Sukhiani (Andy s Apartments Ltd., referred to as the Landlord ) - and - - and - Rented Premises Parking Term Rent Clothes Washer Dryer [NAME OF TENANT] [Signature].[Contact #, , and Address] (referred to as the Tenants(s) ) [NAME OF GUARANTOR] [ Contact#, , and Address] (referred to as the Guarantor(s) ) In consideration of the rent covenants contained herein, the Landlord agrees to rent to the Tenant(s) upon the existing tenant vacating prior to the commencement of the term of this Lease, the premises known as the Floor, Apartment # _, Room # TBD of the apartment premises known as 309 Spruce Street, Waterloo, Ontario ( the Building ), together with the right to use in common with the other tenants the common areas of the main house being those areas not available to be leased to other tenants and the effects contained therein and with the express license to use the common areas in accordance with the terms of this lease in common with the other tenants provided the suite and common areas shall be used solely for residential dwelling purposes. The Parking at the front of the Building may be used only for the parking of a vehicle specifically authorized by the Landlord with the nature and type of vehicle always to be subject to the Landlord s approval. Tenants so approved shall use the parking area at his own risk and the Landlord shall not be responsible for theft or damage to the Tenant s vehicle however caused. Each Tenant wishing to use the parking area shall apply in writing to the Landlord for consent to do so and shall provide the Landlord with the make, model, serial number, license plate number, colour and complete name of the owner of the vehicle. The cost of parking this vehicle is negotiated at twenty five dollars ($25.00) per month for the entire term of the lease. Unauthorized vehicles found on the premises are subject to fines between $20 and $ which will be charged to the tenant account. The Landlord is not responsible for any parking tickets received by tenants. If a designated spot is taken by an unauthorized vehicle the tenant may contact by-law to have the vehicle tagged and/or towed. TENANT S COVENANTS: (1) The Tenant hereby leases the premises for a term of _twelve_ months, to start on the First day of September 2016 and ending on the 28th day of August, TENANT INITIAL. (2a) The Tenant shall pay Five Hundred and eighty Five ($ ) [monthly rent] dollars each month during the term to be due and payable on the 1st day of each and every month. The tenant agrees to provide 12 post dated cheques dated for the 1 st of each month. These post dated cheques are to be delivered to the landlord at least five business days prior to the move in date. Rent delivered to the landlord after the 1 st at 12pm noon is charged at an additional 2% per month. TENANT INITIAL. Such payment includes compensation for the use of the suite above described. (2b) The Landlord agrees to provide a Washer and Dryer for the use of the tenants in the suite. Utilities (2c) Landlord will pay the electricity (also known as hydro), water, gas, sewage and heating bills up to two hundred and fifty dollars per month for a suite of five bedrooms. If the total cost of the annual hydro heat, water, gas and sewage bills exceeds an average of $250 per month for the suite rented the tenant shall reimburse his or her share of the utilities to the landlord. Furthermore, If there is an obvious waste of utilities taking place (e.g. running water from a toilet, tap, faucet, etc.) the tenant shall immediately notify the landlord and also in writing to confirm the verbal notification. Failure to do so shall place the tenant responsible for the additional costs of the wasted utilities. TENANT-INITIAL. Charge to Reprocess (2d) Provided that if a cheque is not honoured by the Tenant s bank, an additional amount of $45.00 over and above that in covenant 2(a) will be charged for each cheque so returned to partially defray the Landlord s cost of reprocessing, etc. TENANT INITIAL. 