7 AGENDA ITEM NUMBER: 3 STAFF REPORT Planning Commission MEETING DATE: August 23, 2017 CASE NUMBER: Conditional Use Permit No. CU PROPERTY OWNER: APPLICANT: City Yard Housing Partners L.P Cowan Avenue, Suite 200 Irvine, CA Wu Jen Enterprises, Inc th Street Buena Park, CA APPLICATION REQUEST: To allow the sale of beer and wine for on-site consumption with outdoor dining and live entertainment PROPERTY LOCATION / APN: 8002 Orangethorpe Avenue, Suites A and B / , , and GENERAL PLAN / ZONING: General Mixed-Use / GMU (General Mixed-Use) LAND USE CHARACTERISTICS: The subject site is zoned GMU (General Mixed-Use) and is developed with a 70-unit affordable housing development including leasing office and lobby areas, recreation and open space, and approximately 5,900 sq. ft. of non-residential flex space. Parking facilities are located on the ground level of the development. The properties to the north, across Orangethorpe Avenue, are zoned CM (Commercial Manufacturing) and developed with an auto repair facility and a multitenant office/industrial development. The properties to the east and south are zoned GMU and developed with new multi-family residences. The properties to the west, across Stanton Avenue, are zoned CG (Commercial General) and CO (Commercial Office) and are developed with a multi-tenant office building and the Salvation Army Thrift Store as well as Pendleton Elementary School, respectively. RECOMMENDATION: Staff recommends that the Planning Commission adopt the attached Resolution approving Conditional Use Permit No. CU with findings of fact and conditions.

8 Planning Commission Staff Report Conditional Use Permit No. CU Page 2 APPLICATION ANALYSIS: Background: In 2007, the former Redevelopment Agency began assembling property southeast of Orangethorpe and Stanton Avenues. The assembled properties, centered around the former City Maintenance Yard, included substandard structures with irregular lot configurations. Former Redevelopment Agency housing set-aside funds were used to acquire a total 10-acre site to revitalize the area with new affordable housing. The subject site was previously developed with a multi-tenant commercial center that included a liquor store and a restaurant that served alcohol for on-site consumption In 2011, the former Redevelopment Agency entered into an Exclusive Negotiation Agreement with homebuilder City Ventures to develop the site with single-family townhomes. In an effort to include a quality affordable rental housing project at the site, non-profit developer Jamboree Housing was selected to partner with City Ventures. Jamboree Housing completed the successful Park Landing project in Buena Park in During the planning process for the project, state law abolished redevelopment agencies and changed the requirements for former agencies to utilize housing assets. The development plan evolved in order to meet these new requirements, resulting in 140 townhomes developed by City Ventures on approximately 8 acres and a 70-unit affordable rental apartment complex developed by Jamboree Housing on approximately 2 acres of the site. In February 2014, the City Council approved Development Agreement DA to construct the 70-unit affordable housing development including leasing and lobby areas, recreation and open facilities, 5,900 sq. ft. of non-residential flex space, and other site improvements on the 2- acre site. Construction of the development (now known as Clark Commons) was completed in August However, selection of the tenants for the non-residential flex space and build out of the restaurants and community room was completed in July Proposal: The submitted application and plans propose the sale of beer and wine for on-site consumption with outdoor dining and live entertainment in conjunction with a new fast-casual dining and beverage business which recently began operation at 8002 Orangethorpe Avenue, as part of the approximately 5,900 sq. ground floor area of the Jamboree apartment building. The associated approximately 600 sq. ft. barbecue restaurant and approximately 350 sq. ft. beverage outlet are under single ownership and occupy a shared approximately 1,400 sq. ft. interior common dining area adjacent to an approximately 1,100 sq. ft. common outdoor seating area. The approximately 1,000 sq. ft. entry foyer and restroom areas are shared spaces with the approximately 1,600 sq. ft. community room. The barbecue restaurant will serve beer for on-site consumption. The coffee/tea café will serve wine for on-site consumption during evening hours. Service of beer and wine within the outdoor patio area will be only within an enclosed area with entry and exit only from within the building. Hours of operation for the barbecue restaurant are from 11:00 am to 11:00 pm daily including proposed service of beer for on-site consumption. Hours of operation for the beverage café are from 6:00 am to 9:00 pm, with proposed service of wine for on-site consumption between 5:30 pm to 9:00 pm. The project is conditioned so that closing hours of operation for beer and wine AGENDA ITEM NO. 3

