3 Scorecard Background & Information The Scorecard reflects the status of the six Core Elements necessary for transparent and efficient property market development. Each Core Element includes three Lead Indicators that are further divided into Sub-Indicators. Colors signify the strength of institutions that support market development very strong, strong and weak. No color indicates that institutions are very weak. Gray indicates more information is needed for an objective determination. 4 Scorecard Methodology The International Property Markets Scorecard Methodology is a systems analysis tool to measure the strength of institutional support for transparent, rational and effective property markets. It provides stakeholders with a visual representation of the status of the core elements necessary for sustainable property markets that help to distribute power and economic opportunity. Quantitative and qualitative measures are taken from established international economic development organizations and paired with on-the-ground assessments of market participants. The purpose of the Scorecard is to bring about an awareness of the interconnections between the microeconomic factors necessary for development and provide advocates, policymakers, and development groups with clear, actionable goals for continuous improvement. Property markets are inherently local and can vary widely from one city to another, even from one block to the next. The Scorecard is meant to measure how policy decisions and levels of implementation affect property markets. It is not meant to provide specific guidance, measures or predictions of individual property performance and is only completely valid in the cities where field assessments have occurred. 4 I nternational Property Markets Scorecard Guatemala 2014

5 1. Property Rights Goal Property rights that are legally protected, secure, recorded in a single, accurate, widely accessible electronic registry and that lead to high levels of formal ownership for all citizens 5 I nternational Property Markets Scorecard Guatemala 2014

6 1.1 Legal Protection (Weak) Core Question: Does an effective and sufficient legal framework exist to protect property rights for all citizens? Legal Framework (Very Weak) Guatemala does not have a clear integrated agrarian policy or land law. In 1973, Guatemala made a Civil Code, which provides only general principles on possession, use, transfer, and ownership rights over real property Are property rights clearly defined and protected by law? Ranked 135 out of 148; Score 3.83 out of 7; Trend The judiciary is troubled by corruption, and intimidation of judges, prosecutors, and witnesses. The law is very unstable. The bundle of rights associated with residential and commercial property ownership are weak because the government places serious restrictions on ownership and the Civil Code does not explain in detail what rights one has. 6 I nternational Property Markets Scorecard Guatemala 2014

7 "Guatemala has the most inequitable and concentrated distribution of land ownership in Central America. Historical and pervasive inequality in land distribution was a fundamental contributor to the country's 36 year civil war and continues to be a primary cause of rural poverty. As of 2007, 2.6 million people -or 40% of the urban population lived in slums. In Guatemala City, slum and non-slum households share neighborhoods on the urban periphery, the dilapidated city center, and in "slum islands" that are located amidst more affluent, fully serviced areas. Also, Guatemala has not yet adopted procedures for registration of communal land. Guatemala has begun to establish their Registration for Cadastral, and has specified land use and zoning designations in Guatemala City, along with GPS and beginning phases of GIS Cadastral Information (Strong) Survey Questions SQ 2 Is cadastral information (information about the dimensions and location of land parcels) accessible to the public? Yes SQ 3 Is zoning/permitted use information included and are regulations respected and enforced? Yes, although each municipality manages its own territory, and there are often incompatibilities in land use and service between neighboring areas. The only city that has adequate planning and zoning is the Guatemala City Municipality, but it has no jurisdiction beyond its territory. 8 SQ 4 Are Geographic Information Systems (GIS) including Global Positioning Satellite (GPS) information used to create and update the registry? Yes, but GIS is barely used with evidence of only one company providing GIS data for Guatemala. This company has only surveyed Guatemala City. What is the duration of time in calendar days that it would take to complete the transfer? 9 1.2.3 Mortgage Registry (Weak) The mortgage market is still relatively new in Guatemala. Mainly all information is still on paper and not available electronically. Guatemala is trying to improve on their information systems so that data can eventually be stored online. Survey Questions SQ 5 The mandatory use of notaries or similar officials slows down and adds cost to the process. Does a notary need to be involved in the registration process? Yes SQ 6 Is information in the registry available electronically? Yes, available from the local property administration, but mainly written and not electronically SQ 7 Title insurance is indemnity insurance against financial loss from defects in title and from the invalidity or unenforceability of mortgage liens. Is title insurance available to lenders? Research has indicated only international title insurance products such as Stewart Title. Guatemala recently emerged from a 36 year civil war in 1996 that resulted in many land distortions. As a result land conflicts are a major issue. There was a civil war for 36 years and the Peace Accords attempted to address land issues, including access for poor, legal reform, and land administration. However, political will for reform has been limited, and Guatemala continues to have the most inequitable and concentrated distribution of land ownership in Central America. Land conflicts are a major issue in Guatemala and people have noted that the country's economic development and competitiveness will be stunted until land conflicts are addressed. 