2 RIVER VALLEY ESTATE HOMEOWNERS ASSOCIATION Page 1 of 23 The House Rules forms part of the Conduct Rules which were approved at the Annual General Meeting, with reference to the powers given to the Director and to be adhered to as referred to in Item 3 (Legal Status). 1. SAFETY AND SECURITY 1.1 The Security Personnel are doing a difficult job and are to be treated in a courteous and co-operative manner. The Security Personnel may not e abused under any circumstances! Any dispute with or contravention of Security Regulations by Security Personnel or any transgression of Conduct Rules or dispute by residents or visitors will be logged by the Security Personnel in the Occurrence Book (OB) and reported to the Directors/Managing Agent. 1.2 Security protocol at the gate must be adhered to at all times. Under no circumstances may residents or any person other than the Security Personnel/ Managing Agent or a Director be allowed into the Guard House. 1.3 New occupants (owners/tenants) must advise the Directors/Managing Agent of their contact telephone numbers and addresses to enable the Security Personnel to make telephonic contact for permission to allow visitors access to the complex. Security Personnel may not recognise residents, therefore the vehicle stickers act as identification. 1.4 New occupants (owners/tenants) are required to fill in a form in order to obtain stickers. The stickers are to be placed in the left-hand corner of the car window. 1.5 All residents are to display a River Valley Sticker on the windscreen of their motor vehicle, failing which, they must sign in at the gate. 1.6 New occupants (owners/tenants) are to read and sign an acknowledgement of the Conduct Rules.

3 RIVER VALLEY ESTATE HOMEOWNERS ASSOCIATION Page 2 of No firearms, pellet guns, bows and arrows, crossbows or any other form of projectile may be discharged on or over the common property. 1.8 It is the owner's responsibility to keep trees trimmed away from the electric fence. Please make sure that there is nothing touching the electric fence as this interferes with the electric current. 1.9 No stones or other solid objects may be thrown on the common property Tampering with fire hydrants is strictly prohibited. Improper use or removal of any part of the equipment is a criminal offence No occupant shall interfere in any way with the normal operation of the motorised gates or booms No occupant shall interfere in any way with any electrical component or installation which forms part of the common property Occupants are accountable for the actions of any person who they admit to the property, in their own interest and that of their neighbours. Occupants are urged to admit only persons with whom they have business or personal guests, and not to admit work seekers, beggars, itinerant salesmen, etc Occupants shall not admit contractors or goods deliveries to the property on behalf of another occupant unless by prior arrangement with that occupant Visitors enter the complex at their own risk and occupants should advise their visitors accordingly No fireworks are permitted within the complex Access to the complex is strictly reserved at all times An electrified fence protects the complex perimeter. Tampering with the system will result in electric shock and activation of an alarm at the Guard House. No

4 RIVER VALLEY ESTATE HOMEOWNERS ASSOCIATION Page 3 of 23 liability whatsoever will be borne by the HOA for any injury caused to any resident as a result of such unauthorised tampering. In addition, all costs for rectification of damages to the electrified fence will be borne by the person who causes the damage Tampering with the gate system is strictly prohibited and costs for any damage caused to it or any other equipment or structure at the Guard House as a result of negligent driving or any other intentional or unintentional act will be borne by the guilty party, be it an owner, tenant, visitor or contractor Residents of the complex are required to abide by all security procedures which may be instituted from time to time. Any amendments to these procedures will be communicated to all residents of the complex as and when necessary It is the responsibility of every owner to ensure that their tenants and visitors are made aware of the security measures applicable at the complex. Residents or visitors must not give instructions to the Security Personnel Owners/tenants with Home Security Systems must ensure that these systems are efficient and do not malfunction. Information regarding the Security Company (Armed Reaction) servicing these systems must be supplied to the Directors/Managing Agent so that access to the complex may be authorised in the event of an alarm being triggered Units having Home Security Systems may erect one sign only on their boundary wall at the entrance to the units, 1.24 Vehicle access stickers are available from the Directors and are to be affixed to the left-hand side of the vehicle's window. The first two stickers are issued free of charge. Replacement or additional stickers are R30.00 each. Stickers are issued to residents only. Stickers will not be issued for vehicles that "visit very frequently". Residents are directed to ensure that access stickers are removed from the windows of cars which are sold by them A maximum of three stickers will be issued per unit.

