PRESENTATIONS: David Brletic: provided a brief update on the Housing Element and potential parcels for rezone for High Density Residential. Staff and the Planning Commission discussed various properties and development challenges, alternative sites for re-zone. Commissioner Wall: requested additional information on the vacant parcels. Dick Shepard: Asked about previous and current cycle. G. PUBLIC HEARINGS: Chair Perez: No public hearings. H. COMMISSIONER COMMENTS/ COMMUNICATIONS: David Brletic: I will leave Planning Commission Policies on the agenda. Commissioner Wall: That s not enough. Dick Shepard: No need to re-invent the wheel. David Brletic: Asked if the direction was to look for previously approved policies? Chair Perez: Called for a vote. Unanimously approved.

4 Agenda Item G.1 CITY OF SANGER PLANNING COMMISSION MEETING OF JUNE 28, 2018 TO: FROM: Sanger Planning Commission David Brletic, Senior Planner SUBJECT: Tentative Parcel Map Application No & Variance No This item is an application by Jose Carlos Gonzalez to allow one parcel of land to be divided into two parcels of land on property zoned R-1-6, Single Family Residential. The request is for property located at 1205 Rawson Avenue. The application includes a variance request to allow deviation from the minimum lot width standard for property zoned R-1-6, Single Family Residential. RECOMMENDATION: Staff recommends that the Planning Commission adopt Planning Commission Resolution No , approving Tentative Parcel Map No and Variance No PROJECT SURROUNDINGS: General Plan Zone District Existing Land Use North Medium Density Residential R-1-6, Single-Family Residential Single-Family Residences South Medium Density Residential R-1-6, Single-Family Residential Single-Family Residences East Schools RSC, Recreation, School, & Conservation SUSD Sports Fields West Medium Density Residential R-1-6, Single-Family Residential Single-Family Residences PROJECT BACKGROUND AND SUMMARY: The Planning Commission previously reviewed Tentative Parcel Map No , and denied the application through Planning Commission Resolution No The reason for denial was that proposed Parcel B did not meet the minimum lot width requirements for parcels in the in the R-1-6 zone district. The existing parcel that is proposed to be divided is approximately 16,296+ square feet. The zoning designation of the existing parcel is R-1-6, Single-Family Residential. The existing parcel fronts Rawson Avenue. The current property owner intends to divide the property into two (2) parcels. The two (2) proposed parcels are Parcel A, approximately 10,119+ square feet, and Parcel B, approximately 6,177+ square feet. Both of the proposed parcels will have access to Rawson Avenue. The proposed land division is to accommodate construction of a new singlefamily dwelling on proposed Parcel B. Proposed Parcel A contains an existing single-family dwelling. The existing single-family dwelling on proposed Parcel A is currently served by City and other utilities. Construction of a new single-family dwelling on Proposed Parcel B will require construction of new, independent,

5 Page 2 of 2 Tentative Parcel Map No & Variance No utility services to Proposed Parcel B. The width of proposed Parcel B is feet. This is less than the standard minimum 60 feet. Approval of the substandard minimum lot width requires approval of a variance request. The Planning Commission s action on a Tentative Parcel Map and Variance are final unless appealed to the City Council. The project site is located on the west side of Rawson Avenue south of Magnolia Court. See Exhibit A Location Map. The General Plan designation of the project site is Medium Density Residential. The Zoning designation of the project site is R 1 6, Single Family Residential. In addition to other property development standards, the R 1 6 zone district requires the following lot area, minimum yard setbacks, maximum lot coverage, and minimum lot depth: Requirement Standard Lot Area 6,000 Square Feet Front Yard 20 Feet Side Yard 5 Feet Rear Yard 10 Feet Maximum Coverage 40% Minimum Lot Width 60 Feet Minimum Lot Depth 100 Feet As previously stated, the applicant would like to divide the existing single parcel into two parcels. See Exhibit B Tentative Parcel Map. However, doing so would result in once parcel that does not meet the development standards of the R 1 6 zone district. This is less than the minimum Front Yard standard of 20 feet. This is a, Legally Existing, Non-Conforming condition. As indicated in the chart above, the proposed Parcel B would not meet the minimum lot width. Variance Review Criteria In review of a variance request, the Planning Commission is being asked to evaluate a request to deviate from adopted standards. This evaluation is objective in nature as opposed to subjective. The criteria for approval of a variance are as follows: (1) That because of special circumstances applicable to the subject property, including

6 Page 3 of 3 Tentative Parcel Map No & Variance No the size, shape, topography, location or surroundings, but not including monetary hardship, the strict application of the provisions of this chapter deprives the subject property of privileges enjoyed by a substantial number of other properties in the vicinity and under identical zoning district classification. (2) That the granting of the variance will not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity or district in which the property is located. (3) That the granting of the variance will not adversely affect the city general plan, any adopted specific plan, or the purposes of this chapter. (4) That the granting of the variance will not constitute a grant of special privilege to the property owner. (5) That any conditions established by the commission for the variance are deemed necessary to protect the public health, safety, and general