13 2.1 Banks (Strong) Core Question: Are traditional banking services robust and extensive enough to serve the needs of the population to help them build wealth and purchase property Guatemala s banking system is very strong and their micro lending is also strong. Access (Strong) How easy is it to obtain a bank loan? Ranked 51 out of 148; Score 3.07 out of 7; Trend ( ranked 53) Soundness (Very Strong) How sound are the country s banks? Ranked 17 th out of 148; Score 6.08 out of 7; Trend ( ranked 23) Source: The Global Competitiveness Report , World Economic Forum Microlending (Strong) Currently there are 24 Microfinance institutions in Guatemala, the majority of which are rated 4 diamonds. Although micro lending is strong, recently there is alarm over rising default rates on microloans having a total of 1,708 outstanding loans at the end of the first quarter of "According to Rocael Garcia, manager of the Microfinance firm FInca, in this issue there are two variables: the willingness and the ability to pay. People in rural areas who have microcredit loans with us have more will to pay than capacity and middle class people who request loans have less willingness and more ability to pay,' he says. " Microfinance allows citizens without traditional creditworthiness to build a credit history. Financial Freedom (Weak) Stock exchange in Guatemala is basically non-existent. Not until 2011 did four companies prelaunch preferred shares in the amount of 39.5 million GTQ (Guatemalan currency). Venture capital and Private Equity funds are starting to develop in hopes creating more jobs in the country and the wider Central American region How much control does the government exert over financial services? Ranked 60 out of 148; Score 2.76 out of 7; Trend The biggest investment into Guatemala was in 2012, when the IFC Capitalization fund invested $100 million in Guatemala-based Banco G&T Continental. 15 opportunities for business and growth. However it remains difficult for small entrepreneurs to raise capital. Equity Investors (Very Weak) How easy is it to raise money by issuing shares on the stock market? Ranked 122 nd out of 148; Score 2.42 out of 7. Trend Public offering is possible only if it is previously registered according to the Law of Value Markets and Merchandise, and they are not subject to administration authorization. Coverage is complete within the public and private credit bureau. The public credit bureau does not have to distribute credit information from retailers and utility companies, but the private credit bureaus do. More than 2 years of historical credit information is distributed between the public and private credit bureau, which is good. 18 3.1 Democratic Representation (Weak) Core Question: Does the country have free and open elections for the leadership and can citizens engage in free enterprise? Voice & Accountability (Weak) The state still directs most economic activity while public information on legislative processes and documents are often delayed or not provided at all. The United States is the biggest investor forgiving 20% of Guatemala debt for protection of rain forests. Overall Ranking 87 th out of Are citizens able to elect their government and do they enjoy freedom of expression, association and a free media? Score: 7.35 out of 10 Source: The Economist Intelligence Unit Democracy Index Public Information (Weak) Overall Score: 65 out of 100 (2010) Are there regulations governing conflicts of interest in the executive and legislative branches of government? Executive Score: 49 out of 100; Legislative Score: 49 out of 100. The head of state and government and the members of the national legislature are required to file a regular asset disclosure form. Also, regulations governing gifts and hospitality offered to members of Executive branch and national legislature. 19 Can citizens access legislative processes and documents? The law provides guarantee to all persons interested, without any discrimination, the right to request and access the information held by public authorities and persons subject to this act. The problem is that the right to information request is not effective because responses regarding sensitive topics such as presidential programs are usually provided late or not given at all. The government can also appeal for an additional 10 days making the process longer. A peer review said sometimes institutions don t want to disclose information requested so they simply don t give an answer or they deny the information, naming it reserved. This situation has happened several times, especially with the Prosecutor s officer and the Ministry of Interior. 20 3.2 Lack of Corruption (Strong) Core Question: Is the public sector transparent and free of corruption? Transparency (Weak) Although the indicator is strong, transparency is very weak. Requests for information can be ignored if pertaining to government or it can be delayed for 10 additional days. Guatemala has all the NIS pillars in place, but total cooperation is needed. The reason why the indicator is strong is because only 6.2% of firms have said they have expected to have extralegal payments What is the perceived level of corruption in the country? Ranked 29 out of 178; Trend. The level of corruption in the country is fairly high, with corruption, gang violence and drug smuggling at an all-time high. Source: Corruption Perception Index 2013, Transparency International Integrity Mechanisms (Strong) A National Integrity System is a framework where the principle institutions that contribute to integrity, transparency and accountability in a society can address corruption in a systematic way. Does a National Integrity System exist? Guatemala has all the NIS pillars in place, but cooperation is needed. "An example would be "Civil Society" where cooperation between civil servants, public officials, and CSOs, which does not consistently occur, depends on the situation and political will of authorities. Also, for the business sector, social corporate responsibility is still new in this country. Size of Government Guatemala s government effectiveness is decreasing every year on top of their poor civil services. The size of government relative to GDP is strong only because of a debt forgiveness by the United States. Guatemala must improve on the quality of services as well as their civil servants. Only by training and educating them will this ever improve What is the size of government relative to GDP? 25% The only reason why this indicator is strong is because the United States forgave 20% of Guatemalan debt for protection of rain forests. 24 4.1 Rule of Law (Very Weak) Core Question: Do all market participants abide by the rule of law and have confidence in the courts and the ability of police to control crime? Impartiality (Very Weak) The level of confidence for the police, courts, and contract enforcement is very weak due to corruption in the country. Even when records are supposed to be accessible, sometimes citizens have zero access and are ignored. It is the second to worst country in the world in terms of what it costs investors in the event of crime and violence What is the confidence level of the strength and impartiality of the police, courts and contract enforcement? 