5 TOWNSHIP OF CENTRE WELLINGTON NOTICE OF PUBLIC MEETING REGARDING A PROPOSED ZONING BY-LAW AMENDMENT TAKE NOTICE that the Council of the Township of Centre Wellington will hold a public meeting regarding a proposed zoning by-law amendment pursuant to Section 34 of the Planning Act, R.S.O. 1990, on Monday April 24, 2017 at 6:30 p.m., in the Council Chamber, 1 MacDonald Square, Elora. The purpose of the public meeting is to present the proposed by-law amendment and to receive public input prior to making a decision. The Township s File Number for this amendment is RZ03/17. Purpose and Effect The purpose and effect of the proposed zoning by-law amendment is to change the zoning of the land from R3 to R1C Residential Exception. The effect of the amendment is to permit a single detached dwelling with a reduced rear yard setback. The subject land is part of Block 60 of Registered Plan 868, as shown on the key plan below. Public Meetings to Consider Zoning Amendments CARRIED 5.1 RZ01/ Stumpf Street and 405 Geddes Street, Elora (Pinestone Homes) Mayor Linton indicated the purpose of this public meeting is to present and receive public input regarding a proposed zoning by-law amendment on the subject properties known as Stumpf Street, Elora and 405 Geddes Street, Elora. He noted the purpose of the proposed zoning by-law amendment is to change the zoning of the land from R1A Residential to R1B Residential. The effect of the amendment is to implement zoning regulations necessary to permit three single detached dwellings. Mayor Linton indicated the zoning amendment is a condition of approval of the County of Wellington Land Division Committee Applications B75/16 & B76/16. The application also includes a proposed change to the required rear yard setback on an adjacent property with an existing single detached residence. Mayor Linton noted if a person or public body does not make oral submissions at the public meeting, or make written submissions to the Township of Centre Wellington before the by-law is passed, the person or public body is not entitled to appeal the decision of the Township of Centre Wellington to the Ontario Municipal Board. Mayor Linton advised if a person or public body does not make oral submission at the public meeting, or make written submissions to the Township of Centre Wellington before the by-law is passed, the person or public body may not be added as a party to the hearing of an appeal before the Ontario Municipal Board unless, in the opinion of the Board, there are reasonable grounds to do so. 10 Council Minutes March 27, 2017 also advertised in the Wellington Advertiser on March 3, She confirmed the requirement for giving notice was completed on March 3, Mayor Linton called upon Mariana Iglesias, Planner to introduce the application. M. Iglesias, Planner indicated the properties are located on the east side of Geddes Street, north of Stumpf Street. She explained the rezoning is associated with three severance applications (B75/16, B76/16, and B21/17) which will result in the reconfiguration of the existing lots and the creation of three residential lots on Stumpf Street. M. Iglesias noted the severance applications were conditionally approved by the County Land Division Committee in November 2016 and zoning compliance is required prior to final consent. M. Iglesias noted the proposed rezoning will change the zoning of these lands from R1A to R1B to allow reduced lot frontages and lot areas that better align with the R1B zoning and with the smaller lots in the neighbourhood to the east. She explained the rezoning will also recognize a reduced rear yard setback for the existing dwelling on the corner lot. M. Iglesias noted to date, comments have been received by the County and the Grand River Conservation Authority with no objection to the rezoning. No other oral or written submissions have been received. Mr. Arnold DeBoer, the applicant, indicated he had nothing further to add but is available to respond to questions. Mayor Linton asked anyone wishing to address Council to come forward at this time, to please state their name and address for the record. There being none, Mayor Linton advised written comments are encouraged to be submitted to the Municipal Clerk and Council will consider all input prior to making a decision. Mayor Linton thanked everyone for attending, declared the public meeting adjourned and proceeded with the second public meeting. 5.2 RZ02/ Wellington Road 22, Eramosa Mayor Linton indicated the purpose of this public meeting is to present and receive public input regarding a proposed zoning by-law amendment on the subject property known as 8378 Wellington Road 22, Page 3 of 12 Page 10 of 39

He noted the purpose of the proposed zoning by-law amendment is to change the zoning of the subject land from A Agricultural and EP Environmental Protection to A Agricultural Exception and EP Environmental Protection. He indicated the effect of the amendment is to implement zoning regulations necessary to facilitate a farm dwelling surplus severance and to restrict residential uses on the retained parcel. The zoning amendment is a condition of approval of the County of Wellington Land Division Committee Application B113/16. Mayor Linton stated if a person or public body does not make oral submissions at the public meeting, or make written submissions to the Township of Centre Wellington before the by-law is passed, the person or public body is not entitled to appeal the decision of the Township of Centre Wellington to the Ontario Municipal Board. 