welfare. In review of the request, the Planning Department has evaluated properties in the vicinity of the project site to determine if there are nearby properties experiencing or benefiting from similar conditions. Staff has identified properties within the vicinity of the project site that do not meet the minimum lot width of the R 1 6 zone district. See Exhibit C Properties Within Vicinity. ENVIRONMENTAL ANALYSIS The project has been determined to be exempt from the requirements of the California Environmental Quality Act pursuant to Section In-Fill Development Projects. Class 32 consists of projects characterized as in-fill development meeting the conditions described in this section. (a) The project is consistent with the applicable general plan designation and all applicable general plan policies as well as with applicable zoning designation and regulations. (b) The proposed development occurs within city limits on a project site of no more than five acres substantially surrounded by urban uses. (c) The project site has no value as habitat for endangered, rare or threatened species. (d) Approval of the project would not result in any significant effects relating to traffic, noise, air quality, or water quality. (e) The site can be adequately served by all required utilities and public services. This section is intended to promote infill development within urbanized areas. The class consists of environmentally benign in-fill projects which are consistent with local general plan and zoning requirements. This class is not intended to be applied to projects which would result in any significant traffic, noise, air quality, or water quality effects. Variance: Recommended Findings and Planning Commission Determination In accordance with Municipal Code Section , the commission, before granting a variance, shall make all of the following findings. Staff s analysis of each finding is included: (1) That because of special circumstances applicable to the subject property, including the size, shape, topography, location or surroundings, but not including monetary hardship, the strict application of the provisions of this chapter deprives the subject property of privileges enjoyed by a substantial number of other properties in the vicinity and under identical zoning district classification.

(2) That the granting of the variance will not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity or district in which the property is located. Proposed Parcel B meets all other development standards in the R 1 6. Creation of a the proposed parcel and construction of a new single family dwelling is consistent with the existing neighborhood. (3) That the granting of the variance will not adversely affect the city general plan, any adopted specific plan, or the purposes of this chapter. The Medium High Density Residential General Plan designation is the primary single family housing category in the City. The proposed Variance would not result in an increase in density. (4) That the granting of the variance will not constitute a grant of special privilege to the property owner. As similar properties existing within the project vicinity, the proposed Variance is not considered to be the granting of a special privilege. (5) That any conditions established by the commission for the variance are deemed necessary to protect the public health, safety, and general welfare. The resulting parcel will be required to meet the setback requirements of the R 1 6 zone district. Tentative Parcel Map: Recommended Findings and Planning Commission Determination Municipal Code Section provides that prior to approving a tentative map that the planning commission makes the following determinations: 1. This application has been processed in accordance with the requirements of the Municipal Code. 3. Applicable provisions of the map act. The tentative map has been reviewed by the City Engineer to ensure compliance with the State Map Act. 4. Applicable provisions of the zoning ordinance. With approval of Variance No , the proposed parcels meet the development standards for lot size, lot frontage, and lot depth of the R-1-6 Zone District. 5. Where a planned unit development has been approved or tentatively approved subject to approval of a tentative map, the commission shall consider whether or not the tentative map conforms to such planned unit development. Not applicable. 6. Report and recommendation of the Planning Director. Staff recommends approval of the application, subject to conditions of approval. 7. 12 CITY OF SANGER PLANNING COMMISSION RESOLUTION NO TENTATIVE PARCEL MAP NO SUBMITTED BY JOSE CARLOS GONZALEZ FOR PROPERTY LOCATED AT 1205 RAWSON AVENUE, APN WHEREAS, the Planning Commission of the City of Sanger conducted a duly noticed public hearing in the Council Chambers of the Sanger City Hall in Sanger, California, on January 25, 2018, to consider Tentative Parcel Map Application No to allow the subdivision of one (1) existing parcel into two (2) proposed parcels; and WHEREAS, the Planning Commission of the City of Sanger continued the public hearing to February 22, 2018, to review minimum lot standards; and WHEREAS, the Planning Commission of the City of Sanger, at the continued public hearing of February 22, 2018, denied Tentative Parcel Map Application No due to substandard lot width; and WHEREAS, the Planning Commission of the City of Sanger did conduct a duly noticed public hearing in the Council Chambers of the Sanger City Hall in Sanger, California, on June 28, 2018, to consider Variance No , to allow fifty-three point ninety-five (53.95) foot lot width for proposed Parcel B of Tentative Parcel Map No , and to re-consider Tentative Parcel Map No ; and WHEREAS, the Planning Commission of the City of Sanger approved City of Sanger Planning Commission Resolution No , to allow fifty-three point ninety-five (53.95) foot lot width for proposed Parcel B of Tentative Parcel Map No ; and WHEREAS, the Commission, after reviewing the staff report prepared for the Project, which is herein incorporated by this reference, and public testimony offered at the hearing on the project, did make the following findings: 1. 