3 Request for Decision Background Report Prepared by: Tracy Napier, Planning Technician Prepared For: Board of Directors Special Meeting, April 14, 2009 Subject: Application for Non-Farm Use in the ALR Applicant: Legal Description: General Location: Bass Coast Project Ltd., Agent (Ali Albolfathi, Owner) DL 994, NWD 16.5 Mile, Squamish Valley Road, Area D Problem Defined: BACKGROUND The SLRD has received an application for non-farm use in the ALR for the lands legally described above. The subject property is roughly 72ha in size, and approximately 45ha are within the ALR. Some of the activities are proposed to occur on lands within the ALR, thus the permission of the Commission is required (see attached Subject Property Map). PROPOSAL The purpose of the application is to seek approval for a two day music festival on the subject property (see attached Applicant s Submission). As the application states, most of the festival activities will occur on the non-alr portions of the property, however the festival gates, security check-point, a portable toilet will be at the entrance to the property, and within the ALR. The property is currently used as the Squamish Valley RV and Campground. This non-farm use appears to have been approved by the ALC under File # YY The applicant s have indicated that the existing approved campground will be used for festival parking and camping. POLICY The subject property is designated Agriculture in the Electoral Area Whistler South Official Community Plan Bylaw No. 495, and it is un-zoned under Zoning Bylaw 540. The OCP contains the following policies with respect to agricultural Land: The Regional District supports the agricultural industry and the mandate of the Agricultural Land Commission to protect lands which have value for agricultural purposes; Uses permitted in areas designated as Agriculture are agriculture and residential. In addition to permission from the Agricultural Land Commission for this festival, the applicant s are required to obtain a Special Event Permit (SEP) from the SLRD. Prior to receiving the SEP, the applicant is required to provide information to show that the proposal has been considered SLRD Special Board Meeting Agenda; April 14, 2009 Page 3 of 38

4 and approved by the appropriate health authority, the RCMP, and the local Fire Marshal. The applicant is aware of these requirements and is preparing the necessary materials for submission. AGRICULTURAL CAPABILITY The provincial agricultural capability mapping indicates that the land in the vicinity of the subject property is rated 70% Class 2 with excessive water as a limiting factor, and 30% Class 4 with low moisture holding capacity as a limiting factor. The lands are improvable to 70% Class 1 and 30% Class 2 with low moisture holding capacity as a limiting factor. This rating system is based on 7 Classes, with Class 1 having no limitations, and Class 7 having no productivity. This information was gathered from the 92G/14 Agricultural Capability Map from the Ministry of Environment, Ecosystems Branch. ADJACENT LAND USES The applicant describes the adjacent land uses as follows: North: Private land, not farmed, no primary residence East: Squamish Valley Road, partially used for hay South: Cheakamus Indian Reserve No. 11, Glacier Valley Farms, organic vegetables and herbs West: Squamish River, Crown land LETTERS OF SUPPORT The applicant has included several letters of support for the proposed festival from adjacent land owners, and has contacted the Squamish Nation to discuss the proposal. Conclusion: As the applicant s submission states, the bulk of the festival activities will occur outside the ALR boundary, with the uses proposed for ALR lands including the following: security checkpoint; portable toilet; recycling and garbage containers along the existing driveways; camping and parking at the existing campground facility. It appears that the festival activities that are proposed to occur within the ALR represent a low likelihood of negative impacts to the agricultural capability of the land, or to adjacent agricultural operations. The activities involve only two temporary structures (checkpoint tent and toilet), and mainly use an existing driveway to provide access between the two stages. The adjacent farms and property owners have indicated their support for the festival. Although the policies of the OCP describe suggested uses for lands designated Agriculture, in the absence of an implementing zoning bylaw, there are no permitted uses, thus from a zoning perspective, there is nothing to prohibit this type of use. Action Plan / Communication Plan: The recommendation of the Board will be forwarded to the ALC for their consideration. The property owner will be notified of the Board recommendation. 