9 1 Basic Situation of the Project 1.1 Brief Introduction to the Project 1. The proposed NQREIP financed by the ADB will include five components: the Inner Qinhuai River Sewerage & Water Replenishing Component, the City East Wastewater Treatment Plant and Sewerage Component, the He Xi North District Sewerage, River Improvement & Water Replenishing Component, the Storm water Drainage Component and the Sludge Treatment & Disposal Component. The total investment is CNY billion, of which CNY billion is to come from an ADB loan The Inner Qinhuai River Sewerage & Water Replenishing Component (IQRSWRC) 2. The Inner Qinhuai River Sewerage & Water Replenishing Component (IQRSWRC) includes Inner Qinhuai River Sewerage Collection Sub-component and Inner Qinhuai River Water Replenishing Sub-component. The total investment is CNY million Inner Qinhuai River Sewerage Collection (Sub) Component (IQRSCC) 3. The Inner Qinhuai River Sewerage Collection System Improvement Component (IQRSCSIC) of IQRSCC will be amongst the first of the components to be implemented. 4. IQRSCSIC mainly contains two parts: 5. (1) Upgrading the closure pipes beside the south-section of Inner Qinhuai River and rebuilding some of the inverted siphons which are 9590m long, located in the mid-section of the Qinhuai River. 6. (2) Upgrading the Dazhongqiao Pumping Station. The present Dazhongqiao Pumping Station has a 3.13 m3 /s scope, the design capacity of which does not reach the planning standard. Combined with the upgrade and expansion of the sewerage transportation system of the Inner Qinhuai River, it is planned to upgrade the equipment of the transformer substation to reach the optimum sewerage capacity standard, which is 4.0 m3 /s Inner Qinhuai River Water Replenishing (Sub) Component (IQRWRC) 7. IQRWRC includes 3 parts: water replenishing pumping station and transportation pipe, 8. Replenishing sluice and water preparation control, which are described as the following: 9. Water Replenishing Pumping Station and Transportation Pipe (WRPSTPC) 10. This mainly concerns the Qiqiaoweng Water Replenishing Pumping Station. The planning scope of this Station is 3.00m3 /s with 2.00m3 /s scope of water transported to the east moat, and 1.00m3 /s scope of water reserved for Youyi River replenishing. 1

10 This latter function is to be achieved via a transportation pipe (DN1500) which is about 2400m long, to be constructed from the Qiqiaoweng Water Replenishing Pumping Station to southeast moat. Replenishing sluice component (RSC) 11. This concerns the Tongxin Sluice gate, Mingyuhe Sluice gate, Dongyudaihe Sluice gate, Xiyudaihe Sluice gate and the east and west sluice gate of Zhongshandong Road. The planned Tongxinguan Sluice gate will lay a d1800 pipeline using the technique of pipe jacking construction, which will connect the river-way between the east moat (Yueya Lake) to the water system of the east part of the city. The pipeline is 300m long, with a discharge capacity of 2.00m3 /s. The planned Mingyuhe Sluice gate is to be constructed on the south side of Ruijinlu Bridge (over the Mingyu River). The gate size is 20m 10m, and the elevation of the bottom of the sluice gate is 4.50m. The planned Dongyudaihe Sluice gate is to be built in a section of grounds inside Nanjing University of Aeronautics & Astronautics. The gate size is 20m 10m, and the elevation of the bottom of the sluice gate 5.20m. The east and west Zhongshandong Road Sluice gates involve backing out existing passing pipes and building two box culverts, utilizing a half amplitude excavation technique. This implies temporary land state-owned acquisition and grounds restoration. Water Preparation Control Component (WPCC) 12. This is the proportioning control center of the IQRWRC. According to the planned diversion routine, this will control the operation of the pumping station and operate the sluice gate rationally to let water flow into the provided river-way according to level of supply or change, meanwhile, monitoring and inspecting the running condition of each pumping station and sluice gate and the water level of every river-way in a timely manner The City East Sewage Water Treatment System Component (CESWTSC) 13. The City East Sewage Water Treatment System (CESWTS) Component includes Construction of the City East WWTP Outer Sewer Pipelines Sub-Component, Expansion of City East WWTP Stage 2 Sub-Component and the River Improvement Sub-Component Expansion of City East WWTP Stage 2 (ECEWWTP2) 14. City East WWTP is a city sewerage treatment plant which deals with the sewerage of the city. Its total capacity is to be expanded from the existing capacity of 100,000m3 /d to 300,000m3 /d in two phases. Under this project, the second phase will be completed, bringing capacity to 200,000m3 /d, but with design provision for the ultimate capacity of 300,000m3 /d, required to cope with the additional seasonal volumes of rain water ha land has already been acquired for the construction of City East WWTP among which 13.56ha had been used in stage 1 and 3.33ha will be used in stage 2 of this component. So the land needed in City East WWTP stage 2 is already acquired without additional land or impacts of land acquisition and house demolition. A policy review of City East WWTP Stage 1 is shown in Appendix IV. 2

