39 REPORT OF LEGAL DIVISION For City Council January 22, 2018 From: Legal Division Date: January 17, 2018 Subject: Public Hearing Date 7-15 Eatman Avenue, 528 MacLaren Avenue, 450 Bowlen Street, Union Street, 279 Aberdeen Street As per the Planning Advisory Committee Process, Council now refers completed Development Applications to the Planning Advisory Committee for the views of the Committee; authorizes preparation of the draft by-laws; authorizes advertising pursuant to Section 110 of the Community Planning Act; and sets the date for Hearing of Objections/Support in advance of the Planning Advisory Committee meeting. Context: North of the Ring Road west of Royal Road Industrial development to the east, forested land to the north and west, Ring Road to the south. Ward No: 1 Municipal Plan: Zoning: Existing Land Use: Industrial/Business General Industrial (GI) Contractor shop (Service Master) Previous Applications: S , V EXECUTIVE SUMMARY: The application is for a tentative plan of subdivision to create a lot for a cell phone tower on the west portion of the industrial site beside the existing Rogers cell tower ( co-location is not possible on the existing tower). The area is considered to be a suitable location and Eastlink is in the process of obtaining a telecommunications license from Industry Canada. A lot created solely for utility purposes is exempt from the lot standards of the Zoning By-law and this application is required only to consider the 8% public land dedication. Staff are comfortable with the proposed location and support this application subject to terms and conditions. 42

43 APPLICATION: Eastlink Wireless has made application for a tentative plan of subdivision to create a lot for a new cell phone tower on a portion of property located at 65 Royal Parkway. PLANNING COMMENTS: Proposal: The proposal is to create a 105 square metre lot as shown on Map II beside the existing Rogers Cell tower. The existing tower is not able to accommodate another telecommunications carrier due to insufficient height. The proposed lot will be leased by Eastlink for the purpose of constructing a 30.5 metre high mono pole cell phone tower and related infrastructure. An access easement over the property will provide access to the cell tower lot from Royal Parkway as shown on Map II. Eastlink is in the process of applying for a telecommunications license for this site through Industry Canada and the tower proposal has been through the mandatory public notification process. Staff feel the area is suitable for cell tower development and are comfortable with the proposed location. Zoning By-law Z-5 exempts lots specifically created for the purpose of utilities, land for public purposes or for a future street from the minimum lot area, frontage and depth requirements of the zone (in this case the Bl zone). Since Eastlink will be leasing this portion of the site from the property owner for a period of ten years with the option to renew, it is considered a subdivision under the Community Planning Act. As a result the 8% public land dedication is payable on the newly created lot. The Community Services Department recommends that the dedication be taken in cash. RECOMMENDATION: It is recommended that the application submitted by Eastlink Wireless for a tentative plan of subdivision to create a new lot for a cell phone tower on a portion of property located at 65 Royal Parkway be forwarded to City Council with a recommendation that the public land dedication be taken as cash. Additional Information: Pursuant to Section 75(1) of the Community Planning Act, the following term and condition will be imposed upon the subdivision by the Development Officer: a) The final plan of subdivision be submitted substantially in accordance with Map Ill attached to PR 3/18 and to the satisfaction of the Development Officer. Terms and Conditions: a) The site be developed substantially in accordance with Maps II, III and IV attached to Planning Report 87/17 to the satisfaction of the Development Officer; b) Final building design be generally in accordance with Map IV attached to PR 87/17; c) A final parking and landscaping plan be submitted to the satisfaction of the Development Officer prior to the issuance of a building permit; d) A building permit be obtained prior to construction; e) All exterior signage comply with the requirements of Section 6 of Zoning By-law Z-5 and requires a sign permit; f) Servicing, lot grading plans and storm water management plans are to be provided to the satisfaction of the Director of Engineering and Operations at time of building permit application; g) Backflow preventer and storm oil-grit separator are required; and h) Record drawings prepared by a Professional Engineer are required at completion of the project. The agreement also includes the stop up and close of the western portion of Howe Street, which means the road will be removed from the public right-of-way and become a private street. The property will be held by a commercial corporation (Saint Mary's Indian Nation Enterprises Ltd.), who intends to develop a gas bar and convenience store on the site as shown on Map IV. 2 61

62 Municipal Plan: The applicant is proposing to amend the Municipal Plan to re-designate the subject property from First Nations and Residential to Commercial. Because the land is City-owned and not part of SMFN, this application will formalize the proper Municipal Plan designation. In terms of Municipal Plan policies, the proposal complies with the objectives for commercial areas as well as land development issues with SMFN. Section (3) of the Municipal plan states that commercial development should be: 1) Compatible with surrounding land uses; 2) Adequately serviced with transportation facilities and services, including parking; 3) Attractively designed and planned to further enhance Fredericton's built environment. The proposal satisfies the objectives of the Municipal Plan by creating a commercial lot within an existing commercial area that will serve residents of SMFN and the City. In terms of land development with SMFN, Section of the Municipal Plan outlines the following objective: 1) To encourage dialogue between the City and the St. Mary's First Nation where land development issues are of mutual interest and/or concern. As mentioned previously, this proposal is one phase of a large land trade agreement between the City and SMFN that has been almost two decades in the making. Zoning By-law: While the intent for this land is to eventually be added to SMFN, it needs appropriate zoning in the interim. Based on the proposed use, a gas bar and convenience store, the most appropriate zone is the COR-2 zone. The COR-2 zone accommodates commercial development along major roads within primary commercial areas. The Two Nations Crossing area is a growing commercial hub for residents on Fredericton's north side. This proposal will tie in with new development occurring at the corner of Two Nations Crossing and Cliffe Street, as well as the Smart Centre near the intersection of Saint Mary's Street. The technical frontage for the proposed

