1 October 4, 2018 The Honorable Board of Lyon County Commissioners met this day in regular session with the following present: Chairman Bob Hastings, Vice-Chairman Joe Mortensen, Commissioners Greg Hunewill, Don Alt and Ken Gray. Also present: County Manager Jeff Page, District Attorney Steve Rye, Clerk and Treasurer Nikki Bryan and Deputy Clerk Donna MacGill. 1. Roll Call Present: Bob Hastings, Joe Mortensen, Greg Hunewill, Don Alt and Ken Gray. 2. Invocation given by Jonathan Montgomery Jonathan Montgomery of the Harvest Baptist Church gave the Invocation. 3. Pledge of Allegiance 4. Time Certain 4.a. Time Certain at 9:15 A.M: Nevada Association of Counties (NACO) presentation by Dagny Stapleton, Executive Director, and Vinson Guthreau, Deputy Director, to update the Board and community on NACO items of interest, NACO activities and NACO priorities. - NACO Presentation to Lyon County Executive Director of NACO Dagny Stapleton discussed the Board of Directors and gave a power point presentation. She thanked Comm. Hunewill for his participation at the NACO meetings. She discussed items that affect the counties. She also discussed PILT funding and the importance to the members. She discussed the various topics that are tracked by NACO. She also discussed the Natural Resources lawsuits they have been involved with. Dagny also thanked Comm. Alt for his participation in NACO and the Natural Resources and the Public Lands issues. Deputy Director of NACO Vinson Guthreau thanked Comm. Gray for his participation and help in drafting the agenda for the upcoming legislative session that begins in February. The NACO board approved five BDR s that can be submitted to the Legislature. He reviewed the proposed BDR s that will be brought forward. Dagny Stapleton also discussed the BDR regarding counties having the ability to establish a 501(3) c for those who want to help the jurisdiction in terms of raising funds and providing emergency assistance to victims in the community. A 501(3) c could be used to accept and distribute donations that come in after a tragedy or major event such as the shooting in Las Vegas one year ago. She discussed the proposed changes to the primary election procedures and also commented on unfunded mandates. She said the annual NACO meeting will be held November 13 through November 15 in Douglas County. She said the National NACO meeting will be held next year in Clark County and hopes that some of the commissioners will be able to attend. County Manager Jeff Page applauded the efforts of Dagny Stapleton and her staff. He discussed the improved communications concerning Health and Human Services issues. He also complimented Comm. Hunewill for his involvement with NACO. 4.b. Time Certain at 9:30 A.M: For Possible Action: Western Nevada College is seeking feedback on programs that Lyon County would like to see in their communities. 101 October 4, 2018

2 The Fallon Campus Rural Outreach Director Holly O Toole and advisor and mentor Walt Lewis were present to field any questions the Board of Commissioners may have. They currently have a new president for Western Nevada College and are interested in renewing their partnership with Lyon County to offer credit classes for adult students who are seeking a degree or to upgrade their education and skills. She is requesting feedback for classes desired in Fernley and in Yerington. This is not part of the Jump Start Program that already exists in the high schools. She discussed the various ways a person could achieve their degrees. She discussed needs based on communities. She discussed the areas of Fallon, Fernley and Silver Springs. She talked about emulating TMCC and bringing opportunity to the rural areas of Nevada. The commissioners had questions and comments. County Manager Jeff Page also had comments regarding Lyon County s past WNC participation. He is very supportive of conversation to promote this venture. He said the unemployment rate in Lyon County has gone down to 4-6%. Holly O Toole advised us to work with the other counties and put together a rural advisory board. 4.c. Time Certain at 10:15 A.M: For Possible Action: Approve waiver of potential conflict of interest due to Taggart and Taggart's representation of former client in water rights matter that potentially overlaps with water rights issue in Lyon County. At the request of the District Attorney Steve Rye, the Board of Lyon County Commissioners went into closed session before hearing the 10:15 Time Certain item. CLOSED SESSION Comm. Mortensen moved to approve the waiver of potential conflict of interest due to Taggart and Taggart's representation of former client in a water rights matter that potentially overlaps with water rights issues in Lyon County. Comm. Gray seconded and the motion passed Public Participation 6. For Possible Action: Review and adoption of agenda Comm. Mortensen moved to approve the agenda as presented. Comm. Gray seconded and the motion passed Presentation of awards and/or recognition of accomplishments There were no awards or recognitions. 8. Commissioners/County Manager reports Comm. Alt commented on the Public Lands meeting. He said the Department of Interior came out with the new areas. We are now included with parts of California, Oregon and parts of Arizona. He also discussed the bi-state sage grouse issue and urged the county to finalize their plans and updates. Comm. Hunewill invited everyone to Rotary Fun Days this weekend in Smith Valley. 102 October 4, 2018

