4 EXECUTIVE SUMMARY This Abbreviated Resettlement Action Plan is prepared for the sub-project Comprehensive Water Supply Service Improvement to Manuguru Municipality taken up under APMDP with World Bank assistance. Main objective of this RAP is mitigation of negative impacts due to this Sub-Project. This ARAP covers project information and its impacts, R&R Policy frame work, Stakeholder s meeting details, R&R entitlements, implementation arrangements, budget, Grievance Redressal Mechanism and synchronization of R&R and civil works. Comprehensive Water Supply Service Improvement to Manuguru Municipality is formulated with intake well in River Godavari as source. This sub-project comprises construction of Water Treatment Plant and strengthening of distribution system by construction of two ELSRs and laying of distribution system. In order to ensure participation of citizens in project preparation, to improve public awareness of development objectives of the projects and to promote project acceptability and transparency, Stakeholders meeting was conducted on where details of the project were explained and suggestions of participants were sought for wider acceptability of the proposal. The components of this sub-project have been so finalized that negative impacts are avoided as far as possible. The negative impacts are limited to 0.25 acres of land acquisition from single land owner for Construction of intake well. Sites required for construction of two ELSRs are being donated by respective land owners. WTP is proposed in Revenue land at Kattumallaram. No other negative impacts due to this sub-project have been assessed. This project will follow consent award and if this fails, normal course of land acquisition under LA Act, 1894 will be followed. Implementation of RAP will be done by the Commissioner, Manuguru Municipality. The RAP along with the budget for the same will be approved by Manuguru Municipality. The R&R implementation schedule has been synchronized with construction schedule. It will be ensured that compensation for the land owner is paid before the commencement of construction of intake well. Tentative budget for this RAP works out to Rs lakhs. The budget provides for land acquisition and other necessary activities for implementing the ARAP. 4

5 INTRODUCTION 1.1 Andhra Pradesh Municipal Development Project (APMDP) is a US$ 350 MILLION project being implemented by Government of Andhra Pradesh (GoAP) with support from World Bank. The Project is aimed at improving urban services in select ULBs mainly in water supply and sewerage sectors. The project will also support improvements in the financial, technical, and management capacities of all ULBs of Andhra Pradesh through technical assistance to sustain the infrastructures being created. 1.2 This sub-project for Manuguru Municipality is one of the water supply service improvement projects taken up under Andhra Pradesh municipal Development Project (APMDP). This sub-project is formulated with intake well in River Godavari as source. and strengthening of distribution system to improve water supply service. This Sub-project is divided in to the following two Packages. Package I: Salient components of this package are: Construction of 9 m Dia Intake well cum pump house in River Godavari at Chinaravigudem. Laying of raw water DI pumping main from intake well to WTP Construction of 5.00 mld WTP at kattumallaram. Construction of 150 KL clear water sump at Water Treatment Plant Construction of Pump House at clear water sump at WTP for conveying clear water from clear water sump at WTP to 405 KL ELSR at Bhagatsingh Nagar in Zone I. Laying of DI clear water pumping main from WTP to existing 405 KL ELSR at Bhagatsingh Nagar. Construction of 700 KL capacity ELSR at Municipal Office for Zone-II. Construction of 700 KL capacity ELSR at Shivalingapuram for Zone-III. Laying of 350mm /775m, 250 mm dia /1568m DI clear water gravity main from existing 405 KL ELSR at Bhagatsingh nagar in zone-i to Zonal ELSRs. Laying of Distribution lines in all 3 zones of the ULB. Construction of compound wall at Water Treatment Plant. Construction of compound wall at 700 KL ELSRs in Zone II & III. Construction of Watchmen quarters at WTP, ZONE-II & Z-III. 5

6 Package II: Installation and maintenance of water meters. This package comprises of procurement of bulk meters and domestic meters and fixing at suitable locations and maintenance for specified period. OBJECTIVES OF THE ARAP: 1.3 Minimisation of negative social impacts has been considered while finalising the components of this sub-project which resulted in avoiding any impacts within the town. However, acquisition of 1012 sq.m ( 0.25 acres ) of private land from single land owner is required for construction of intake well. Mitigation of the adverse social impacts due to land acquisition needs assessment of the impacts, estimation of the compensation, methodology and schedule for payment of compensation and establishment of institutional mechanism for grievance redressal. This ARAP is prepared to propose and implement these mitigation measures. The objectives of this RAP are summarised as follows: Assessment of impacts of the sub -project Identification of PAPs by type and extent of loss. Propose compensation as per the policy frame work. Estimation of compensation and R & R assistance for the PAPs. Outline Institutional Mechanism for implementation and Grievance Redressal. Proceedings of the meeting are provided as Annexure- I. The suggestions received during the meeting and the replies are summarized below. 6

