Upon call of the roll, Mrs. Matacic present, Mr. Schramm present, Mr. Farrell present. PUBLIC PRESENTATION Teaera Roland, FNP-BC MSN RN CCM: Discussion on Medical Marijuana PUBLIC HEARING #1 ZC18-003: Applicant Hutsenpiller Contractors, Inc. is requesting a Zoning Map Amendment from R-1 to O-2 for an approximate acre site. The properties are located at 5763, 5771, 5781, 5791, 5799, and 5805 Princeton Glendale Road (Parcels #D ; 007; 008; 009; 010; 011; 012; 013; 014; 014; and 016), Section 3, Town 2, Range 3, Liberty Township, Butler County, Ohio. Mr. Juengling presented the staff report. Comments for Opposition: No comments. Comments in Favor: Bob Hutsenpiller, Applicant, 7404 Liberty One Drive, presented draft boards representing the project. He also stated he submitted letters from neighboring properties in support of the project to the zoning department.

Dates will be posted on the Liberty Township Website. Departmental Business Fire / EMS Chief Klussman requested a Motion to approve a resolution to hire David Higgins, Austin Piening and Adam VonderHaar as Part-Time Fire Fighters / EMTs at $13.00/hour and Scott Smith as a Part-Time Firefighter / Paramedic at $14.25/hour contingent upon successful completion of pre-employment testing. Services Mr. Plummer requested a Motion to approve a resolution to authorize the Township Administrator to execute an agreement with FYDA Freightliner Cincinnati for the purchase of a 2019 M2 106 Conventional Chassis for $76, and an agreement with Henderson Products, Inc. for the up-fitting of the 2019 M2 106 Freightliner chassis for $60, for a total amount not to exceed $136, from account # Mr. Schramm MOVED TO APPROVE A RESOLUTION TO AUTHORIZE THE TOWNSHIP ADMINISTRATOR TO EXECUTE AN AGREEMENT WITH FYDA FREIGHTLINER CINCINNATI FOR THE PURCHASE OF A 2019 M2 106 CONVENTIONAL CHASSIS FOR $76, AND AN AGREEMENT WITH HENDERSON PRODUCTS, INC. Administration Ms. Bitonte requested the following resolution to authorize the Township to enter into an Architect Project Agreement with MSA Architects in connection with design services for the Administration Building be tabled until further notice. Ms. Bitonte requested a motion to approve a resolution to authorize the Township Administrator to execute the attached License Agreement with Barrett Paving Materials Inc. Mr. Schramm MOVED TO APPROVE A RESOLUTION TO AUTHORIZE THE TOWNSHIP ADMINISTRATOR TO EXECUTE THE ATTACHED LICENSE AGREEMENT WITH BARRETT PAVING MATERIALS INC. ( ) Ms. Matacic seconded. The motion passed unanimously. Department Reports Fire / EMS Training Report o Chief Klussman stated that he is updating the yearly departmental reports. Trustees had no questions on the Departmental Reports.

5 Minutes Page 5 TOWNSHIP ADMINISTRATOR S REPORT Holiday Closings: Presidents Day o Monday, February 19th TRUSTEE COMMENTS Ms. Matacic stated she will be compiling information gathered at the Ohio Township Association Conference and will be sharing with the other trustees and staff. Ms. Matacic will be requesting that the Trails meeting be moved to a different time in order to encourage more residents to be able to attend. Mr. Schramm MOVED TO ADJOURN. Ms. Matacic seconded. 6 RESOLUTION NO Board of Trustees, Liberty Township Butler County, Ohio RESOLUTION TO ACCEPT THE RECOMMENDATION OF THE LIBERTY TOWNSHIP ZONING COMMISSION NOTICE OF DECISION FOR CASE ZC18-003, APPLICANT: HUTSENPILLER CONTRACTORS, INC. TO APPROVE A ZONING MAP AMENDMENT TO THE LIBERTY TOWNSHIP ZONING MAP FROM R-1 (SUBURBAN RESIDENCE DISTRICT) TO O-2 (OFFICE/LIMITED INDUSTRIAL) FOR 5763, 5771, 5781, 5791, 5799, AND 5805 PRINCETON GLENDALE ROAD RESOLVED by the Board of Township Trustees of Liberty Township, Butler County, Ohio that WHEREAS, the Butler County Planning Commission conducted a public hearing for the proposed request on Tuesday, January 9, 2018 and made a motion to recommend approval of the Zoning Map Amendment to the Liberty Township Zoning Map as presented; and WHEREAS, the Liberty Township Zoning Commission conducted a public hearing for the proposed request on Wednesday, January 17, 2018 and made a motion to recommend approval of the proposed Zoning Map Amendment to the Liberty Township Zoning Map as presented; and WHEREAS, a public hearing was conducted by the Liberty Township Board of Trustees on Tuesday, February 6, 2018 at 6:00 p.m. to review the proposed Zoning Map Amendment to the Liberty Township Zoning Map; and WHEREAS, all those present for the hearing who wished to be heard voiced their opinions with respect thereto; and, WHEREAS, said application was reviewed by the Board of Township Trustees and determined to be consistent with the Liberty Township Comprehensive Plan; now, THEREFORE BE IT RESOLVED that the Liberty Township Board of Trustees does hereby approve the request for the Zoning Map Amendment from R-1 (Suburban Residence District) to O-2 (Office/Limited Industrial District) to the Liberty Township Zoning Map for 5763, 5771, 5781, 5791, 5799, and 5805 Princeton Glendale Road.

