4 CITY OF HUTCHINSON COUNCIL COMMUNICATION FOR MEETING OF 9/15/2015 AGENDA ITEM J./tL FOR ACTION INFORMATION ONLY,/ PROCLAMA T/ON WHEREAS, the Downtown Hutchinson Rod Run & Classic Car Show will be held on Main Street in Downtown Hutchinson on October 2, 3 and 4, 2015; and WHEREAS, thousands of visitors and citizens of Hutchinson come Downtown to enjoy the Car Show; and WHEREAS, the weekend events include a Show and Shine, vendor demonstrations, City-wide cruise, Poker Run, burnout event, BBQ contest, live music, awards ceremony and car giveaway along with great music, shopping, food and drink. WHEREAS, Hutchinson, Kansas being centrally located and home to many great tourist attractions including Downtown Hutchinson, blessed with its wide Main Street, is an attractive location to bring classic cars and hot rods from throughout Kansas and many other states so that all can benefit and enjoy this exciting experience. NOW, THEREFORE, I, Jade Piros de Carvalho, Mayor of the City of Hutchinson, Kansas do hereby proclaim October 2, 3 and 4, 2015 "Downtown Hutchinson Rod Run & Classic Car Show Weekend" in the City of Hutchinson, Kansas. The Governing Body of the City of Hutchinson, Kansas, met in regular session at 9:00 a.m. on Tuesday, September 1, 2015, in the City Council Chambers with Mayor Piros de Carvalho presiding. Councilmembers Dechant, Inskeep, Daveline and Soldner were present. 2. The Pledge of Allegiance to the flag was recited. 3. The prayer was given by Pastor Kim Biery of Trinity United Methodist Church. 4. Petitions, Remonstrances and Communications a. Communities That Care - Presentation on electronic cigarettes and vapors; and related public health concerns. Several youth from Communities That Care spoke about their concerns regarding electronic cigarettes and vapors; and presented a PowerPoint presentation. Discussion ensued. Mayor Piros de Carvalho said she would like to hear all sides of the story; and asked the City Manager how to proceed. John Deardoff, City Manager, said a letter could be sent out to businesses specializing in electronic cigarettes, inviting them to a Council meeting to discuss this matter. Mr. Deardoff said a date would be established; and Communities That Care would be notified of that date. b. Oral communications from the audience. Pieter Miller, Airport Manager, spoke about a public meeting the airport is hosting regarding the use of drones in the City. He said there have been approximately 12 instances in the last several months where individuals have called asking about operating drones, or simply operated them in our air space. Mr. Miller talked about the three different classifications of drones; and said you basically can't operate droves within the City limits. The meeting will be held on September 10, 2015 at 6:00 p.m. at the Water Treatment Center located at 23rd and Severance. Councilmember Soldner said if you watch the national news you see story after story about drones; and appreciates we are getting in on the cutting edge.

6 City Council Minutes September 1, 2015 Page 2 5. Consent Agenda Joann Barb of 420 East 5th, said she has called the police several times about a semi-truck/trailer parked in the street. She said you can't see around the truck; and it makes it difficult to get out of her driveway. Ms. Barb said the City needs a law saying you can't park a semi-truck in the street. The City Manager said we do have regulations relating to semitrucks parking in residential areas. Jana Mccarron, Director of Planning and Development, said if the truck is on private property it would be handled by the Zoning Department, but on the street, the Police Department would handle it. Mr. Deardoff said an attempt will be made to contact the property owner; and urged Ms. Barb to contact the police if it happens again. a. Approval of Minutes of August 18, 2015 City Council meeting. b. Approval of appointment to the Community Improvement Commission of Joe Keck, 1410 Landon, to fill the unexpired term of Jacqui Demars for the term beginning 6/03/2014 to 6/03/2017. c. Approval of appointment to the Hutchinson ConventionNisitors Bureau Board of Gregg Wahlers, 1400 N. Lorraine, to fill the unexpired term of Holly Leiker, for the term beginning 1/01/2014 through 12/31/2016. d. Approval of appointment to the Landmarks Commission of Jo Higgins, 615 E. Sherman, to fill the expired term of Sara Sipe for the term beginning 8/11/2015 to 8/11/2018. e. Approval of appointments to the Hutchinson Human Relations Commission of the following: David Dove, 18 E. 12th, for reappointment to a second three-year term beginning 9/11/2015 to 9/11/2018. J. W. Martin, Jr., 602 E. 5th, for reappointment to a first three-year term beginning 9/11/2015 to 9/11/2018. Olivia Martinez, 106 E. 19th, for reappointment to a second threeyear term beginning 9/11/2012 to 9/11/2018 f. Approval of appointment to the Reno County Community Corrections Advisory Board of Elizabeth Allen, 1709 East 24th, to replace Betsy Mansel for the term beginning 1/01/2015 to 1/01/2017. g. Approval of voting delegates for the 2015 League of Kansas Municipalities Annual Conference. h. Approval of appropriation ordinance in the amount of $1,064, Motion by Councilmember Soldner, second by Councilmember Dechant, to approve the Consent Agenda. The motion passed unanimously.