17 Page 1 of 4 Exhibit A, Conditions of Approval, Tentative Parcel Map No Community Development & Public Safety: Exhibit A Conditions of Approval Tentative Parcel Map No Notwithstanding all other conditions, all construction and improvements need to be in strict accordance with zoning, building, fire, and all other codes and ordinances of the City of Sanger. 2. No abandoned, junk or inoperative vehicles or equipment of any kind can be parked, kept and/or stored on the premises. 3. Construction debris must be contained within an on-site trash bin and the project site must be watered for dust control during construction. 4. All contractors or sub-contractors working within the City of Sanger are required to obtain a business license from the City Finance Department at Sanger City Hall. 5. All property not occupied by structures, paving or landscaping on the subject site shall be maintained for both health and aesthetic reasons. Grasses and weeds shall be kept to a minimum as required by the Fire Department and County Health Department. 6. An all-weather surface around the entire facility must be maintained as required by the Fire Department. 7. The drive aisles will be kept unobstructed at all times to allow clear access by the Fire Department. Vehicles shall not block any driveways. 8. The developer/owner needs to obtain approval and any required permits from the Fire Department for the storage of flammable and/or combustible materials on the site. Fire extinguishers should be provided inside of the building at locations determined by the Fire Department. Engineering Department: 1. The Parcel Map shall be prepared in conformance with the provisions of Government Code Section Prior to further development of any of the parcels, the Applicant shall submit Improvement Plans to the City Engineer for review and approval. Said plans shall be drawn to a size and scale approved by the City Engineer and on reproducible materials. The plans shall be prepared, signed, and stamped by a California registered Civil Engineer. All improvements shall be designed and constructed in accordance with City of Sanger standards and specifications. Along with the plans, the Applicant shall submit a cost estimate for all improvements to be located on public property, all prepared, signed, and stamped by a California registered Civil Engineer. 2. Any and all public or private easements on the property identified in the title report shall be shown on the parcel map with recording data.

A licensed land surveyor or civil engineer licensed to perform land surveying shall certify the placement of all required monumentation prior to final acceptance. Brass caps required for installation of new monuments or replacement of existing monuments shall be provided by the applicant and approved by the City prior to installation. 4. All conditions of approval shall be fully complied with prior to the recording of the final Parcel Map. 5. If required by the City Engineer, the Applicant shall enter into an agreement with the City upon mutually agreeable terms to complete any required public improvements required for this Parcel Map. The performance of such an agreement shall be guaranteed by appropriate security. Any agreement entered into relative to these Conditions of Approval shall comply with the requirements of the Subdivision Map Act. 6. Prior to review of the Parcel Map and any proposed Improvement Plans, the Applicant shall deposit with the City a sum determined by the City Engineer for map and plan check fees. Prior to recordation of the Parcel Map, the Applicant shall deposit any required public works improvement inspection fees as determined by the City Engineer. 7. Upon approval by the City Engineer of the Parcel Map and any Improvement Plans, signed and stamped reproducible copies of these plans shall be provided to the City, as well as an AutoCAD file of the Parcel Map. 8. If applicable, the Applicant shall annex the subject properties to the Sanger Landscaping and Lighting District. In a manner approved by the City, the Applicant shall notify all potential buyers of the parcels of this annexation. The Applicant shall supply all necessary assessment diagrams and other pertinent materials for the Landscaping and Lighting District. 9. The Applicant will be required to annex the parcels to a Community Facilities District (CFD) to provide special tax revenue for the anticipated cost increases associated with providing City services (i.e. police, fire, ambulance, paramedic, parks maintenance, etc.). The Applicant shall disclose to all potential lot buyers that the parcels are part of a Community Facilities District. 10. Prior to any construction within existing public right-of-way the Applicant shall submit for review and approval an Encroachment Permit application. The application is to be submitted to the Public Works Department. 11. The Applicant shall install separate water and sewer services to each parcel if not currently existing in accordance with current City Standards. 12. Prior to or concurrent with ground rough plumbing inspection, water meters and meter boxes shall be installed. Upon installation of the meter, the City of Sanger has blanket authority to establish a utility account for water usage in the Applicant s name. Water will be charged at the current base rate per month plus consumption. Before development begins, the Applicant must submit a valid blanket authority authorizing the City of Sanger to bill the Applicant for water usage, provide billing information and deliver a $ water deposit.

