1 The Lexington Apartments RESIDENT RULES AND REGULATIONS It is our goal to make your residency the best experience possible. The following addendum to the lease agreement contains information and community policies to better serve and protect the interests of both the RESIDENT and The Lexington Apartment Community. Apartment living requires consideration and cooperation on the part of all who reside here. Therefore, the following rules and regulations have been prepared as an agreement of our mutual obligations. These policies serve as an attachment to your housing contract. Alterations RESIDENT shall not make, or cause to be made, any alterations of the said premises or their contents without first obtaining the written consent of RESIDENT Housing. Automobiles & Motorcycles All automobiles and motorcycles must be registered with the RESIDENT manager. Parking regulations are listed below and have been adopted to ensure that you will have ample parking on a clean, well maintained and safe parking lot. Bicycles Bicycles may be parked in designated areas only. Each bike on the premises needs to show a valid Lexington bike permit. BBQ s: BARBEQUES MAY NOT BE USED ON THE BALCONIES OR PATIOS! A barbeque pit is provided by the lawn area for RESIDENT use and needs to be cleaned after each use. Common Facilities RESIDENT may use all recreational and study facilities on the premises, subject to posted Regulations. Entry Pursuant to California Civil Code 1954, RESIDENT Housing/Lexington Apartments facilities may enter the dwelling unit only in the following cases: o in case of emergency o to make necessary or agreed repairs, decorations, alterations, or exhibit the dwelling unit to prospective or actual purchasers, mortgagees, RESIDENTs, workers, or contractors o when RESIDENT has abandoned or surrendered the premise o pursuant to court order o with RESIDENT'S consent o Entry may not be made other than between eight in the morning and eight in the evening, and only after giving 24 hours written notice of the intent to enter. o Any RESIDENT receiving said notice or giving consent shall inform other RESIDENTS, if any, of proposed entry. o THE LEXINGTON APARTMENTS MANAGEMENT and RESIDENT Housing shall not abuse the right of access. Garbage Areas Dumpsters are located throughout the community. Lids should remain closed to prevent garbage from falling on the ground. Garbage areas are available for garbage, paper, and glass. Recycle containers are available for your convenience. Boxes must be broken down before placed in the recycling bins. RESIDENT shall keep the dumpsters clean and sanitary.

2 Mold Notification Addendum It is our goal to maintain the highest quality living environment for our RESIDENTs. Therefore, know that the OWNER/AGENT has inspected the unit prior to lease and knows of no damp or wet building materials and knows of no mold or mildew contamination. RESIDENT is hereby notified that mold, however, can grow if the premises are not properly maintained or ventilated. If moisture is allowed to accumulate in the unit, it can cause mildew and mold to grow. It is important that RESIDENT regularly allows air to circulate in the apartment. It is also important that RESIDENT keeps the interior of the unit clean and that they promptly notify the OWNER/AGENT of any leaks, moisture problems, and/or mold growth. RESIDENT agrees to maintain the premises in a manner that prevents the occurrence of an infestation of mold or mildew in the premises. RESIDENT agrees to uphold this responsibility in part by complying with the following list of responsibilities: o keep the unit free of dirt and debris that can harbor mold o immediately report to the OWNER/AGENT any water intrusion, such as plumbing leaks, drips, or sweating pipes o notify owner of overflows from bathroom, kitchen, or unit laundry facilities, especially in cases where the overflow may have permeated walls or cabinets o report to the OWNER/AGENT any significant mold growth on surfaces inside the premises o allow the OWNER/AGENT to enter the unit to inspect and make necessary repairs o use bathroom fans while showering or bathing and to report to the OWNER/AGENT any nonworking fan o use exhaust fans whenever cooking, dishwashing, or cleaning o use all reasonable care to close all windows and other openings in the premises to prevent outdoor water from penetrating into the interior unit o clean and dry any visible moisture on windows, walls, and other surfaces, including personal property, as soon as reasonably possible (Note: Mold can grow on damp surfaces within 24 to 48 hours.) o notify the OWNER/AGENT of any problems with the air conditioning or heating systems that are discovered by the RESIDENT o indemnify and hold harmless the OWNER/AGENT from any actions, claims, losses, damages, and expenses, including, but not limited to, attorneys fees that the OWNER/AGENT may sustain or incur as a result of the negligence of the RESIDENT or any guest or other person living in, occupying, or using the premises Noise or Nuisance When entertaining, consideration must be given to other RESIDENTS and noise must be kept to a minimum. Do not play musical instruments or operate a stereo, television, or appliances so as to disturb your neighbors, especially between the hours of 10pm and 8am. Parking Regulations All vehicles are to be parked solely in those areas designated by THE LEXINGTON APARTMENTS MANAGEMENT. No charge shall be made for parking. All vehicles must be registered with the office and have a Community Parking Decal installed on the lower inside driver s side front window. If decal is removed for any reasons, it becomes INVALID and must be returned to OWNER/AGENT in order to receive a new decal. All vehicles must have current state DMV registration tags on license plates. All vehicles must be parked facing the curb. Vehicles may not be backed into spaces. All vehicles must be in working condition (operable). Vehicles with expired tags, non-operative status and/or flat tires will be subject to towing. Working on vehicles, such as oil changing and engine repair, is prohibited on the premises. Washing of vehicles is prohibited on the premises. Loitering around parked cars is prohibited.