7 City Council Minutes September 1, 2015 Page 3 6. New Business a. Consider request for a Conditional Use Permit for installation of an electronic message sign at 100 West 1st Avenue. Casey Jones, Senior Planner, spoke. Discussion ensued. Motion by Councilmember Daveline, second by Councilmember Inskeep, to accept and approve the recommendation of the Planning Commission to approve the Conditional Use Permit for an electronic message sign at 100 West 1st Avenue, pursuant to the factors and conditions as presented. The motion passed unanimously. b. Consider donation of property from the Hutchinson Land Bank. Jana Mccarron, Director of Planning and Development, spoke. Ms. Mccarron said the property would be used to extend the current Ashmeade Park; and a portion of the alley would need to be vacated to join the two properties. Justin Combs, Director of Parks and Facilities, also spoke. He said he is excited about this property; and there is a lot of energy in the neighborhood through things that the Hutchinson Recreation Commission is doing. He said there is room for a playground down the road, but that nothing is budgeted at this point. He does want to fix the sidewalks, vacate the alley, plant grass, put up a sign, etc. Discussion ensued. Motion by Councilmember Soldner, second by Councilmember Dechant, to accept the Offer of Donation of property located at 300 West Sherman Street from the Hutchinson Land Bank for the purpose of expanding Ashmeade Park; and authorize the Mayor to sign property transfer documents. The motion passed unanimously. c. Report on Fire Station #3 conceptual plans and time frame. Kim Forbes, Fire Chief, spoke. Chief Forbes said they hope to finalize construction documents by September 30; and begin demolition by November 17. The expected completion date is May 30, Discussion ensued. d. Consider 2016 IAFF Contract. Meryl Dye, Assistant City Manager, spoke. Discussion ensued regarding the extension of the probation period; required training, etc. Motion by Councilmember Dechant, second by Councilmember Soldner, to approve the 2016 Memorandum of Understanding with the International Association of Firefighters Local 179; and authorize the Mayor to sign. The motion passed unanimously. e. Consider agreement with Athco for playground equipment at Carey Park. Justin Combs, Director of Parks and Facilities, spoke. Mr. Combs said when he was looking at the playgrounds, the wood fort playground in Carey Park appeared to be unsafe; and he knew there were safety violations there. The equipment was

8 City Council Minutes September 1, 2015 Page4 subsequently removed. There were no funds budgeted for new equipment, so he approached the City Manager about using funds from the Heartland Credit Union Hutch Fund that the City receives. The City Manager agreed this was a good use of the funds; and Mr. Combs also reached out to the credit union for their approval. Three firms were interviewed; and Athco was selected. Mr. Combs said they will use a community build system, with Athco having two supervisors here to oversee the build. He hopes to have the project completed by late October or early November. Discussion ensued. Motion by Councilmember Daveline, second by Councilmember Inskeep, to approve the contract with Athco LLC to supply playground equipment and supervision of a community build in Carey Park for an amount not to exceed $88,471.00; and authorize the Mayor to sign. The motion passed unanimously. f. Consider 2015 audit engagement agreement. Frank Edwards, Finance Director, spoke. Discussion ensued. Motion by Councilmember Dechant, second by Councilmember Inskeep, to approve the audit agreement for 2015 with Lindburg, Vogel, Pierce, Faris Chartered; and authorize the Mayor to sign. The motion passed unanimously. 7. Report of City Officials a. Council Councilmember Dechant had no comments. Councilmember Soldner said she attended the Avenue A visioning process; and was very enlightened. She said there is a great deal of energy in that neighborhood; and is looking forward to seeing what can be done. Councilmember Inskeep thanked the firefighters for what they do; and thanked City staff for putting together a mutually agreeable contract. Councilmember Daveline had no comments. Mayor Piros de Carvalho asked about a possible ordinance for electronic cigarettes; and sending letters to merchants. She also asked about the process for informing the public. The City Manager said media outlets would be used to notify the public; and letters would be sent to businesses. He said the Council is not proposing an ordinance at this time; and this is just for discussion. Councilmember Inskeep said once businesses are notified, their clientele would be made aware of it. Councilmember Dechant said he would be interested in seeing data about e-cigs. Discussion ensued.