3 Rental Deposit (3) The Tenant agrees to deposit with the Landlord the sum of, ($ ) Dollars. This Deposit is refundable to the tenant after they return possession of the premises to the landlord. A key deposit will be required if allowed by law. Failure to Give Proper Notice (4) Where the Tenant fails to give proper notice in writing at the end of any term as set out in covenant #22(a), and vacates the premises, THE TENANT AGREES TO PAY THE RENT for two further months in lieu of such proper notice and AGREES FURTHER to remain responsible for the same period for any utilities, such as heat and electricity, which are not included in the rent. Use Amenities Incoming Inspection Report Damages (5a) The Tenant agrees to use the premises for no other purpose than as a residential dwelling; to exercise cleanliness and care in the use of the rented premises; common areas, service systems, facilities and amenities supplied; to abide by the covenants. Agreements and rules and regulations which form part of this agreement and all reasonable additions thereto; to cooperate with the Landlord and his staff in the administering of rules and regulations and in maintaining and cleaning common areas; and generally to refrain from doing anything injurious to the reputation of the premises or disturbing to the other tenants or that would significantly increase the cost of maintenance of operation of the building or increase the fire insurance or the taxes thereon. The tenant is responsible for Replacing light bulbs, plunging and using draino on toilets/drains as part of the normal use of the premises. Should the landlord have to perform any work that is the responsibility of the tenant during or at the end of the rental term the hourly rate of $75.00 will apply during business hours and $140 per hour if outside business hours defined as 9:00 am 5:00 pm Monday through Friday. (5b) Any additional services of amenities provided by the Landlord are for the exclusive use of the Tenants and all the Rules and Regulations governing the use of the same must be adhered to, otherwise the Landlord or his agent may restrict or refuse the use of such services or amenities. (6) The Tenant hereby acknowledges receipt of Incoming Inspection Report and agrees to complete the Report before moving into the premises which Report shall be signed by both parties (tenant to retain one copy signed by landlord). If no report is completed it is mutually agreed there was no damages to report or maintenance required at the time of move in, and that any damages found or maintenance required will be billed to the tenant. (7) The Tenant agrees to responsible for all damage to the premises and common areas FOR ALL THE BREAKAGE OR DAMAGE TO GLASS OR WINDOW SCREENS ON THE RENTED PREMISES WHATEVER THE CAUSE, and for all damages resulting for his failure to notify the Landlord promptly in writing of any defect or damage within the rented premises. THE TENNANT FURTHER AGREES not to fasten, affix or adhere any item or material to the rented premises, common areas or other part of the Landlord s premises, not to make any alteration or to decorate without the Landlord s written approval. Cleanliness (8) The Tenant agrees to clean floors, fixtures, appliances, broadloom, drapes, etc., and generally all cleanable surfaces in the rented premises sufficiently often to prevent abnormal wear and deterioration during tenancy and to keep the premises a condition of cleanliness and repair suitable for immediate re-rental. Provided that if the Tenant fails to do so he shall indemnify the Landlord for the cost of such cleaning and/or repair as well as for any consequential rental loss the Landlord may sustain because of such cleaning/repairs. Assign or Sublet Over holding Lockouts Snow Removal (9) The Tenant agrees not to assign, sub-let or otherwise part with the possession of the premises without the written consent of the Landlord; such consent to be subject to the Landlord s covenant # 16. An administration charge of $ will be billed to the tenant for each room placed under a sublease if the landlord assists in finding a sublet. (10a) In the event that the Tenant fails to vacate on or before the specified date in a proper written notice given to or by the Landlord or on the expiry of the term of this Lease, in addition to the Tenant s liability to the Landlord for such over holding, the Tenant agrees to further indemnify the Landlord for all losses suffered by reason of the Landlord s liability to any third party in respect of a new tenancy agreement for the rented premises based upon the anticipated availability of the premises after the aforementioned vacancy date. (10b) Tenant Lockouts are defined as when a tenant requires a room to be unlocked by the landlord or his staff. Lockouts are chargeable to the Tenant at a rate of $25.00 if occurring during business hours (Mon-Fri) 10-5pm. Outside of business hours the amount chargeable is $ Landlord does not promise to provide service, and if landlord is not available Tenant shall have to call a locksmith. Tenant Initial. (10c) Tenant(s) agree to keep city sidewalks, and the steps and walkways leading to their apartment entrance salted and cleared of snow and ice. Any city fines resulting from snow/ice are to be paid by equally divided by the tenants obligated by this lease. Page 2 of 8 TENANT INITIAL.