9 Planning Commission Staff Report Conditional Use Permit No. CU Page 3 service shall not exceed 11:00 pm daily indoors, and shall not exceed 10:00 pm daily outdoors. There will be approximately 10 employees per shift. The interior and exterior areas allow seating for approximately 119, including common social gathering areas for residents of the development and customers of the business. Parking for the restaurant and beverage establishment was previously included in the calculations for DA14-001, which included this sub-tenant space. DA approved a total of 137 parking spaces throughout the site. Parking for the restaurant/beverage business will include a total of 27 designated parking spaces available to patrons, including 17 on-site parking spaces, 10 parking spaces on Ackerman St (a private street). In addition, an off-site parking agreement is being finalized that will allow use of 53 parking spaces in a parking lot located across the street at 8061 Orangethorpe Avenue, A.C. Industrial Properties LLC, for special events and overflow parking on weekdays after 5:00 pm and on weekends. (See Attachment 6) As described in the attached Business Plan, the operator of the business is proposing to operate as a community center to support local non-profits and schools, including entertainment events for adults and children anticipated focusing on local musicians and DJ s, karaoke, and televised sports. There will also be community activities including art and acting classes, networking, game nights, and charity events with the associated community room. The operations of the community room will be closely managed by the Clark Commons to ensure programming schedules complement peak parking demands of the restaurants. The applicant has also submitted an Entertainment Permit for review and approval by the Community Development and Police Departments pursuant to the Business Plan. Discussion: Section of the Zoning Code requires the applicant to obtain Planning Commission approval for the proposed sale of beer and wine for on-site consumption via the Conditional Use Permit process. Staff reviewed the applicant s plans and visited the property and is of the opinion that the existing building and surrounding site are adequate to support the new fastcasual dining and beverage business with patio dining with the addition of sale of alcoholic beverages for on-site consumption, as conditioned. Staff believes that on-site sale and consumption of alcoholic beverages will be an appropriate amenity in the context of the restaurant and beverage establishments. The proposal to allow interior and exterior patio area consumption of beer and wine will not negatively impact the subject and surrounding properties, as conditioned. In Staff s opinion, the proposed operating hours are appropriate for the new fast-casual dining and beverage business with patio dining which recently began operation and are consistent with other similar approvals in the area. Parking for the eating establishment was previously included in the calculations for DA14-001, which included this sub-tenant space, with a total of 137 throughout the site. Also, upon review of the applicant s request, the Police Department has indicated that they have no objection to the proposed on-site sale and consumption of alcoholic beverages, as conditioned. A Community Meeting was held at the location regarding the proposal on Thursday, August 17. Staff will report to the Planning Commission under separate cover the results of the Community Meeting. PUBLIC HEARING NOTICES: Notice of public hearing was posted at City Hall, the Buena Park Library, and Ehlers Community Recreation Center on August 10, 2017, and 23 notices were mailed to property owners within 300 ft. radius of the subject property on August 10, Additionally, public hearing notices were distributed to the tenants of the Clark Commons (Jamboree) Apartments. FINDINGS OF FACT: a. The proposed on-site ancillary sale and consumption of beer and wine in conjunction with the new fast-casual dining and beverage business with patio dining as well as associated live entertainment is consistent with the City s General Plan and Zoning Ordinance, as conditioned, and will include appropriate operating requirements. b. The