9 City Council Minutes September 1, 2015 Page 5 The Mayor also asked about a meeting between the Landmarks Commission, Council and residents in the Houston Whiteside area. Jana Mccarron said they are considering a meeting on September 24 at 8:30 a.m.; and asked councilmembers to check their calendars for that date. b. City Manager 8. Adjournment The City Manager said the Sports Arena Building Committee will meet on September 3 to review construction cost estimates, etc. He also said there are two finalists for the Animal Shelter Director; and hope to have someone hired this week. Update on Main Street construction. Michael Kramer, Director of Engineering, spoke. He said as of last Friday, in terms of dollars, Main Street is about 50% complete. He said traffic lanes will be open during the Fair, and the roadway is a little rough around the edges. He said storm sewers and waterlines have gone in; and about half of the pavement base is done. Mr. Kramer said Cornejo will work through the end of this week on the pavement, curbing and guttering. They plan on having the sidewalk at 23rd and Main done. He also talked about the traffic signals at 23rd and Main and 25th and Main. Discussion ensued. Mr. Kramer also said the 3Qth Avenue project is complete. Striping is done; and City crews will do markings for turn arrows, crosswalks, etc. He said the residential chip seal project is also complete. Additional discussion ensued. Councilmember Dechant asked about the study session September 10. The City Manager said there is a study session at 8:30 a.m. on September 10 to discuss health insurance renewals; and the rural housing incentive program. Motion by Councilmember Inskeep, second by Councilmember Dechant, to adjourn. The motion passed unanimously.

10 Interoffice Memorandum To: Honorable Mayor and City Council From: Frank Edwards, Director of Finance Date: September 15, 2015 Re: August City Council Financial Reports City of Hutcmm~~=c==::j Finance Department Each month the Finance Department provides three monthly reports consisting of 1) Statement of Cash Receipts, 2) Statement of Expenditures, 3) Statement of Cash Receipts, Expenditures and Cash Balances. These financial reports for August 2015 are submitted for your information and review. The Statement of Cash Receipts for August is a Year-to-Date report of all cash received. Through August the General Fund collections were $25.0 Million. The key revenue items were Property Taxes of $9.0 Million, Sales Taxes of $8.3 and Franchise fees of $3.5 Million. The seasonal property tax collection represented 94.6% of the full year budget for this item. August YTD sales tax collections were ahead of budget by $0.6 Million. Special Revenue Funds, which includes the Recreation Commission were $4.2 Million. Through August this fund group collected 67.7% of the full year budget. The Debt Service Fund is for collection of special assessments and taxes to support bonded City projects. YTD August collections were $5.2 Million or 117.2% of the annual budget due to July collection of 2nd half property taxes. The Enterprise Funds are for services that are intended to be fully self-supported. The largest of these funds are the Refuse Collection, Water and Sewer which account for approximately 90% of the Enterprise Fund collections. The collection within these funds was $11.1 Million through August. The Statement of Expenditures is a report of expenditures by the four fund categories mentioned in the preceding paragraph. YTD August, the General Fund expenditures were $20.4 Million compared to collections of $25.0 Million as the July 2nd half property tax collections impact this comparison. The Special Revenue Fund expenditures are listed by fund type for review and are impacted by seasonal usage in several of these funds.

