The current population of Adams County is people spread out over 1182 square miles with the majority of the population concentrated on the western third of the County. The County contains a diverse mix of land uses varying from older first-ring cities to new green-field suburbs to expanses of open rangeland. All or portions of nine municipalities are found in Adams County. The City and County of Denver is contiguous to our southern border. Roughly residents live in unincorporated Adams County with the majority of the rest of the populations in the cities of Northglenn Thornton Westminster Brighton Commerce City Aurora Arvada and Federal Heights. The towns of Bennett Strasburg and Watkins are located in the eastern plains and are predominately agricultural but rapidly urbanizing communities. All communities with the exception of Westminster Arvada and Aurora (which are their own entitlement communities) participate in the Urban County partnership jurisdiction. Historically poverty in Adams County has hovered around 9%. Populations with low-incomes and living in poverty are concentrated in a number of locations throughout the County but predominately in the southwestern portion of the County including Aurora Commerce City the older communities of unincorporated Adams County and portions of the older neighborhoods of Thornton Federal Heights Northglenn and Brighton. Adams County Community & Neighborhood Resources (ACCNR) looked at various resources to determine the areas of greatest need within the County. Certain neighborhoods throughout the County continue to see a large number of foreclosures and ACCNR looks to NSP3 to continue the effort to stabilize neighborhoods through homeownership. In connection with neighborhood stabilization efforts of 2008 the Federal government passed the Housing and Economic Recovery Act (HERA) the first new legislation in a generation for housing and economic development. HERA appropriated $3.92 billion nationally for the Neighborhood Stabilization Program (NSP) to support the acquisition rehabilitation or demolition of foreclosed and abandoned properties. HUD has developed a foreclosure and abandonment risk score to assist local governments in targeting the areas of greatest need within their jurisdictions. As prescribed by the HERA legislation a determination of priority targeting was completed by analyzing indicators of distress including rates of home foreclosures homes financed by subprime loans homes in default or delinquency and abandonment risk. NSP III Target Areas and Activities Adams County will not be using a tiered approach to NSP III funding. The areas of greatest need were established by finding smaller areas within the County where the biggest impact would be successful in conjunction with the homes purchased through NSP I and determining their risk score. All areas have a risk score of 18 or above and are optimal for highest long-term impact. Sherrelwood has total housing units of 8261 and an NSP3 Need Score of Welby has total housing units of 4821 and an NSP3 Need Score of Commerce City has total housing units of 5108 and an NSP3 Need Score of In January 2014 additional c Summary of Distribution and Uses of NSP Funds: ensus tracts were added to this project within the City of Thornton ( and 93.16). These Thornton census tracts have an average foreclosure score of Funding and Activities Each category of NSP funding has targeted spending amounts per NSP eligible activity. The follow budgets reflect these targets: Activity B: Acquisition Rehabilitation & Disposition budgeted at $ for a projected 17 units of single familyhouseholds. 2

3 Activity F: Administration budgeted at 10% of the total program fund and program income at $ Total BUdget is $ Activity B includes acquisition and rehabilitation of at up to 17 single family housing units. Housing units will be sold to households with incomes at or below 120% of the Area Median Income (AMI). At least 4 housing units will be sold to households at 50% of AMI or less. Units must be located within designated census tracts serving one of the areas of greatest need within the county. ACCNR has contracted with Community Resources and Housing Development Corporation (CRHDC) as the NPO community developer for this program. CRHDC will solicit rehabilitation contractors to carry out the construction work and ensure both vicinity hiring and Section 3 compliance in its solicitation. Financing mechanisms will be made available to ensure continued affordability for each property. ACCNR will utilize the recapture method to ensure long term affordability and the affordability period will correlate to the amount of funding provided to the new homeowner. How Fund Use Addresses Market Conditions: NSP3 funds will be used to effect improvements in the areas most impacted by foreclosure as indicated on the NSP3 Mapping Tool. Adams County will work with CRHDC to locate the most logical units for acquisition and rehabilitation; those which will likely be impactful to the neighborhoods selected and support affordable resale. The aging stock in the neighborhoods selected for NSP3 fund targeting is indicative of the overall need for rehab and the neighborhood conditions include aging businesses older established families as well as a recent return of younger adults into the neighborhoods who grew up in the targeted areas and want to raise their families there - these signs indicate a strong desire for community support and neighborhood improvements that will be long-lasting once the NSP3 funds are exhausted. Additional leveraging of CDBG rehab and economic development initiative funds can where applicable leverage the efforts to revitalize the areas and improve the existing market conditions for future generations. NSP partners will conduct property inspections and are encouraged to incorporate the following design standards if replacement is necessary: Indoor Air Quality Green Label Low VOC carpet. Low or no-voc paint and adhesives. Radon mitigation at levels of > 4.0. Smoke and carbon monoxide detectors installed. HVAC/ gas combustion appliances- gas leaks carbon monoxide leaks eliminated. Water Saving Design Xeriscape landscaping plans. Low-flow toilets and plumbing fixtures. Install new or repair water irrigation systems. Ensuring Continued Affordability: CRHDC will utilize a marketing plan to ensure fair and comprehensive affordable marketing of NSP3 programs and housing units to include the following: 1. NSP3 partners will follow the terms of the Agreements with Adams County; 3

