2 Dear Applicant, This application packet has been developed as a means to assist you, the applicant, in understanding the application procedure and requirements when applying for a Zone District, Master Plan, & General Plan Map Amendment. This packet includes all the necessary background information you will need to prepare and file a complete submittal that will allow your application to be processed and reviewed in the timeliest manner possible. The following materials have been included in this application packet for your convenience: Form Affidavit Form Checklist Review Process Chart Incomplete applications will not be accepted, receipted, or processed. In order to adequately process your zone district, master plan, or general plan map amendment request, the following materials will be required at the time of submission of your application: Form Signed & Notarized Affidavit Form All items listed on the Zone District, General Plan, & Master Plan Map Amendment Application Checklist (incomplete submissions will not be accepted). Application & Processing Fees, as specified in the current Draper City Fee Schedule. Other supporting materials as applicable. Once a set of map amendment plans are submitted, the plans are subject to compliance reviews by the various city departments and may be returned to the applicant for revision if the plans are found to be inconsistent with the requirements detailed in the City Code. All submitted map amendment proposals shall be reviewed in accordance with (h) & of the Draper City Code. Submission of map amendment plans in no way guarantees placement of the application on any agenda of any particular City reviewing body. 5 Zone District, General Plan, & Master Plan Map Amendment Application Checklist Incomplete applications will not be accepted or held. All required items shall be submitted. Map Amendment Submission Requirements Application Fee Noticing Fee Completed Application Form Mailing labels from the county recorder s office of all property owners within 400. Labels must be original label sheets obtained from the Utah (100 E. Center St.) or Salt Lake (2001 S. State St.) County Recorder Office as applicable. Note: The county recorder s office will not give labels unless applicant has application and checklist. Labels from a title company will not be accepted. Copies of the original label sheets. County sidwell plat maps (with aerial underlay if available) showing the subject property outlined in red. Plat maps may be obtained from the applicable county recorder office. A legal description of all properties involved & a perimeter legal description of the entire area to be changed. On a separate sheet of paper, respond to the following questions (answer applicable set): Zone District 1. What is the present zoning of the property? 2. Is the proposed zoning consistent with the current land use designation? Please explain. 3. Is the proposed zoning similar or compatible to the current zoning in the same area? Please explain. 4. Is the proposed zoning suitable for the proposed site? Please explain. General Plan / Master Plan 1. What is the present land use designation of the property? 2. Is the proposed land use designation similar or compatible with other land use designations in the immediate area? Please explain. 3. What do you anticipate the land being used for? 4. How would the proposed land use designation affect Draper City? Development Agreement Submission Requirements Application Fee Completed Application Form County sidwell plat map showing the subject property outlined in red. Plat maps may be obtained from the applicable county recorder office. 4 hard copies of the complete development agreement, which shall meet the requirements of DCMC Section , including the following: 1. A legal description of the land subject to the development agreement. 2. The restrictions or conditions to be attached to the property including development standards and the provision of public facilities. 3. The configuration of the project as shown on a project master plan. 4. A statement of the benefits and value the development agreement will have for the City as a whole, including but not limited to assurances of design standards, dedication and improvement of open space, parks, trails, amenities, or infrastructure such as public rights-of-way or utilities. 5. The time frames for performance by the parties. 6. A description of the various city approvals required before the commencement of construction and other procedures that will be required after approval of the development agreement. 7. Provisions for enforcement of the terms and conditions of the development agreement. 8. Provisions for making amendments to the development agreement. 9. The time limitation of the agreement. 10. Such other terms as may be proposed and agreed to between the city and developer or subdivider. 1 digital copy of the complete development agreement in word format.