OTHER ITEMS OF NOTE: Based upon the request of the Engineering Department for a smaller vacation area for South Walnut Street, a revised Site Plan was submitted on August 13, 2015 (Exhibit 3) with the parking lot shifted an additional five feet to the east. In addition, the building footprint has been slightly modified. The Director of Planning & Development made the determination that these changes were minor in nature and did not require re-submittal to the Planning Commission. The Planning Commission meeting was called to order with the following members present: Jack Martin, Rod Weinmeister, Terry Bisbee, Ken Peirce, Janet Hamilton, Harley Macklin (6:35 p.m.), and Josie Thompson. Mark Woleslagel was absent. Staff present were: Jana Mccarron, Director of Planning and Development; Justin LaFountain, Associate Planner; Stephen Hughes, Associate Planner; and Charlene Mosier, Secretary. 2. Thompson welcomed everyone in attendance. 3. The minutes of the July 21, 2015, meeting were approved on a motion by Bisbee, seconded by Peirce, passed unanimously. 4. The documents and staff reports were accepted into the official record on a motion by Peirce, seconded by Bisbee, passed unanimously. (Hamilton arrived). 5. OPEN COMMENTS FROM THE AUDIENCE - none. 6. PUBLIC HEARINGS 6a. 15-CUP-06: 102 East Avenue E Request to reconstruct City Fire Station No. 3 Applicant/Owner: City of Hutchinson Thompson asked if there were any outside contacts or conflicts of interest; there were none. LaFountain presented the staff report for the case. The request is for a conditional use permit to rebuild Fire Station No. 3 located at 102 East Avenue E. The property is zoned R-4 Residential Neighborhood Conservation District. The existing structure will be tom down and the proposed new building will be more than 20% larger than the current structure. Drawings of the proposed project and maps of the area were shown. A portion of Walnut Street will be vacated to allow for angled parking, the alley will be paved, and landscaping will be installed. Public art will be required for this City project and installed per standards set by the Public Art Design Council. Notices were mailed to owners of 19 parcels within 200 feet of the property and no comments were received. Thompson asked for the applicant presentation. 66 2 architect. The existing building had structural concerns. Construction should begin in late October and be completed in April. The plan is to be in the building in May, There will be six to seven employees in the building at all times and it will be open 365 days per year. This is phase one of three phases to upgrade fire stations in the City. Two more buildings will eventually be constructed. Chief Forbes said our Fire Department covers 108 square miles. Peirce asked if any of the road width will be removed to accommodate the angled parking. Lafountain said the parking would be in the former right-of-way area and the street width will not be affected. There were no comments from the audience. Thompson asked for the staff recommendation. LaFountain said staff recommends approval of this request with the following twelve conditions: 1. This conditional use permit shall only be used for a fire station and permitted accessory uses at 102 E A venue E; 2. The parcel shall only be developed in accordance with the approved site plan, landscape plan, and architectural elevation drawings; 3. The vacation of a portion of South Walnut Street (as applied for) must be approved in order for the parking to be allowed where it is currently proposed; 4. Curb guards will be required at the end of all parking spaces; 5. Rooftop mechanical equipment shall be screened from public view with a compatible architectural treatment, such as metal panels, stucco panels, a parapet wall, or similar treatment, as required by Section E.8. of the Hutchinson City Code; 6. Exterior lighting must meet the standards as required by Section of the Hutchinson City Code; 7. The portion of the alley that borders the property must be paved with concrete to meet standards set forth by the City Engineering Department; 8. Public art will be required for this City project, and must be installed per standards set forth by the Public Art Design Council; 9. A building permit shall be obtained prior to construction; 10. A permit must be obtained for any new fencing on the property, and any fencing must meet the standards of the Section of the Hutchinson City Code. The buffer fence between the fire station and residential uses must be 6 feet high. 11. A sign permit shall be obtained prior to installation of any signs; and 12. A final occupancy certificate shall be obtained prior to opening, and such certificate shall not be obtained prior to installation of all improvements and landscaping. Thompson closed the hearing and asked for a motion. Motion by Martin, seconded by Bisbee to recommend to the City Council approval of this request for a conditional use permit for a fire station at 102 East A venue E based upon due consideration of the following factors: 1. 