11 Construction of City East WWTP Outer Sewer Pipelines (CCEWWTPOSP) 15. According to RP there will be no permanent land occupation and houses demolition in Construction of City East WWTP Outer Sewer Pipelines Sub-Component. 16. For the construction of City East WWTP Outer Sewer Pipelines Sub-Component t, 37,400m of wastewater collection sewer pipelines and 108 working-wells of 8m diameter are required. Pipe jacking (thrust boring) excavation techniques are to be used to minimize temporary land acquisition. Nevertheless there will be temporary acquisition of asphalt road belonging to the state, totaling 82,080m 2. And the acreage of land occupation temporarily is 142,280m 2, including the land required temporarily for 108 working-wells, the total state-owned land occupied temporarily comes to 147,706m 2, or mu. 17. Up to now, the construction of City East WWTP Outer Sewer Pipelines project has not begun. The land occupation has not begun too River Improvement 18. The River Improvement sub-component includes three parts: Upper Qinhuai River Improvement, Construction of Yunliang River Wetland Park and South River Improvement. Upper Qinhuai River Improvement 19. The Upper Qinhuai River Improvement includes a dike project, river course correction project, the water and a soil conservation and ecological restoration project. 20. Dike project. This project is to be carried out together with the construction of a road along the river bank. The width of the top dike will be widened to 8m from the current 4-6m. On top of the dike, there will be a road constructed at a width of 5m and length of 38.8km. The whole road will be paved. The levee crown elevation of the dike will be designed for about m.The rate of the slope facing the river is 1:3, and 1:2 against the river. 21. River course correction project. This project to be carried out in the Qiqiaoweng area includes river course straightening, river dredging and riverbed consolidation. 22. The width of the outer Qinhuai River in the Qiqiaoweng area is 1540m. The Qiqiaoweng Bridge obstructs the water seriously and hence the river course in this area is steadily deviating. The river course in this area will be straightened. The plan is that then, the width of the river course will be 940m, the riverbed depth 60m and the bayou (wetland) about 120m. The levee crown elevation of the riverbed will be 1.0m, and the ground level 11.00m. Under this project, about 900,000 m 3 of soil will be excavated and 200,000 m 3 of soil filled back in. 23. This project results in both permanent and temporary land acquisition of state and privately occupied land, demolition of houses and structures of residents, and physical resettlement of residents. Construction of Yunliang River Wetland Park 24. The restoration of Yunliang River involves two parts: the biological slope 3

12 protection of the sides of the Yunliang River and the restoration of the Yunliang River ecological wetland. 25. Biological slope protection. According to the requirements of the water system and flow intensity of the Yunliang River and related to the natural slope profile, pitching slope technology will be involved in this project. Meanwhile, stakes will also be used as the fixation measure for the proposed retaining wall. This process is used for constructing the landscape above the normal water level. 26. Ecological wetland.the wetland of Yunliang River is located at the junction of the outer Qinhuai River with the Yunliang River, covering an area of 33 hectares. At present, this are is relatively built up, including a residential area (Meijialang), factories and some farmland, in addition to a mass of ponds, stagnant pools and scrub. The area is transected by Zhongheqiao Road and the landscape is notable for expansive areas of water at the junction of the two rivers, wild bulrush, maple groove, and cultural relics under provincial protection, namely the historically important Qiqiaoweng Ancient Bridge. South River Improvement 27. The South River Improvement project includes a dike project, river course dredging and related works. 28. Dike project. The design principle of the standard cross-section is: the dike elevation is m; the rate of the riverside slope is not less than 1:2.5; the rate of the downstream batter is not less than 1:2. The width of the top of the dike is not less than 6m; the width of which is 4.5m; if the current width of the top of the dike doesn t reach the design standard, widen it; if the current width of the top of the dike exceeds the design standard, keep it. 29. River course project. According to the demand of the present plan, river-bottom mud will be dredged to a level of 4.00m along the whole river course. The controlled width of the bottom of the river is not to be less than 5m, the rate of river slope is not to be less than 1:3. The existing rubbish dump sites will be eliminated and removed to official refuse sites. 30. The dredged up mud will be carried to the Nanjing Municipal Sludge Treatment Plant which is planned for Fenghuang Iron Mountain. This project will therefore be the last part to be implemented because it is dependent on the construction of Nanjing Municipal Sludge Treatment Plant. Hence the dike project will be implemented first and then the mud will be treated. The mud can be carried to a low-lying pond near Lianhua pump station if there is not enough time. This area was expropriated by the Nanjing Qinhuai River Construction and Development Limited Company (NQRCDC) in 2004 and it is now designated as state-owned land belonging to the company which is also one of the IAs The He Xi North District Sewerage, River Improvement & Water Replenishing Component (HXNDSRIWRC) 31. The He Xi North District Sewerage, River Improvement & Water Replenishing Component (HXNDSRIWRC) includes He Xi North District Sewerage Sub-component, He Xi North District River Improvement Sub-component and He Xi District Water Replenishing Sub-component with a total investment of about CNY billion. 4

13 He Xi North District Sewerage (Sub) Component (HXNDSC) 32. The He Xi District Sewerage Sub-component can be divided into three parts. The first part is the construction of km of sewerage pipelines; the second part is the capacity expansion of South Lake No1 sewerage PS from 0.14m3 /s to 0.30m3 /s at the existing site; the last part is the construction of separate rain and sewerage systems in the residential districts, which will separate formerly mixed rain and sewerage systems (which placed additional strain on the treatment plants) in about 80 residential districts, via the re-engineering of overflow chambers He Xi North District River Improvement (Sub) Component (HXNDRIC) 33. The He Xi North District River Improvement Sub-component includes two works packages, Longjiang River Improvement and Qingjiang North Canal Improvement. The works include the construction of a 450m box culvert (3mx1.5m) and dredging at a silt volume of m In the He Xi North District River Improvement Sub-component, there are two tasks concerning Longjiang River Improvement. The first task is to dredge about 10950m3 of silt from the river bottom to reduce the design bottom elevation to 3.5 metres. The second task is to construct a connection box culvert, which will connect the section of Longjiang River from Liwei River to Yincheng Rd. and from Caochangmen St. to Dinghuaimen St. This will be achieved through laying a meter box culvert, the length of which is 450 meter, the depth of which is 3.50 metres. 35. The engineering task at Qingjiang North Canal is dredging a volume of 3120m3 of silt and at the same time, ecological restoration of the canal landscape He Xi District Water Replenishing (Sub) Component (HXDWRC) 36. The He Xi District Water Replenishing Sub-component contains two works packages. One is water replenishing engineering in the Longjiang Region, the other is the South River water diversion PS. 37. The water replenishing engineering in the Longjiang Region includes three tasks. The first is upgrading the gravity culverts of Xiaodoumen PS and Liwei PS. The second is the construction of 1.71km of D1500 pipelines for river water diversion between Qingjiang South Canal, Qingjiang North Canal and Zhongbao PS to form a water replenishing network. The third is the construction of two controlling water gates. 38. The South River water diversion PS, which will occupy about m 2 of state-owned land (2.7mu), is to be built at the entrance to the South River on the north bank of the Qinhuaixin River. It will consist of a pumping room, power change & distribution room and other associated facilities The Stormwater Drainage Component (SDC) 39. The Stormwater Drainage Component (SDC) is one sub- project of the Nanjing Qinhuai River Environmental Improvement Project. This component is the transformation of the Qinhuai River basin drainage water pipe network. Works will include the replacement of drainage pipelines (D500 D1500, 26.5 km total) in the 5

