O TOWNSHIP COMMITTEE MEETING DATE May 20, 2008 AN ORDINANCE AMENDING CHAPTER 190, LAND USE, OF THE CODE OF THE TOWNSHIP OF FREEHOLD, COUNTY OF MONMOUTH AND STATE OF NEW JERSEY BE IT ORDAINED by the Mayor and Township Committee of the Township of Freehold, County of Monmouth, and State of New Jersey as follows: The purpose of this Ordinance is to amend Chapter 190, Land Use, as follows: I 1. Amend Section 190-3, Definitions, to add new definitions for "auction or auction market", "garage sales" and "flea markets." 2. Amend Section , "Prohibition of Uses", to provide regulations for Garage Sales, Auction Markets" and "Flea Markets" within the Township. 3. Amend Section , B-10 Highway Development Zone, to permit fitness and recreational centers and bowling alleys as permitted uses and family-style restaurants with video games and children entertainment facilities as a conditional use; 4. To amend the CMX-2, CMX-3, P-1 and R-80 Zoning Districts to add house of worship as a permitted use on arterial, major collector and minor collector roadways. 5. To rezone Block Lot 2.02 containing acres within the shopping center on Route 9 and Route 33 north of Schanck Road from CMX-3 Corporate Multi-Use to B-10, Highway Development. 6. Section , Village Center Zone is amended to permit Fitness and Recreational Sports Centers as an additional permitted use. 7. To amend the P-1 and CMX-4 Zones to reduce the permitted Floor Area Ratio (FAR) from 0.20 to 0.15 in the P-1 Zone and from 0.30 to 0.20 in the CMX-4 Zone. 2 Article 1, General Provisions, Section 190-3, Definitions, is hereby amended to read as follows: II Deleted: AUCTION or AUCTION MARKET - A room, building or open air area space regularly or periodically devoted to the sale of goods to the highest bidder. DWELLING UNIT - A building, or portion thereof, providing complete living facilities for one [family] or more persons living together as a single house keeping unit in one or more rooms with cooking, living, sanitary and sleeping facilities. FLEA MARKET - A single location use wherein there are multiple vendors who have paid a fee for the privilege of occupying the space allotted to each vendor for the purpose of displaying and selling items of tangible personal property. Said location may be either open, enclosed or a combination of both. An enclosed "flea market" shall mean a flea market at a single location enclosed in a building or structure, rather than an open area not enclosed by a building or a structure. GARAGE SALE - shall mean and include all sales entitled "garage sale", "lawn sale", "attic sale," "rummage sale," yard sale or any similar casual sale of tangible personal property which is advertised or displayed by any means whereby the public at large is or can be made aware of the sale. III Deleted: Article I, General Provisions, Section , Prohibition of other uses, is hereby amended as follows: Prohibition of [other] uses. A. Any use not provided for in a zone is prohibited except for those uses listed below: [Home occupations are prohibited in all residential zones. Certain business-related activities do occur on and in residential dwellings in the regular course of human affairs; the degree of such activity will determine whether a business is being conducted in a residential zone. As a guide for such determination, consideration shall be given to:] (1) Garage sales, as defined herein, limited to no more than two sales per year per household. 2

3 (2) Business-related activities in residential dwellings, except that home occupations are prohibited in all residential zones. The degree to which there is a business related activity being conducted in a residential zone shall be determined by the following criteria: (1) (a) Increased vehicular traffic attributable to the use; (2) (b) Additional vehicular parking on or off the site; (3) (c) Placement of signs and or advertising data upon the site; (4) (d) Devotion of more than 30% of the dwelling structure to nonresidential use; (5) (e) Storage of goods for sale, either retail or wholesale; (6) (f) Frequency and intensity of nonresidential activities; (7) (g) Employment of non-family persons on a regular basis, except for babysitters, gardeners and the like. (3) Auctions and flea markets may be authorized by the Township Committee for a period not to exceed two days when operated or sponsored by and for the benefit of a public, semipublic, educational, eleemosynary, charitable or religions organization, based in the Township of Freehold, provided that: (a) A favorable report is received by the Recreation Commission if the even involves public lands. (b) Only one event may occur within the Township on a given day. (c) No event is scheduled in a traffic-congested area of the Township as determined by the Police Department. (d) No merchandise will be displayed or sales made in or in immediate proximity to an automobile or other motor vehicle. (e) No group or organization may be permitted more than one event during the calendar year. (f) The premises upon which the auction or flea market is conducted are returned to their prior condition within 24 hours after termination of the event. If the premises are not so returned, the Township shall have the right to enter upon them, return them to their prior condition, and assess the cost as a lien upon the land. (g) The sponsor of any auction or flea market conducted in accordance with the preceding conditions may be required by the Township Committee to furnish either a performance bond or cash or other guarantee acceptable to Township Committee to assure that cleanup occurs after termination of the event. 3