67 3 2. Zoning and uses of nearby property; 3. Suitability of the property for the proposed zoning classification and use; 4. Impacts on nearby properties; 5. Length of time the property has remained vacant; 6. Relative gain to the public health, safety, and welfare, as compared with the hardship to the land owner if the application were denied; 7. Availability of public utilities to serve the development; 8. Conformance to the Comprehensive Plan; and 9. Recommendations of the professional staff. The motion passed with the following vote: Yes - Hamilton, Weinmeister, Peirce, Bisbee, Martin, Thompson. The City Council will consider this case on August 18, STUDY SESSION 7a. Continue study session on the proposed Subdivision Regulations, Article VI, Design Standards, Part 3. Mccarron said this is the last component of the study session. The input from tonight's meeting will be incorporated into the final document for the public hearing. The primary issue for sidewalks is whether to require them on both sides of the street or only one side of the street for residential subdivisions. At the last Planning Commission meeting, comments were submitted by the Young Professionals, Hutchinson Recreation Commission, and the public in favor of requiring sidewalks on both sides of the street. A Complete Street Policy has been adopted which recommends sidewalks to provide an opportunity for easier walkability and for health reasons. The Planning Commission requested that staff provide some additional information comparing the current and proposed regulations for street width. These comparisons were included in the agenda packets. The Planning Commission discussed the options of sidewalks on one side of the street and both sides of the street, the width of sidewalks at four feet or five feet, whether sidewalks should be located at the street or separated with a grass area between the street and sidewalk, and when to install sidewalks. Additional written and verbal comments were received from Ron Sellers, who indicated he supported sidewalks on one side of the street with developers installing sidewalks on the undeveloped lots within five years of the subdivision approval; Tomi Foust, Big Brothers and Sisters, who is in favor of sidewalks on both sides of the street; Patsy Terrell, in favor of sidewalks in general; Jim Gruver, Gruver Construction, said his preference is to have a five foot sidewalk adjacent to the curb on both sides of the street for dense lot subdivisions and to install them as homes are constructed. 68 4 of sidewalks on one side of the street. Amy Raigoza, A venue A resident, stated there is a need for sidewalks on both sides of the street. Harley Macklin, Planning Commissioner, had to miss the first portion of the meeting and told staff he is in favor of sidewalks on both sides of the street and adjacent to the street. Aubrey Patterson, Hutchinson Community Foundation, is in favor of sidewalks on two sides and said this is a decision for the quality of life for future citizens of Hutchinson. Thompson stated she received a realtor newsletter on the walkability of neighborhoods in commercial and residential zones which indicates a plus for marketing properties that have access to sidewalks. McCarron said these regulations would only affect new subdivision that are developed after these regulations are approved. It will not apply to subdivisions that are already approved. Currently, our regulations say sidewalks may be required and there are variations of sidewalks throughout the entire city. Picking a standard would create uniformity and better walkability for residents. Peirce commented in subdivisions with townhouses it is convenient for sidewalks to be next to the curb as it makes it easier to get out of a vehicle and not have to step up a curb and into the grass to get onto the sidewalk. Thompson asked for comments from the audience. Nick Baldetti, Reno County Health Department spoke in favor of sidewalks and said Reno County has a high rate of overweight residents. He believes sidewalks would promote a healthier life style by making Hutchinson more walkable. Tony Finlay, Hutchinson Recreation Commission, spoke in favor of sidewalks on both sides of the street because data that shows millennials are choosing the towns and neighborhoods where they want to live based more on amenities, such as sidewalks and trails and this will be the wave of the future. He believes it is easier to put sidewalks in at development than to apply for grant money later to install sidewalks. Ryan Diehl, 10 Rambler Road, said his neighborhood does not have sidewalks but could be very walkable if it did because there are schools and churches in the neighborhood and it is dangerous to walk in the street. Jay Schrock, 62A Willowbrook Road, was in favor of sidewalks on one side only. He would like the developer to have more say on what is done in their development. Jim Gruver was in favor of making the sidewalk requirement be based upon density of the subdivision, with denser developments having sidewalks on both sides of the street. Michael Kramer, City Engineer, spoke in favor of having sidewalks separated from the roadway by a planter strip and having sidewalks on both sides of the street. 