19 Page 3 of 4 Exhibit A, Conditions of Approval, Tentative Parcel Map No The Applicant shall pay applicable Development Impact Fees to the City of Sanger at the rate in effect at the time the Parcel Map is recorded. These fees may be deferred until final occupancy. 14. Grading/construction work including start-up of equipment/machinery shall not begin prior to 7:00 A.M. Monday through Friday. Prior authorization must be obtained from the City Engineer for any work (including underground work) occurring on weekends and holidays. 15. The Applicant shall continually maintain the existing pavements keeping them clear of dirt, dust, and mud until the Parcel Map improvements are accepted by the City. Applicant shall utilize best management practices (BMPs) for erosion and dust control during construction. 16. During construction, asphalt rubble and construction debris shall be disposed of in an appropriate landfill facility or some other method acceptable to the Public Works Director. 17. The Applicant shall construct a new concrete drive approach along the Rawson Avenue Street frontage to conform to City standards and ADA requirements. 18. The Applicant shall submit construction plans on 24 x36 sheets with City Standard title block for all required improvements. These plans shall be prepared by a registered civil engineer and shall be submitted to the Engineering Division at or before the time the building plans are submitted to the Building Division and shall be approved by the City and all other affected agencies prior to the issuance of any grading, encroachment, and/or building permits. 19. Prior to granting of final occupancy or final acceptance, the Applicant shall submit to the City Engineering Division an approved set of construction plans revised to reflect all field revisions and marked Record Drawings. 20. Prior to the start of any demolition, grading and construction, the Applicant shall submit to the City Engineer and Chief Building Official a written list of his or her authorized representatives and their phone numbers of who will be present on the site while work is in progress. 21. Prior to the commencement of any work within the City of Sanger, the general contractor and all sub-contractors shall obtain a business license from the Finance Department. 22. As determined by the City Engineer and the Public Works Director, the Applicant will be required to abandon and seal any existing septic system, agricultural well, and water well in accordance with the California Department of Health Standards and the Fresno County Community Health Department. The Applicant shall submit evidence of such compliance to the Chief Building Official before the issuance of a Final Certificate of Occupancy. 23. Any trenches cut in public streets shall be backfilled, compacted, and resurfaced with rock base and AC paving in accordance with City Standards. Existing pavement shall be saw cut. The Applicant shall resurface or reconstruct areas of the street as may be required by the Public Works Director. 24. The Applicant shall comply with any applicable requirements of the utility companies which have franchise agreements with the City of Sanger.

20 Page 4 of 4 Exhibit A, Conditions of Approval, Tentative Parcel Map No The Applicant shall underground all new gas main services, telephone lines, cable television lines, electric power lines, and new utility lines. The depth, size, type and spacing shall be approved by the City Engineer. 26. The Parcel Map shall reflect appurtenant easements or a shared utility or other common use agreement between Parcels A and B for any proposed cross-parcel utility services (i.e. electric, gas, cable, etc.). 27. The Applicant shall comply with the NPDES General Permit for Storm Water Discharges Associated with Construction and Land Disturbance Activity, State Water Resources Control Board Order No DWQ as amended by DWQ. The Applicant shall obtain coverage under the permit and implement all associated requirements including, but not limited to, the run-off reduction requirements and post-construction standards. Plans for these requirements shall be included in the previously required set of construction plans. 28. The Applicant shall install all on-site and off-site improvements in accordance with City of Sanger Standards and Specifications, and shall provide and pay for any compaction tests required by the City during the course of construction.