14 Districts of Gu Lou, Xuan Wu, Bai Xia, Qin Huai and Xia Guan, with reconstruction of 29 storm drain outlets. This component s total expense is estimated at CNY 16.14million The Sludge Treatment & Disposal Component (STDC) 40. The sludge treatment & disposal component is composed of two sub-projects, which are the urban sewage & sludge treatment plant and the municipal sludge disposal plant. The project total investment is CNY billion The Urban Sewage & Sludge Treatment Plant (USSTP) 41. The urban sewage & sludge treatment plant is located in the Jiangxin Island sewage treatment plant. Jiangxin Island is the biggest island in the Yangtze River in the Nanjing region, lying to the southwest of Nanjing, about 6.5 kilometers from the city center and administrated by Jianye District government. The urban sewage & sludge treatment plant will treat 80t sludge per day using the process of desiccation. The final sludge product will be partially recycled as green manure and other waste will be used as covering soil in the landfill.this project will make use of land reserved under stage 2 of the project, so doesn t involve new land acquisition or house demolition The Municipal Sludge Disposal Plant (MSDP) 42. The municipal sludge disposal plant lays on the abandoned Phoenix mountain iron mine between the airport expressway and another arterial road, distant from the urban fringe area in the south of Jiangning District. The municipal sludge disposal plant adopts the landfill process with a scale about 1040m3 /d. When the plant is fully commissioned, and operations are optimized, the treated sludge will be able to be used as raw building materials. This project will require the allocation of state-owned land usage rights and the demolition of houses belonging to an operating quarry. 1.2 Project impact 43. Up to now,the construction of MSDP Component of Nanjing Qinhuai River Environmental Improvement Project hasn t began and resettlement impact has not been appeared IQRWRC 44. According to RP, the IQRWRC of the project requires 9.05 MU of permanent land acquisition, of which 0.9 MU of land is state-owned, and 8.15 MU is collectively-owned land. This is further described following: Qiqiaoweng Diversion Pumping Station will occupy require permanent land acquisition of 8.15MU. The selected site is currently rural collectively-owned land in Qiqiao Village, Honghua Sub-district, Qinhuai District which is utilized for (mainly vegetable) gardening. No demolition of houses or structures is required. 45. According to RP, Mingyuhe Sluice gate, Dongyudaihe Sluice gate and Xiyudaihe Sluice gate each require 0.3MU of permanent land acquisition. The land, which is state-owned, is inside the river-way protection line. The land is bare, and no demolition of houses or structures is required. Other components do not require any permanent land acquisition. 6

15 46. The excavation area of the project is m 2 in total, with a temporary land acquisition requirement of 80.54m 2, all of which are state-owned areas of land. The new sewerage pipeline along the state-owned road of IQRSCSIC needs to be occupied temporarily during construction is67.36mu. The Qiqiaoweng Diversion Pumping Station transportation pipelines needs be occupied temporarily during construction is 9MU. Construction of the Tongxinguan Sluice gate requires temporary land acquisition in a residential area and a park totals 0.28MU. Mingyuhe Sluice gate, Dongyudaihe Sluice gate and Xiyudaihe Sluice gate will each occupy 0.3 MU of state owned land inside the river-way protection line during the construction process. The east and west parts of Zhongshandonglu Sluice gate requires temporary land acquisition of adjacent state owned land of 3MU. Other components do not require temporary land acquisition. 47. In the project, WRPSTPC affects 10 power poles, 500m low voltage line. The excavation of east and west of Zhongshandonglu Sluice gate crosses Zhongshandong Road, which need explain two chinar of 20cm diameter, six of 40cm diameter, two of 75cm diameter, two small trees and parterre 30m 2. Other projects don t refer to ground attachments. 48. In the project, only WRPSTPC exists direct affected persons, of which there are 10 HHs and 30 persons to be affected, and other projects don t refer to APs. 49. One of the important rules in the execution is to inimaze the permanent land acquisition and its effect. Up to M&E this time, Up to M&E this time, the Inner Qinhuai River Sewerage & Water Replenishing Component (IQRSWRC) and Inner Qinhuai River water diversion locates the selected place in Yangzhuang community in Guanghua Street of baixia district, which is the state-owned reservation land of 3.0mu. The land is bare and is assigned for this project, which avoiding the impact on land acquisition Dongyudaihe Sluice gate project and xiyudaihe sluice gate project cancelled. Mingyu sluice gate occupied a land area of 0.3mu which is state-owned land, and has no resettlement impact. The project requires total permanent land acquisition of 3.3 mu, Comparing to 9.05mu of RP, 5.75mu reduced The City East Sewage Water Treatment System (CESWTS) Expansion of City East WWTP Stage 2 (ECEWWTP2) 50. According to RP, expansion of City East WWTP Stage 2 occupies land about 3.35 hectares. It will not occupy any land and demolishes houses by using the saving land in the first stage. 51. Up to now, the construction of City East WWTP project has begun and there has been no change in the works scope and impacts Construction of City East WWTP Outer Sewer Pipelines (CCEWWTPOSP) 52. According to RP, the construction of City East WWTP Outer Sewer Pipelines Sub-Component plan to pave 37,400m of wastewater collection sewer pipelines and 108 working-wells of 8m diameter. Pipe jacking (thrust boring) excavation techniques are to be used to minimize temporary land acquisition. Nevertheless there will be temporary acquisition of asphalt road belonging to the state, totaling 82,080m 2. And the 7

