Whereas the demand notice was issued U/s 13 (2) of the above Act in eligible SARFAESI loan accounts to borrower and others by the Authorised Officer of Syndicate Bank as mentioned below. Likewise also in respect of other loan accounts mentioned below a separate demand notice under the Hypothecation Agreement was issued to the respective borrower/bailor by the Bank. The borrowers having failed to repay the money demanded under the notice issued under respective Act and as result of which the possession of the below mentioned property was taken by the Authorized Officer of the Syndicate Bank under the SARFAESI Act in the eligible SARFAESI loan account cases and in respect of other loan accounts the Bank had taken possession under the Hypothecation Agreement clause as mentioned below. Whereas the Bank and its Authorized Officer has decided to sell the below mentioned eligible secured assets under rules 8 & 9 of the said SARFAESI Act and also the Hypothecated Vehicles under the Hypothecation agreement clause for recovery of dues on AS IS WHERE IS, WHAT IS THERE IS AND WITHOUT ANY RECOURSE BASIS on the terms and condition as mentioned herein. The sale is subject to confirmation by the Bank. If the borrower / guarantor pays the amount due to the Bank in full before date of sale, no sale will be conducted. 15. The property is sold in AS IS WHERE IS, WHAT IS THERE IS AND WITHOUT ANY RECOURSE BASIS in all respects, the prospective bidder should satisfy themselves about the title, extent quality and quantity of the property before submitting their bid. The bank shall not be liable for any contingency arising in respect of the property sold. 16. No claim of whatsoever nature regarding the property put for sale, charges / encumbrances over the property or on any other matter etc. will be entertained after submission of the online bid. 17. The undersigned has the absolute right and discretion to accept or reject any bid or postpone / cancel the sale or modify any terms and conditions of the sale including allowing inter-se bidding without any prior notice and assigning any reason. 18.
