1 PERMIT COMPLIANCE FILINGS Permittee: Odell Wind Farm, LLC Permit Type: LWECS Site Permit Project Location: Cottonwood, Jackson, Martin and Watonwan Counties, MN Docket Number: IP-6914/WS Permit Section: Site Permit Condition 5.8 COMPLAINTS Date of Submission: March 27, 2015 Odell Wind Farm, LLC respectfully submits this filing in compliance with Section 5.8 of the Site Permit for the Odell Wind Farm: At least 14 days prior to the pre-construction meeting, the Permittee shall file with the Commission the company's procedures to be used to receive and respond to complaints. The Permittee shall provide a copy of its complaint procedures to all local government officials and landowners listed in Section 5.2 of this permit at least 5 days prior to the start of construction. The Permittee shall report to the Commission all complaints received concerning any part of the Project in accordance with the procedures provided in Attachments 2 of this permit. Section 5.8 of the Site Permit further requires that a copy of the complaint procedure be sent to all local government officials at least five (5) days prior to the start of construction. Odell Wind Farm, LLC developed a complaint procedure in accordance with Section 5.8. A copy of the complaint procedure, along with the contact information for the Permittee s representative, was mailed to government officials in accordance with Section 5.2 and Attachment 2. A copy of the procedure, correspondence, affidavit of mailing and service list is attached. Purpose: The purpose of this document is to establish a uniform and timely method of reporting Complaints received by Odell Wind, LLC ("Permittee") concerning Permit conditions for site preparation, construction, cleanup and restoration, operation, and resolution of such Complaints. B. Scope: This document describes Complaint reporting procedures and frequency to be used by Odell Wind in response to all Complaints received. C. Applicability: The procedures for processing Complaints related to the Odell Wind Farm will be consistent with the terms of this document. D. Definitions: Complaint: A verbal or written statement presented to the Permittee by a person expressing dissatisfaction or concern regarding site preparation, cleanup or restoration or other LWECS and associated facilities site permit conditions. Complaints do not include requests, inquiries, questions, or general comments. Substantial Complaint: A written Complaint alleging a violation of a specific Site Permit condition that, if substantiated, could result in Permit modification or suspension pursuant to the applicable regulations. Unresolved Complaint: A Complaint which, despite the good faith efforts of the permittee and a person(s), remains to both or one of the parties unresolved or unsatisfactorily resolved. Person: An individual, partnership, joint venture, private or public corporation, association, firm, public service company, cooperative, political subdivision, municipal corporation, government agency, public utility district, or any other entity, public or private, however organized. E. Complaint Documentation and Processing: 1. To the extent practicable, upon receipt of a Complaint, Odell Wind will document and maintain a record of all applicable information concerning the Complaint, including the following: a. Name of complainant, address, phone number, and address. b. Precise property description or parcel number. c. Name of Permittee representative receiving Complaint and date of receipt. d. Nature of Complaint and the applicable Site Permit conditions(s). e. Activities undertaken to resolve the Complaint. f. Final disposition of the Complaint. 2. The Permittee shall designate an individual to summarize complaints for the Minnesota Public Utilities Commission (MPUC). This person's name, phone number and address shall accompany all complaint submittals. In maintaining records, the Permittee representative will: a. Determine the nature of the Complaint. b. Depending on the nature of the Complaint, record, respond and report the Complaint using the following procedures: ALGONQUIN POWER Co

Records of this type will not be forwarded to the MPUC. 2. If the record is a Complaint, it will be handled according to the process described as follows. i. If the Complaint is not considered to be a Substantial Complaint, the Permittee's representative will contact the appropriate project personnel to follow up with a resolution. The project personnel will process the Complaint on the same day the Complaint is received. ii. A form will be completed for each Complaint received. The form is included as an attachment to this document. Information to be provided on the form will include that enumerated in Section E.1., items (a) through (f) of this document. iii. Document the Complaint in a Monthly Compliance Filing Log of Complaints for submittal to the MPUC. 3. If the record is considered a Substantial Complaint, the Permittee will: i. Collect more information on the issue as needed. ii. iii. iv. A form will be completed for each Substantial Complaint received. Information to be provided on the form will include that enumerated in Section E.1., items (a) through (f) of this document. Report the Substantial Complaint to the MPUC by phone or on the same day that the Substantial Complaint is received, or on the following working day for those received after normal business hours. The record will be directed to the MPUC's Consumer Affairs Office at (800) or consumer.puc@state.mn.us. Voice messages are acceptable. Contact the Complainant to discuss the issue and in good faith determine a solution. v. Document the Substantial Complaint in a Monthly Compliance Filing Log of Complaints for submittal to the MPUC. c. Maintain and update the Monthly Compliance Filing Log to include the current status of each Complaint received. 3. To the extent possible, Odell Wind will request that Persons presenting the Complaint include the following informationin their communications: F. Reporting Requirements: a. Such reports are to be directed to the MPUC's Consumer Affairs Office at or consumer.puc@state.mn.us, voice messages are acceptable. Monthly Reports: By the 15th of each month, a summary of all Complaints, including Substantial Complaints received or resolved during the preceding month, shall be efiled to Mr. Daniel P. Wolf, Executive Secretary, Public Utilities Commission, using the Minnesota Department of Commerce edocket system (see efiling instructions attached to this permit). Permittee shall commence complaint reporting at the beginning of construction and continue through the term of the permit. If no Complaints were received during the preceding month, the Permittee shall submit (efile) a summary indicating that no complaints were received. G. Complaints Received by the Commission or the Department of Commerce: Complaints received directly by the Commission from aggrieved persons regarding site preparation, construction, cleanup, restoration, operation and maintenance shall be promptly sent to the Permittee. Commission Process for Unresolved Complaints: Initial Screening: MPUC staff shall perform an initial evaluation of unresolved Complaints submitted to the MPUC. Complaints raising substantial LWECS Site Permit issues shall be processed and resolved by the Commission. Staff shall notify Permittee and appropriate person(s) if it determines that the Complaint is a Substantial Complaint. With respect to such Complaints, each party shall submit a written summary of its position to the Commission no later than ten days after receipt of the Staff notification. Staff shall present Briefing Papers to the Commission, which shall resolve the Complaint within twenty days of submission of the Briefing Papers. I.