8 REPORT TO THE LIBERTY TOWNSHIP BOARD OF TRUSTEES For Meeting of February 6, 2018 CASE NO. ZC ZONING MAP AMENDMENT R-1 TO O-2 APPLICANT HUTSENPILLER CONTRACTORS, INC. PROPOSED REQUEST: The applicant is requesting a Zoning Map Amendment for the properties located at 5763, 5771, 5781, 5791, 5799, and 5805 Princeton Glendale Road (Parcels #D ; -007; -008; -009; -010; -011; -012; -013; -014; -015; and -016) from R-1 (Suburban Residence) to O-2 (Office & Limited Industrial District) for a total of acres. BACKGROUND INFORMATION: The subject property is located west side of Princeton-Glendale Road (SR-747), approximately 1,600 feet north of Millikin Road, and approximately 3,225 feet south of Kyle s Station Road. The site is comprised of 11 single-family acreage parcels, currently zoned R-1, that are planned to be consolidated by the applicant. The overall site is approximately acres in size, with approximately 420 of frontage along Princeton-Glendale Road. The property adjacent to the north is zoned B-2 (Community Business District) and is developed as an auto repair shop (Barry s Complete Auto); the property adjacent to the south is zoned R-1; the properties adjacent to the east (opposite Princeton-Glendale Road) are zoned R-1; and the property to the west is zoned R-1 and is the site of the Vista Verde single-family residential subdivion. 9 REPORT TO THE LIBERTY TOWNSHIP BOARD OF TRUSTEES For Meeting of February 6, 2018 COMPREHENSIVE VISION PLAN: The Comprehensive Vision Plan for Liberty Township offers the following guidance for the future development of the subject properties: Single Family Liberty Township Proposed Land Use Map Single Family Residence ½ Acre Min. Lots Estate Residential 1 5 Acre Lot Size Planned Community Mixed Use Residence Planned Development Single Family Residence ½ Acre Min. Lots Planned Community Mixed Use Includes areas that develop with a mix of uses (office, retail, recreational, and residential) which maintain a more vibrant, walkable, and economical development. Neo-traditional street and pedestrian patterns shall be maximized to achieve a community oriented urban lifestyle. General Location and Development Characteristics Large Sites, generally 20 or more acres; Developed as Mixed Use Planned Unit Development; Max building height three (3) stories or 45 feet, whichever is greater; Retail uses are only permitted on the first floor; Office and residential uses are permitted on all floors; Commercial (retail/office uses shall be at least twenty-five percent (25%) of the overall development; Residential buildings may be freestanding from other uses; Mixed Use Buildings (Residential/Commercial) shall not exceed twelve (12) dwelling units per acre; Residential density that is free standing within the mixed use development shall not exceed six (6) dwelling units per acre; Detached residential units shall not exceed two (2) dwelling units per acre; Minimum open space shall be thiry percent (30%) Streetscape design shall be included in development plan; The sidewalks and parkways must be tree lined; 2

10 REPORT TO THE LIBERTY TOWNSHIP BOARD OF TRUSTEES For Meeting of February 6, 2018 Parking rations must conform to the zoning resolution except when common/shared parking areas can be provided; Community gathering areas and/or focal points shall be provided at all major nodes; Uniform building materials, signage, lighting and landscaping shall be provided throughout the development or divided by neighborhood district; and Buffering shall be provided between existing adjacent divergent or less restrictive uses. STAFF COMMENTS: 1. The Planned Community Mixed Use land use designation for this site, identified in the 2013 Comprehensive Vision Plan, recommends a minimum of 25% of the land be allocated to commercial (retail or office) use. The proposed O-2 district would allocate 100% of the land to commercial usage. 2. A rezone of the property to the O-2 district would allow for the uses below to be approvable on the subject properties by the Planning & Zoning Department (permitted by right) or by the Board of Zoning Appeals (conditional use). The permitted uses of the O-2 district, per Table 4.7-A of the Liberty Township Zoning Resolution are as follows: Permitted by Right: Agricultural Use (w/ conditions) Day Care Center (w/ conditions) Equipment Rental Financial Institutions Hotel Medical Equipment/Supplies Office Office Park or Campus Pharmacies Pharmaceutical Use Restaurant, Sit-Down Technology Telecommunication Tower Laboratory Research & Development Hospital, Medical Center, and Outpatient Clinic (w/ conditions) Parks and Open Space Conditional Use (Requires Board of Zoning Appeal approval) 24 Hour a Day Business when Restaurant, Drive-Thru adjacent to a Residential District Wholesale Commercial Use or Recorded Subdivision Distribution Center and Animal Hospital/Veterinary Warehousing Clinic Light Industrial Use Flex Space (Office Warehouse) Storage Facility Fuel/Convenience Store Government and Public Use Funeral Home Instituional Care Facility Motel 3. The applicant intends to use the property as a storage facility use, which is a conditional use in the O-2 district per Table 4.7-A, which would require review and approval by the Liberty Township Board of Zoning Appeals. 