8 Applicant: Bass Coast Project Ltd. is applying for a Non Farm use permit with the authorization of Ali Reza Albofathi owner of Squamish Valley Campground & RV Park. A letter is attached formalizing this agreement (Appendix 7: Agent Authorization). Local Government: The land is partially zoned under the ALR and is in the district of the SLRD. Land Under Application: The parcel of land is numbered District Lot 994 The size is 74 hectares Copies of the Title are attached: BG (Appendix 6) Proposal: Bass Coast Project is proposing a 48-hour festival of 1500 participants on Private district lot 994 in the Squamish Valley. A portion of district lot 994 falls under the Agriculture Land Reserve (refer to Appendix 1: Proposed Site Plan: ALR Land use), and the lot is currently zoned and approved to operate as an RV Park and Campground by the ALC (ALC File 30447). Bass Coast Project intends to use the existing entrance gates and existing roads, which fall on the Agriculture Land Reserve, for the event. Increased traffic levels will occur during event entrance and exit periods. (Fri. July 24 12pm 10 pm & Sun. July 26 10am-6pm, 2009). Minimal Camping and parking is also proposed on ALR land as per current approved land use (ALC File 30447). All temporary structures & activities lay outside the Agriculture Land Reserve (refer to Appendix 2: Proposed Site Plan). This event will not require any temporary or permanent alteration or construction on the land. There is little potential for impact on neighbouring properties. Forest and river border the proposed site to the north, and a fence borders the site to the south. The purpose of this proposal is to ensure the ALC is aware of this event s minimal impact through increased traffic, on the existing entrance and access roads. Bass Coast Project is proposing the following usage of ALR land: 1. Existing Entrance Gate on to property with Security Check Point 2. One Portable Toilet at entrance gate for limited use (staff & emergency). [Refer to Appendix 8: Photographs] 3. Existing Main Access Road (for campground access). 4. Recycling & Garbage Stations will be located every 100m of the existing property roads and collection will be conducted every 6 hours. 5. Camping and parking of participants as per current use of approved campground. [Refer to Appendix 8: Photographs] Bass Coast Project is proposing the following usage of land adjacent to ALR land: (Please Refer to Appendix 2: Proposed Site Plan) 1. Portable Toilets Collected & Serviced by Carneys Waste Systems 2. First Aid Facility: consisting of a 10X10 Pop-up Tent, Walls, tables, cot and chairs. 3. Information Centre: A tent 30 X15. With Tables, Chairs, Merchant Vending, Shelves, Merchandise, Lost/Found etc. 4. Portable Power Source at each main stage area: 60 KW Generator Trailer. 5. Potable Water: A 10 X 10 Tent to serve as a water bar where Potable Water Bottles will be available. 6. Merchant Vending: X10 Pop-up Tents, with tables, chairs & shelves. 9 7. Two 5,000 gallon water tank will be relocated from the upper portion of the property to stage & main meeting areas for emergency fire response (refer to Appendix 5: Fire Plan 8. Two Temporary Stages consisting of Scaffolding*, Table, Sound system* (Speakers are raised on wooden boxes), 1 Lighting* (all lights are free-standing and connected via commercial grade electrical junctions) Potential Impact & Proposed Action Plan: Increased Volume of Motorized Vehicles on existing entrance gate and access road o Organizing a shuttle bus to transport participants to and from event o Restricting the use of motorized vehicle access to entrance and exit only o Charging Re-entry fee to discourage participants from traveling during the festival hours Portable Toilets o One unit located at entrance for staff use only o Main waste management system for the festival is located off of ALR land to reduce impact o Waste Management Servicing company will use existing roads and entrance way to service portable toilets as per current usage Increased Garbage & Waste o Bass Coast Project has adopted a Leave no Trace Initiative through collaboration with sustainability professionals working in the Squamish area to encourage & educate participants to minimize their footprint on the land during the event through: All marketing and promotional items Signage and Garbage/Recycling Stations every 100 m of Access Roads Bass Coast Project has a team of 10 volunteers and two staff members to organize and perform collection and sorting of garbage and recycling every 6 hours of stations and to perform walk through collection of stage areas Bass Coast Project has a comprehensive clean-up task force to strike after the festival close. 