63 Howe Street is the western end of the lot (see Map II). While the property boundary is 44 metres, staff can only count the portion fronting on the public street, which is 22.6 metres. The remainder of the property boundary fronts onto private property and cannot be counted as frontage. The frontage variance for the COR-2 zone is minor (only 1.4 metres), but the variance required for a gas bar is larger (11.4 metres). However, staff are not concerned with the requested variance as the proposal provides adequate access to the site from Howe Street as well as Gabriel Drive, and there is further potential to connect from the Bingo Hall property to the north. The 8% public land dedication is applicable in this case for the new commercial lot. Staff recommend that the dedication be taken in the form of cash given the open space/playing fields and existing park areas in proximity to the subject site. RECOMMENDATION: 1. 82 APPLICATION: Marine Capital Ltd. has made application to rezone a portion of land from MR-2 to MR-4 to accommodate a boundary adjustment to allow 16 units within the existing apartment building under construction on property located at 72 Waggoners Lane. The proposal also requires a 2m parking separation variance. PLANNING COMMENTS: Proposal: Construction of a four storey, 14 unit apartment building began last year which required some minor variances that were approved by the Development Officer. The approved building design is shown on Maps Ill, IV and V. The applicant applied for a 14 unit building at the time in order to begin construction with the intent of adding a parcel of land from the abutting property to the south-east corner of the site in order to allow an additional two units within the building for a total of 16 units. The consolidation of the 228m 2 parcel of land requires a rezoning to the MR-4 zone to match the rest of the site. Two of the previously approved variances (for landscaped area and one parking stall) will disappear with the proposed boundary adjustment. Staff have no objections with the proposed rezoning and boundary adjustment. The proposal will not result in any deficiencies with the remnant parcel (30 Simpson Court) and will eliminate two previously granted variances. The resulting 16 units is an appropriate density on the subject property and overall the development represents an quality infill development. A screen fence will also be provided along this portion of the side property line. Given these reasons the variance is considered to be minor and it should not adversely impact the neighbouring property. Engineering and Operations Department have no objections to the application. City Council has identified a new Performing Arts Center as its top priority. Due to a lack of momentum and increased risk of Playhouse building failure, the FPI introduced a new site option expanded Playhouse on the current property - at the December 18, 2018 meeting of Council-in-Committee. FPI made 6 recommendations to Council at that meeting; the recommendations were referred to staff for consideration. Staff agrees with all six recommendations. Ward No: 11 Municipal Plan: Zoning: Existing Land Use: Residential MR-4 Apartment building Previous Applications: P.R. 16/07; P.R. 87/93 EXECUTIVE SUMMARY: The applicant is seeking to renovate the existing apartment buildings on the subject properties to add additional dwelling units. The renovations will take place within the existing footprint of the building and do not include any additions. In 1993, there was a PAC application to rezone the properties from R-7 to R-8 and add land from both lots to create 29 Abbott Court. A term and condition of this approval limited the number of units in 39 Abbott Street to 23 and 458 Priestman Street to 26. Colpitts is proposing to add one unit to 39 Abbott and two units to 458 Priestman. The properties were rezoned to MR-4 when Zoning By-law Z-5 came into effect and the proposed densities are in keeping with the standards of the zone. Staff feel the proposed renovations are reasonable and support this application subject to terms and conditions. 130

131 APPLICATION: Colpitts Developments Ltd. has made application to amend terms and conditions as it relates to By-law No in order to permit renovations for 24 dwelling units in 39 Abbott Court and 28 dwelling units in 458 Priestman Street. PLANNING COMMENTS: Background: In 1993, land was taken from 39 Abbott Court and 458 Priestman Street to create 29 Abbott Court and construct a 32-unit apartment building. As part of the development application, the properties were rezoned from R-7 to R-8 and the number of units in 39 Abbott (23) and 458 Priestman (26) were limited to what was existing. In 2007, the original terms and conditions were amended to permit a 35-unit apartment building at 29 Abbott Court. Proposal: Analysis: Colpitts Developments is seeking to renovate the existing apartment buildings to add one unit to 39 Abbott Court and two units to 458 Priestman Street. The renovations would take place within the existing footprint of the building and do not include any additions. Even though the proposed density meets the standards of the current MR-4 zone, this proposal requires an amendment to the previous terms and conditions in order to permit the additional units. The previous development application was made under Zoning By-law Z-2 and based on the standards of the R-8 zone. The subject term and condition limiting the number of units was likely intended to make sure the subject properties stayed within the permitted density standards of the R-8 zone. When staff reviewed the terms and conditions for the application in 2007, there was no technical rationale for limiting the number of units, as the lot area permitted 35. It seemed that the developer at the time simply wished to construct a 32-unit apartment building. Zoning By-law Z-5 came into effect in As part of the by-law review, staff identified areas of the City that could accommodate additional density and 'up-zoned' them to allow more units. The subject properties at 39 Abbott Court and 458 Priestman Street are examples of this up-zoning. The area is appropriate for additional density given the surrounding land uses. There are multiple apartment buildings in the immediate neighbourhood, and it is near amenities, employment centres and major arterial road connections. The properties were rezoned to MR-4, which permits higher densities than the R-8 zone. The lots are large enough to handle the number of proposed units and meet the minimum parking n quirements

RECOMMENDATION: It is recommended that the amended terms and conditions adopted by City Council on March 26, 2007 associated with By-law No.1649, be amended by repealing term and condition (c), which reads as follows: "(c) That the total number of dwelling units on property located at 458 Priestman Street not exceed 26; the total number of dwelling units on property located at 39 Abbott Court not exceed 23; and the total number of dwelling units on property located at 49 Abbott Court not exceed 23."