3 Guests may not park on the premises without a Temporary Parking Permit and will be subject to towing. RESIDENT must obtain a Temporary Parking Permit from the OWNER/AGENT on a first come first serve basis. OWNER/AGENT is not responsible for any damage to a RESIDENT S or GUEST S vehicle while parked on the premises. OVERNIGHT GUEST PASSES WILL ONLY BE GIVEN FOR FRIDAY AND SATURDAY NIGHT. RESIDENTs shall indemnify and hold owners harmless of any liability in the event that guest or invitee s vehicle is removed from the property. Unauthorized vehicles, illegally parked vehicles, or vehicles in violation of parking regulations will be subject to tow with no warning and at vehicle owner s expense. If you should sell, trade or dispose of a vehicle, the original parking sticker must be scraped off and brought into the office before another sticker may be issued (even if the sticker is damaged). Vehicles without proper handicapped markings parked in a handicapped space will be towed. Cars parked in Fire Lanes (Red Curb Areas) will be towed with no warning at vehicle owner s expense. No vehicle can be parked on the premises if it is leaking fluids of any kind. RESIDENTs are asked to help management in policing the parking lot and grounds against crime. Please call the office at (530) and the police at 911 if you should see anyone tampering with autos. RESIDENT parking is on a first-come, first served basis. Parties All parties larger than 10 persons shall be registered with the office 48 hours in advance. RESIDENTS are responsible for the behavior of their invited or uninvited guests anywhere on the premises. Any damage caused by a guest is the responsibility of the RESIDENT having such a guest. Patios, Balconies, & Stair Alcoves In order to maintain the attractiveness of your apartment and the entire community you are required to keep your patios, balconies and stair alcoves free from all debris. No towels, swim suits, clothing or blankets shall be hung from the railings of balconies. No cleaning supplies shall be left out on balconies/patios. No collecting of garbage/recycling on the balconies/patios. Pest Control Notice Addendum California law requires that an OWNER/AGENT of a residential dwelling unit shall provide each new tenant a copy of any notices provided by a registered pest control service. The premises you are renting, or the common areas of the building are covered by a contract for regular pest control service, so you are being notified pursuant to the law. The notice provided by the pest control company is attached to this Acknowledgment. Contact the office for any pest issues that may arise or use the on line work order. Pets Pets are not allowed in the premises or other portions of the building Playground Equipment Release Form The playground equipment has been established for the benefit of our RESIDENTs. Any misuse of the equipment by a RESIDENT will automatically forfeit the RESIDENT s privilege to use the playground equipment. Children at play must be in view of a supervising adult on-site at all times. Warn children not to climb or walk on top of playground equipment, as it is not intended for such use. Children should be advised to wait their turn on activities such as slides; thus, each child is able to slide down and safely move to the side before another child begins their descent. Person s using the playground equipment do so at their own risk.