3 County Manager Jeff Page said there was a significant rain event and resulted in some flash flooding last night. He also commented on his annual performance appraisal and said it would be on the next agenda. He also discussed the Silver Springs Airport Master Lease and the response from FAA. He commented on the City of Fernley Community Center that will be built. Both sides have sat down and discussed the plans. He commented on the money being spent on Information Technology (IT). He is pleased with Lyon County s IT system. He explained that sheriff deputies squad cars are now equipped with computers. He talked about updating the Master Plan. He discussed Public Lands and storm water drainage concerns. He talked about future funding to deal with those issues. 9. Elected Officials reports 9.a. Dayton Justice Court - Civil, Criminal and Traffic Monthly Statistics Report 9.b. Other Elected Official Reports Sheriff Al McNeil talked about establishing base lines for crimes and response time. He discussed priority one, two and three calls, priorities one and two being the most critical. He discussed pre-dispatch times. He said that Fernley and Silver Springs have done a great job on improving response times. He said they are continuing to work on Dayton, Mason Valley and Smith Valley. The watch commander system is up and operational. He read a statement into the record regarding brothels and compliance issues for employees of brothels. He said his staff is continuing to work with brothel staff and attempting to implement new guidelines. He said he does not believe the brothels are knowingly engaged in international human trafficking. He discussed regional sex trafficking. He thanked U.S. Immigrations for the report. He talked about the availability of equipment to validate U.S. and foreign passports. Comm. Mortensen had questions regarding work cards. Sheriff Al McNeil discussed legal prostitution in Lyon County and strengthening the county code. District Attorney Steve Rye said it is his opinion that if they possess documents that allow them to work in the United States, they could not be precluded under county code to work in the brothels. 10. Appointed Officials reports Comptroller Josh Foli updated the board on a number of projects. He talked about replacing the repeaters for the simulcast project. The cost will be four to five hundred thousand dollars for the equipment to replace the repeaters. It will end up being about a million dollar project in all. They are working on the building permit and planning software implementation. They are trying to implement online applications. The audit is moving forward and will be brought before the board in December. If the items are approved today that are proposed to come from contingency, it would leave approximately a $160,000 balance in contingency funding in the General Fund. The majority has been spent on software or technology and $125,000 was for a legal settlement. We need to adopt new policies for the Federal grant purposes. Some of the items will be on the next agenda. Planner Rob Pyzel said they are targeting the October 18 th meeting for Title 15. It is available online. He updated the board on the second bridge in Dayton. He commented on the benefits. They were told to look at the north side of Dayton. He also received a draft population estimates from the state demographer. They received notifications from the State Clearing House 103 October 4, 2018

4 regarding the Nevada transportation plan and the Carson River Mercury Super Fund draft feasibility study. He also discussed the water tank to assist Stagecoach. He talked about the Crosby Ranch and also discussed a future parcel map regarding a grocery store on the corner of U.S. 50 and Fortune. The remaining parcels will be developed as a commercial center. Edrie LaVoie commented on the Yerington Senior Center Barbeque at 11:30 on Friday, October 5 th. There will be a Board of Health item on the next agenda regarding the opioid response from the Attorney General s office. She said that Jeff Page stole her thunder on the Fernley building project. She doesn t want recognition; she only wants the agreement signed. She talked about the transition plan in her various departments. She spoke very highly of Dagny Stapleton. 11. Planning 17.a. For Possible Action: WOODBRIDGE ESTATES / DAYTON 2015, LLC TENTATIVE SUBDIVISION MAP Request for a Tentative Subdivision Map to create 91 single family residential lots on approximately acres, including approximately acres of open space within the mixed use portion of the Woodbridge Estates Planned Unit Development, all subsequent to and in conjunction with a Boundary Line Adjustment being processed concurrently; located South of Highway 50 at Mark Twain Avenue, Dayton (APNs & ) PLZ Staff Report - Letter of Transmittal from DRAC Planner Rob Pyzel presented. He explained this was a previous PUD that was proposed in 2007 and was later abandoned in He discussed an NDOT maintenance facility that will be constructed. He described the construction process of the proposed project. He said the planning commission recommended approval based on the findings and the 28 conditions. He said the project is in compliance. Comm. Mortensen moved to approve WOODBRIDGE ESTATES / DAYTON 2015, LLC TENTATIVE SUBDIVISION MAP Request for a Tentative Subdivision Map to create 91 single family residential lots on approximately acres, including approximately acres of open space within the mixed use portion of the Woodbridge Estates Planned Unit Development, all subsequent to and in conjunction with a Boundary Line Adjustment being processed concurrently; located South of Highway 50 at Mark Twain Avenue, Dayton (APNs & ) PLZ , with the findings A. through K. as follows: A. Environmental and health laws and regulations concerning water and air pollution, the disposal of solid waste, facilities to supply water, community or public sewage disposal and, where applicable, individual systems for sewage disposal; B. The availability of water which meets applicable health standards and is sufficient in quantity for the reasonably foreseeable needs to the subdivision; C. The availability and accessibility