5 RIVER VALLEY ESTATE HOMEOWNERS ASSOCIATION Page 4 of Non- resident owners will be issued with one sticker It is a security breach to "loan" your vehicle access sticker to anyone. The Security Personnel have been instructed to deny access to such vehicles and call for assistance Any home security system which consistently malfunctions and which inconveniences neighbours will be required to be disconnected until the malfunction is repaired An OB is retained in the Guard House for the registering by owners, tenants or guests of any complaints which they may wish to note or have investigated. The Directors, in conjunction with a representative of the Security Company, will investigate the incident/complaint and report back to the individual concerned. Please note that any incident not noted in the OB will not be followed up on. 2. ACCESS CONTROL 2.1 Security Personnel must keep the gate closed at all times and open only the gate to River Valley residents who have a vehicle sticker and guests who have been authorised to enter by the Owner/Tenant of the destination unit. 2.2 Before opening the gate for visitors, they have to be asked who they are visiting and the number of the unit they are visiting. Security Personnel are to complete all info necessary in the visitor's book and contact the relevant unit for authorisation. 2.3 A visitor is defined as either a person or persons who seek to gain access either by vehicle or on foot. The rules and procedures apply to both methods of entry.

6 RIVER VALLEY ESTATE HOMEOWNERS ASSOCIATION Page 5 of Security Personnel have the right to remove any guest or unwanted trespassers from River Valley and the Guard on duty has the right to deny guests access at his own discretion. 2.5 Any incidents are to be reported to the Directors/Managing Agent immediately and logged in the OB at the Guard House. 2.6 Security Personnel are to remain at the gate at all times unless, in his discretion, he believes it is necessary to leave the gate. 2.7 Security Personnel are to advise any residents or visitors who are hooting or speeding (includes revving of engines) that it is against the rules of the complex and that they should refrain from so doing. Should these individuals fail to comply, their details are to be entered into the OB and this should be brought to the attention of the Directors/Managing Agent. 2.8 Residents: No sticker, No entry. Visitors: No telephonic authorisation, No entry. 3. VISITOR ACCESS PROCEDURE The Security Company will receive instructions from the Directors which must be adhered to. 4. ARCHITECTURAL STANDARDS AND BUILDING PLAN APPROVAL 4.1 All building plans for structures should be in accordance with the Design Standards applicable to the complex and must be approved by the HOA prior to submission to the Council. This applies to any additions and alterations to existing structures as well as amendments to any previously approved Committee or Council plans. The Council has been notified by the HOA not to consider plans for approval unless accompanied by a letter of consent from the HOA.

7 RIVER VALLEY ESTATE HOMEOWNERS ASSOCIATION Page 6 of The basic architectural design of each structure may not be altered, even where high walls screen the entire frontage of properties. All garden walls and gates must match the basic design, dimensions, colours and materials of the complex. No wire or precast walls will be allowed. 4.3 No owner or tenant shall paint any external part of their property any colour other than the approved complex colours: neutral earthy tones. 4.4 No owner or tenant shall alter or add to the exterior of any property without the prior written consent of the HOA. This also applies to the fitting of any gates, awnings, as well as any other addition and/or alteration visible from the outside, as the properties are required to be uniform in style and colour. 5. PROCEDURE FOR BUILDING PLAN APPROVAL 5.1 Depending on the nature of the alteration or addition, written consent from the affected neighbouring units (as determined by the HOA) may also be required. Where this consent is not unanimous, the objection/s will be considered by the Directors; the decision of the Directors will be final and binding. 5.2 Once plans have been approved by the City Council, a copy of the approved plan must be submitted to the HOA. 5.3 Where applicable, plans will be approved by the HOA and a consent letter will be issued by the HOA to be submitted with the plans to the City Council. A copy of the unapproved plan must be lodged with the HOA. 5.4 An approval letter permitting the owner to commence building will be issued and an agreement of the duration of the building operations must be signed. 5.5 Security will not allow access to the complex to any builder or building material supplier, or owner entering with building material unless authorised by the HOA.