12 Council Minutes March 27, 2017 noted as required by Provincial Policy, the purpose of the rezoning is to prohibit new residential development on the retained 17 hectare farmed parcel, the severed parcel otherwise complies with zoning requirements. M. Iglesias indicated comments have been received by the County and the Grand River Conservation Authority with no objection to the rezoning and no other oral or written submissions have been received. Mayor Linton calls on Jeff Buisman, agent for the applicant, to make a presentation. J. Buisman indicated he had nothing further to add to the Planner s presentation and responded to questions regarding previous severances on the property and current official plan severance policies. Mayor Linton asked anyone wishing to address Council to come forward at this time, to please state their name and address for the record. There being none, Mayor Linton advised written comments are encouraged to be submitted to the Municipal Clerk and Council will consider all input prior to making a decision. Mayor Linton thanked everyone for attending and declared the second public meeting adjourned. 6. Business Arising from Closed Session 6.1 Mayor Linton indicated an item was discussed in Closed Session regarding a property matter. Moved by Councillor K. McElwain, Seconded by Councillor S. VanLeeuwen WHEREAS no valid tender was received after the property denoted by roll number (641 Anderson Street North, Fergus) was advertised for sale in 2016 pursuant to the Municipal Act as amended, Part XI Sale of Land for Tax Arears; AND WHEREAS pursuant to sections 354(2)(a) and 354(3) of the Municipal Act as amended, the Treasurer of a local municipality, only after an unsuccessful tax sale under Part XI, shall remove unpaid taxes from the tax roll if the council of the local municipality, on the recommendation of the treasurer, writes off the taxes as uncollectible; AND WHEREAS pursuant to the Municipal Act as amended, Part XI Page 5 of 12 Page 12 of 39

13 Council Minutes March 27, 2017 Sale of Land for Tax Arears section 379(5)(b) if there is no successful purchaser, the Treasurer may prepare and register, in the name of the municipality, a notice of vesting; AND WHEREAS because no building permit can be issued for this property, the property has limited marketability; AND WHEREAS the Township has no interest in acquiring the property; AND WHEREAS the requirements of By-law , being a By-law with respect of the sale and other disposition of land by the Municipality have been met; AND WHEREAS the owners of the adjacent property have offered to purchase the property in exchange for the Township s legal and other costs of sale; NOW THEREFORE the Council of the Township of Centre Wellington directs the Managing Director of Corporate Services/Treasurer to undertake the following actions with the property denoted by assessment roll number : Write off the balance of taxes in the amount of $5, pursuant to sections 354(2) and 354(3) of the Municipal Act, 2001 as amended. Prepare and register, in the name of the Township, a Notice of Vesting pursuant to section 379(5)(b) of the Municipal Act, 2001, as amended. Execute an Agreement of Purchase and Sale between the Township and Robert and Jennifer Nowack in the amount of $1, CARRIED 7. Presentations/Announcements Andy Goldie, Chief Administrative Officer introduced Sandra Schulz, as the new Manager of Human Resources. He indicated Sandra comes to us from Niagara Region and has extensive experience in numerous Human Resources disciplines. 7.1 Mayor's County Council Report Mayor Kelly Linton highlighted the re-opening of the Aboyne Library branch and the Children's Early Years Division offices, the Canada 150th preparations underway by the Fergus and Elora BIA s, and the dinner hosted by the Wellington Centre for Sustainable Agriculture. 14 Council Minutes March 27, Councillor's Committee Updates Councillor Don Fisher provided an update on the work of Heritage Centre Wellington, including recommendations for heritage designations. Councillor Fred Morris highlighted the very successful Victoria Park Senior Centre s Active Living and Retirement Show, where more than 50 vendors showcased items and services to help make the most of life. Councillor Stephen Kitras spoke of the Farm Safety pancake breakfast in Alma and the ongoing work of the Economic Development Task Force working groups. Councillor Steve Vanleeuwen expanded on the exciting projects and recent discussions undertaken by the Economic Development Task Force working groups. 7.3 County Councillor Shawn Watters County Councillor Shawn Watters provided an overview of the County projects underway or soon to be underway in 2017, including road work on Wellington Road 7 from Salem to Alma, as well as bridge and wall construction on Geddes Street and St. Andrew Street. Councillor Watters responded to questions regarding future opportunities for more affordable housing and enhancements to the Badley Street bridge. 8. Confirmation of Agenda 8.1 Moved by Councillor D. Fisher THAT the Council of the Township of Centre Wellington approve items 1-13 of the report from the Committee of the Whole dated March 20, 2017 as follows: 1.THAT the Council of the Township of Centre Wellington approves the request from Garry & Linda Sullivan for an exemption to By-law , the Noise By-law for the Township of Centre Wellington, to permit the amplification of music at 0046 Side Road 18, Fergus, on Saturday, August 19, 2017 between 11:00 p.m. to 1:30 a.m., for a wedding celebration; AND THAT the applicant ensure neighbouring property owners are notified in advance of the event. 