of utilities; D. The availability and accessibility of public services such as schools, police protection, transportation, recreation and parks; E. Conformity with the zoning ordinances and master plan, except that if any existing zoning ordinance is inconsistent with the master plan, the zoning ordinance taking precedence; F. General conformity with the governing body s master plan of streets and highways; G. 7 H. Physical characteristics of the land such as floodplain, slope and soil; I. The recommendations and comments of those entities and persons reviewing the tentative map pursuant to NRS to , inclusive; J. The availability and accessibility of fire protection, including, but not limited to, the availability and accessibility of water and services for the prevention and containment of fires, including fires in wild lands; and K. The submission by the applicant/property owner of an affidavit stating that the applicant/property owner will make provision for payment of the tax imposed by chapter 375 of NRS and for compliance with the disclosure and recording requirements of subsection 5 of NRS 598,0923, if applicable, by the applicant/property owner or any successor in interest. and the 28 conditions as follows: 1. Approval of the tentative map shall not constitute acceptance of the final map. Approval of the tentative map shall lapse unless a final map based thereon is presented to the Board of Commissioners within four (4) years from the date of such approval, unless a provision for an extension of time has been granted. The Board of County Commissioners, with the recommendation of the Community Development Department, may grant to the developer a single extension of not more than two (2) years within which to record a final map after receiving approval of the tentative map. 2. The applicant shall comply with all Federal, State, County and special purpose district regulations. 3. The developer shall provide the proposed Covenants, Conditions and Restrictions ( CC&Rs ), landscape maintenance association/homeowners association agreements, easements and/or other legal instruments containing sufficient detail to constitute enforceable provisions necessary for operation and maintenance by the developer and his successors, and assignees as well as the individual subdivision lot property owners as the project is subdivided and the individual lots sold for all open space/common areas, the club house and storm drainage facilities (easements, channels and basins) as well as any associated landscaping within the open space/common area lots and storm drainage facilities and other provisions necessary for the subdivision as approved, for review by the Community Development Director, the Utilities Director, the County Engineer and District Attorney s Office. The approved legal instrument shall be signed and recorded prior to approval of a final map or first in a series of final maps for the project. 4. The applicant shall submit and receive approval of a street-naming application prior to submittal of an application for a final map or first in a series of final maps. Should any requested street name(s) be denied, the Community Development Director is authorized to administratively process a request for a replacement street name(s), obtain review and comment from the fire district with jurisdiction, Road Department and any other appropriate agency, and approve a revised street name(s) without the requirement of a public hearing before the Planning Commission. 5. A phasing plan must be submitted prior to the recordation of the first final map if the development is to be phased. 6. All property taxes must be paid in full through the end of the fiscal year (June 30) and any applicable agricultural deferred taxes shall be paid in full prior to recordation of any final map. 7. The applicant shall comply with the final subdivision map requirements as prescribed by NRS 278 and Title 11 of the Lyon County Code. 8. Required recording fees to be paid at time of recording map. 9. No lot shall be offered for sale or sold until the final subdivision map has been approved and recorded. 10. No building permits shall be accepted for processing until a final subdivision map has been approved and recorded. 11. The applicant shall make corrections of any engineering or drafting errors and other technical map corrections to the satisfaction of the County Engineer and Community Development Director prior to submitting the final subdivision map for recordation. 107 October 4, 2018

8 12. The applicant shall pay the actual costs for County Engineer plan and map checking and County Inspector site improvement inspection fees, in accordance with the adopted County fee resolution in effect at the time, and provide proof of payment to the Community Development Department prior to final subdivision map recordation. 13. The applicant shall provide written evidence (i.e. will-serve letters) demonstrating that the proposed parcels are able to be served by municipal water and sewer systems, natural gas, electricity, cable television, and telecommunications prior to recordation of a final subdivision map or first in a series of final maps for this project. 14. The applicant shall provide the final subdivision map to the Lyon County GIS Coordinator in form and format compatible with the County geographical information system (GIS) pursuant to of the Lyon County Code. The scale of the site plan, improvements, monuments and other items shall be in model space correctly oriented to coordinate system as established by the GIS Coordinator. Cover sheet and standard details need not be included. 