4 Plumbing Please report any plumbing or draining issues to the office immediately. DO NOT USE DRAINO. RESIDENTS may be charged for damages related to plumbing or draining issues by RESIDENT if at fault. Pool Rules Addendum The Pool is to be used only between the hours of 9am and 11pm on Friday and Saturday and 9am to 10pm Sunday through Thursday. The Pool is reserved exclusively for use of RESIDENTS of the building and their guests. Children under the age of fourteen (14) shall not use the pool without an adult in attendance. No food may be served or eaten in or around the Pool area at any time without OWNER/AGENT S consent. Refreshments must be served in unbreakable containers. No alcoholic beverages shall be served or consumed in or around the Pool area at any time. No person under the influence of alcoholic beverages is permitted in or near the Pool. Running and jumping, horseplay, fighting, boisterous or dangerous conduct, and/or any noisy behavior disturbing to the other RESIDENTs, is forbidden in or around the Pool area. No radios, record players, or other musical instruments may be used in or around the Pool area without consent of OWNER/AGENT. RESIDENTs and their guests are required to be properly attired at all times, going to and from and in or around the Pool area. Showering is required prior to using the Pool. Those using the Pool shall dry themselves off before leaving the Pool area. RESIDENTs and guests will place their own towels over Pool furniture when using suntan oil or other lotions. No toys, inner tubes or any other objects whatsoever will be allowed in the Pool at any time. Safety equipment is not to be used except in case of emergency. NO LIFEGURARD WILL BE ON DUTY. Persons using pool facilities do so at their own risk. OWNER/AGENT is not responsible for accident or injury. OWNER/AGENT is not responsible for articles lost, damaged or stolen. NO GLASS ALLOWED IN OR AROUND THE POOL AREA. Proposition 65 Warning and information Warning: This Property Contains Chemicals Known To the State of California To Cause Cancer and Birth Defects or Other Reproductive Harm Office of Environmental Health Hazard Assessment Proposition 65 in Plain Languages 1. What is Proposition 65? In November 1986, California voters overwhelmingly approved an initiative to address growing concerns about exposures to toxic chemicals. The initiative became The Safe Drinking Water and Toxic Enforcement Act of 1986, better known by its original name. For Further Information, contact the Office of Environmental Health Hazard Assessment s Proposition 65 Implementation Office at (916) or log on to Repairs and Maintenance OWNER shall place the premises in good repair and condition fit for human habitation, as defined under California Civil Code 1941, before RESIDENT begins to occupy the premises, and shall keep the premises

5 and the building in good repair during the term of this lease. The Lexington Apartments management shall do the same in regard to the common areas of the building. RESIDENTS agree to exercise reasonable care in the use of the premises and to keep areas under their control free from dirt, trash, and filth. RESIDENTs also agree not to litter or damage the common areas of the building. The cost of repairs caused by RESIDENTs, their guests, or persons under their control shall be paid for by RESIDENTs; otherwise, the cost of repairs shall be paid by The Lexington Apartments management. All repairs shall be made within a reasonable time. Repairs: Please let the RESIDENT manager know promptly of any maintenance problems or malfunctioning appliances in the apartment so that we may correct the problem without running the risk of further damage. Leaks are difficult to repair if not reported immediately and may cause considerable damage to your apartment. Any maintenance and emergency repairs must be reported at (530) at all times! Work orders can be submitted online at the Lexington website: Smoke Detector Agreement The premise is equipped with a smoke detection device(s). RESIDENT acknowledges the smoke detection device(s) was/were tested and its operation explained by OWNER/AGENT in the presence of RESIDENT at time of initial occupancy and the detector(s) was/were operating properly at that time. RESIDENT shall perform the manufacturer s recommended test at least once a week to determine if the smoke detector(s) is/are operating properly. RESIDENT(s) must inform the OWNER/AGENT immediately in writing of any defect, malfunction or failure of any detector(s). In accordance with California law, RESIDENT shall allow OWNER/AGENT access to the premise for that purpose. Sublease or Assignment RESIDENT shall not sublease or assign this contract or any interest therein. Unlawful Activity RESIDENT and any guest or other persons under the RESIDENT'S control shall not engage in criminal activity, including drug-related criminal activity, on or near property premises. "Drug-related criminal activity" means the illegal manufacture, sale, distribution, use, or possession with intent to manufacture, sell, distribute, or use of a controlled substance (as defined in section 102 of the Controlled Substance Act (21 U.S.C.802)). RESIDENT and any guest or other persons under the RESIDENT's control shall not engage in any act intended to facilitate criminal activity, including drug-related criminal activity, on or near property premises. RESIDENT will not permit the dwelling unit to be used for, or to facilitate, criminal activity, including drugrelated criminal activity, regardless of whether the individual engaging in such activity is a member of the household or a guest. RESIDENT will not engage in the manufacture, sale, or distribution of illegal drugs at any location, whether on or near premises and property or otherwise. RESIDENT or a guest or other person under the RESIDENT's control shall not engage in acts of violence or threats of violence, including, but not limited to the unlawful discharge of firearms on or near property/premises. A single violation shall be deemed a serious and material violation of the contract. It is understood and agreed that a single violation shall be good cause for referral to RESIDENT Judicial Affairs. Unless otherwise provided by law, proof of violation shall not require criminal conviction, but shall be by a preponderance of the evidence. Use The premises are to be used exclusively for lawful RESIDENT purposes only.