Permitted uses: (1) (5) No Change. (6) Houses of worship on principal arterial highways, minor arterial highways, major collector streets, minor collector streets and collector streets as defined and listed in the Circulation Plan Element of the Freehold Township Master Plan. Houses of worship shall be required to have a 100 front yard setback and 75 foot side yards but otherwise shall be governed by the P-1 Zone in terms of other bulk standards, building coverage, impervious surface coverage and other site design standards. [except that] Fast-food restaurants [may] shall not be located nearer than 3,000 feet from one another, except that this provision shall not apply to fast-food restaurants located within shopping centers. Family-style restaurants without liquor licenses with video interactive games and/or child entertainment centers with or without video interactive games shall be permitted subject to the following design standards: (a) Minimum floor area devoted to an individual family style restaurant or child entertainment center use: 2,500 square feet. (b) Minimum floor area for each restaurant where two or more family style restaurants are located in the same building: 2,500 square feet. (c) Minimum number of seats is 125. (d) No separate take out service area is permitted. (e) No drive-up windows are permitted. (f) Video interactive devices, video games, and children entertainment uses in conformance with Chapter 75, Article II, 75-19, provided that the area used for such uses shall not reduce the minimum required restaurant floor area and shall not exceed twenty five (25) percent or 1,000 square feet of the total floor area of a family style restaurant, whichever is less. (g) In any child entertainment center the area which contains video interactive games shall not exceed 7,500 square feet and the total area devoted to food service and party rooms shall not exceed twenty (20) percent of the total floor area of the child entertainment center. (5) (12) No Change. (13) Fitness and Recreational Sports Centers (NAICS ). (14) Bowling Centers (NAICS ). (15) Other indoor recreational facilities including dancing schools, gymnastic and cheerleading centers, miniature golf, target golf, archery centers, skateboard parks and similar types of indoor recreational activities and/or instruction. The Township Engineer is hereby authorized to revise the Official Zoning Map of the Township of Freehold to incorporate the Zoning District change for Block Lot 2.02 following adoption of this ordinance. All Ordinances and parts of Ordinances inconsistent herewith are hereby repealed. XII XIII If any section, subparagraph, sentence, clause, or phrase of this ordinance shall be held to be invalid, such decision shall not invalidate any remaining portion of this Ordinance. 10 STATEMENT: This Ordinance amends Chapter 190, Land Use, of the Freehold Township Code as follows: (1) Section 190-3, Definitions, is amended to add new definitions for "auction or auction markets", "garage sales" and "flea markets"; (2) Section , "Prohibition of Uses", is amended to provide regulations for "Flea Markets", "Auction Markets" and Garage Sales within the Township; (3) Section , B-10 Highway Development Zone, is amended to permit fitness centers, recreational centers and bowling alleys as permitted uses and family-style restaurants with video games and children entertainment facilities as a conditional use; (4) the CMX-2, CMX-3, P-1 and R-80 Zoning Districts are amended to allow houses of worship as a permitted use on arterial, major collector and minor collector roadways; (5) Block Lot 2.02 containing acres north of Schanck Road within the former Pathmark Shopping Center is rezoned from CMX-3 Corporate Multi-Use to B-10, Highway Development; (6) Section , Village Center Zone is amended to permit Fitness and Recreational Sports Centers as an additional permitted use; (7) the maximum floor ratios is reduced from 0.20 to 0.15 in the P-1 Professional Office Zone and from 0.30 to 0.20 in the CMX-4 Corporate Multi-Use Zone and (8) amend building setback requirements for houses of worship as permitted uses and as conditional uses. 20 Resolution of the Township of Freehold Monmouth County, New Jersey No: R Date of Adoption: June 17, 2008 TITLE: RESOLUTION APPOINTING WILLIAM FITZPATRICK AS TOWNSHIP TAX ASSESSOR R E S O L U T I O N WHEREAS, it is necessary to fill the position of Township Tax Assessor, as long-time Tax Assessor Helen Ward is retiring; and, WHEREAS, upon the conclusion of its search for a Tax Assessor, Township Administration has recommended to the Township Committee that William Fitzpatrick, 1892 Cleveland Avenue, Wall, NJ 07719, is the best candidate to carry out the duties of this position; and, NOW, THEREFORE, BE IT RESOLVED that the Township Committee of the Township of Freehold, pursuant to Freehold Township Ordinance, appoints William Fitzpatrick as Deputy Tax Assessor