You have made the assumption that it is sufficient to only look within 500 meters but I believe more justification is required. If there are no poultry farms, hog farms or earthern manure storages within 2000m then a reduction may be warranted however I do not see the justification to reduce to as little as 500 meters. In your report you state Examples of livestock facilities that tend to generate greater setbacks which would warrant a 2000m radius include pig farms, mink farms and chicken farms, none of which are located in the general vicinity of the proposed development. What is meant by general vicinity. within 2000m? I spent a great deal of time looking at aerials of the properties within 2000 meters and I believe some outside the 500 meters warrant further investigation. For example, at the edge of the 2000 m is a large farm with outdoor manure storage appears to exist at 7668 Franktown Road. Another example of a property I would not want to discount immediately is 7975 Franktown Road which is beside 8037 (which you evaluated) but appears to have more barn building footprint area. 2) You also state that Additional livestock facilities beyond the 500m study area would be discounted by Implementation Guideline 12. I see this only to be the case for lots directly west of the existing Heron Estates, on the north side of Franktown Road and the south side of Copeland Road. However, there are many farms and even prime agricultural lands with 2000m to the south, east and north. Ideally I would like to see an inventory of them all and a justification for not doing the MDS calculation in each case. 3) It is of the opinion that the barns at 8040 Franktown, 8172 Copeland Road and 8120 Franktown Road cannot be discounted as potential livestock facilities. The photos actually indicate that manure was on the property at 8120 Franktown Road fairly recently. You also stated that for 8040 Franktown that livestock existed as recently as 1997,. 4) Guideline # 42 is meant to determine setbacks when lot severances occur. It is actually Guideline 36 and 37 that apply to Plans of subdivisions, which gives direction towards the municipal planning documents. The municipal policies direct back to the MDS guidelines so it appears to be a circular argument. I will need to explore that further. 5) For 8230 Bleeks there are two properties combined as one. The two properties should be evaluated separately. In addition for manure V# is for horses. 6) For 8037 Frantown Road the side cattle assembly shelter cannot be excluded and so it appears that there is capacity for 65 cows. In addition the barn area should be estimated and the factors L1 or V4 should be used in place of V3. 5/11/2011