4. All developments within the O-2 district are subject to the General Development Standards outlined in Article 6 of the Zoning Resolution. This includes architectural standards (customer entrances, roofs, ornamentation, and façade massing), dumpster and trash enclosure standards, exterior lighting, performance standards, commercial property maintenance standards, and outdoor sales, displays, and storage. Any waiver or variance request from the standards of 3

11 REPORT TO THE LIBERTY TOWNSHIP BOARD OF TRUSTEES For Meeting of February 6, 2018 Article 6 will require approval by the appropriate review board (Zoning Commission or Board of Zoning Appeals). The Zoning Commission serves as the architectural review authority, as granted by Section of the Ohio Revised Code and Section of the Zoning Resolution, for cases specified in Article Any development within the O-2 district will require the appropriate buffers from adjacent uses/districts per Section 8.4 of the Zoning Resolution. 6. Any access point onto Princeton-Glendale Road requires review and approval by the Ohio Department of Transportation (ODOT). OTHER AGENCY COMMENTS: Butler County Planning Commission The Butler County Planning Commission conducted a public hearing on January 9, 2018 for the proposed request and made a recommendation of approval to the Liberty Township Zoning Commission & Board of Trustees. This recommendation is attached for reference. 12 BUTLER COUNTY PLANNING COMMISSION RESOLUTION #18.02 WHEREAS, WHEREAS, WHEREAS, Hutsenpiller Contractors, 7404 Liberty One Drive, Liberty Township, OH, has submitted to Liberty Township an application for a zoning map amendment from R-1 to O-2 for acres located in Section 3, Town 2, Range 3, Liberty Township; and Liberty Township has referred said application (LTZ 17-09) to the Butler County Planning Commission for their review; and the Planning Commission has reviewed said application at a public meeting and finds that the amendment is generally consistent with the Comprehensive Plan for Butler County; THEREFORE, BE IT RESOLVED that the Butler County Planning Commission recommends to Liberty Township approval of the proposed zoning map amendment for Fire House Storage (parcels D , -007, -008, -009, -010, -011, -012, -013, -014, -015, and -016), with the attached comments. 13 Butler County Planning Commission Comments for LTZ Fire House Storage, R-1 to O-2 At the time of site plan review, the following items should be considered: 1. Maintain existing waterways. BCEO will perform a civil site review during submittal of building permits. 2. The detention basin for Vista Verde subdivision outlets into channel which crosses this parcel. 3. Ohio EPA is in process of updating OHC permit. The renewed permit will require Post-Construction Best Management Practices (BMP's) on all sites 1 acre or greater. Keep this change in mind during design/layout of development. OEPA has stated there is no "grandfather" clause in proposed draft permit renewal. 4. A subdivision replat will be required to combine the various parcels. 5. No existing sanitary sewer; therefore proposed use must be of low water demand, to eliminate risks to potential failure of the old existing sewage system. May require O.E.P.A. approvals upon application for a building permit. 6. Provide easement for future sanitary sewer along SR 747. 41 REPORT TO THE LIBERTY TOWNSHIP BOARD OF TRUSTEES For Meeting of February 6, 2018 CASE NO. ZC ZONING TEXT AMENDMENT MARIJUANA BUSINESSES APPLICANT LIBERTY TOWNSHIP BOARD OF TRUSTEES BACKGROUND: House Bill 523 was recently passed by Ohio, which permits the use of medical marijuana. As such, the bill authorizes the legislative authority of a municipal corporation or a board of township trustees to adopt regulations to prohibit, or limit the number of, retail establishments. In addition, the bill provides that agricultural use zoning limitations that apply to townships do not prohibit a township from regulating the location of retail dispensaries or prohibiting the dispensaries from being located in the unincorporated territory of the township. The bill prohibits a cultivator, processor, retail dispensary, or laboratory from being located or relocating within 500 feet of a school, church, public library, public playground or public park. In September of 2016, House bill 523 became effective, and in September 