7 Issues raised by the Community What are the measures for controlling air pollution during construction of ELSRs, WTP and Pipelines. What are the measures taken by officers for payment of proper compensation for land acquisition if necessary. Tribal Development Plan for displaced tribal people in the project. Roads shall be restored immediately after laying of pipe lines and inconvenience to public shall be avoided. Reply/Integration in DPR A comprehensive Environmental Management Plan will be prepared and integrated in BoQs of the sub-project. ULB will pay proper compensation as per the project guidelines. If any tribal people are displaced in this project, a Tribal Development Plan will be prepared and the affected people, if any, will be properly rehabilitated. Suitable provision has been made in DPR for restoration of roads and this will be included in the BoQs. Policy Legal And Administrative Framework: 1.5 Project will be governed by, R&R Policy of Andhra Pradesh (Irrigation Sector), 2005 National R&R Policy 2007 World Bank Operational Policy 4.12 on Involuntary Resettlement. World Bank Operational Policy 4.10 on Indigenous peoples. 7

8 SOCIAL IMPACT ASSESSMENT Assessment Of Impacts: 2.1 While formulating the subproject, various efforts have been made to minimize resettlement and land acquisition. During planning and designing, attempt has been made to restrict the construction works within the vacant ULB/ Revenue lands and RoW of roads. Due to these efforts, impacts are limited to acquisition of 0.25 acres of land from single land owner for Construction of intake well. 2.2 The impacts are ascertained for each component of the project based on the proposed site of construction/alignment. Necessity of land acquisition, impacts on public/private properties, necessity for temporary relocation of roadside kiosks on RoW and disturbance to business have been ascertained for each component of the sub-project. The details of proposed investment components and the potential impacts of those components are described below. Component wise Impacts: 2.3 The salient components of the sub-project and their impacts are tabulated below package wise. Package I Component Land Requirement and IR Impact. 10 Package II: Component Land Requirement Land Ownership Remarks and IR Impact. Water Meters No Impact Water Meters will be fixed on Clear water Mains and Distribution lines. Total Land Requirement = 7432 sq.m. Note: 5 MLD WTP is proposed in Revenue land (total extent of 3 Acres and 4 Guntas ) at Kattumallaram. This land is being cultivated by G.Narasimhulu (non-tribal ) unauthorisedly. Out of the total extent of about 3 acres, 5220 sq.m (1.29 acres) required for WTP only will be alienated to ULB. If there is any temporary loss of crops / properties during execution of raw water main, they will be dealt as additional impacts and losses will be compensated appropriately. Positive Benefits Due to The Sub-Project: 2.4 Not withstanding of the few above mentioned advese imapcts,the prosoed proejct will have positive impacts in the form of : Reduction in water shortage Increased access to potable water (At present limited drinking water is supplied through public stand posts only. This sub-project is designed to supply 70 lpcd through House Service Connections) Reduction in waterborne diseases Time saving for the residents Job opportunity in the Project Scope for improving quality of life. Exposure to awareness programmes and hence updating knowledge. 10

11 Summary of Impacts: 2.5 The number of affected persons under the assessed categories of impacts are summarized below. Provision is made in the RAP for additional impacts in this category, if any, identified during execution. These amounts are for the FYI and shall be 10% at the beginning of each financial year. 11

12 LAND ACQUISITION PROCEDURE 3.1 An extent of 0.25 acres of agricultural land need to be acquired from single land owner for Construction of intake well cum pump house at River Godavari and laying of pumping main from intake well to the existing road. LAND ACQUISITION PROCESS PLAN 3.2 Land acquisition process plan for the proposed project has been prepared with the help of revenue maps and location of the proposed intake well. LA plan includes the following key activities. Collect photocopies of Village Revenue Maps from the Revenue Department Superimpose location plan of the proposed intake well and pumping main up to the road on Village Revenue Maps Verify the plot under question in the field. Delineate and estimate the exact area to be acquired where LA is proposed Collect land ownership details from the concerned Mandal Office Joint inspection of the land by LAO and representative of the ULB. Preparation of LA Plan up to the requirement of 6(1) notification under LA Act, Submission of LA Plan to LAO. CONSENT AWARD 3.3 In order to meet replacement value of lost land and assets, consent award process will be followed as per AP negotiation rules Consent award not only ensures market value at replacement cost (mutually agreed price), but also it reduces expeditious steps of LA and number of court cases. The negotiation committee begins negotiation with a base price (market value along with solatium and interest ). If the market values are more than one year old at the time of negotiations, these will be updated for inflation to bring the price to the current level. If rate offered by the committee is not acceptable to PAP, the collector can enhance the rate by 50% and State Government by any percentage (generally up to 100% of offered rate). If consent award fails, normal course of LA will be followed. Consent award will be considered failed only when the land owners do not agree even for enhancement of offered rate by 50 %. The market value for the land at Chinaravigudem furnished by the sub-registrar is Rs per Acre. 12