21 CITY OF SANGER PLANNING COMMISSION BY-LAWS Item H.1 INTRODUCTION The City of Sanger Municipal Code at Sections through establishes the Planning Commission, appointment of members, terms of office, removal and retirement of commissioners, and the commission s powers, duties, and general procedures. The Municipal Code at Section (c) also provides that the Planning Commission may adopt its own rules and procedures that it deems necessary and appropriate. ORGANIZATION AND ELECTION AND DUTES OF OFFICERS RULE 1. The Commission shall elect a Chairperson and Vice Chairperson at the first regular meeting of the Planning Commission in January to serve for a period of one year from the date of their election. RULE 2. The Chairperson of the Planning Commission shall preserve order and decorum and shall decide questions of order. The Vice Chairperson shall preside in the absence of the Chairperson. RULE 3. The Chairperson of the Planning Commission may second any motion and present and discuss any matter as a member of the Commission without having to step down from the Chair and shall be entitled to vote on all matters before the Planning Commission. RULE 4. The Secretary to the Planning Commission shall be a City Employee, normally the City Planner. RULE 5. The Secretary shall be responsible for the preparation and posting of the Planning Commission Agenda and transcribing the minutes of any Planning Commission meeting. The minutes shall include all official actions or decisions by the Commission. The Secretary shall keep a public record of the Commission s resolutions, transactions, findings and determinations. RULE 6. The City Attorney of the City of Sanger shall be the legal counsel to the Planning Commission. SCHEDULE OF MEETINGS RULE 7. The Planning Commission shall hold at least one Regular Meetings per month, which shall be held on the fourth Thursday of the month. In the event the fourth Thursday is a holiday, an alternate meeting may be held. An additional Adjourned Meeting may be held, if necessary. Such regular meetings may be canceled by a vote of the majority of Commission members present at a regular or special meeting or when a quorum is not available. Meetings shall be held in the City Council Chambers, 1700 Seventh Street, Sanger, CA starting at 6:00 P.M. 22 vote of the Planning Commission. Notice of such meeting shall be given in accordance with State law. RULE 8. Emergency or special meetings may be called as provided in Section of the Government Code of the State of California. RULE 9. In the absence of a quorum all items on the agenda shall be continued to the next scheduled meeting. AGENDA ITEMS RULE 10. All matters to be considered by the Commission shall be properly filed with the City in compliance with the provisions, standards, and procedures established by adopted City Ordinances. The Secretary shall not accept for presentation to the Commission any matter unless it is properly made on the prescribed forms properly filled out with all data attached. RULE 11. Any matter that comes before the Commission orally under Public Forum shall not be discussed or acted upon by the Commission unless and until it is heard as a scheduled agenda item at a Regular, Adjourned, or Special meeting of the Commission. RULE 12. Request for informal or advance decisions concerning potential future developments or plans will not be considered by the Planning Commission. RULE 13. The regular order of business of the Commission shall be: 1. Call to Order & Roll Call 2. Flag Salute 3. Agenda approval, additions, or deletions 4. Public Participation 5. Consent Calendar 6. Public Hearings 7. Action Items not requiring a Public Hearing 8. Staff Communications 9. Commissioner Comments/Communications 10. Next scheduled meeting 11. Adjournment RULE 14. The Chairperson, with consent of the Commissioners, may revise the order of the agenda for a particular meeting in order to expedite business for the convenience of the public or for improved continuity. RULE 15. Commission meetings may remain in session up to, but no later than 11:00 P.M. However, the Commission may, by a majority vote, extend the meeting if the Commission deems such extension necessary. Otherwise, the meeting shall be adjourned to another day acceptable to the Commission, or unfinished business may be continued to the next Regular Meeting. Letters, petitions, or other written material pertaining to any item on the agenda may be filed with the Secretary of the Commission prior to the time of the public hearing or may be presented to the Commission at the time of the public hearing. The Commission shall consider such material in deciding any issue before it. All written material shall become part of the Commission s file on the agenda item. RULE 17. Items submitted after distribution of the Agenda Packet: Materials related to any item on the Agenda submitted to the Planning Commission after distribution of the agenda packet are available for inspection in the Secretary of the Commission s office at 1700 Seventh Street, Sanger, CA during normal business hours. All such materials will be brought to the meeting and will be available for public inspection at the meeting site. Either