15. The applicant shall comply with County requirements, in accordance with Chapter (F) of the Lyon County Code, mandating that a grading permit(s) be obtained for any site development work prior to any disturbance occurring on the subject site. The grading permit application shall also include documentation of approval of a Stormwater Pollution Prevention Plan ( SWPPP ) with the Nevada Department of Environmental Protection (NDEP). 16. The applicant shall obtain any required Air Quality Permit(s) from the (NDEP) and apply appropriate dust abatement processes as part of the development construction prior to any disturbance on the site. 17. The improvements required by the terms of Title 11 of the Lyon County Code shall be inspected by the County as the work progresses. Such improvements shall not be started until the inspection fee, required as a prerequisite to the filing of the final map, has been paid. 18. Prior to any construction of improvements, a preconstruction conference shall be held between the contractor/developer and the appropriate County inspection personnel. 19. The applicant shall comply with Lyon County improvement requirements as set forth in Chapter of the Lyon County Code including, but not limited to: a. The developer shall obtain all necessary encroachment permits and approvals as well as coordinate and comply with the requirements of the Roads Department; b. The developer shall design the street alignments in compliance with AASHTO standards to the approval of the Road Superintendent; c. The developer shall install all required signage, striping and traffic control improvements in compliance with Nevada Department of Transportation and Lyon County requirements; d. Street name signage shall be installed. e. The developer shall install street lighting in compliance with the requirements of the Roads Department; f. The developer shall submit a detailed geotechnical report with the final map(s) for the project that includes roadway structural sections and the structural section calculations demonstrating that the proposed structural section is adequate to support the weight of the anticipated traffic; g. The developer shall provide a slurry seal onto the streets and roadways in compliance with the current County standards every five (5) years from the date of installation of asphalt concrete paving of the subdivision s streets and roadways until such time as the subdivision is 90% completed and the County accepts the offer for dedication for the rights-of-way for all streets and roadways within the subdivision; and h. The developer shall make a perpetual offer of dedication for the right-of-way for all streets and roadways within the proposed subdivision. The County rejects the offer of dedication at this time and will not accept the offer of dedication until at least 90% of the lots within the respective unit have been developed, the improvements are inspected and approved by the County, and the County accepts the improvements for maintenance. 108 October 4, 2018

The developer shall install Type 3 barriers and cattle guards at the terminus of all streets that terminate at the boundaries of the subject site and vacant undeveloped lands to the satisfaction of the Road Superintendent; 20. The developer shall submit an amendment to the November 2016 traffic study with the revisions to include: a. The applicant shall refer to the US 50 East Corridor Study (November 2007) to coordinate improvements identified as potential mitigation for any impacts born from this development. b. All the analyses provided in the appendix of the 2016 traffic study were done using PTV Vistro software for traffic impact analyses and traffic signal optimization. NDOT accepts either HCS or SYNCHRO (latest applicable version). The applicant shall revise their traffic study and provide the results using either one of these software packages. c. The 2016 traffic study assumes a one percent (1.0%) growth rate for background traffic for the horizon year assessment. Based on the completion of USA Parkway, previous documents indicate a growth rate well above 1.0%. The amendment will adjust future year projections based on the most recent travel demand forecasting model in the area. d. The applicant shall have a pre-application meeting with NDOT and Lyon County staff to coordinate potential improvements that shall require mitigation prior to initiating the amendment to the November 2016 traffic study. e. The existing approaches are personal and not transferable with the sale of the property. If the property changes ownership or use, the new property owner will need to apply for an occupancy permit for access onto the state highway. f. An occupancy permit is required for facilities within the NDOT right-of-way. g. Prior to any grading adjacent to NDOT rights-of-way, a Drainage Information Form, including a grading plan must be submitted to the Permit Office. h. A drainage report shall be submitted for any development or construction that impacts flow to or within State rights-of-way. i. Contact the Permit Office to coordinate with NDOT s Hydraulic Design Division. It is beneficial to the developer to start to work early in the process with the Hydraulic Design Division to answer questions and give guidance. j. The information provided in the traffic report is only an estimate of volumes accessing the proposed driveways. NDOT requests all site access configurations be constructed initially for the project and will include a frontage road connection between the proposed high-t intersections at La Fond Avenue and Mark Twain Avenue. The development shall close the unimproved access but will allow frontage road access (as a continuation of the south US 50 frontage road) for other users to access the proposed high-t intersections at La Fond Avenue and Mark Twain Avenue. In addition, the consultant shall construct connecting median islands for each of the previously mentioned high-t intersections that should extend sufficiently (per design criteria) to the east and west of the project s reconstruction of US 50 to transition/match the existing pavement sections. k. The existing access for the NDOT maintenance facility near La Fond Avenue shall be maintained and not negatively impacted by the development s access proposal. 