13 STATUS OF LAND ACQUISITION 3.4 The exact extent of land to be acquired from the land owner has been identified with respective survey numbers. Accordingly LA plans will be prepared and LA proposals will be submitted to LAO. The 4(1) notification will be published by 30 th June, Similarly declaration under section 6(1) is expected to be published in September, Payment of compensation is expected to be completed by October,2013. (Table 3.1).The normal land acquisition process will be followed and the use of urgency/emergency clause on section 17 (1) will be avoided to enable the land owners to submit their concerns and seek clarifications under section 5-A enquiry, before proceeding with land acquisition process and fixing of compensation. November, Donation of land required for two ELSRs: The land owners of proposed sites for construction of two ELSRs in the ULB have given their willingness to donate required land for construction of ELSRs (Annexures IV and V ). These letters will be forwarded to Revenue Department for taking necessary action for transferring the land to ULB. Revenue Department will process the file and issue orders for transfer of land to ULB. 13

14 IMPLEMENTATION ARRANGEMENTS AND BUDGET Implementation Of RAP: 4.1 The RAP with necessary budget for implementation will be approved by the ULB and will be implemented by the ULB in coordination with Revenue Department. Following steps will be taken for effective implementation of RAP. The exact land to be acquired will be identified as per the location of the proposed intake well. Joint inspection of the land by LAO and representative of the ULB. Preparation of LA Plan up to the requirement of 6(1) notification under LA Act, Submission of LA Plan to LAO. Land acquisition process will be carried out in co-ordination with Revenue Department in consent award method. Valuation of trees will be done by the Forest and Horticulture Department. Payment of compensation to the land owners The payment of land acquisition compensation will be certified by the Municipal Commissioner. The land will be handed over for construction of intake well only after payment of compensation. Necessary provisions will be made in the agreement to ensure this. Additional Impacts During the Implementation of Sub-Project: 4.2 During the implementation, if any additional impacts are encountered in addition to those described in this RAP, they will be promptly addressed through additional measures in line with the policy provisions. The contractor will communicate promptly to bring to the notice of S&E officer about any additional impacts that he may encounter during the execution of works and these will be mitigated promptly. The S&E Officer of the ULB is responsible for initiating the process for addressing the additional impacts and the supplementary plans will be processed in a similar manner by which this RAP is prepared 14

15 and approved. The S&E officer will provide a confirmation to MSU, APMDP once in quarter during the construction period about the details of new impacts encounter and measures taken to deal with those impacts or confirm that no impacts were encountered. Synchronization of R&R and Construction Schedule: 4.3 Synchronization of Construction schedule and the corresponding R&R activities are proposed as follows. Construction Schedule R&R Activities Invitation of bids Draft RAP. Award of / signing the contract Approval and Disclosure of RAP and setting up of Grievance Redressal Mechanism. Alienation of WTP Land and ELSR Sites. Regulatory permissions for Laying of pipe lines. Handing over of site for the proposed intake well to the contractor. Payment of compensation to the owner. land Grievance Redressal Mechanism: 4.4 The grievances can be registered at the complaint cell established at the ULB. The Complaint Cell would forward the grievance to the S&E officer who will forward the grievance to the Revenue Officer and the NGO/ Community representative in the ESMC ( Environmental and Social Management Committee) for redressal. The Complaint Cell will also act as a Public Information Centre, where the grievances of the community will be registered and other information with regard to the project, the sub-projects, social and environmental safeguards will be provided. The grievances can pertain to any social and/or environmental issues triggered by sub-projects under the APMD Project. A District Urban Grievance Redress Body will be established for redressing the grievances that couldnot be solved by Grievance Redress Officer at ULB level This body will consist of 4 to 5 eminent citizens in the District and are from diverse backgrounds such as, education, health and sanitation, urban infrastructure, civic affairs, etc. In 15

16 an advisory capacity, it will facilitate and suggest suitable action to redress the grievances of the community/public. At the State level a State Urban Grievance Redressal Body will be established along similar lines. If the grivance redress officer cannot redress the grievance within a specified time period, the grievance would be forwarded to the ESMC and further to the District Urban Grievance Redressal Body constituted at the District level. The grievances that cannot be redressed at the District level would be referred to the State Urban Grievance Redressal Body. Each of these authorities can be approached directly for grievance redress by the aggrieved person/party. Public Disclosure: 4.5 The RAP in English and Summary in Telugu will be placed at public places and gthe web sites of Munciplaity and CDMA for the benefit of all concerned. The public disclosure places, at the minimum, include the following: Offices and libraries of the project area (Commissioner office and Municipal libraries) District Collectorate Departmental websites. Monitoring and Reporting: 4.6 A report on payment of assistance will be sent to MSU- APMDP once the payments are completed along with the certification of payments. In addition, Quarterly Confirmation Note will be sent indicating the details of additional impacts or otherwise, throughout the construction period Tentative Budget estimate for RAP: 4.7 The Budget is indicative of outlays for different expenditure categories. The provisions are tentative and costs may be up dated due to change in the project designs/alignment and additional impacts. Any additional funds required for implementation of RAP will be provided by the ULB. 16