City Staff or the Chairperson at the hearing shall give public notice of any such materials. If copies are not available in sufficient quantity for interested parties or members of the public at the hearing, the Chairperson shall take reasonable steps to afford all such persons the opportunity to inspect the materials before the start of the hearing on a scheduled matter. The purpose of the foregoing is to avoid the interruption of testimony with requests for inspection of materials. RULE 18. Any person desiring to address the Planning Commission (may) (shall), when recognized by the Chairperson, give his or her name and address. A person appearing in a representative capacity shall provide the name and address of each represented party. RULE 19. Testimony and argument relative to any item scheduled on the agenda as a Public Hearing shall, unless otherwise ordered by the Chairperson, be presented in the following order and within the time limits specified. a. The Chairperson shall declare the Public Hearing to be open. b. Staff Report. c. Commission discussion for purposes of clarification of Staff Report. d. Presentation and arguments in support of the project by applicants, and/or agents/consultants directly associated with the project. (10 minutes) e. Acknowledge and/or reading of written testimony if not presented at the time the staff report is presented. f. Public Testimony in support or opposition of the project. (5 minutes per person) g. Applicant s rebuttal. (5 minutes) h. Supporters or opposition rebuttal. (3 minutes per person) i. Applicant s rebuttal. (3 minutes) j. Chairperson declares public hearing to be closed. k. Planning Commission debate. The Commission through the Chairperson may ask questions of staff, the applicant or persons who provided testimony to assist in the Commission s deliberations. l. Call the Question and vote. Note: At the option of the Chairperson the public hearing may be reopened for further testimony on the question provided said testimony is directly related to the motion. RULE 20. The Chairperson may, in the interest of facilitating the business of the Planning Commission, limit the amount of time that a person may use in addressing the Planning Commission. 24 RULE 21. The applicant or his or her appointed representative may, with the permission of the Planning Commission, withdraw any matter pending before the Commission at any time prior to the Commission acting on such matter. VOTING RULE 22. A majority of the members of the Commission shall constitute a quorum. Unless otherwise required by federal, state or local regulation, the affirmative vote of a majority of the quorum is necessary to take action. If a majority is unable to be assembled on any motion (including a motion to continue a matter to a specific time) relating to a specific project for which the Commission must make a recommendation to the City Council, the project shall be referred to Council with a divided recommendation which reflects the individual votes of the Commissioners. If a majority is unable to be assembled on any motion (including a motion to continue a matter to a specific time) relating to a specific project for which the Commission has final authority, the matter before the Commission shall be deemed denied and the applicant may appeal such decision in accordance with the applicable rules. A tie vote, or deadlock, constitutes a denial unless the applicant requests a continuance of the item to a subsequent meeting at which a quorum is present. RULE 23. On matters of procedure or order of business the Chairperson may make a motion and without a second and after calling for objection and hearing none, so order. In the event of objection, the Chairperson shall call for a second and a roll call vote. MISCELLANEOUS RULE 24. Unless otherwise provided by these Rules, all proceedings before the Commission shall be conducted in accordance with and pursuant to the parliamentary rules of procedure as prescribed in Robert s Rules of Order. RULE 25. Testimony and argument relative to any other item on the agenda shall generally follow the procedure for a Public Hearing as may be modified at the discretion of the Chairperson. RULE 26. Any rule of these By-Laws may be altered, amended, or repealed by majority vote of the Commission, except that such alteration, amendment, or repeal shall not affect any pending matter. RULE 27. Any rule of these By-Laws may be temporarily suspended by unanimous consent of the Commission. RULE 28. A Resolution of the Planning Commission may be adopted conditionally and referred to the Secretary of the Commission for drafting in proper form. RULE 29. Commission members shall decide for themselves whether they have a conflict of interest on any matter before the Commission. Such determination shall be made in accordance with State law and City of Sanger Municipal Code Sections 2-61 through When a member has disqualified himself/herself, he/she shall remove himself/herself from the dais stating their reasons for conflict of interest. The member shall also remove himself/herself from the meeting room, unless they are permitted to remain for a qualified interest as set forth in State law.