2017, processor, testing, laboratory, dispensary and patient/caregiver rules were adopted by the state. On December 5, 2017, the Liberty Township Board of Trustees banned Medical Marijuana with Trustee s Resolution (attached) and initiated the subject text amendment to define Marijuana Business uses and prohibit them in all zoning districts. TEXT AMENDMENT: Amend Table 4.7-A: Principally Permitted Uses to include Marijuana Business and establish the use as prohibited in all Base Zoning Districts and Overlay Zoning Districts. Define Marijuana Business in Section STAFF COMMENTS: 1. By not clearly defining Marijuana Businesses, any potential business that includes the cultivation, processing, distribution, or sales of marijuana, or any other derivative of marijuana, could be defined as an existing use type defined in the Zoning Resolution. 2. This approach is similar to the approach the township took regarding Internet Sweepstakes Café uses in that the use will be defined in the Zoning Resolution, but prohibited in all zoning districts. 3. Per House Bill 523, if no action is taken, these businesses would still be required to be located a minimum of 500 feet away from any school, church, public library, public playground or public park. However, these restrictions do not include residential properties, day cares, or other potential sensitive uses. OTHER AGENCY COMMENTS: Butler County Planning Commission The Butler County Planning Commission conducted a public hearing on January 9, 2018 for the proposed request and made a recommendation of approval to the Zoning Commission. This recommendation is attached for reference. Liberty Township Zoning Commission The Butler County Planning Commission conducted a public hearing on January 17, 2018 for the proposed request and made a recommendation of approval to the Board of Trustees, with the comment that the word tests should be considered to be included in the proposed definition of Marijuana Business (as outlined in attachment). This recommendation is attached for reference.

42 ACTION: REPORT TO THE LIBERTY TOWNSHIP BOARD OF TRUSTEES For Meeting of February 6, 2018 The Board of Trustees shall concur with the Zoning Commission s recommendation of approval, or deny the request for a Text Amendment to the Liberty Township Zoning Resolution regarding Marijuana Businesses.

43 OHIO MEDICAL MARIJUANA TIMELINE The following is a timeline regarding Medical Marijuana as it is regulated in the State of Ohio and considerations to assist in determining how to regulate it from a zoning standpoint. Of note, medical marijuana June 2016 Gov. John Kasich signed Ohio s Medical Marijuana Law (House Bill 523) September 6, 2016 Liberty Township passed one year moratorium temporarily prohibiting the cultivation, processing and retail sales of medical marijuana. Expires on September 6, (Resolution No ) September 8, 2016 House Bill 523 became effective, but will take a year to establish regulations and another year to make program operational. Ohio Medical Marijuana Law Highlights Treatable Conditions: - HIV/AIDS - ALS - Alzheimer s Disease - Cancer - Chronic Traumatic Encephalopathy - Crohn s Disease - Epilepsy or other seizure disorders - Fibromyalgia - Glaucoma - Hepatitis C - Inflammatory Bowel Disease (IBD) - Multiple Sclerosis - Parkinson s Disease - Post-traumatic Stress Disorder - Sickle Cell Anemia - Spinal Cord Disease or Injury - Tourette s Syndrome - Traumatic Brain Injury - Ulcerative Colitis - Pain that is chronic and severe, or intractable The law does not allow the smoking of marijuana, but vaporizers, edibles and oils are ok. CULTIVATION: Ohio will issue 24 statewide cultivator licenses: - 12 Level I licenses for large grows of up to 25,000 square feet of cultivation area - $20,000 application fee + $180,000 license fee (large grow) - 12 Level II licenses for small grows of up to 3,000 square feet of cultivation area - $2,000 application fee + $18,000 license fee (small grow) - The state can decide in September 2018 whether to boost the number of licenses or expand the cultivation space for license holders to meet the demand. PROCESSING: Ohio will issue up to 40 processor provisional licenses prior to September 9, $10,000 application fee + $90,000 operational fee. The annual processor license renewal fee is $100,000. TESTING: There is no limit to the number of testing laboratory licenses that will be issued by Ohio. - $2,000 application fee + $18,000 operational fee. The annual testing license renewal fee is $20,000. DISPENSARIES: The number of licenses and fees will be determined by the State of Ohio board of Pharmacy. A dispensary must be located at least 500 feet from a school church, public library or public playground. The state pharmacy board will decide how many dispensary licenses to issue. May 6, Cultivator rules adopted (OAC 3796:2 Cultivators) June 30, 2017 Ohio received 185 applications for cultivator licenses..109 applied for a Level I license and 76 applied for a Level II license. Ohio will award 24 licenses (12 Level I and 12 Level II) and the selected growers will have 9 months to meet program requirements. July 28, 2017 The draft dispensary districts were released. A total of 60 dispensaries would be permitted statewide. Liberty Township is located in the Southwest Region, which is a 20 county area where 15

