2 Project Summary: _ There will be no Increase in Density within Tollgate Canyon _ A previous Deer Meadows Proposal was for a total of 21 lots in 117 acres under a Specially Planned Area application. _ Based on input and concerns from area lot owners, and County Council members, the proposed lot density has been reduced to a total of 8 lots. _ The proposed 8 lots include the existing residence, the existing structure known as Uncle Tom's Cabin, and 6 new lots, all to be contained within 117 acres. _The current proposal follows closely that of a 2007 agreement with Pine Meadows Ranch HOA _ The 6 new lots and the Uncle Toms lot will be platted only after an equal number of Building Rights have been extinguished from Lots of Record within Pine Meadows Ranch. Individual lots within Deer Meadows to be platted after an equal number of Building Rights have been extinguished. Platting to occur in phases.
3 Project Summary: _Lot layout to follow Concept Lot Layout configuration. (exhibit) _ Any Lot of Record within Pine Meadows Ranch will be eligible as a lot for elimination. This will be by agreement with the Pine Meadows Ranch HOA. _ There will be no development on the eliminated lots. No structure, pad, deck, or improvement will be made. Eliminated lots will not be used to park vehicles or trailers. Such restriction shall be enforced by a Deed Restriction against the eliminated lot. Eliminated lots will transfer associated water right to PMMWC (Pine Meadows Mutual Water Company) at time of lot transfer. _ Construction on all Deer Meadows lots will be contained within defined building pads. Building pads will occupy less than 10% of the Deer Meadows property. 90% of Deer Meadows property will be dedicated to open space, and can never be developed. _ There will be no fencing or livestock allowed on Deer Meadows property.
4 Project Summary: _ Deer Meadows will be part of the Pine Meadows Ranch HOA and will abide by Pine Meadows Ranch HOA CC&R s. _ Deer Meadows lots will pay all regular and special assessments of the Pine Meadows Ranch HOA including impact fees, according to then current fee schedule of PMRHOA. _ Deer Meadows lots will be obligated to participate in the winter plowing fund. _ Deer Meadows will establish a perpetual 1% transfer fee on the sale or transfer the new Deer Meadows lots, for the benefit of the Pine Meadows Ranch HOA. _ Funds of the transfer fee agreement to be based on all future real estate transactions and will provide funds that will benefit road maintenance within the Pine Meadow Ranch HOA.
5 Project Summary: _ Deer Meadows LLc agrees that the Development Agreement is subject to a conceptual approval by the PMRHOA prior to submittal to Summit County. Any revisions required by Summit County will be submitted to PMRHOA prior to final adoption of the Development Agreement. _ No short term rental are allowed within Deer Meadows. Short term rentals defined as those less than 30 days in length. _ Deer Meadows will establish its own HOA with more restrictive covenants primarily addressing architectural standards. In no instance, will the CC&R s be less restrictive than those for the PMRHOA. _

7 Community Benefits 1. Establishment of a good precedent for future possible development of large non-subdivided parcels near Pine Meadows Ranch. A. A precedent for minimum disruption by development. Deer Meadows utilizes existing roads, wet water, water rights, and utilities. B. A precedent that development of Property nearby Pine Meadows Ranch will be done with the acceptance and cooperation of the Pine Meadows HOA. C. A precedent for lot size being as large or larger than surrounding lots. D. A precedent for not increasing overall density in Tollgate Canyon. 2. Maintains over 90% of Deer Meadows 117 acres as nonbuildable Open Space through the designation of specific and restricted building envelopes. 3. 1% perpetual Real Estate Transfer fee will provide funds that benefit Tollgate Canyon.
8 Community Benefits 4. Preserves the recreational and cabin nature of the area while eliminating possible livestock in the area. 5. Eliminates the possibility of further development of Deer Meadows property should Summit County revise its Land Use Code in the future. 6. Creates improved winter access through Deer Meadows mandatory participation in winter snow plow funds. (Participation in snow plowing for Pine Meadows Ranch is optional, which creates problems with maintaining needed winter access.) 7. In some cases, the elimination of lots will reduce negative impacts that would be created by building on existing sensitive areas within Pine Meadows Ranch. 8. Reduces overcrowding and creates open space in Pine Meadows Ranch.