Additional Mutual Covenants: Maid Service/Garbage (56) The tenants have opted not to receive the monthly maid service. Tenants are responsible to deliver their normal domestic garbage and recycling to the curb weekly in large black plastic bags and blue bins on Garbage day and will be responsible for any fines issued by the city for not handling domestic garbage properly. Tenants are required to label and retrieve their bins. Lost bins are replaceable at cost plus one hour per bin at the labour rate detailed previously in this agreement. Tenants are responsible for keeping the rear garbage area clean and tidy at all times. Availability of the Building (58) The Landlord agrees to make every reasonable effort to ensure the Building is available for occupancy. However Given that bedrooms are usually vacated simultaneously the Tenant must give at least one week notice in the form of a written request for a move in time agreeable to the landlord. The landlord must approve the requested date so that he can schedule any cleaning or repairs deemed necessary by the landlord. Tenants must submit an incoming inspection report within 48 hours following the move in date to help identify any areas that require repairs or extra cleaning. Ongoing Maintenance Emergencies Smoke Free (59) The tenant agrees to allow the landlord and his agents or subcontractors access to the rented apartment to complete any work as required on a Monday to Saturday regular working hours basis. The Property Manager will Coordinate between tenants any agents or subcontractors of the Landlord. Tenant has received the attached Schedule A Maintenance Agreement and agrees to the terms. (60) Tenant will and call the landlord leaving a voic in the event of an emergency. If the landlord is not available the tenant is required to contact 911 for the authorities for any Fire or smoke alarm issues or Safety concerns that would be a police matter and Is further required to contact a 24 hour emergency plumber or roofer (yellow pages has several listed) for any water leaks or emergencies. Water main shut offs are under the stairs in unit B, room 2 (by the living room) (61) Smoking on the premises will be fined at $50.00 for the first Building incident and $95.00 fine amount for each incident per individual thereafter. Outdoor smoking areas are located at the rear of the property. Cigarette butts are to be placed in a tin canister with a lid located at 5 meters away from the building to prevent any risk of fire. (62) The Landlord will provide Wifi internet for the building at 309 Spruce street, due to the nature of the separation between apartment dwellings and the absence of a common area the landlord cannot guarantee the quality or reliability service will always be running perfectly. One of the tenants, perhaps in a neighbouring apartment unit, will agree to be an authorized person on the account to troubleshoot any technical difficulties with the Internet Service Provider. (63) This document represents the entire agreement and supersedes any verbal discussion, advertisements, correspondence prior to the signing of this agreement Any and all prior correspondence, advertisements will be ignored in the resolution of any dispute between the parties. 5 Schedule A - Maintenance Notice DATE: TO: PURPOSE: Tenant in Apartment at All parties to be aware of the procedure for any maintenance requests In the event any maintenance issue should arise, the tenant agrees to: 1. Notify the Landlord in Writing by sent to both andy@andysapartments.ca and repair.andysapartments@gmail.com 2. If the maintenance request is an EMERGENCY (water leak, no heat) the tenant must call the landlord at and and leave messages on each of the voic answering services. If there is an emergency and there is no response from the landlord the tenant is responsible to call 24 hour emergency services from the yellow pages until they can get an immediate response to the emergency to prevent any further damage or loss. The water shut off valves are located in, B room 2 closet, the bedroom beside the living room. If there is an emergency where there is an urgent safety or health emergency the tenant(s) should dial 911 before contacting the landlord. 3. If the maintenance request is not an emergency, a reasonable amount of time should be agreed upon with the landlord to inspect, hire a contractor, and repair. 4. If there is no response for a non-emergency maintenance request as per the time allowed in (3.) the tenant must try to contact by a second time and send a notice of the issue to the Landlord in writing by registered mail to: Andy s Apartments Ltd. Attention: A. Sukhiani Office - 34 Laurel Street Waterloo, ON, N2J 2H2 Only once the above 4 steps have been completed will the landlord be properly Notified of any issue. The tenant should not contact the any third party, including a authority, government municipal or otherwise, or proceed to the Landlord and Tenant Board to apply for a hearing unless they have Notified the landlord as stated in the above 4 step procedure. If the tenant proceeds to a contact an authority without following the steps 1-4 to notify the landlord the landlord may seek damages against the tenant for extra costs, higher labour rates, and inspection fees. The tenant agrees that the premises is currently free from any obvious maintenance issues and that the smoke detector was installed and tested to be found fully operational at the time of move-in. _Andy s Apartments Ltd.