44 dispensaries would be permitted. Butler County is located in SW District 2 with Preble and Darke Counties. The SW District 2 would permit a total of 2 dispensaries. August 15, 2017 Liberty Township extended the moratorium by an additional six-months temporarily prohibiting the cultivation, processing and retail sales of medical marijuana. Expires on March 8, (Resolution No ) September 8, 2017 Processor, Testing Laboratory, Dispensary and Patient/Caregiver rules adopted (OAC 3796:3 thru 8); and, Physician Certificate to Recommend Rules Adopted. September 22, 2017 Ohio received 2 applications for testing licenses from public institutions of higher education (Central State University and Hocking College). November 3, 2017 Ohio announced the 12 recipients of the Level II Cultivator Provisional Licenses. November 17, 2017 Ohio received 370 applications for dispensary licenses, 11 of which are located in SW District 2. Ohio will award 60 licenses, 3 of which will be located in SW District 2. November 27-December 8, 2017 Additional applications for testing licenses will be accepted, which may be from private entities (not affiliated with public institutions of higher education). This was added due to the low number of applications received on 9/22/17 for the purpose of meeting the expected demand for laboratory testing laboratories. November 30, 2017 Ohio announced the 12 recipients of the Level I Cultivator Provisional Licenses. December 4-15, 2017 Applications for processing applications will be accepted by the state. A total of 40 processor licenses will be issued. 70 December 28, 2017 TO: FROM: Ethan Klussman Fire Chief Liberty Township Andrew Braun Support Services Captain Dayton Fire Department - Fire Maintenance Garage SUBJECT: Fire Apparatus Repair Estimate Ladder 113 With the recent preventative maintenance servicing of the Liberty Township ladder truck, the Dayton Fire Maintenance Garage observed significant maintenance related issues that we recommend be addressed in the near future. As certified as Emergency Vehicle Technician I & II, specializing in fire apparatus, our mechanics are trained specifically in emergency vehicle maintenance and as such are able to identify issues such as those listed below in a proactive manner before they create costly damage which could affect safety and emergency response capabilities. Although these repairs are not safety related, the issues noted by our mechanics if not repaired in a timely manner will likely cause unnecessary damage to your vehicle. In addition to the miscellaneous list of concerns you provided, our mechanics noted numerous issues that need addressed in the near future. The ladder truck currently has leaks in both the hydraulic fluid and power steering systems that need repaired. Upon servicing of the aerial, our mechanic noted multiple grease fittings that would not take grease, meaning the fitting may simply need replaced or a more extensive repair with removing the fitting and replacing the pins in the aerial may be necessary. The longer the aerial is operated without grease in the fittings, the more potential for damage or catastrophic failure exists. While servicing the pump, our staff noted the pump and auto lube system also needs attention, the mechanics were unable to pull a vacuum on the pump, the diaphragm is ruptured, and the gauges are in need of cleaning and repair to ensure accuracy. The master intake valve is also leaking air and should be repaired. This may require removal and offsite rebuild which is not included in the attached estimate. The recommended repairs above highlight the significant issues identified during our comprehensive inspection and preventative maintenance process. Additional repair components and specifics are listed in the second page. Without the benefit of previous maintenance records, it is difficult to assess what maintenance has been performed in the past. Our comprehensive inspection identified numerous components per NFPA standards that should be included in an ongoing maintenance plan to prevent major repairs in the future. The Dayton Fire Maintenance Garage will work with you and your staff to ensure we remain fiscally responsible and perform the appropriate work to keep your apparatus ready to safely and effectively respond to your community.