Salient features of this sub-project are explained to the tribal population in these consultaion meetings where the sub-project received acceptance of local population. The requirements of the tribal villges are expressed in these consultations are also stated in the Tribal Development Plan. Some of the demands that can be resolved by ULB will be taken up by the ULB. Other demands are forwarded to Project Officer, ITDA, Khammam for taking up the demand which are feasible. 17

18 ANNEXURE- I STAKE HOLDERS MEETING ON COMPREHENSIVE PLANNING OF WATER SUPPLY SERVICE IMPROVEMENTS IN MANUGURU MUNICIPALITY FEASIBILITY & CONCEPT Proceedings of the Meeting Date: January 06 th,2010 Time:11.00 A.M Venue: Lions Club, Manuguru Mr. Naganna RDO, Badrachalam & Special Officer Manuguru Municipality inaugurated and chaired the session and he has given a brief introduction to the present project of Comprehensive Planning of Water Supply Service Improvements in Manuguru. He has assured that the land acquisition in the project will suitably be compensated with a good package if project demands such requirement. Mr. Surender, Municipal Commissioner, Manuguru in his welcome remarks, briefed the participants about the present project, mentioned that this project is funded by World Bank. He also expressed that this scheme is taken up cater to the ultimate water requirement of Manuguru town for next 30 years. He suggested to participate in all stakeholders meeting on the project and invited their suggestion for betterment. He added that this water supply project will be finalized shortly and sent to World Bank for approval. 18

19 Mr. Regala Kantha Rao, MLA has mentioned that it is glad to receive such prestigious project through World Bank Fund. He suggested that the water tank proposed in Mallepalli area may fall in mining zone and it has to be relocated at a suitable location. He also suggested to avoiding the land acquisition part or pipeline alignment through forest lands. In case land acquisition is required for the project, he expressed that suitable compensation package should be provided. He appreciated the consultants for their work and ensured his support to them in successful completion of the project. Mr. G.V Raghava Rao, Team Leader, Voyants Solutions Pvt. Ltd has presented the feasibility and concept plan to the participants of the stake holders meeting. He has given a power point presentation on the proposed water supply scheme for the town describing the medium & long term interventions to be taken up under the proposed water supply improvement scheme for Manuguru. Mr. Jitendra.T, AGM, Voyants Solutions Pvt. Ltd has given a brief presentation on the financial status of the ULB access criteria for taking up sub project under APMDP. He has also mentioned the Social & Environmental aspects will be taken care under this project for Manuguru ULB as per SEAMF. 19

20 Mr. Rammurthy CPM Leader has expressed that it is a good initiative to take up project like water supply improvement for Manugur town, He requested the cooperation of all political parties to extend their support for successful completion of this project for the benefit of people in Manuguru. Mr.Bolluju Ayodhya, ZP Vice Chairperson expressed that the water supply being made by Singareni Collieries Company Ltd at present is insufficient to cater to the needs of population of ULB. He invited the cooperation of all members to extend to take this project forward irrespective whether the ULB will continue to be a Municipality or it becomes a Panchayat. Mr. Bhushanpathi, CPM Leader expressed that there is a decreasing trend in the population from the year 2001 to The water supply made by the SCCL at present is insufficient and hence there is a need for this project to be taken up. He extended cooperation on behalf of CPM party. Mr. Jetti Venkateswara Rao, BJP Leader expressed his pleasure on conducting such public consultation meeting for this project. He suggested that the road shall be laid immediately after laying of pipeline, to avoid inconvenience to the public. He expressed that the design of the scheme is to be carried out to benefit of the people of Manuguru. 20

21 Mr. Kudithipudi Koteswar Rao, congress party leader invited the cooperation of the members of all political parties and requested their cooperation for this project. He also mentioned that suitable compensation has to be provided for any land Acquisition, if such case arises in the project. He extended his cooperation for successful completion of this project from Congress Party. Mr. E. Venkateswara Rao, TDP Leader expressed that the people of Manuguru are facing the problem for drinking water. He mentioned that presently SCCL is providing drinking water supply to Manuguru Municipality and is helping the ULB in contributing a part of potable water supply, which is not sufficient to cater the needs of the population. He also requested all officials and political leaders to extend their cooperation to retain the ULB as Municipality. Mr. Jadi Chokarao, Lok Satha Party member expressed that safe drinking water is very important for a person to keep him away from diseases and to remain healthy. He has welcomed this project and expressed that this project should be utilized to mitigate the water problem in the town. 21
