1 COUNTY OF SANTA BARBARA PLANNING AND DEVELOPMENT Consent Agenda TO: County Planning Commission FROM: Nicole Mashore, Planner, (805) HEARING DATE: December 3, 2008 RE: Hearing on the request of Ron Carlentine, agent for General Services, Support Services, to consider Case Number 08GOV , application filed on November 5, 2008, for a determination that acquisition of two vacant beach parcels by the County of Santa Barbara for pedestrian beach use and access is consistent with the Comprehensive Plan of the County of Santa Barbara pursuant to Government Code 65402(a). This site is identified as Assessor Parcel Numbers and , located seaward of Santa Claus Lane and the Union Pacific Railroad, in the Carpinteria area, First Supervisorial District. APPLICANT: Ron Carlentine, General Services, Support Services, (805) Project Description: The proposed project is for acquisition of two vacant beach parcels by the County of Santa Barbara, Parks Department, for the purpose of providing public beach access and use. Acquisition of the two parcels is necessary to allow Public Utility Commission consideration of the County s permit application for an at-grade railroad crossing in the Santa Claus Lane beach area. The parcels proposed for acquisition are known as Assessor Parcel Numbers and , located seaward of Santa Claus Lane and the Union Pacific Railroad, in the Carpinteria area. Consistency with Applicable Comprehensive/Community Plan Policies: Land Use Element LUD Policy 4: Prior to the issuance of a use permit, the County shall make the finding that adequate public or private services and resources (i.e. water, sewer, roads, etc.) are available to serve the development. Coastal Act Policy 30221: Oceanfront land suitable for recreational use shall be protected for recreational use and development unless present and foreseeable future demand for public or commercial recreational activities that could be accommodated on the property is already adequately provided for in the area. Coastal Act Policy 30210: In carrying out the requirement of Section 4 of Article X of the California Constitution, maximum access, which shall be conspicuously posted, and recreational opportunities shall be provided for all the people consistent with public safety needs and the need to protect public rights, rights of private property owners and natural resource areas from overuse. Policy PRT-TC-1: The County shall strive to provide new park facilities, increased beach access and new trails. Action PRT-TC-2-4: The County shall pursue public access to the beach from Santa Claus Lane. Public access shall be formalized as soon as feasible by securing and opening a vertical accessway between Santa Claus Lane and the beach, by clarifying the status of lateral beach access rights, or by securing any easements that may be necessary and appropriate. Land Use Designation RES-3.3: The subject parcels are designated under the Comprehensive Plan as Residential, 3.3-residences per acre.

2 Consistent: Adequate fire protection services would be provided by the Carpintera-Summerland Fire District. Vehicular access to the area is available via Santa Claus Lane. The proposed project does not involve new structural development of property which would require water or sewer service; however, the subject parcels are located in the service areas of the Carpinteria Sanitary District and Carpinteria Valley Water District and application for connection to these services would be available if required at a future point in time. Acquisition of the subject parcels would help facilitate the creation of a dedicated public access over the railroad tracks to the beach and would allow the County to protect oceanfront land for recreational use and development. The proposed project and future intended use of a portion of the properties for pedestrian access would not conflict with the RES-3.3 land use designation. Recommendation: That the Planning Commission: 1. Determine that the proposed acquisition by the County of Santa Barbara of two vacant beach parcels for the purposes of public beach access and public beach use is consistent with the Comprehensive Plan; and, 2. Transmit the consistency report required by Government Code Section 65402(a) to Ron Carlentine, General Services, Support Services and the Board of Supervisors. The memo dated October 31, 2008 and the letter reflecting the Planning Commission's action shall constitute the required report.