4 2. NSP3 partners will adopt an Affirmative Marketing Plan; 3. NSP3 partners will list properties on MLS ColoradoHousingSearch.com and others as requested or required by Adams County; 4. NSP3 partners will include the Adams County logo ADA logo HUD logo Equal Opportunity logo and NSP reference in all marketing materials; and 5. Developer will use real estate agent(s) of their own choosing. 6. All units sold will have affordability covenants imposed for HOME-required affordability periods to ensure long-term affordability. NSP partners can also use a variety of marketing methods such as developing an NSP3 program website. Adams County encourages partners to find as many methods and strategies as possible to market to low and moderate-income households and underserved populations throughout Adams County. Affordability Periods To ensure that NSP-assisted homeownership properties will remain affordable recapture provisions will apply to each transfer of NSPassisted property. For all rental properties assisted with NSP3 funds Adams County will follow the minimum affordability requirements of the federal HOME Investment Partnership program under 24 CFR (a) (c)(e) and (f) and The minimum affordability period based on investment of NSP funds is: Amount of NSP Funds Invested AND Minimum Affordability Period For Rental Units Up to $ Years $15001 to $ Years More than $ Years New Construction - Any Amount - 20 Years Adams County will annually monitor rental developments that are assisted with NSP funds to ensure that NSP-assisted units remain affordable and continue to meet minimum housing quality standards. Continued affordablility will also be promoted and maintained through project development in conjunction with the Adams County Balanced Housing Plan which was adopted by the Adams County Commissioners in Spring This Plan outlines the geographic areas in need of rental and for-sale housing aligned with the needs of communities and service areas. Definition of Blighted Structure: Adams County has adopted Section 115 of the 2006 International Building Code (IBC) as the formal guidelines for identifying and addressing blighted structures within the County as follows: SECTION 1 15 UNSAFE STRUCTURES AND EQUIPMENT Conditions. Structures or existing equipment that are or hereafter become unsafe insanitary or deficient because of inadequate means of egress facilities inadequate light and ventilation or which constitute a fire hazard or are otherwise dangerous to human life or the public welfare or that involve illegal or improper occupancy or inadequate maintenance shall be deemed an unsafe condition. Unsafe structures shall be taken down and removed or made safe as the building official deems necessary and as provided for in this section. A vacant structure that is not secured against entry shall be deemed unsafe Record. The building official shall cause a report to be filed on an unsafe condition. The report shall state the occupancy of the structure and the nature of the unsafe condition Notice. If an unsafe condition is found the building official shall serve on the owner agent or person in control of the structure a written notice that describes the condition deemed unsafe and specifies the required repairs or improvements to be made to abate the unsafe condition or that requires the unsafe structure to be demolished within a stipulated time. Such notice shall require the person thus notified to declare immediately to the building official acceptance or rejection of the terms of the order Method of service. Such notice shall be deemed properly served if a copy thereof is (a) delivered to the owner personally; (b) sent by certified or registered mail addressed to the owner at the last known address with the return receipt requested; or (c) delivered in any other manner as prescribed by local law. If the certified or registered letter is returned showing that the letter was not delivered a copy thereof shall be posted in a conspicuous place in or about the structure affected by such notice. Service of such notice in the foregoing manner upon the owner's agent or upon the person responsible for the structure shall constitute service of notice upon the owner Restoration. The structure or equipment determined to be unsafe by the building official is permitted to be restored to a safe condition. To the extent that repairs alterations or additions are made or a change of occupancy occurs during the restoration of the structure such repairs alterations additions or change of occupancy shall comply with the requirements of Section and Chapter 34. Definition of Affordable Rents: For any NSP-funded rental activity affordable rents shall be defined as 30% of adjusted income for the household less utility allowances as adopted by the Adams County Housing Authority for the Section 8 program as appropriate. The maximum Affordable Rents shall not exceed the Fair Market Rents (FMR) as published annually by the U.S. Department of Housing and Urban Development for each county in Colorado. ACCNR uses the definition of affordable rents rent schedule and utility allowances affordability period and continued affordability as provided by HUD in 24 CFR sections (a) (c) (e) (f) as well as (c). Specifically: (a) Rent limitation. HUD provides the following maximum HOME rent limits. The maximum HOME rents are the lesser of: (1) The fair market rent for existing housing for comparable units in the area as established by HUD under 24 CFR ; or (2) A rent that does not exceed 30 percent of the adjusted income of a family whose annual income equals 65 percent of the median income for the area as determined by HUD with adjustments for number of bedrooms in 4