TV aerials are to be installed on the roof. 5.7 Lean-to's, fixed or free-standing carports and free-standing huts or storage structures will not be allowed. The erecting of shade cloth or net is not permitted without the Director's prior written consent. 6. CONDITIONS WITH REGARD TO BUILDING/ CONTRACTOR ACTIVITY 6.1 The primary intention of the provisions hereunder is to ensure that all building activity occurs with the least possible disruption to residents. In the event of any uncertainty, residents and/or their contractors are most welcome to contact the Managing Agent. 6.2 The conditions governing building activities that are set out in this document are rules adopted by the HOA and are therefore binding on all residents, their contractors and sub-contractors. Furthermore, all residents are obliged to ensure that their building contractors and subcontractors are made aware of the conditions and comply strictly with them. Residents are, therefore, required to include the conditions in their entirety in any building contract concluded in respect of property in the complex. 6.3 Owners and tenants are required to comply with the conditions regarding complex architecture and the process for building plan approval. The HOA reserves the right to monitor building operations, via the Managing Agent and the Directors, in order to ensure building compliance with approved plans. 6.4 The HOA has the right to suspend any building activity in contravention of any of the conditions and it accepts no liability whatsoever for any losses sustained by a resident as a result thereof. 6.5 All contractors and/or contractor's sub-contractors are required to submit information regarding their and their workers' details to the Security Personnel,

This information will be lodged at the Guard House, and only then will the Security Personnel grant access. 6.6 Employees of Contractors must be supervised at all times and they are not permitted to roam the complex. 6.7 The contractor shall provide facilities for rubbish disposal and ensure that the workers use the facility provided and that the rubbish is removed regularly and no burning takes place on site. 6.8 The dumping of materials, building or rubble will not be permitted on any grassed pavement which are outside the complex, at the Guard House or areas adjacent to the complex. 6.9 Where materials are off-loaded by a supplier encroaching onto the pavement or roadway, the contractor must move these materials onto the site. Where possible, no material must be allowed to remain on the roadway or pavement, or to obstruct traffic flow, and it is the contractor and owner's responsibility to clean the roadway of all such materials. The same applies to sand or rubble washed or moved onto the road during building operations The owner and the contractor shall be responsible for damage to kerbs, grass and plants on the sidewalks and/or damage to private or complex property. Where repairs to any verges are required, these will be affected by the HOA and will be charged to the relevant unit Building operations are subject to a completion deadline, and all rubble and building materials must be removed by the agreed date, and all painting work completed. Any extensions required, due to unforeseen circumstances, needs to be approved by the HOA Deliveries of building materials from suppliers must be scheduled in public times only.

10 RIVER VALLEY ESTATE HOMEOWNERS ASSOCIATION Page 9 of It is incumbent on the resident and contractor to provide toilet facilities for the workers No building or advertising boards may be erected either inside or at the entrance to the unit or complex No building/contractor staff will be allowed to sleep in the unit at which they are working Building activity may only be engaged weekdays between 08:00 and 17:00 and Saturdays between 08:00 and 13: HYGIENE AND REFUSE DISPOSAL 7.1 An occupant of a Unit shall place normal household refuse for collection into a suitable refuse trolley bin and keep on his own property until collection day. 7.2 An occupant of a Unit shall place his refuse bags, securely tied, between 15:30 on Monday and 08:30 on Tuesday of every week at the unit gate for collection on Tuesdays. The refuse company will NOT collect any building rubble or garden refuse. 7.3 Dustbins must be removed by Tuesday evenings. 7.4 No refuse or any substance which may attract insects, cause undesirable odours or create any other undesirable condition shall be dumped, kept, stored, used or processed on the common property. 7.5 Occupants shall not dump any petroleum-based fluids, chemicals or solid substances into any sewer, drain or manhole. 7.6 Windows of Units are expected to be kept in a clean condition and replaced if broken.