69 5 Jim Strawn, Strawn Contracting, said he agrees with having a sidewalk on one side of the street but does not think the City needs to require them on both sides. It should be left to the discretion of the developer depending on the type of subdivision development. Sidewalks can create extra maintenance issues with edging, irrigation and snow removal. There have been very few new housing starts in Hutchinson this year and he does not want the extra cost of developing sidewalks to put an additional expense of development making it harder to build affordable homes. Thompson said amenities will bring people to Hutchinson and create the need to construct more homes. In the past developers paved areas so there would be less landscaping to maintain and now the trend is to have landscaping because it is more aesthetic and environmentally friendly. We currently have landscaping requirements. Weinmeister agreed that the density of a development could determine what type of sidewalk is appropriate. Bisbee said Hutchinson should be a city to attract young professionals and the cost of a sidewalk is a small price to pay for an amenity that provides healthy options for mobility. He would like to see sidewalks on both sides with the option of either a curb or interior location. Bisbee made a motion that the sidewalks be as listed in the staff proposal. The motion did not receive a second. (Macklin arrived). Thompson took a poll of the Planning Commission members on each of the sidewalks options. The majority of the commission was in favor of the following: Sidewalks on both sides of the street. Adjacent or separated by a five foot wide planter strip, as determined by the developer in conjunction with the City Engineer. Four feet, unless five feet is needed for safety or handicap accessibility. Prior to issuance of the certificate of occupancy for the abutting lot, provided that all sidewalks in a subdivision phase shall be installed within seven years of the issuance of the first building permit within that phase. The Commission asked staff to return with this language spelled out, the tree section, which will need changes, and the gated communities and streets sections which were not yet studied. McCarron said this is the last section of the Subdivision Regulation rewrite. Staff is working on compiling a composite draft which will be brought to the Commission for review and she anticipates this review will be held in October August 4, 2015 Planning Commission Minutes

This parcel recently came under ownership of Strike Development, LLC, and on Tuesday, May 5, 2015, City Council approved rezoning the property from R- 5 High Density Residential to C-4 Special Commercial. Per Section E. of the Hutchinson Zoning Regulations, platting of the property is required prior to any development taking place. The final plat application is included as Exhibit A. On August 5, 2015, the Subdivision Committee approved the preliminary plat for this subdivision with the condition that Lorraine Street be formally dedicated on the final plat.

74 15-SD-04 Fami ly Entertainment District No. 2 - Final Plat Subdivision Committee Meeting: September 2, 2015 ANALYSIS: A Development Review Committee (DRC) meeting was held on June 30, 2015 to discuss draft versions of the preliminary and final plats. Since a drainage study and the final plat application materials were not submitted with the original application, staff moved forward with the preliminary plat only at the August 5, 2015, Subdivision Committee meeting. Staff's comments on the original preliminary plat are included as Exhibit B. On July 24, 2015, the applicant submitted a revised preliminary plat, which addressed all of Staff's comments. On July 24th, the applicant also submitted a final plat. Staff has no comments on the final plat aside from the recommended conditions of approval listed above. On the final plat, the owner dedicates a 10-foot utility easement and a 20-foot landscape and buffer easement along the South side of the property. No other easements are dedicated on this plat. The City will require a drainage study prior to development of the property. Submittal and approval of a drainage study will not be required prior to final plat approval by the City Council. At this time, all outstanding items associated with this application have been addressed. 80 Exhibit C Concerns regarding development for the plat at 2105 N Lorraine: Case No. 15-SD-04 High density commercial activity is too close to adjacent homeowners to be conducive to the quality of living that is expected in a residential neighborhood. It allows hours of operation late into the evening which generates high noise levels, excessive lighting, extended hours with driving and parking activity far into the night, long after regular daytime businesses have closed their doors and ceased serving customers. C2, a lower intensity zoning level, is located directly across the street to the east. It would appear to be more compatible for this site and with the local neighborhood environment which should not have to experience these conditions. Bedrooms are often on the back side of a home. Homeowners should have an expectation of quiet, peace and solitude in their back yards and directly behind their homes. More than 30 petitions signed by area residents expressing these and other concerns were delivered to the City Council last year. None of these written comments seemed to have made a difference. We are disappointed that promises made publically at City Council meetings (specifically February 2013) by Brad Dillon, Jim Gilliland, Jim Strawn and the Commissioners, have not transpired. We were told this development would be treated as a PUD (Planned Unit Development) which keeps property owners periodically informed and involved by offering regular neighborhood information gatherings allowing homeowners to give opinions and have input. We have not been informed nor have we been asked for input. In fact any effort to obtain information has been met with reticence. Jim Strawn, himself, said the following at an early hearing to me and several in attendance, "if you sit on your backyard patios and turn the radio volume up high then you shouldn't be bothered by the