5 the unit. The HOME rent limits provided by HUD will include average occupancy per unit and adjusted income assumptions. (b) Initial rent schedule and utility allowances. The participating jurisdiction must establish maximum monthly allowances for utilities and services (excluding telephone). The participating jurisdiction must review and approve rents proposed by the owner for units subject to the maximum rent limitations in paragraphs (a) or (b) of this section. For all units subject to the maximum rent limitations in paragraphs (a) or (c) of this section for which the tenant is paying utilities and services the participating jurisdiction must ensure that the rents do not exceed the maximum rent minus the monthly allowances for utilities and services. (c) Periods of Affordability. The HOME-assisted units must meet the affordability requirements for not less than the applicable period specified in the following table beginning after project completion. The affordability requirements apply without regard to the term of any loan or mortgage or the transfer of ownership. They must be imposed by deed restrictions covenants running with the land or other mechanisms approved by HUD except that the affordability restrictions may terminate upon foreclosure or transfer in lieu of foreclosure. The participating jurisdiction may use purchase options rights of first refusal or other preemptive rights to purchase the housing before foreclosure or deed in lieu of foreclosure to preserve affordability.the affordability restrictions shall be revived according to the original terms if during the original affordability period the owner of record before the foreclosure or deed in lieu o Definition of Affordable Rents: f foreclosure or any entity that includes the former owner or those with whom the former owner has or had family or business ties obtains an ownership interest in the project or property. (d) Subsequent rents during the affordability period. The maximum HOME rent limits are recalculated on a periodic basis after HUD determines fair market rents and median incomes. HUD then provides the new maximum HOME rent limits to participating jurisdictions. Regardless of changes in fair market rents and in median income over time the HOME rents for a project are not required to be lower than the HOME rent limits for the project in effect at the time of project commitment. Housing Rehabilitation/New Construction Standards: All units rehabilitated with NSP funds must meet Housing Quality Standards (HQS). Each NSP partner must develop inspection and rehabilitation standards to ensure that HQS is met. All NSP rehabilitation activities will meet the accessibility standards at 24 CFR Part 8. Applicable NSP activity housing rehabilitation standards will include the removal or correction of conditions deemed to constitute a violation of Adams County and applicable city building codes as well as improvements needed to result in a property consistent with maintaining safe and habitable conditions. NSP partners will develop Rehabilitation Standards that conform to Adams County Rehabilitation Standards and will be used to create detailed rehabilitation specifications an inspection form for rehabilitation individual unit work write ups of items to be rehabilitated together with projected costs and performance deadlines for completion of all work. These items will be used to create bid documents for private contractors who will perform rehabilitation activities. All rehabilitated housing must be free from defects that pose a danger to the health and/or safety of occupants. Units will meet Housing Quality Standards at the time of inspection. A permit from the local building authority will be required prior to commencement of construction. Following completion of the work a final inspection and/or Certificate of Occupancy per local requirements will be required as proof that the rehabilitation was performed in accordance with work specifications on file with the appropriate authority. In addition NSP partners are encouraged to incorporate energy efficiency and green rehabilitation measures into work performed. NSP3 Standards Adams County commits to compliance with the required NSP3 rehabilitation standards for all units rehabilitated with NSP3 funds. Adams County encourages and supports the use of Green Building Standards for all NSP3 activities. The following references provide Green Building Standards for NSP3 Rehabilitation activities: General E-star web site. E-star standard for moderate rehab and repairs. We are also outlining green finish products in the rehab standard sheet in Attachment E. Gut and new construction. In addition NSP3 rehabilitation will incorporate Healthy Home Standards where applicable and to the extent possible the Enterprise Green Communities standards. NSP Toolkit Single Family Rehabilitation Specifications Sample Including Green Specs Other Sustainable or Green&rd Grantee Contact Information: Adams County Community & Neighborhood Resources: 4430 South Adams County Parkway Brighton Colorado Grants Manager: Kate Smith kmsmith@adcogov.org Fiscal Grants Analyst: Becky Hurt bhurt@adcogov.org Vicinity Hiring: ACCNR is preparing a list of potential employees and small businesses who perform construction related activities in the construction industry and who live within the NSP3 targeted areas of Sherrelwood Commerce City Welby and Thornton which are identified in the NSP Mapping Tool. This list will be provided to the subrecipients and general contractors who participate in 5