11 RIVER VALLEY ESTATE HOMEOWNERS ASSOCIATION Page 10 of All refuse, debris etc. which results from any extensions, alterations or improvements shall be removed by the occupant concerned within two (2) days. If such refuse, debris etc. is not removed, the Directors/Managing Agent may cause it to be removed and all charges in connection therewith shall be for the account of the owner concerned. 8. GOOD NEIGHBOURLINESS 8.1 No business activity or hobby which could cause aggravation or nuisance to residents, including auctions and jumble sales, may be conducted in the complex. 8.2 No washing to be hung in view from the common areas or driveways. The hanging of washing or other articles over balconies or out in any part of a Unit where it is visible to the general public is prohibited. 8.3 No advertisements or publicity material of any person, including maintenance contractors, may be exhibited or distributed without the prior written consent of the Directors. An exception to this rule is one security sign fixed to the boundary wall of the individual property. The Directors/Managing Agent will have the right to remove any material exhibited or distributed in contravention of this rule. 8.4 No residents shall cause a nuisance, disturbance, inconvenience or annoyance to any other resident. If the Directors/Managing Agent are of the opinion that there has been any infringement of this rule, they will be empowered to enforce their rights in terms of these rules after the third infringement. 9. NOISE 9.1 Excessive and unnecessary noise must be avoided at all times and due consideration must be given to other residents.

12 RIVER VALLEY ESTATE HOMEOWNERS ASSOCIATION Page 11 of A reasonable level of quiet must be maintained at all times. If a resident is going to have a function, please notify your neighbours. It is, however, still expected to keep all noise levels down. 10. ENTERTAINING 10.1 In the interests of good neighbourliness it is expected that any entertaining will be contemplated after prior consultation with neighbours who may be disturbed or in any way negatively affected by such activities. Timeous notice and warning of an event that may cause a disturbance must be issued to all occupants of the complex Entertainment must be confined to the individual's property and no entertaining may take place outside the property. The use of car radios on or outside the individual's property for entertainment purposes is not permitted Units that entertain are required to monitor the parking of their guests so as to ensure that they comply with parking regulations. The HOA via the Security Personnel reserve the right to limit or refuse additional vehicles access to the entertaining unit where parking regulations are being infringed No braaiing or entertaining of any nature will be allowed in driveways or on pavements. 11. CONDUCT OF CHILDREN 11.1 Children are subject to the Conduct Rules in the same manner as adults Occupants shall supervise their children, their children's friends and their visitors' children properly so that no provision of these rules is infringed by such children and that no damage or nuisance is caused to any occupant, to the property of any occupant, to the common property or any unoccupied Unit. In particular and without affecting the generality of the foregoing, children shall not

13 RIVER VALLEY ESTATE HOMEOWNERS ASSOCIATION Page 12 of 23 damage, deface or interfere with the animals, plants, decorations, signs, name plates, fire hydrants and exterior lighting, and shall not enter any occupied Unit, climb onto any roof or wall or play ball games in and around the common property Children playing up and down the driveways and on the common property do so at their own risk Children are not permitted to interfere in any way with the performance of duty by the Security Personnel, Gardener, Garden Services or any other approved contractor or visitor Parents of children who cause damage to any property in the complex, either by accident or by way of vandalism, will be held responsible for the repair thereof. 12. VEHICLES 12.1 Speed limit: The speed limit within the complex is 30 kilometers per hour and has to be strictly adhered to. Fast, inconsiderate and noisy driving is not permitted Parking of motor vehicles: Residents and their invitees must ensure that all motor vehicles be parked having due regard to the convenience of other residents. No vehicle should obstruct the flow of traffic, be or is parked opposite or obstructing easy access to driveways or garages The execution of vehicle repairs of whatsoever nature in any area of the complex is strictly prohibited and all residents must ensure that their vehicles do not have any leaks that will stain surfaces within the complex. The owner of the property will bear all costs of the cleaning of such stains and the rectification of such damages regardless of whether such stains or damages were caused willingly or unwillingly.