16 acreage of land occupation temporarily is 142,280m 2.1 Including the land required temporarily for 108 working-wells, the total state-owned land occupied temporarily comes to m 2, or mu. There is no impact of permanent land acqisition and house demolition. 53. Up to M&E this time, the construction drawing of City East WWTP Outer Sewer Pipelines project has completed partly at present, and it was started in February, 2008, which has completed the laying of 900 meter sewage pipelines at present River Improvement (1) Upper Qinhuai River Improvement 54. According to RP there will be no permanent acqisition of collectively-owned land in Upper Qinhuai River Improvement ,565.9 m 2 houses will be demolished by the Upper Qinhuai River Improvement project including 1,083m 2 flood prevention temporary buildings and m 2 residential houses which affect 24 HHs with 73 people. 56. Temporary land occupation of mu of land will be required for the Upper Qinhuai River Improvement project. This consists of mu of collective-owned land and mu of state-owned land. Three districts (including the Jingning Science and Technology Park), 15 villages and 29 people are affected by this subproject. 57. Otherwise, this project will affect some above-ground assets and special buildings. 58. Up to M&E this time, the involved project section of houses demolition in Upper Qinhuai River Improvement project (Yunliang River mouth Raocheng Highway section) has not begun, the task of houses demolition has not begun, the demolition and Temporary Land occupation has not occurred too. (2) South River Improvement 59. According to RP there will be no permanent land occupation and temporary land occupation in South River Improvement. 60. According to the RP, 6 residential houses covering about 300m 2 will be demolished and 17 people are affected by the South River Improvement works. Among 6 residential houses, there are 3 shops connected to residential houses 2 covering an area of about 120m 2, relating to 7 affected people. 61. Up to M&E this time, South River Improvement project has already finished on March 31, 2008 and passed completion acceptance on April 22.The demolition of 1 The acreage of broken road is not the same as the acreage of temporarily land occupation. Broken road acreage means the acreage of road excavation which is a part of land occupation and included in the total acreage of temporarily land occupation. The total acreage of temporarily land occupation includes broken road acreage, working-wells acreage and dust piling acreage. 2 According to Nanjing policy shops connected to residential houses must have land use right certificates, and house property right certificates (or house building permission). This type of house has the dual functions of living and doing business. They are similar to shops but not really shops because the kind of house is still primarily residential. 8

17 houses and shops connected to residential houses for South River Improvement project avoided because the red lines of construction points in Youyi bridge and Lianhua gate have been adjusted. (3) Construction of Yunliang River Wetland Park 62. According to RP, Qiqiao village of Honghua Sub-district Agency of Qinhuai district is involved in permanent land occupation of Construction of Yunliang River Wetland Park. This project occupied collectively-owned land mu, and 195 HHs (309 people) are also affected by this project. In addition, about m 2 houses are demolished and 230 HHs, 309 people are affected in this project. Among house demolition, 66 non-rural residents houses are demolished and 66 people are affected; 164 rural residents houses are demolished and 289 people are affected too. In addition, seven shops connected to resident houses are to be demolished, with 32 associated affected people; 19 free standing shops with an area of 760m 2 are to be demolished with 14 people affected; and 17 institution or corporations buildings covering an area of about 47,165.3m 2 are to be demolished, affecting 219 employees of whom 56 are female employees. Otherwise, this project will affect some above-ground assets and special buildings according to the RP. 63. There will be no temporary land occupation in this project. 64. Up to now, there are mu land have been required permanently in Construction of Yunliang River Wetland Park project. 292 people of 190 households are affected in the land requisition. 65. The House Demolishment Management Office(HDMO) have cleaned up the files which have implemented the demolition and signed an agreement, then afford the impact amount of the demolishment according to the demolition compensation agreement, which is the outcome of door-to-door measure by HDMO and confirm the actual floor space of Property Housing and accessorial housing. The impact amount has some changes compared with previous estimated data afforded and used in the former four M&E reports. Therefore, the date of this M&E report is the factual date of house demolition in this Component. It is showed that up to this M&E,the housing demolition of all residents completed. The actual residents of house domolition is 267 households, 439 people and the demolition area is 40716m 2. Very few residents has reached verbal agreements and not signed the written one yet. The demolition of shops and commercial enterprises has also completed. The actual demolition shops are 27, the affected workers are 235 and the actual demolition area is 76558m 2. In the process of houses demolition, there are 21 type of attachments are affected. 66. Up to M&E this time, Wetland Park basically completed and opened to publics successively. 9