noise", meaning the noise levels created by the new development's area businesses. Would this be acceptable to him if on his own patio? Additional concerns from homeowners: The need for adequate and proper Drainage; a significant concern because of the potential for flooding and damage to property. The need for a Privacy Buffer; adding more trees of comparable size to the east toward Lorraine. We suggest a stone fence of such height that it and the trees together provide adequate protection, privacy and separation. Berms are often used in neighborhoods to create separation and a buffer from noise, excessive lighting and intrusiveness. Please include nearby property owners in the future decision making process. Progress in Hutchinson is important and can be a "win-win" for all involved if it is done properly. We support growth and development that is done thoughtfully and without potential harm to surrounding property owners. We do not believe a decision to allow a business with hours long into the evening would be an appropriate choice and in fact could create potential harm to adjacent property owners. The Joint Subdivision Committee meeting was called to order with the following members present: Mark Richardson, Harley Macklin, Dave Freund, Janet Hamilton, and Jack Martin. Lisa French and Thom Etzler were not in attendance. Jana McCanon, Director of Planning and Development; Stephen Hughes, Associate Planner; and Charlene Mosier, Secretary, were also present. 2. Martin welcomed everyone in attendance. 3. The minutes for the meeting of August 5, 2015, were approved on a motion by Macklin, seconded by Richardson with a correction on page 4 to change "retention" to "detention'', passed unanimously. (Hamilton arrived). 4. PUBLIC HEARINGS 4a. 15-SD-04 Family Entertainment District No. 2 Request for approval of a final plat for prope11y fonnerly known as 2201 N. Lon-aine Street Applicant/Owner: Strike Development, LLC Martin asked if there were any outside contacts or conflicts of interest; there were none. McCanon reviewed the case. This request is for final plat approval of a single lot subdivision located next to the southeast comer of the Family Entertainment District subdivision. The Subdivision Committee approved the preliminary plat for this subdivision on August 5, 2015, with the condition that LotTaine Street be formally dedicated on the final plat. The surrounding lots are platted. This parcel was rezoned from R-5 High Density Residential to C-4 Special Commercial on May 5, Platting is required prior to any development taking place. The Development Review Committee meeting was held on June 30. On the final plat, the owner dedicates a 10-foot utility easement and a 20-foot landscape and buffer easement along the south side of the property. No other easements are dedicated on this plat. A drainage study will be required prior to development of the property. A drainage study will not be required prior to final plat approval. A notice of public hearing was published in The Hutchinson News and notifications were mailed to property owners of 15 parcels within 200 feet. 85 2 There were no comments from the audience. Martin asked the applicant for his presentation. Jim Strawn, 507 N. Whiteside, was in attendance and available to answer questions. He said he wants to be a good neighbor and landscaping will be installed in the south side easement. CmTently there is not a way to water any vegetation. Richardson asked when the landscaping needs to be completed. McCan-on said landscaping must be in place prior to an occupancy permit for any development that might occur on the prope1ty. Martin asked for the staff recommendation. McCairnn said Staff recommends approval of the Final Plat with the following conditions: 1. A signed and notarized mylar shall be provided to the City a minimum of one week prior to the desired City Council meeting. 2. A drainage study shall be submitted and approved prior to development. Drainage shall utilize facilities from Family Entertainment District No A storm water pollution prevention plan and NOI shall be submitted prior to development. 4. Site plan submittal and approval shall be required prior to construction of improvements in the subdivision. Martin closed the public hearing and asked for a motion. Motion by Macklin, seconded by Richardson to approve with conditions as recommended by staff, the Final Plat for Family Entertainment District No. 2. The Hutchinson Crossing final plat was recorded on October 9, The subdivision consists of two lots on acres of land and is zoned C-4 Special Commercial District. The subdivision includes a portion of the southwest quarter of Section 5, Township 23 South, Range 5 West of the 6th Principal Meridian. Due to the nature of the changes involved with this subdivision, McCarron made the determination that a final plat only would be required. Martin asked the applicant for his presentation. Raymond Bretton, Alpha Land Surveys, Inc., 216 W. 2nct Ave., said the entrance on the north side of Buffalo Wild Wings will be shifted 12 feet to the east and this is now shown on the plat. Update on Progress of Subdivision Regulations Rewrite McCarron gave an update regarding the Subdivision Regulations rewrite and said the Planning Commission will hear the final draft at the public hearing on October 6. The City Council will review on October 20. If there are no changes or tabled items, the Subdivision Committee would be dissolved at that point. McCarron thanked all the members for their service to the Subdivision Committee. 