1 Chapter HYDE PARK CONSERVATION DISTRICT Sections: HYDE PARK CONSERVATION DISTRICT RESTRICTIONS AND ALLOWANCES IN THE HYDE PARK C-1CHD ZONE Section HYDE PARK CONSERVATION DISTRICT General Purpose The purpose of the Hyde Park Conservation District is to maintain the historical commercial district as a functioning community asset and maintain a mix of commercial and adjacent residential uses. The conservation district will protect the historical and architectural character of Hyde Park and establish parking standards for this area. The parking requirements are on a graduated scale for certain uses to encourage street level retail and restaurants as well as, second story office uses. These requirements will encourage land uses that are determined to be key to the districts long term health and sustainability. Businesses should share parking in order to reduce its impact on the land use Hyde Park Conservation District Boundaries The Hyde Park Conservation District Boundary is as depicted on the map in Figure (1), and as described herein: Encompassing the two block area from Brumback Street on the north, south to Alturas Street and from the mid-block alleyways approximately 100 feet east and west of, and parallel to the centerline of 13 th street.
2 HYDE PARK CONSERVATION DISTRICT OVERLAY AND ZONES The base zone within the Hyde Park Conservation District shall remain C-1HD, unless otherwise rezoned by ordinance amendment. The Conservation District provides zoning allowances and restrictions beyond those that are contained in the base zone to achieve the intent of the General Purpose of the Conservation District. Any parcel of land lying within the conservation district may also lie within one or more of the existing base zones designated by the Zoning Ordinance. The effect shall be the creation of new zoning districts consisting of the regulations and requirements of both the underlying base zones and the conservation district. (6454, Added, 03/14/2006) Section RESTRICTIONS AND ALLOWANCES IN THE HYDE PARK C-1CHD ZONE The following restrictions and allowances shall apply within the Hyde Park C-1CHD (Neighborhood Commercial Conservation Historic District with Design Review) Zone. The Conservation District requirements and allowances shall have control over any conflicts with the zoning ordinance. Section Prohibited Uses in the C-1CHD Zone
3 1. Off-site parking lots. This prohibition shall not preclude the use of existing on-site parking lots as leasable off-site parking. 2. Parking garage. 3. All uses prohibited in the C-1 zone. Section Allowed Uses in the C-1CHD Zone 1. All uses allowed in the C-1 zone. 2. Any new construction or additions shall comply with all applicable zoning ordinances and building codes. Section Parking Allowances in the C-1CHD Zone Due to the high ratio of pedestrian use of Hyde Park the following parking regulations shall apply: 1. Parking requirements shall follow the attached table*. LAND USE Graduated Scale of Use/ REQUIRED PARKING SPACES Unit of Measure (C-1CHD) RESTAURANT 0-40 seats one space/ twenty seats seats** one space / ten seats Over 81 seats** one space / two seats RETAIL square feet 1 space square feet** 1 space/ 300 square feet Over 2001 square feet** 1 space/ 200 square feet OFFICE -Street level 100 square feet 1 space -Upper floor 250 square feet 1 space (**Parking requirements are cumulative.) *All other uses shall be determined by the P-2 Off-Street Parking Requirements in, Section 11-10of the Boise City Zoning Ordinance. Accessible Parking Spaces shall still be controlled by Section of the Boise City Zoning Ordinance with its required ratios. 2. Outdoor or seasonal seating shall be counted as regular seating and is required to meet all parking and zoning code requirements. Existing outside seating shall be considered a legal non- conforming use as allotted in Section The official count for the number of required parking spaces for each existing business/ parcel is established in Section Any change of use or expansion shall require a zoning certificate to verify the required amount of parking spaces and document the parking space number per this chapter. As of the adoption date of this ordinance, all changes to parking space allocations shall require a zoning certificate that complies with Section A parking reduction shall require a Conditional Use Permit and shall provide a landscaping and a visual buffer to adjacent residential uses. 5. Tandem parking is permitted in rear yards with alley access, provided setbacks and appropriate backup requirements are met. 6. All existing parking spaces shall remain as required parking for existing uses and shall not be counted as parking for new or expanded uses (see attached map with numbered spaces Section ). 7. All off-site parking shall have a valid contract. This contract shall state:
4 a. the location of the parking space(s), b. the contract is binding on all successors and run with the land, c. how the parking spaces are to be maintained and who is responsible, d. that the parking cannot be revoked without prior approval of Boise City, and must show revocation for good cause, e. that sixty (60) days notice of termination to Boise City.