25 4.2 Enforcement of Contracts (Weak) Core Question: Are systems in place for timely and efficient enforcement of contracts? Courts are slow and in some cases corrupt because of unqualified lawyers and judges. Major reform of the judicial system is required, and more courts, better judges, transparency, and automation of the data must be demanded for the future of the judicial system Judicial Enforcement (Strong) Ranked 97 out of 188; Trend = What is the number of procedures involved in resolving a commercial dispute? 26 4.2.3 Power-of-Sale (Weak) SQ 12 Power-of-sale agreements give creditors the power to sell properties after notice to the borrower without court intervention. Although the indicator is strong, the lack of a firm foundation for the rule of law causes commercial dispute resolution to be weak. Corruption weakens the judicial system which drives businesses to Alternative Dispute Resolution (ADR). Courts in rural areas are very corrupt and judges lack knowledge of certain subject matter. Survey Questions Commercial Courts (Weak) SQ 14 Do specialized commercial courts exist for the handling of property disputes and foreclosures? "The ordinary courts dealing with civil matters have the primary responsibility for implementing the bankruptcy legislation for non-financial entities and individuals. As is the case with the other Central American countries that are the focus of this assessment, there are no bankruptcy courts in Guatemala, as there are also no specialized commercial courts. Civil judges of the first instance have subject matter jurisdiction over bankruptcy cases. 27 established, the place where the debtor normally resides. The courts of appeal are also the courts of civil jurisdiction." (USAID) Source: USAID Guatemala Alternative Dispute Resolution (Strong) SQ 15 Are alternative dispute resolution mechanisms in place including commercial arbitration, private mediation and community based processes? Guatemala s 20 language groups and indigenous majority emerged from revolution and civil war violence with no trust in public institutions. ADR, as part of a major effort at judicial modernization, created a new way to resolve civil, criminal, land tenure, family and community disputes non-violently and without recourse to expensive, outdated, delay-ridden litigation. Guatemala began offering court-annexed mediation centers, in the languages of the local people, respectful of their customary laws and norms, but also connected to the formal justice system. Efforts exist to initiate mediation centers throughout the country at new Centros de Administracion de Justicia, especially in remote, under-served parts of the country. Mobile courts (refitted buses) with a justice of the peace in one room and a mediator in the other, travel from neighborhood to neighborhood according to a posted schedule. Guatemala has begun to adopt international standards by joining the IACVA. This organization keeps its members at high standards following the IVSC standards. Training and ethical standards are greatly improving which shows Guatemala is headed in the right direction. 39 Conclusions and Recommendations Interrelated Issues Guatemala is Central America s largest country in terms of population and economy, and plays an important role in the Central American trade and integration. Guatemala has one of the most skewed income distributions and despite a wealth of natural resources, an estimated 51 percent of its people live in poverty and over half of children less than five years old suffer from chronic malnutrition. The poor is mostly consisted of rural indigenous people, mostly women, of Mayan descent who have suffered from repression and exclusion from participating in the Guatemalan society. Guatemala s 36-year civil war was the longest, most violent in Central America claiming more lives than conflicts in El Salvador, Nicaragua, Chile, and Argentina combined resulting in more than 200,000 casualties and violations of human rights. December 1996 marked the official ending to the conflict when the Peace Accords was signed. 11 civil societies were developed from this conflict and is a key force of reform in Guatemala. Although there are civil societies driving reform, democracy is still fragile and governmental institutions remain weak because of lack of funding, inefficiency, and corruption. Moreover, criminal activity and violence have reached historical levels which raises concern for political stability. Nacrotrafficking groups, gangs and other organized crime represent one of the most serious threats to stability since the Civil war. Crime and violence is now a serious economic and social problem with high economic and social costs. Along with criminal activity and corruption, the substantial inequality establishes a risk factor for future stability and constrains to Guatemala s future growth. The land distribution is highly unequal with the largest 2.5% of farms occupying close to two thirds of agricultural land, while 90% of farms occupy only one-sixth of the agricultural land. One of the key causes of poverty among indigenous Guatemalans is the insecure tenure. 43% of the population is indigenous and multiple unresolved land disputes discourage investment and reduce the potential contribution of agriculture to improvements in rural living standards as well as overall economic growth. An astonishing 50% of Guatemala s population is younger than 19 and 51% live in poverty line, which means inadequate education and lack of job opportunities lure youths into organized crime groups. A key issue for Guatemala remains the relatively low level of tax revenues (around 11 percent of GDP) and high levels of corruption. Government institutions do not have the resources to address the challenges posed by crime and violence, high levels of malnutrition and health issues, or to increase the economic development needed to reduce Guatemala s high levels of poverty. Income inequality is related by lack of access to health and education services which is a major cause of Guatemala s poor health statistics and lack of rural development. Their infant mortality rate is the highest in Central America and third highest in the world. Chronic malnutrition is one of Guatemala s public health concerns since it is higher than any country in America as well as most countries in Africa. Chronic malnutrition is concentrated in rural communities among the indigenous populations.
