Recommendation: The recent revision of Chapter , Jacksonville Ordinance Code ( ) requires a minimum of 0.5 bicycle parking space per bedroom for multi-family residential units. It is anticipated that other large multi-family developments will run into similar issues. This would result in a requirement that the proposed development provide 286 spaces for the proposed 572 bedrooms/328 dwelling units. This amount of bicycle parking space would create a situation where the amount of provided spaces is disproportionate to demand and would limit the amount of available space for landscaping and recreational uses. The applicant is requesting to reduce the number of required spaces to 28 which is more than three times the number that would have been required at the time of the Planned Unit Development (PUD) in However, it is the position of the Planning and Development Department that additional bicycle parking spaces should be provided to accommodate the anticipated greater demand for bicycle parking for

2 this complex due to its proximity to the University of North Florida and the St John s Town Center. Findings: 2. There are practical and economic difficulties in carrying out the strict letter of the regulation in that Recommendation: Yes, the applicant has stated that the anticipated number of required bicycle parking spaces as outlined in Chapter would have a significant impact on the amount of available landscape and recreational areas if all required spaces were provided on site. Findings: 3. The request is not based exclusively upon a desire to reduce the cost of developing the site, but would accomplish a result that is in the public interest. Recommendation: No. The request is not exclusively based upon a desire to reduce the costs associated with compliance. Rather, is based on the applicant s efforts to create a successful multi-family development that meets all needs and desired amenities by the residents. Findings: 4. The proposed deviation will not substantially diminish property values in, nor alter the essential character of the area surrounding the site and will not substantially interfere with or injure the rights of others whose property would be affected by the deviation, in that 5. The proposed deviation will not be detrimental to the public health, safety, or welfare, result in additional public expense, the creation of nuisances, or conflict with any other applicable law, in that 6. The effect of the proposed deviation is in harmony with the spirit and intent of the Zoning Code. Recommendation: No. There is no evidence to suggest that the deviation would diminish property values or alter the character of the area. Findings: Recommendation: No. The reduction for the proposed deviation will not be detrimental to the public health, safety, or welfare nor will it have any effect upon the referenced matters. Findings: Recommendation: It is within the spirit and intent of the code to consider the true impacts of the amount of bicycle parking spaces that would be required per Chapter and the surrounding areas. The applicant has demonstrated that a strict interpretation of the

3 bicycle parking standards are not completely appropriate as related to the proposed multi-family development and the request, as conditioned, does not conflict with the intent of Chapter 656. Findings: 7. The City landscape architect (has/has not) recommended the proposed deviation. 8. The existing violation was not created by the applicant with intent to violate the Zoning Code. N/A N/A PLANNER RECOMMENDATION: APPROVE WITH CONDITIONS 1. A minimum of 6 bicycle parking spaces shall be provided per residential building, a minimum of 16 spaces shall be provided at the clubhouse, and a minimum of 8 spaces shall be provided at the dog park. The total minimum number shall be 72 spaces. 2. Prior to the first final inspection within any phase of development, the owner or their agent, shall submit to the Planning and Development Department for its review and approval either: a. An affidavit documenting that all conditions to the development order have been satisfied, or b. A detailed agreement for the completion of all conditions to the development order.