19 1.2.3 HXNDSRIWRC 67. According to the RP, only the construction of the South River PS for water diversion requires permanent LA, with a requirement of about m 2 of state land (2.7 mu) in the Component. The PS is to be built at the entrance of the South River, on the north bank of the Qinhuaixin River. The state-owned land is included in the river-side protection zone of and is therefore unused at present. 68. The TLO of this Component can be divided into two parts. One is the construction TLO of pipelines associated with the He Xi North District Sewerage Sub-component and Water Replenishing Sub-component at a total TLO area of m 2, (about mu), of which mu is for the He Xi North District Sewerage Sub-component and mu is for the Water Replenishing Sub-component. The second is the working-well TLO during pipeline construction. The Component will require at total of 30 working-wells at a spec of D8m, which equates to mu of land. 69. The South River PS for water diversion will be built on vacant land at the entrance to the South River where there are no above-ground assets. 70. This project component only involves state-owned land acquisition impacts and activities. There is no house demolition, and no direct APs, affected enterprises or affected shops. 71. Up to M&E this time, the construction design of He Xi North District River Improvement (Sub) Component had been completed in June, 2007, and it was started in October, 2007 and was completed in June The construction design of Water Replenishing Engineering in the Longjiang Region had been completed in June, 2007, and it was started in October, 2007 and completed up to now. He Xi North District Sewage Water Treatment System Was started in October, 2007 and 41% of construction assignment completed SDC 72. According to the RP, the Stormwater Drainage project is entirely within the main urban area of Nanjing, the pipe network is to be laid along the roads, and temporarily occupied land is all state-owed land, with no construction or attachments on it. There is no direct APs involved in the project construction. 73. Up to M&E this time, parts of the component have been started and temporary land occupation has not been happened STDC 74. According to the RP, the urban sewage & sludge treatment plant is located in the Jiangxin Island sewage treatment plant. Since adjustment happened in sludge treatment, now we use more environmental protection way to transport sewage to power plant directly as fuel without desiccation. Therefore this project is canceled. USSTP will make use of land reserved under stage 2, of the project to avoid any requirement for new land acquisition or house demolition. 75. According to the RP, the urban sewage & sludge treatment plant of Phoenix in this 11

20 project need to permanently occupy 495 mu state-owned land which belongs to the Phoenix iron mine (PIM), which is administrated by the Nanjing Huajian Industrial Group. PIM owned the Mining rights on land before production had been shut down in 1986 and acquired legitimate use of state-owned land warrants in 2006.There is only one enterprise affected by the project. The affected enterprise is the Phoenix iron mine (PIM), which is administrated by the Nanjing Huajian Industrial Group. The MSDP project needs to demolish 400m 2 of houses belonging to this enterprise. There is no person directly affected by the project. 76. There are no effects on cultural property or historically significant areas in both sub-projects. The project doesn t affect any institution or shops. During the social-economic investigation, no vulnerable groups were identified. 77. There are 7 kinds of attachments, such as telegraph pole and tree, etc. affected by the project. 78. Up to M&E this time, the area of sludge treatment plant reduced to 466 mu and primary design passed on May 20, 2008, now the task of approving planning scheme is being dealt with. 79. At present, state-owned land warrants is being processed, the procedure details of transaction are in Chapter III. 1.3 Independent External M&E on the Involuntary Resettlement 80. National Research Center for Resettlement (NRCR) of Hohai University is entrusted to take the work of external M&E of invulnerable resettlement. 81. By the end of June of 2009,with the assistance of project office,m&e team make the fourth M&E on resettlement situation of all components. First, M&E team find out the state of Project progress from all related agencies, including component construction agency, Nation Land Bureau, Demolition Office, Economic Affordable Housing developer Jinghui Economical House Developing Company, House change Office, etc. In addition, the M&E team held the follow-up interviews and questionnaires of APs and field survey of resettlement site. 82. Up to M&E this time, the construction of Economic Affordable Housing Residential District basically completed, and 92% of residents who have applied for relocation have had keys of the new house and check relocation or prepare to stay., so M&E team carry out investigations with residents to get detailed information about their condition of production and living and make a compare with the livelihood of transition period.. 12

21 2 Schedule 2.1 Project Schedule 83. Up to now, all components of Nanjing Qinhuai River Environmental Improvement Project had been approved. Besides, the preliminary design had been finished and approved except some individual are still in the examination and approval. 84. The Inner Qinhuai River Sewerage & Water Replenishing Component (Component I for short, the same as followed) Replenishing sluice Dongyudaihe Brake and Xiyudaihe Brake canceled. Meanwhile the selected location of the Qiqiaoweng Diversion Pumping Station has changed, formerly occupy land acquisition of 8.15mu, which is rural collectively-owned land in Qiqiao Village, Honghua Sub-district, Qinhuai District that is utilized for (mainly vegetable) gardening. No demolition of houses or structures is required. The new selected location located at Yangzhuang Community in Guanghua Street of baixia district, which is the state-owned stored land of 3.0mu. The Mingyu sluice gat occupied the state-owned reservation land of 0.3mu.The land is bare and is assigned for this project. On July 27, 2007, Planning Board approved its selected location and the usage certificate of state-owned land is being processed at present, it was started in October, Up to this monitoring, the site has not changed and the is test running now. 85. In the City East Sewage Water Treatment System Component (Component II) The constructional drawing of City East WWTP Outer Sewer Pipelines subproject has been completed, the construction started in February, 2008, has finished 63%. The constructional drawing of Expansion of City East WWTP Stage 2 subproject completed. The construction started in December, 2007 and has finished 80% up to this monitoring. Preliminary design of Upper Qinhuai River Improvement Component has been finished but not started; Preliminary design of Construction of South River Improvement finished and started in December; Wetland Park basically completed and opened to publics successively. 86. He Xi North District Sewerage, River Improvement & Water Replenishing Component (Component III) the constructional drawing of Water Replenishing Sub-component designed completely by the end of October, 2007 and the construction has finished. Nanhe water pumping station in He Xi North District Sewerage, River Improvement & Water Replenishing Component involves the permanent occupation of state-owned land and the actual area is about 2300m 2, which equivalent to 3.45 mu. The state-owned unused land located in the north bank of Qinhuai Nanhe is allocated to this project, and received the approval of the site from Planning Board in May 26, Currently, the permits of land use are being processed. Up to this monitoring, the site has not changed and the test run is ongoing. 87. Stormwater Drainage Component (SDC) and the Sludge Treatment & Disposal Component (Component IV): the designs of this project have been finished partly and will begin its construction in succession in December. 88. The Sludge Treatment & Disposal Component(Component V)the problem about land usage rights is being consulted, primary design is approved on May, 20,2008, at present it is dealing with approving planning schedule. Up to now, the actual schedules of all components are shown in Table