for the period of June 23 through June 30, 2008, and as Township Tax Assessor for the term of July 1, 2008 through December 31, 2009, as per employment acceptance by Mr. Fitzpatrick; BE IT FURTHER RESOLVED that a certified copy of the within Resolution shall be forwarded to William Fitzpatrick; Thomas E. 22 Resolution of the Township of Freehold Monmouth County, New Jersey No: R Date of Adoption: June 17, 2008 TITLE: OPPOSING S-1137 WHICH INCREASES MANDATORY EMPLOYEE COLLECTIVE BARGAINING NEGOTIATION SUBJECTS AND ISSUES R E S O L U T I O N WHEREAS, governing bodies are concerned about their ability to manage their employees using methods in the most appropriate and efficient manner possible; and, WHEREAS, governing bodies further believe that it is in an employer's right to hire, promote, transfer, assign or retain employees in positions deemed necessary and appropriate; and, WHEREAS, Senate Bill No would redefine the New Jersey Public Employment Relations Commission (PERC) law by adding new mandatory collective bargaining subjects and issues, which have been historically non-negotiable; and, WHEREAS, S-1137 will diminish the authority of municipalities over their day to day operations and severely impair the ability to manage personnel in an effective manner; and, WHEREAS, these changes are imposed on governing bodies, while under severe financial stress and with the State's plans to substantially reduce or eliminate State Aid to many municipalities; and, WHEREAS, S-1137 would increase the time and cost of negotiations, which costs will ultimately fall on our beleaguuered property taxpayers; NOW, THEREFORE, BE IT RESOLVED that the Township Committee of the Township of Freehold adamantly opposes adoption of S-1137, which impinges on local management prerogatives and would potentially result in protracted costly negotiations and advanced encroachments by public unions; BE IT FURTHER RESOLVED that a certified copy of the within Resolution be forwarded to Governor Jon Corzine, Senator Jennifer Beck, Assembywoman Caroline Casagrande, Assemblyman Declan O'Scanlon, the New Jersey State League of Municipalities and all Monmouth County Municipal Administrators. 1

26 Resolution of the Township of Freehold Monmouth County, New Jersey No: R Date of Adoption: June 17, 2008 TITLE: RESOLUTION - CERTIFICATION OF LOCAL BUDGET EXAMINATION R E S O L U T I O N WHEREAS, N.J.S.A. 40A:4-78b has authorized the Local Finance Board to adopt rules that permit municipalities in sound fiscal condition to assume the responsibility, normally granted to the Director of the Division of Local Government Services, of conducting the annual budget examination; and, WHEREAS, N.J.A.C. 5:30-7 was adopted by the Local Finance Board on February 11, 1997; and, WHEREAS, pursuant to N.J.A.C. 5: through 7.5, the Township of Freehold has been declared eligible to participate in the program by the Division of Local Government Services, and the Chief Financial Officer has determined that the Township of Freehold meets the necessary conditions to participate in the program for the 2008 budget year; NOW, THEREFORE, BE IT RESOLVED by the Township Committee of the Township of Freehold that, in accordance with N.J.A.C. 5:30-7.6a & b and based upon the Chief Financial Officer's certification, the Governing Body has found the Budget has met the following requirements: 1. That with reference to the following items, the amounts have been calculated pursuant to law and appropriated as such in the Budget. a. Payment of interest and debt redemption charges b. 51 Resolution of the Township of Freehold Monmouth County, New Jersey No: R Date of Adoption: June 17, 2008 TITLE: RESOLUTION AUTHORIZING A CONTRACT WITH PINE BARRENS GOLF CLUB FOR THE 2008 GOLF OUTING FOR PARKS AND RECREATION R E S O L U T I O N WHEREAS, the Township of Freehold Parks and Recreation Department will be holding their annual golf outing on September 25, 2008; and WHEREAS, the Purchasing Agent has determined and certified in writing that the value of the acquisition will not exceed that Township's bid threshold, but will exceed $17,500 in vendor aggregation; and WHEREAS, the anticipated term of this contract is for 1 year; and WHEREAS, Pine Barrens Golf Club can supply the Township with the required services for a cost of $20,688.48; and WHEREAS, Pine Barrens Golf Club has completed and submitted a Business Entity Disclosure Certification which certifies that Pine Barrens Golf Club has not made any reportable contributions to a political or candidate committee in the Township of Freehold, County of Monmouth, in the previous one year, and that the contract will prohibit Pine Barrens Golf Club from making any reportable contributions through the term of the contract; and WHEREAS, the Director of Finance has certified to the Township Clerk that additional funds are available in the following budget account: R NOW, THEREFORE, BE IT RESOLVED by the Township Committee of the Township of Freehold that a contract for a golf outing on September 25, 2008 is hereby authorized with Pine Barrens Golf Club in the amount of $20,688.48; BE IT FURTHER RESOLVED that certified copies of the within Resolution be forwarded to the Finance Officer, Purchasing Agent, and Superintendent of Parks and Recreation. 1