6 NSP3 related activities throughout the hiring process in the applicable areas. All agencies and the public will be notified that because Adams County is receiving Neighborhood Stabilization Funds 3 (NSP3) through the Federal Department of Housing and Urban Development and the funding is being used to acquire rehabilitate and make available for purchase to income-eligible residents foreclosed homes the funding is regulated by the Housing and Economic Recovery Act of 2008 (HERA) and the Wall Street Reform and Consumer Protection Act of 2010 (Dodd-Frank Act) which establishes certain requirements for "vicinity hiring." ACCNR will develop maintain and make available the vicinity hiring list to all requestors; the list will be developed through the solicitation of neighborhood groups subrecipients and the general areas identified. All interested parties will complete a Vicinity Hiring Certification Form which will be kept on file in ACCNR offices. Section 3 Compliance Each agency implementing NSP activities must comply with Section 3 requirements in the Provision of Training Employment and Business Opportunities. The work to be performed under the NSP initiative is subject to the requirements of section 3 of Housing and Urban Development Act of 1968 as amended 12 U.S.C. 1701u (Section 3). The purpose of Section 3 is to ensure that employment and other economic opportunities generated by HUD assistance or HUD-assisted projects covered by section 3 shall to the greatest extent feasible be directed to low and very low-income persons particularly persons who are recipients of HUD assistance for housing. Agencies must agree to comply with HUD's regulations in 24 C.F.R. Part 135 which implement Section 3. As evidenced by their execution of their the parties to the contract certify that they are under no contractual or other impediment that would prevent them from complying with the Part 135 regulations. A partner's combined investment in excess of $ of NSP funding into projects arising in connection with housing construction demolition rehabilitation or other public construction makes the requirements of Section 3 applicable to all individual properties that receive services with these funds regardless of the actual amount that is spent on each individual unit/property. Accordingly each NSP partner shall ensure compliance with the statutory and regulatory requirements of Section 3 in its own operations and those of covered contractors. These responsibilities include: 1) Making efforts to meet the minimum numerical goals found at 24 CFR Part ; 2) Complying with the specific responsibilities at 24 CFR Part ; and 3) Submitting Annual Summary reports in accordnce with 24 CFRp> If covered partners receive awards that exceed $ for t Vicinity Hiring: he construction and rehabilitation activities listed above responsibility for Section 3 compliance is shared with that firm (with the exception of the submission of the Section 3 Annual report (Form HUD 60002) which must be submitted by the direct recipient of covered funds). If no NSP partner receives an award exceeding $ responsibility for complying with the requirements of Section 3 stays with the Grantee. Specifically Adams County shall be responsible for awarding 10 percent of the total dollar amount of all covered contracts to Section 3 business concerns. Each recipient shall fulfill the responsibilities described below to meet the requirements of Section 3. Agencies agree to send to each labor organization or representative of workers with which they have a collective bargaining agreement or other understanding if any a notice advising the labor organization or workers' representative of the partner's commitments under this section 3 clause and will post copies of this notice in conspicuous places at the work site where both employees and applicants for training and employment positions can see the notice. The notice shall describe the section 3 preference shall set forth minimum number and job titles subject to hire availability of apprenticeship and training positions the qualifications for each and the name and location of the person(s) taking applications for each of the positions; and the anticipated date the work shall begin. All NSP partners agree to include this section 3 clause in every subcontract subject to compliance with regulations in 24 C.F.R. Part 135 and agree to take appropriate action as provided in an applicable provision of the subcontract or in this section 3 clause upon a finding that the subcontractor is in violation of the regulations in 24 C.F.R. Part 135. All NSP partners are prohibited from subcontracting with any subcontractor where the NSP partner has notice or knowledge that the subcontractor has been found in violation of the regulations in 24 C.F.R. Part 135. Noncompliance with HUD's regulations in 24 C.F.R. Part 135 may result in sanctions termination of the NSP Agreement for default and debarment or suspension from future HUD-assisted contracts. MBE/WBE Outreach Plan Partners shall structure contractor bidding and selection process as necessary and maintain a list of eligible contractors which should include the names of the ACCNR designated Minority Business Enterprises (MBE's) and Women Business Enterprises (WBE). Contractor shall make a good faith effort to utilize qualified MBE/WBE as eligible contractors. Partners shall use a good faith effort to collaborate with Adams County Workforce Development (ACWD) to identify opportunities to train and recruit skilled workers for all projects under this contract. Activities ACWD can assist with may include but are not limited to the design and implementation of strategies related to job profiling skill assessment targeted recruitment wage subsidies and bonding opportunities. Procedures for Preferences for Affordable Rental Dev.: Adams County has not identified rental housing as a priority for NSP3. Adams County based on its current Consolidated Plan and Balanced Housing Plan has identified homeownership as the top priority. Additonally through NSP1 Adams County has been able to identify homeownership opportunties for homeowner making at or below 50% AMI.