25 2.2 Implementation Schedule of Resettlement 89. According to RP, the permanent land acquisition and house demolition were happened in component I, II and V. Meanwhile, the temporarily land occupied were mainly happened in component III and IV. Up to this M&E, the resettlement schedules are described as follows: 90. Component I (IQRSWPC): According to RP, this component requires 9.05 mu of permanent land acquisition, of which 0.9 mu of land is state-owned, and 8.15 mu is collectively-owned land. This is further described following: Qiqiaoweng Diversion Pumping Station will occupy require permanent land acquisition of 8.15mu. The selected site is currently rural collectively-owned land in Qiqiao Village, Honghua Sub-district, Qinhuai District which is utilized for (mainly vegetable) gardening and affected 10 households with 30 people in Qiyi Zu. No demolition of houses or structures is required. Up to this M&E, the selected site changed to Yangzhuang community in Guanghua sub-district of Baixia district which is state reserve land. The permanent land occupation reduced to 3 MU and the state-owned is bare with no house or structures. 91. Mingyuhe Sluice Gate, Dongyudaihe Sluice Gate and Xiyudaihe Sluice Gate each require 0.3mu of permanent land acquisition. The land, which is state-owned, is inside the river-way protection line. The land is bare, and no demolition of houses or structures is required. 92. Component II (CESWTS): According to RP, among the City East Sewage Water Treatment System Component, only the River Improvement subproject containing houses demolition. Besides, the Construction of Yunliang River Wetland Park project of the River Improvement subproject contains permanent land acquisition; there is not any permanent land acquisition and houses demolition in Expansion of City East WWTP Stage 2 subproject and Construction of City East WWTP Outer Sewer Pipelines subproject. The stated-owned land temporarily occupied in these two subprojects is m Up to this M&E, Upper Qinhuai River Improvement has not begun and house demolition works have not executed. 94. According to RP, there are 6 households with total area of 300m 2 affected by the project of South River Improvement. Up to this M&E, the works of South River Improvement have begun and the project completed. The demolition of houses and shops connected to residential houses for South River Improvement project avoided because the red lines of construction points in Youyi bridge and Lianhua gate have been adjusted. 95. Up to now, the plan license for construction land of Construction of Yunliang River Wetland Park is applied; the state-owned land use permit is applying. There is mu collectively-owned land acquired permanently. The process of compensation for land acquisition permanent and resettlement had finished. The houses demolition task goes on wheels. 96. Up to now, the implementation of the archiving of relocation information from demolition implementation unit is in progress. The demolition number offered by the demolition implementation unit is estimated data which is been carried out by door-to door measure, and the actual data can be received until the accomplishment of the archiving after the end of demolition work. According to the preliminary estimates of the 17

26 demolition implementation unit, the residential houses and shops connected to the residential houses which the area is m 2 have also been demolished in this project. There are 696people and 303households are affected. Up to now, there are 22 enterprises and 19 shops which the area is m 2 are demolished. 97. Other affected residents have reached verbal agreements with Qinhuai REMB and the house demolition agreements are in future negotiations and consultations. The demolition work will be implemented after the formal signing of the agreement. 98. Up to this M&E, the House Demolishment Management Office(HDMO) have cleaned up the files which have implemented the demolition and signed an agreement, then afford the impact amount of the demolishment according to the demolition compensation agreement, which is the outcome of door-to-door measure by HDMO and confirm the actual floor space of Property Housing and accessorial housing. The impact amount has some changes compared with previous estimated data and uses the monitoring data this time. It is showed that up to this M&E, the housing demolition of all residents completed, of which 267 households, 439 people and the actual demolition area is 40716m 2. The demolition of shops and commercial enterprises has also completed, of which 27 of 235 affected workers and the actual demolition area is 76558m Component III (HXDSRWRC): The construction of the South River PS for water diversion requires permanent LA, with a requirement of about m 2 of state-owned unused land (2.7 mu) according to RP, which located at the entrance of the South River, on the north bank of the Qinhuaixin River. Actually occupy about 2300 m 2 of state-owned unused land (3.45mu), which is located at the entrance to the South River on the north bank of the Qinhuaixin River It is state-owned unused land, and is allotted to this project. Planning Board approved its selected location on May 26, 2006 and the usage certificate of state-owned land is being processed at present Component IV (SDC): Temporary land acquisition is all excavated land and state-owned road that temporarily occupied, affected people are not involved Component V (STDC): Currently, the reclaim of Land-use right to the stated-owned land and demolition has not been carried out. 18