2. THAT the Council of the Township of Centre Wellington appoint the following to the Board of Management for the Elora Business Improvement Area: Jon Laurencic, Chair Steve Scott, Vice-Chair Fran Weima, Treasurer Bronwyn Tolmie Cate Mulholland Jacquie Shantz AND THAT By-law be amended to reflect the new Board of Management for the Elora Business Improvement Area, pursuant to s. 204(2) of the Municipal Act 2001, as amended. 3. THAT the Council of the Township of Centre Wellington approves the issuance of a demolition permit to demolish the single detached dwelling located at 6281 Eighth Line West, former Township of Pilkington, Concession C, West of Grand River, Lot 7, Lot 8, Including Islands. 4. THAT the Council of the Township of Centre Wellington approves the issuance of a demolition permit to demolish the single detached dwelling located at 503 James Street (Salem), former Township of Nichol, Plan 75, Wisslers Portion Lot 6, East Side James Street, Part George Street Salem. 5. THAT the Council of the Township of Centre Wellington receives the 2016 Annual Building Activity Report for information dated March 20, THAT Council approve a Level Two (2) Façade, Building and Property Improvement Grant/Loan for the Priority Site listed as 101 St. Andrew Street West, Fergus (former Rafferty Insurance) in the amount of a $10,000 grant and a $10,000 loan; AND THAT Council delegate the signing authority for Level Two (2) Façade, Building and Property Improvement Grant/Loan financial agreements to the Managing Director of Corporate Services. 8. THAT the Council of the Township of Centre Wellington approve zoning amendment application RZ02/16; AND THAT the proposed zoning by-law amendment to Zoning By-law be given three readings. 9. THAT the Council of the Township of Centre Wellington approve zoning amendment application RZ08/16 for the properties located at 6074 Fourth Line East and 6029 Sixth Line East, Pilkington; AND THAT a by-law to amend By-law be given three readings. 10. Report: Section 2 of the Line Fences Act, R.S.O. 1990, c.l. 17 requires every local municipalities to appoint fence-viewers to carry-out the provisions of the Act, and to establish the remuneration to be paid to the fence-viewers. a previous By-law , to appoint fence-viewers, expired on December 31, Since that time, the Township has advertised on numerous occasions for those interested in being a fence-viewer to apply and no interested parties have come forward. A fence viewing application has been received and in order to conduct the viewing in a timely manner fence-viewers from the Township of Wellington North and the Town of Minto have agreed to assist. In addition, Subsection 5 (2) of the Act permits viewings to be banned during the winter months in areas where snow conditions make it impracticable for them to be held. Staff is proposing to continue the ban of proceedings requiring the attendance of the fenceviewers for the period between the 1st of November of one year and the 31st of March of the next year. Report: When a subdivision is registered, it is a requirement of the Township that all dead ends and open sides of road allowances be terminated in a 0.3 metre, or one foot reserve that is dedicated to the Township. These blocks are generally placed at the dead end of a street in one phase of a subdivision where it is to be extended in a future phase. The reserve is to prevent unauthorized access to the land abutting the reserve. As a new subdivision phase is registered, it is necessary to dedicate the reserve blocks as part of the road allowance. A number of new phases in subdivision plans were registered in 2016 and it is now appropriate to pass a by-law to dedicate the reserve blocks in these subdivisions. The necessary by-law is attached, as are key maps to identify the affected blocks. Report: Plan 868 is a plan of subdivision in Fergus that was registered in The plan incorporates a portion of McTavish Street as well as Scott Street. Scott Street is a culde-sac that presently contains several blocks of townhouses and also provides access to the Heritage Lane development that is under construction. At the time of the execution of the subdivision agreement for Plan 868, it was contemplated that Scott Street may be extended as a public road onto the abutting land that was in separate ownership and not part of the subdivision. One of the townhouse blocks on the plan, Block 60, was used to create a temporary turning circle. The developer of the subdivision was required by the subdivision agreement to construct the temporary turning circle and convey Block 60 to the municipality. The municipality, in turn, agreed to convey Block 60 back to the developer if the land was no longer needed for a temporary turning circle. Fast forward to 2014 and the abutting land was sold and a draft plan of vacant land condominium was proposed. The development plan proposed a private road with access to Scott Street. The Township therefore required the temporary cul-de-sac to be reconstructed to a permanent standard within a portion of Block 60, at the developer's expense. The completion of this cul-de-sac has taken place and it is now appropriate to pass a by-law to dedicate the cul-de-sac portion of Block 60 as part of Scott Street. A remnant parcel that remains will be conveyed to the developer as per the original subdivision agreement. In addition, Block 51 is a reserve block at the end of the original dedicated Scott Street that must also become part of Scott Street to allow the adjacent Heritage Lane development to have legal access to Scott Street.