10 o After the Close of Bass Coast Project an environmental assessment and restoration task force will look at any possible damage that occurred as a result of the festival Scope of Bass Coast Project: The focus will be on cutting edge music with film, fashion, and performance art supporting the sonic experience. There will be a strong environmental focus created through camping, guest speakers, and by hosting the event in a pristine setting. The supporting businesses will be sourced locally and the festival will have a positive impact on the local economy. The business will be designed with every effort made to minimize the environmental footprint through product selection, energy conservation, education, and recycling. Current Use of Land: The land is approved for RV parking and camping by the ALC and a private campground currently operates during the summer season. Gravel roads measure 6 meters wide with sufficient turn around areas for emergency vehicles. Parking and camping areas are cleared and RV parking is available and will serve as over-flow parking for campers. The land is privately owned, and currently has 2 dwellings, multiple sheds and containers, an entrance off of Squamish Valley Road and an access road to the unserviced campsites along the river. See for details. The land has never been in use for farming. Bass Coast Project is making no alterations on the land that would restrict the potential for farming use. The neighbouring property on the north side is a private land not in use for farming or as a primary residence (refer to Appendix 3: Adjacent Land Use). The owner is over-seas and rarely visits. On the West side of the property is the Squamish River. On the other side of the river are crown land and a small island that is part of Lot 994, the campground. The river is large and impossible to cross without a boat. The neighbouring property on the South side is Glacier Valley farms owned by Steve Moir, who is in support of the festival (refer to Appendix 4: Neighbour Endorsements). This property is host to special events and a portion is sublet to a family that farms organic vegetables and herbs, who is in support of the festival and may present an information session on organic farming practices during the festival. The neighbouring property on the East side is across the Squamish Valley Road. This is district lot 993 owned by Bob McGee and family who have given his verbal permission and support of the festival. A small portion of lot 993 farms hay. Further down the road is the subdivision of Rustad Road, which currently has 3 residents. Jonovan Moore is living there full-time and is in support of the festival (refer to Appendix 4: Neighbour Endorsements). The Temple family is building a home there and is in support of the festival (refer to Appendix 4: Neighbour Endorsements). The other property has a home built on it and it is currently vacant, and Bass Coast Project has approached the owner (who is in Europe) to rent the house during the festival. The Cheakamus Indian Reserve No.11 borders a small portion of the land. Bass Coast Project has a formal meeting to discuss the festival with Paul Wick from the Squamish Nation on Wednesday March 25,2009. Bass Coast Project will be discussing the opportunity for the Squamish Nation to have substantial involvement in the opening and closing ceremonies. 31 July 11, 1996 Reply to the attention of Alena Straka Ali Abolfathi Street Edmonton, Alberta T6V 1C2 Dear Mr. Abolfathi: Re: Application #YY The Agricultural Land Commission has now had an opportunity to thoroughly review all of the information contained in your application regarding land described as District Lot 994. You have asked for permission to subdivide the subject property along Squamish Valley Road in order to create a 7 ha northern lot and a larger 72 ha southern parcel to be used for tourist commercial recreation and accommodation. In considering the application, the Commission carefully reviewed the file material in addition to information concerning existing and surrounding land uses and lot sizes, topography, the agricultural capability of the subject property and the application history in the surrounding area. In its review, the Commission noted that the subject property has excellent agricultural potential, as indicated by the land s improved agricultural capability ratings. With proper management, this land has the capability of sustaining a wide range of agricultural options, not to mention its many non-soil bound farming opportunities. It is the Commission s view that subdivision would have a number of negative effects on the agricultural potential of the subject property and the integrity of the surrounding agricultural community. Larger agricultural