21. The applicant shall comply with Lyon County s 1996 drainage guidelines (as revised 2006). The applicant shall demonstrate that the proposed drainage facilities will comply with the Lyon County Drainage Requirements to the satisfaction of the County Engineer and Utilities Department Director prior to recordation of the final subdivision map. Major drainage facilities shall be constructed in the first phase of development and each phase of building development shall have drainage improvements that tie into the major facilities and function without dependency on improvements in future phases of development. a. The developer shall demonstrate to the satisfaction of the County Engineer, the County Utilities Department Director and the Community Development Director that provisions for maintenance and continued operation of the stormwater system have 109 October 4, 2018

10 been developed and put in place prior to approval of a final subdivision map or first in a series of final maps for this project. b. The applicant shall provide documentation that easements have been recorded to permit discharge of project generated stormwater to all off-site properties receiving stormwater discharges prior to recordation of a final subdivision map or first in a series of final maps for this project. c. The applicant shall demonstrate to the satisfaction of the County Engineer, the County Utilities Department Director, and the Community Development Director that facilities necessary to protect source water from potential stormwater contamination have been designed and will be installed prior to approval of a final subdivision map or first in a series of final maps for this project. d. The applicant shall demonstrate to the satisfaction of the County Engineer, the County Utilities Department Director, and the Community Development Director that facilities necessary for the treatment of stormwater prior to discharge have been designed and installed prior to approval of a final subdivision map or the first in a series of final maps for this project. e. The applicant shall demonstrate to the satisfaction of the County Engineer, the County Utilities Department Director and the Community Development Director that provisions for maintenance and continued operation of the stormwater system have been developed and put in place prior to approval of a final subdivision map or first in a series of final maps for this project. f. Debris grates are required at the pipe inlets of the retention/detention basins. 22. The applicant shall complete any and all required development improvements and facilities to the satisfaction of the Community Development Director, County Engineer, Road Director, Utilities Director, Building Official, CLCFPD or other authorized County personnel, as applicable, or an appropriate security must be provided and approved prior to recordation of a final subdivision map or first in a series of final maps for this project. There may be temporary restrictions to obtaining building permits even with an acceptable security instrument depending on the County s approval of the various systems. All facility construction shall be completed and inspected to the Building Official s satisfaction prior to the issuance of a Certificate of Occupancy will be allowed in any single family residence for this project. 23. The applicant shall comply with all applicable building and fire code requirements. 24. The water system must meet the requirements of the Lyon County Utilities Department and CLCFPD and be constructed in accordance with the following: a. The location of fire hydrants shall be determined by the CLCFPD Fire Chief or their designee. b. A minimum required fire flow is required for each fire hydrant as directed by the CLCFPD Fire Chief or their designee. c. Prior to any combustible materials being brought on site the following shall occur: d. All required fire hydrants are to be installed and fully operating. 25. Distinct and legible temporary addresses are required of any structures under construction until such time as permanent address numbers are installed and posted. 26. The applicant will maintain the property until the development is complete. This maintenance will include the semi-annual mowing of all weeds within the development boundaries and the removal of noxious weeds when they are identified. 27. The applicant shall post and maintain a rules and regulations sign at the entryways to the property until it is fully developed. The signs shall be intended for the subcontractors performing work and shall include: a. No loud music; b. No alcohol or drugs; c. Dispose of personal trash and site debris; d. Clean up any mud and or dirt that is deposited from the construction parcels onto the streets; and e. No burning of construction or other debris on the property. 110 October 4, 2018

Mortensen moved to approve the initial license and installation of an ArcGIS Enterprise server in the amount of $34,000 to have our own environment for our GIS data with funding to come from a contingency budget transfer. Comm. Gray seconded and the motion passed b. For Possible Action: Approve purchase of a Storage Attached Network (SAN) and related hard drives for server disaster recovery not to exceed $75,000 with funding to come from a contingency budget transfer. Josh Foli said that Lyon County will need to add another hard drive or two. We need to update the backup system to be sure it is adequate. We need to enter into the contract by end of October to save approximately $15,000. He explained some of the bandwidth needed for system backups. Comm.