6. The Joint Subdivision Committee meeting was called to order with the following members present: Mark Richardson, Harley Macklin, Dave Freund, Janet Hamilton, and Jack Martin. Lisa French and Thom Etzler were not in attendance. Jana McCarron, Director of Planning and Development; Stephen Hughes, Associate Planner; and Charlene Mosier, Secretary, were also present. 2. Martin welcomed everyone in attendance. 3. The minutes for the meeting of August 5, 2015, were approved on a motion by Macklin, seconded by Richardson with a correction on page 4 to change "retention" to "detention'', passed unanimously. (Hamilton arrived). 4. PUBLIC HEARINGS 4a. 15-SD-04 Family Entertainment District No. 2 Request for approval of a final plat for property formerly known as 2201 N. Lorraine Street Applicant/Owner: Strike Development, LLC Martin asked if there were any outside contacts or conflicts of interest; there were none. McCarron reviewed the case. This request is for final plat approval of a single lot subdivision located next to the southeast comer of the Family Entertainment District subdivision. The Subdivision Committee approved the preliminary plat for this subdivision on August 5, 2015, with the condition that Lorraine Street be formally dedicated on the final plat. The surrounding lots are platted. This parcel was rezoned from R-5 High Density Residential to C-4 Special Commercial on May 5, Platting is required prior to any development taking place. The Development Review Committee meeting was held on June 30. On the final plat, the owner dedicates a 10-foot utility easement and a 20-foot landscape and buffer easement along the south side of the property. No other easements are dedicated on this plat. A drainage study will be required prior to development of the property. A drainage study will not be required prior to final plat approval. A notice of public hearing was published in The Hutchinson News and notifications were mailed to property owners of 15 parcels within 200 feet. 98 2 There were no comments from the audience. Martin asked the applicant for his presentation. Jim Strawn, 507 N. Whiteside, was in attendance and available to answer questions. He said he wants to be a good neighbor and landscaping will be installed in the south side easement. Currently there is not a way to water any vegetation. Richardson asked when the landscaping needs to be completed. McCarron said landscaping must be in place prior to an occupancy pe1mit for any development that might occur on the property. Martin asked for the staff recommendation. McCarron said Staff recommends approval of the Final Plat with the following conditions: 1. A signed and notarized mylar shall be provided to the City a minimum of one week prior to the desired City Council meeting. 2. A drainage study shall be submitted and approved prior to development. Drainage shall utilize facilities from Family Entertainment District No A stom1 water pollution prevention plan and NOI shall be submitted prior to development. 4. Site plan submittal and approval shall be required prior to construction of improvements in the subdivision. Martin closed the public hearing and asked for a motion. Motion by Macklin, seconded by Richardson to approve with conditions as recommended by staff, the Final Plat for Family Entertainment District No. 2. The motion passed with the following vote: Yes - Freund, Hamilton, Macklin, Richardson, Martin. 4b. 15-SD-07 Hutchinson Crossing Second Request for approval of a final plat for property known as Lot 1 Block I Hutchinson Crossing Applicant I Owner: Douglas Henzlik Martin asked if there were any outside contacts or conflicts of interest; there were none. Mccarron presented the staff repo1t. The request is for approval of the final plat for Hutchinson Crossing Second, a replat of Lot 1, Block 1 of Hutchinson Crossing which is located south of Waldron and north of East 17th Avenue to the east of Olive Garden restaurant. The Hutchinson Crossing final plat was recorded on October 9, The subdivision consists of two lots on acres of land and is zoned C-4 Special Commercial District. The subdivision includes a portion of the southwest quarter of Section 5, Township 23 South, Range 5 West of the 6th Principal Meridian. On June 2, 2015, City staff approved a lot split application for Lot 1 of the original plat, which was recorded by Reno County on June 11, The property is being replatted in order to Hutchinson-Reno County Joint Subdivision Committee Minutes September 2, 201 5

99 3 move the access control area and driveway entrance along Waldron to match what was constructed. The subject property includes Buffalo Wild Wings, Mattreess Hub and AT&T. The property owner has requested the access control and drive be corrected prior to purchase of Lot 2 of the subdivision by AT&T. Due to the nature of the changes involved with this subdivision, McCairnn made the determination that a final plat only would be required. Martin asked the applicant for his presentation. Raymond Bretton, Alpha Land Surveys, Inc., 216 W. 2nd Ave., said the entrance on the north side of Buffalo Wild Wings will be shifted 12 feet to the east and this is now shown on the plat. There were no comments from the audience. Martin asked for the staff recommendation. Mccarron said Staff recommends approval of the final plat with the following condition: 1. A signed mylar for the replat shall be submitted in a minimum of one week prior to the desired City Council meeting.
