1 Violation Removal SUMMARY OF OPTIONS New York City Department of Housing Preservation & Development December, 2011 THIS GUIDE IS INTENDED FOR INFORMATIONAL PURPOSES ONLY, AND IS NOT A COMPLETE OR FINAL STATEMENT OF ALL OF THE DUTIES OF OWNERS WITH REGARD TO CERTIFICATION OF CORRECTION OF VIOLATIONS OF THE HOUSING MAINTENANCE CODE.

2 HPD VIOLATIONS The Department of Housing Preservation and Development issues violations for conditions like no heat or hot water, vermin, leaks, broken plaster and lead-based paint after an inspection by a Housing Inspector. All of these conditions and many others which affect the quality of residential housing are violations of the Housing Maintenance Code. You can find out whether there are HPD violations pending on your property by viewing open violations at On the home page, you enter the address of your property on the right hand side section labeled Complaints, Violations and Registration Information and click Search. Then select for the information you want to see in the left hand toolbar. 2

3 HOW CAN I HAVE VIOLATIONS REMOVED FROM HPD S RECORDS WHEN THE CONDITIONS HAVE BEEN CORRECTED? Options depend upon the issue dates of the violations: Recent violations: Certify correction using ecertification Notice of Violation Certification of Correction Old violations: Dismissal Request Violation Re-issuance Defect Status on Lead-Based Paint violations YOUR BUILDING MUST BE VALIDLY REGISTERED WITH HPD FOR VIOLATION REMOVAL PROCESSES!! 3

4 PROPERTY REGISTRATION Registration is required annually for all multiple dwellings and for 1-2 family houses when neither the owner nor any family member lives there. There is a $13 fee. The form must be signed and dated by the owner and managing agent. An owner cannot certify, apply for a Dismissal Request or request a violation re-issuance if the building is not validly registered! If you receive a notice indicating that some information is missing or incorrect on the registration form, respond quickly because the building registration may not be valid. 4

5 PROPERTY REGISTRATION The registration form is available online at or at any borough office. You can search for Property Registration or go to the left hand toolbar on the HPD homepage and select Residential Property Owners then Property Registration for more information. 5

6 RECENT VIOLATIONS: WHAT DO I DO IF I RECEIVE A VIOLATION FROM HPD? Notices of Violation have a correction date and a certification date. First, correct the violation condition. Then, respond to HPD by the certification date. For more information on Certification, see the presentation called Violation Removal Certification. **Certification is FREE and will result in the dismissal of the violation if the condition was properly corrected.** 6
