2 FILE NO. B-5/ BUILT UP AREA Yes No PART B - COMMENTS CONFORMITY WITH OFFICIAL PLAN The proposal conforms with the Official Plan, based on the information available to this Department. The proposal will conform with the Of?cial Plan if/when, (Sec. Nos. ) - Under Section 14.2(2) the severed and retained lands can meet Minimum Distance Separation (MDS1) requirements. - Under Section 14.2(3) the severed and retained lands can meet the requirements of Transcanada Pipeline. (C) The proposal does not meet the intent of the Official Plan because, (a) (b) CONFORMITY WITH ZONING BY-LAW The proposal appears to meet the requirements of the Zoning By aw. The severed/retained portion/overall proposal would contravene the By aw because, PROVINCIAL POLICY STATEMENT and MUNICIPAL PLAN REVIEW DATA No Concerns Concerns X Explanation of Concerns: planning authorities shall plan for and protect corridors and rights-ofway for transportation and infrastructure, including transportation...and electricity generation facilities and transmission systems to meet current and projected needs.
3 FILE NO. B-5/ new land uses, including the creation of new lots shall comply with the minimum distance separation formulae 3.1.1(c) Under Section 3.1.1(c), Natural Hazards, of the Provincial Policy Statement (PPS), development shall generally be directed to areas outside of hazardous sites [sensitive marine (leda) clays]. The PPS de?nes hazardous sites as property or lands that could be unsafe for development and site alteration due to naturally occurring hazards. The PPS specifically lists leda clays as an example of a hazardous site. GENERAL PLANNING COMMENTS There are three Provincial land use planning matters affecting the subject lands; Transcanada pipeline, minimum separations from livestock and/or manure storage facilities and hazardous sites (leda clays). The Transcanada Pipeline (TCPL) crosses the proposed retained lands. Both the Official Plan and Zoning By-law stipulate that all permanent structures and excavations must be a minimum of 7 metres from the TransCanada Pipeline (TCPL) right-of-way. This does not appear to be an issue for this application. However, it is recommended that the Township circulate TCPL and favourable comments will be required. In accordance with the Provincial Policy Statement (PPS), the Township's Of?cial Plan and Zoning By-law require new severed and retained lots to meet the Minimum Distance Separation (MDS1) requirements from neighbouring livestock and/or manure storage facilities. MDS 1 must be calculated for all livestock/manure storage facilities within 1 km of the proposed severed lot. Our records indicate that the following properties have barns within 1 km: 570 Barrie Rd; 55 and 203 Mountain Rd; 633 Robertson Line. There may also be facilities to the south in Mississippi Mills for which information needs to be collected. Please see enclosed maps showing 1 km radius. If these barns contain or are capable of containing livestock, or there is manure storage on the property, an MDS form must be completed for each livestock facility and/or manure storage and returned (with Township fee) to the Chief Building Official at the Township office to determine the minimum separation distance for the severed and retained proposed lots. A copy of the MDS form is enclosed and copies may be made of it, as required. Lastly, Waba Creek borders the retained lands to the south. Our mapping identi?es slip (leda) clays along Waba Creek. The retained lands are large and development may only be affected, if located near the creek. Slip clays do not appear to be a risk for the proposed severed lands.
4 5. RECOMMENDATIONS (a) Planning concerns have NOT been identified in this report. Therefore, consent may be appropriate if supported by Council and the agencies. FILE NO. B-5/16 (b) There are some planning concerns which Council should deal with as follows, before deciding whether to support the consent. (c) The proposal may be acceptable when the following matters are addressed 2] and resolved: - Favourable comments are received from TransCanada Pipeline. - MDS1 calculations are favourable (d) Conditions to the giving of consent should be considered for the following: 3 Registered Plan of Survey Zoning By-law Amendment: Minor Variance: Private Road Agreement: Development Agreement: Site Plan Control Agreement: Notice on Title: Shoreline Road Allowance Closure/ Acquisition: Other: (9) There are serious planning concerns, refusal is recommended.