14 RIVER VALLEY ESTATE HOMEOWNERS ASSOCIATION Page 13 of Vehicles exceeding approximately 2 tonnes, caravans, motor boats, trailers and other similar vehicles shall not be parked on the property, unless inside a garage, without the permission of the Directors first having been obtained. The Directors may grant such permission subject to such conditions as they in their absolute discretion may impose. Such permission may be revoked by the Directors at any time and in their absolute discretion Garage doors are to be kept closed unless owners are working in their garages Oil stains are to be removed immediately by the resident who caused the stain The use of motorized recreational vehicles (e.g. quads, motorbikes, go karts etc.) are restricted from entering and exiting the premises, and riding these vehicles in the complex is not permitted Vehicles over 3.5 tonnes will not be permitted into the complex The parking of caravans, boats, trailers and the like is not permitted on the pavement or in the street, and must be housed within the individual stand's boundaries. The parking of cars in the street (including grassed pavements) is not permitted. 13. PETS 13.1 Occupants shall ensure that their pets do not foul common property. Should any excrement be deposited in a public area, the immediate removal thereof shall be the sole responsibility of the owner of the pet No visitor shall be allowed to bring pets onto the common property Owners are to ensure that their dogs do not bark incessantly, thereby disturbing other owners. The HOA reserves the right to request the owner to remove his pet, purchase anti-barking collars or perimeter control equipment, should an animal become a nuisance within the complex.

15 RIVER VALLEY ESTATE HOMEOWNERS ASSOCIATION Page 14 of Pets shall not be left unattended for any length of time as they fret and become a nuisance to the residents by uncontrollably barking and howling. If this occurs, the pets will have to be removed from the property. The HOA have the right to investigate any complaints regarding animal cruelty, lack of adequate space, food and care of any animal within the complex Without the written approval of the HOA no person may keep more than 2 pets (e.g. 1 dog and 1 cat or 2 dogs or 2 cats) on the property No poultry, pigeons, aviaries, wild animals or livestock may be kept within the complex without prior written consent from the Directors The local authority bylaws relating to pets will be strictly enforced Dogs should not be left to roam in the complex. Dogs walking with owners in the complex must be kept on a leash. All cats and dogs must wear a tag with details of the owner. Any dog found roaming will be sheltered for its own safety. A fee of R100 per day will be charged to the owners Pedestrians are strictly advised not to tease or play with dogs that are securely housed inside their units. 14. PARK RECREATIONAL PROPERTY 14.1 Please consider the park recreational property our little place of retreat, for some quiet time in beautiful surroundings. Any damage caused to the park area will be charged to the relevant resident. Please note that Unit No. 1, which borders the park, and units adjacent to the recreational property are private residences. Please be considerate when using the park and its facilities Residents wishing to enjoy the park are to request the key from the Security Personnel and to sign the OB indicating the time of receipt, and likewise with returning of the key.

16 RIVER VALLEY ESTATE HOMEOWNERS ASSOCIATION Page 15 of GARDENING AND WEEDS 15.1 Residents must maintain their gardens by keeping them neat and tidy If there are complaints about untidy gardens, garden refuse or rubble, the garden service will be called in to clean up and the cost will be for the owner/tenant Driveways are to be kept weed-free at all times. Driveways not being maintained will be weeded by the Garden Service and charged to the relevant owner Ensuring a pleasant streetscape: Every owner shall maintain the area between the street kerb and his/her boundary wall and ensure that this area is kept free of stones, weeds and other objects. The Directors are empowered to instruct the Managing Agent to undertake such maintenance at the cost of the owner should the owner fail to comply with requests to maintain this area by the Directors Gardens on pavements and common property shall not interfere with any pedestrian or obscure the vision of motorists Owners are expected to maintain the exterior of the residences regularly to ensure an aesthetics standard compliant with the other residences in the complex. The Directors are empowered to instruct the Managing Agent to undertake such maintenance at the cost of the owner failing to comply with requests to do so by the HOA. 16. USE OF PROPERTY 16.1 The storage of any hazardous material and/or substance on the properties by any resident at any given time is prohibited.

