has received an application to purchase city owned property under HMC , (1) (a) negotiated sales, Purchase of city property by an owner of property contiguous on a side with the City land applied for and the purchase is necessary for the proper utilization of the owner s contiguous property; and WHEREAS; the property listed in (Exhibit A), has been conveyed to the City of Houston by State of Alaska Patent # 4445 on September 27, 1979; and WHEREAS, the applicant owns contiguous property; and WHEREAS, the purchase is necessary for the proper utilization of the owner s contiguous property; and WHEREAS, the applicant meets the qualifications of an applicant in accordance with HMC ; and WHEREAS, the property is zoned as PLI: Public Lands and Institutions District; and WHEREAS, no lands or any interest in lands shall be sold or exchanged unless the same has been appraised by a qualified appraiser within six months prior to the date fixed for the sale or exchange; and WHEREAS, alternatively, the latest available Matanuska- Susitna Borough assessed value may be used; and WHEREAS, no land shall be sold or exchanged for less than the approved minimum appraised or assessed value; and WHEREAS, the property was appraised on March, 28, 2018 (Exhibit C); and Bold and Underline, added. 2 WHEREAS, upon determination of a public use or upon disposal of the land to a private ownership, the land shall be rezoned to an appropriate district, if required, depending on the anticipated uses; and WHEREAS, the change in zoning district shall be in accordance with HMC 10.08; and WHEREAS, Changes in the land use district map may be initiated by the following, 1. The Houston City Council upon its own motion; 2. The Planning Commission upon its own motion; 3. Any individual, corporation or agency other than those listed above, subject to the following conditions; for a land use district map amendment, the owners or owner of a majority of the lost in the petition area; WHEREAS, the Houston City Council refers the question of the land use to the Houston Planning and Zoning Commission; and WHEREAS, the sale is contingent pursuant to the approval of a land use amendment; and WHEREAS, any sale or disposition of City lands or any interest in lands shall be subject to terms and conditions in HMC Public Lands and in the City ordinance approving the disposition; and WHEREAS, any sale, lease or exchange of City land shall be approved by the Council by ordinance. The ordinance shall identify the parcels for sale, lease or exchange, the manner of disposition and any special terms or conditions; and WHEREAS, the identity of the parcel for sale, the manner of disposition and any special terms and conditions are incorporated as exhibits in this ordinance; and WHEREAS, the property is for sale on an as-is basis. Terms of the negotiated sale are as outlined in (Exhibit B) WHEREAS, the sale is contingent upon approval of a land use amendment by the Houston City Council; and WHEREAS, all revenue from the sale shall be deposited in the capital account fund. SECTION I: CLASSIFICATION: This is a non-code ordinance. SECTION II: SEVERABILITY: If the provisions of this ordinance, or any application thereof to any person or circumstances is held invalid, the remainder of this ordinance and the application to another person or circumstances shall not be affected thereby. SECTION III: PURPOSE: This ordinance is enacted to: Authorize the Mayor to negotiated the sale of city property.