properties offer their owners a greater range of agricultural options. Subdivision reduces these options and increases the likelihood that the resulting lots will not be utilized for agricultural purposes in the long term. In addition, the proposed subdivision would also have the effect of raising the expectations of surrounding property owners in the ALR. Heightened expectations can lead to the speculative purchase of farmland for anticipated subdivision, the withdrawal of agricultural investment, and ultimately, the decline of the agricultural community. Finally, it has also been the Commission s experience that parcelization in agricultural areas can result in the introduction of incompatible urban influences which can lead to increased pressures on existing farm operations and have negative implications for agriculture in the long term. 32 For these reasons, the Commission, under Section 20(1) of the Agricultural Land Commission Act, by Resolution #586/96, refused your application as submitted. However, the Commission sympathizes with the reasoning behind your request and is prepared to allow in principle the construction of a maximum of twenty cabins on the property subject to the following conditions: July 11, 1996 Page 2 1. The cabin ground cedar support posts must be treated to prevent rotting. 2. There is to be no separate septic tanks for each of the cabins. 3. The access trail to the cabins cannot be paved or gravelled. 4. There is to be no cement laid for the cabin foundations. The Commission requests that a final site plan for the approved twenty cabin development be submitted for its review prior to final approval being granted. The applicant wishes to subdivide a 7 ha parcel which is cut off by the road, encumbered by a Hydro easement and has a small creek running to the east boundary requiring a set back. The intention is to sell this property and use the proceeds to develop the larger balance of the property, between the Squamish Valley Road and the Squamish River for tourist commercial recreation and accommodation. The application suggests that the owner would include twenty cabins and up to one hundred and fifty camping or recreational vehicle spots. There are two statutory right-of-ways in favour of B.C. Hydro registered against the property. The Regional District presently has no zoning in effect for the Upper Squamish Valley, therefore, there is no list of permitted uses against which to compare this proposal. There have been no previous applications on the subject property. 35 were all refused as have the large majority of applications for subdivision of nearby ALR lands. 37 Page 4 #586/96 STAFF COMMENT/RECOMMENDATION: Staff recommends that the Commission give consideration to the refusal of the application as presented as the property consists of some of the best agricultural land in the province, possessing the capability of sustaining a wide range of farming options. The proposed subdivision of a 7 ha parcel from the 79 ha property is being requested in order to financially facilitate the proposed tourist/recreational use on the remaining 72 ha. As this use would only serve to alienate the land from potential agricultural production either now or in the future, staff believes the subdivision request should be denied. DISCUSSION: The Commission concurred with the staff recommendation as presented. However, a previous 1989 decision on the adjacent property to the east permitting the development of 10 cabins subject to specific conditions was discussed. In light of this previous decision, the Commission, with the exception of D. Taylor and A. Hadland, agreed that as the subdivision was being requested in order to assist in financing the development of the remaining 72 ha for a tourist/recreational use, the applicant should be allowed to construct only the requested twenty cabins subject to the following conditions: 1. The cabin ground cedar support posts must be treated to prevent rotting. 2. There is to be no separate septic tanks for each of the cabins. 3. The access trail to the cabins cannot be paved or gravelled. 4. There is to be no cement laid for the cabin foundations. 5. A site plan must be submitted for the Commission s review prior to final approval. IT WAS MOVED BY: SECONDED BY: Commissioner G. Horn Commissioner J. However, the Commission is prepared to allow in principle the construction of a maximum of twenty cabins on the property subject to the following conditions: 1. The access trail to the cabins cannot be paved or gravelled. 4. There is to be no cement laid for the cabin foundations. The Commission requests that a final site plan for the approved twenty cabin development be submitted for its review prior to final approval being granted.