17 RIVER VALLEY ESTATE HOMEOWNERS ASSOCIATION Page 16 of The number of individuals residing permanently in any unit must comply with Council and Health regulations, as well as being commensurate with the number of bedrooms in that unit The properties within the complex may under no circumstances portray any image that, in the opinion of the HOA, could in any way harm the overall image of the complex. 17. SUNDRY PROVISIONS 17.1 Disorderly behaviour and any act that may jeopardise the safety and/or security of any resident in the complex or harm in any way the image of the complex or cause any damage to the complex or private property will not be tolerated Without in any way detracting from the generality of the aforegoing Rules and in addition thereto: The Directors shall have the right to take any action deemed fit to prevent any infringement of these Rules No occupant shall use his unit or permit it to be used for any purpose which is injurious to the reputation of the complex No occupant shall do or permit any thing to be done in his unit or on the common property which will or may increase the rate of premiums payable by the HOA on any insurance policy Common property and garden areas must at all times be kept neat The gardeners/garden service employed by the HOA may not be employed by or asked to do any private work for occupants during their normal working hours unless by prior arrangement with the Directors.

18 RIVER VALLEY ESTATE HOMEOWNERS ASSOCIATION Page 17 of Any complaints regarding a breach of the Conduct Rules must be addressed in writing to the Directors/Management Agent No ball games are allowed on driveways or against walls All building and garden rubble should be removed (not burned) by the owners at their own cost Littering in the streets and common property is prohibited Residents shall ensure that declared alien/noxious flora/fauna are not on their property. 18. ENFORCEMENT OF RULES 18.1 It is the responsibility and in the direct interest of every resident of the complex to ensure that they, their visitors and other residents adhere to these Rules and any frequent deviations and/or violations should be reported in writing to the HOA The Directors have the right to impose a levy penalty on transgressors where any of these rules, as stipulated by the HOA from time to time, have been broken. Such levy penalty will form part of the levy and be due and payable on due date of payment of the levy, and is subject to the same payment conditions as the monthly levy A levy penalty will only be imposed where a transgressor has failed to respond to or comply with a formal warning letter issued to him. Such letter will serve reasonable notice to the transgressor to either avoid the repeat of a transgression or to discontinue an ongoing transgression Levy penalties incurred by tenants will be levied to the account of the owner. In the event of repeated transgressions by tenants or visitors to the complex, the letters will be sent to the owner.

19 RIVER VALLEY ESTATE HOMEOWNERS ASSOCIATION Page 18 of Any owner imposed a levy penalty has first right of appeal to the Directors. 19. NOTICES 19.1 Every owner of a property undertakes to notify the HOA of their and, if applicable, their tenants' postal and physical addresses as well as telephone numbers, a fax number, address and banking details (for debit order purposes). They further undertake to notify the HOA immediately and in writing when a change of the above particulars occurs in order to facilitate the proper administration of the complex In the event that the HOA is required to deliver documentation to a non-resident owner and the non-resident owner has or will not supply the necessary contact information, the HOA will employ the services of a Tracing Agent at the cost of the owner concerned Sale of Properties Owners are responsible for ensuring that the Estate Agents and prospective buyers comply with all the Rules as laid out in the Rules of Conduct, with particular reference to parking and speeding The purchaser agrees to be bound by these Rules from the date of his occupation of the residence Any offer to purchase a property within the complex shall be subject to the express and unconditional acceptance by the respective purchaser of the Rules of the complex and their subsequent amendments The offer to purchase shall include the following clause: "The offertory verifies by virtue of his/her signature to the offer to purchase that he/she has read and understood fully the current rules of the complex and its amendments. He/She expressly and unconditionally agrees to abide by these rules."