30 3 Permanent land Acquisition 3.1 Land Acquisition 104. Up to now, the selected location of Qiqiaoweng Water Replenishing Pumping Station in Component I changed, which avoiding collective land acquisition that involved in RP. Moreover, all the components don t involve collective land acquisition in spite of the Component II, so that this M&E only makes detailed description on the plan and actual land acquisition as well as resettlement plan for Component II Component II will permanently occupy mu collectively-owned land which belongs to Qiqiao village of Honghua sub-district. Among them with the land already reserved under stage 1 of the City East WWTP project; there will be no land acquisition for the stage 2 expansion. The land required for the construction of the City East WWTP Outer Sewer Pipelines is for excavating and laying pipes is temporary stated-owned road. There will be no land acquisition for the South River Improvement sub component. Yunliang River Wetland Park Construction will permanently occupy mu of collectively-owned land. Up to now,construction of the City East WWTP Outer Sewer Pipelines Sub-Component and Expansion of City East WWTP Stage 2 Sub-Component do not begin. The actual quantity of PLA of River Improvement Project is the same as planned. The detail of PLA for this component is showed in Table 3-1. In June of 2006, the name list of persons acquired land was finally determined July of 2006, the Second-branched Bureau of Nanjing National Land Resource Bureau proclaimed the Plan of Compensation and Resettlement for Land Acquisition (No. 004 EFJ[2006]) From July, 2006 to now, people influenced by land acquisition can voluntarily go to Labor Security Bureau of Qinhuai District to register for farmer s basic living security. Meanwhile, No.2 sub-bureau of Nanjing national land resource bureau transfers million Yuan farmer s basic living security fund of every farmer influenced by land acquisition to a special account, namely Social Security Department of Nanjing Financial Bureau In the process of land requisition in December, 2006, inside the red line arises compensation of planting and Housing facilities between farmers and contract households. The owners signed the land requisition Supplemental Agreement with the second sub-bureau of Nanjing National Land and Resources Bureau and Qiqiao Village committee, Honghua Sub-district, Qinhuai District Up to now, permanent land acquisition of Yunliang River Wetland Improvement Component completed. The owner units have already disbursed land compensation funds to the second sub-bureau of Nanjing National Land which then paid to Resources Bureau and Qiqiao Village committee, Honghua Sub-district, Qinhuai District according to the land compensation agreement. The work of Basic living insurance for land-lost farmers as their willing is still in progress. Land examination procedure approved and they have got state-owned construction land use of instruments of ratification in May, Land Acquisition and Resettlement Farmer s Basic Living Security Resettlement 117. We arrange the farmer s basic living security of land-lost farmers according to the RP. APs who sign the land acquisition agreement and confirmed in the implementation process will be subsidized with farmer s basic living security of land-lost farmers of Nanjing and organized by Street Office to choose the level of security fee in Social Security Bureau March, 2007, HongHua Sub-district office confirmed the land acquisition list again. Compared with RP, total affected population of Yunliang River Wetland Improvement Component reduces from 309 to 292, but the compensation standard and resettlement pattern have no change. Affected population in Seven One Group and Seven Three Group of Qiqiao village is still 49 without any change. Actually settled agricultural population in Meijialang Group reduces from 260 to 243, 205 of which are subsidized with farmer s basic living security and 38 of which receive one-time life subsidy. The outcome after confirmation shows that 254 people are entitled to get farmer s basic living security subsidy, most of whom have registered in Labor Security Bureau of Qinhuai District voluntarily and they voluntarily go to Labor Security Bureau of Qinhuai District to register for farmer s basic living security. Meanwhile, Nanjing national land resource bureau transfers farmer s basic living security fund to a special account. Up to 24

33 this survey, 248 people totally have registered in Labor Security Bureau of Qinhuai District voluntarily and begin to get farmer s basic living security subsidy, but 6 people who have already bought other types of insurance still do not decide to participate in farmer s basic living security or attain money compensation directly, so they have not register in Labor Security Bureau of Qinhuai District. Summary of compensation standards and resettlement pattern is shown as Table The sub-component adopts the resettlement form of basic living security for land-lost farmers in terms of RP. APs who have signed the contract of land acquisition are brought into Nanjing Basic Living Security System for Land-lost farmers and Honghua Sub-district Agency organizes them to select the payment level of basic living assurance at Qinhuai Labor and Social Security Bureau. According to their selection, Nanjing National Land Resource Bureau leaves 70% of land compensation fund and all resettlement subsidies to help them buy the assurance, and pays the last part to these APs. When land-lost farmers are retired, they can get relevant basic living assurance capital from Nanjing Social Security Bureau according to their selection. In the RP, the standard of basic living security subsidy is decides by the current policies of Nanjing municipal government (Table 3-4). In 2007, the standard of basic social security capital raised CNY 20/month according to the price conditions of Nanjing, which makes each of them get more CNY 240 per year. Concrete condition is shown as Table

The urban sewage & sludge treatment plant of Phoenix in this project need to permanently occupy 446 mu state-owned land which belongs to the Phoenix iron mine (PIM), which is administrated by the Nanjing Huajian Industrial Group. PIM owned the Mining rights on land before production had been shut down in 1986 and acquired legitimate use of state-owned land warrants in Right now, the reclaim of state-owned land warrant is in the processing of transact, the procedure is as follow: Step I: Municipal Council of Nanjing need to pay the compensation of Housing and all attachments to the Nanjing Huajian Industrial Group which own the Phoenix iron mine (PIM), equalize reasonably in accordance with length of land use and sign the compensation agreement. The work is in process; Step II: Prepare relevant procedures as well as report to the Land Resources Bureau of Jiangning District to register, at the same time, pay related fees (compensation fee of land use, management fee of land allocation and land registration fees); Step iii: The Land Resources Bureau of Jiangning District recovers the use right of state-owned land; Step IV: Municipal Council of Nanjing transacts the transfer procedures in Land Resources Bureau of Jiangning District, then access to the use rights of state-owned land. 27