20 RIVER VALLEY ESTATE HOMEOWNERS ASSOCIATION Page 19 of The HOA need issue no clearance certificate for the sale of a property in the complex when such sale has been concluded, without the inclusion of the above clause In the event that an owner involved in conflict with the HOA for breach of a Rule/s in the Conduct Rules wishes to sell, a Clearance Certificate will only be issued once the buyer has confirmed in writing to the HOA that he is aware of the circumstances of the conflict and is willing to resolve the matter Sellers are directed to remove vehicle access stickers from their vehicles when they sell their units and vacate the complex. 20. PAYMENT OF LEVY 20.1 Payment in full of levies (including special and additional levies), interest on late payments and any other charges which the HOA shall have the right to make, are due on the first working day of each month and must be received by the Managing Agent by the 7 th of that month Interest at the Directors' discretion will e charged on any outstanding balance existing after the 1 st of the month, calculated as from the due date of the payment If payment in full of all amounts outstanding for 30 days or longer has not been received by the 1 st of the month, the account may at the sole discretion of the Directors be handed over to attorneys for collection without further notice. 21 RIVER VALLEY ESTATE HOMEOWNERS ASSOCIATION Page 20 of Levies are payable in advance No member of the HOA shall transfer his Unit until the Board of Directors under the hand of one of its members has certified that the member has at date of transfer fulfilled all his financial obligations to the Association. No unit or any interest therein shall be alienated without the consent of the Association. Such consent shall not be withheld unless: such member is indebted to the Association in any way in respect of levies or other amounts which the Association may in terms of these presents be entitled to claim from him; the proposed transferee has not agreed to become a Member of the Association; such member remains in breach of any of the provisions of these presents or any Rules after notice from the Directors requiring him to remedy such breach; the Directors in issuing the certificate referred to in the Article above shall be entitled to charge a reasonable fee therefore, to be determined by the Directors from time to time, subject to review by the Association in General Meeting; the Article above shall be entitled to charge a reasonable fee therefore, to be determined by the Directors from time to time, subject to review by the Association in General Meeting; the Directors may delegate such of their powers to a Managing Agent as they may determine, subject to any restriction imposed or direction given at any General Meeting of the Association The owners of the properties in the complex are responsible for all levies due to the HOA Owners whose levy payments are, despite due notification, still outstanding after 90 days may: be disconnected from the intercom;

FINES AND PENALTIES 21.1 Any resident who contravenes, breaches or fails to comply with any provisions of these Conduct Rules, conditions imposed thereunder or directions given in terms thereof will, inter alia, and without limitation of the HOA's rights in respect of such conduct, be subject to any penalty, fine or charge imposed by the HOA from time to time The resident concerned shall be liable for the payments of any fines imposed as a consequence of any breach by members of the Owner's or Tenant's household, employees, invitees, guests and/or tenants Any fine imposed on a resident shall be a debt due and payable to the HOA on delivery of written demand thereof The fines imposed for any first offence shall be: for any traffic/driving/"use of streets" violations R 500; for any good neighbourliness/architectural standard violation R 750; for any "streetscape"/environmental management violation R 750; for any security violation R1 000; for any abuse of Security Personnel R 300; for any pet violation R 250; for any other violation R The fine for any second or subsequent offence by any person for whom such Owner is liable shall e the amount set out above plus 20% compounded for each subsequent offence.

23 RIVER VALLEY ESTATE HOMEOWNERS ASSOCIATION Page 22 of ENFORCEMENT OF AMOUNTS PAYABLE 22.1 Any amount deemed payable by the owner to the HOA in terms of these Rules shall be deemed an additional levy in respect of such owner's unit and payment thereof shall be capable of enforcement. 23. COMPLAINTS 23.1 If there are any complaints regarding fellow-residents/tenants, speak directly to the residents/tenants first in order to arrive at an amicable solution. If the problem still persists, contact the Managing Agency, Paradigm Property Management Services, on and lodge the concern(s) in writing. 24. INDEMNITY 24.1 The River Valley Homeowners' Association/Management Agency/Directors and staff will not be liable for any injury or loss or damage of any description which an owner or occupier of an erf or any member of his family or his staff or friend, acquaintance, visitor or guest may sustain, physically or to his or their property, directly or indirectly, in or about the common areas or in the individual units by reason of any defect in the common areas, its amenities or in the individual units, or for any act done or any neglect on the part of the HOA or any of its employees, agents or contractors The HOA or its agents and staff shall not be liable or responsible in any manner whatsoever for the receipt or non-receipt and the delivery or non-delivery of goods, postal matter or any other property.