According to the RP, among all components of NQREIP, only Sludge Treatment & Disposal Component (STDC) and Upper Qinhuai River Improvement Sub-component and Construction of Yunliang River Wetland Improvement Sub-component of The City East Sewage Water Treatment System Component (CESWTSC) involve houses demolition In the implementation, the STDC has not began and Upper Qinhuai River Improvement Sub-component has not been started, the demolition of houses and shops connected to residential houses for South River Improvement project avoided because the red lines of construction points in Youyi bridge and Lianhua gate have been adjusted. The happened demolition is almost in Construction of Yunliang River Wetland Park Sub-component This M&E report only summarizes the resettlement plan, compensation standard and transition condition of house demolition of Yunliang River Wetland Improvement Sub-component. 4.1 Residential House Demolition and Resettlement Project and Resettlement Planned Schedules 125. According to RP, the APs will be compensated in cash and Economic Affordable Housing will be offered to them According to the RP, urban demolition of Qinhuai District involves all APs of Qiqiao Village in Construction of Yunliang River Wetland Park and 3 affected households of Upper Qinhuai River Improvement. They can apply for Economic Affordable Housing in Jiagang for their resettlement According to relative policy of Nanjing, the price of Economic Affordable Housing is between CNY 2500 to CNY According to the compensation standard of Nanjing, the house demolition compensation includes replacement subsidy, new house purchase subsidy and location distinctive subsidy. Besides, in order to reset APs of this component well, special new house purchase subsidy (CNY 700/ m 2 ) will be given to the affected families. The total compensation is CNY 2220/m 2 which can afford the economical house by adding some secondary subsidy According to the relevant compensation policy, the shops connected to residential houses would not only receive the house demolition compensation fee, but also the compensation fee for business occupancy, which is 20% of the original compensation called a replacement subsidy and is paid in cash. There is no need to pay other compensation fees such as the shut-down subsidy The families in Jiangning District that are affected by the Upper Qinhuai River Improvement can exchange the property right of their house within Jiangning District. The policy of house property right exchange can make sure the APs get the same area houses as before and with better living facility, environment and traffic. The exchanged house will have more value than the original house. 28

37 4.1.2 The Actual Schedules of the Project Changing of Compensation Rate for House Demolition 130. Up to this M&E, the House Demolishment Management Office(HDMO) have cleaned up the files which have implemented the demolition and signed an agreement, then afford the impact amount of the demolishment according to the demolition compensation agreement, which is the outcome of door-to-door measure by HDMO and confirm the actual floor space of Property Housing and accessorial housing. The impact amount has some changes compared with previous estimated data. It is showed that up to this M&E, the housing demolition of all residents completed, of which 267 households, 439 people and the actual demolition area is 40716m There are 7 Shops connected to residential houses among the APs which are showed in Table 4-1. Through the investigation and interview, it shown that some affected families prepares to rent the houses because the decorations have not completed nor have other separate residences. 32

41 Condition of the Construction of Economic Affordable Housing Construction schedule 136. The total land occupation of Jiagang Economic Affordable Housing Residential District is 315,000 m 2, the area of feasible planning land is 200,000 m 2 and the building scale is about 360,000 m 2. It is located at the Double Dragons Sub-district Grade Separated Bridge, and there are two supermarkets opposite it, named B&Q and Metro. Compared with the existing Qiqiao village, the new residential district will have convenient transport links. The area of the Jiagang Economic Affordable Housing Residential District has 30% of the total land planned to be green land, and it is to be managed by a professional property management firm to dramatically improve the APs living standard Jiagang Economic Affordable Housing Residential District started from 2006, in three phases. The project APs voluntarily select the house of Project II Project, Up to M&E this time, the main construction of Jiagang Economic Affordable Housing Project II Project completed and delivered in October There is a certain proportion of shop front on the first floor in the Economic Affordable Housing residential district, which has area ranging from 20 to 80m 2, The developer is making plans for sale and lease of shop front, but has not promulgated final scheme, shop front will first be rent to APs. Apply for and purchase Economic Affordable Housing 138. Demolition households should sign demolition agreement with project parts, according to family household and actual condition to apply for Economic Affordable Housing within six months, Housing Reform Office in Qinhuai district verifies the information on notice for15 days after approval by Housing Reform Office in Nanjing, then demolition households can choose house, after that development company tells residents how much they should pay basing on their house type and signs purchase contracts with them. Demolition households choose and buy forward housing, so after they paying for the house, have to wait for the completion of the project then they can live in.the procedures of applying for purchasing economical houses are showed in Chart Error! 42 139. Based on the RP, the average prices of the Jiagang economical houses which used for the APs in this project are from CNY 2500 to 2700 Yuan/m 2. Up to last M&E, because of the increased construction costs, the price of the economical houses raised to CNY 2999 Yuan/m 2 which is approved by price departments and construction departments(the second floor),the increased floor, its price increases 20yuan /m 2.The Resettlement Office promised that the average price is CNY 2999 Yuan/m 2 after completion of all APs applying, choosing and purchasing their houses. If the construction costs increased, the price of economical houses will not rise. The government will add the subsidies for their purchasing houses. Based on the raised compensation rates, the present compensation rate is CNY 2800 Yuan/m 2, and the interests of the compensation will be paid in purchasing houses. Adding to interests and compensation for the ground attachments and decoration, the APs can buy a set of economical houses. Paying for the house adopts the principle the excess returned, the lack replenished, namely compensation fund offsets some money paid for housing; the remaining is paid by the buyers. If compensation fund of demolition is more than money paid for the housing, the extra money will be refunded to relocation households. In this Project after they pay for the houses and most relocation households compensation fund is surplus, which is used for housing decoration. Up to this monitoring, the price of Economic Affordable Housing has not changed and still in accordance with the standard of last monitoring. In addition, some affected households use the advantage of first floor to operate barbershop and Card Room which not only facilitate the entertainment of district residents, but also to be a mean of by-business which adds more income for their families. 34