site is adequate in size, shape, topography, location, and other factors, to accommodate the on-site sale and consumption of beer and wine in conjunction with the eating and beverage establishment. Based on the required operating conditions, there will be no conflicts or incompatibility created based on the ancillary nature of the proposed associated uses. c. Adequate vehicle access, traffic capacity, and parking are available to serve the food and beverage business with on-site sale and consumption of beer and wine. The use and design will be compatible with adjacent existing and adjacent uses. d. Adequate utilities and public services are available to serve the new fast-casual dining and beverage business including patio dining with on-site sale and consumption of beer and wine with live entertainment. The proposal, as conditioned, will allow uses and intensity consistent with similar establishments in the vicinity. The site is fully developed and meets City standards for public services and utilities to serve the site. e. The proposed on-site ancillary sale and consumption beer and wine in conjunction with the new fast-casual dining and beverage business with patio dining and live entertainment, as conditioned, will be compatible with the site and area character. 12 RESOLUTION NO. CONDITIONAL USE PERMIT NO. CU A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF BUENA PARK APPROVING A REQUEST FOR ISSUANCE OF CONDITIONAL USE PERMIT NO. CU , TO ALLOW THE SALE OF BEER AND WINE FOR ON-SITE CONSUMPTION WITH OUTDOOR DINING AND LIVE ENTERTAINMENT IN CONJUNCTION WITH OPERATION OF A FAST-CASUAL DINING AND BEVERAGE BUSINESS LOCATED AT 8002 ORANGETHORPE AVENUE, SUITES A & B WITHIN THE GMU (GENERAL MIXED USE) ZONE, AND MAKING FINDINGS IN SUPPORT THEREOF A. Recitals (i) Wu Jen Enterprises, Inc., applicant, th Street Buena Park CA, 90621, on behalf of City Yard Housing Partners, L.P., property owner, Cowan Avenue, Suite 200, Irvine, CA 92614, has filed an application for the issuance of Conditional Use Permit No. CU to allow the sale of beer and wine for on-site consumption with outdoor dining and live entertainment at in conjunction with operation of a fast-casual dining and beverage business located at 8002 Orangethorpe Avenue, Suites A & B, Buena Park, California (APN: , , and ) in the County of Orange. Hereinafter in this Resolution, the subject Conditional Use Permit request is referred to as the application. (ii) On August 23, 2017, the Planning Commission conducted a duly noticed public hearing on the application and concluded said hearing prior to the adoption of this Resolution. (iii) All legal prerequisites to the adoption of this Resolution have occurred. B. Resolution. NOW, THEREFORE, it is found, determined and resolved by the Planning Commission of the City of Buena Park as follows: 1. The Commission hereby specifically finds that all the facts set forth in the Recitals, Part A, of this Resolution are true and correct. 2. Based upon substantial evidence presented to the Planning Commission during the above-referenced hearing, including written staff reports, verbal testimony, and development plans stamped RECEIVED JUN PLNG. DIV., this Commission hereby specifically finds as follows: a. The proposed on-site ancillary sale and consumption of beer and wine in conjunction with the new fast-casual dining and beverage business with patio dining as well as associated live entertainment is consistent with the City s General Plan and Zoning Ordinance, as conditioned, and will include appropriate operating requirements.

PLANNING DIVISION: 1. This approval shall allow on-site sale and consumption of beer and wine with outdoor dining and live entertainment in conjunction with operation of a fast-casual dining and beverage facility located at 8002 Orangethorpe Avenue, Suites A & B, as described and shown on attached business, floor, and parking plans and documents stamped RECEIVED JUN PLNG. DIV., except as modified herein. 2. Closing hour of operation for beer and wine service shall not exceed 11:00 pm daily indoors, and shall not exceed 10:00 pm daily outdoors. The outdoor dining areas shall be closed between the hours of 10:00 PM and 7:00 AM. 3. Sale of beer and wine for off-site consumption shall be prohibited. On-site consumption of alcohol purchased off-site shall be prohibited. 4. Quarterly gross sales of beer and wine shall not exceed quarterly gross sales of food. Quarterly records shall be maintained to separately reflect gross sales of food and gross sales of beer and wine and shall be made available to the City of Buena Park upon request. 5. The premises shall be continuously maintained as a bona fide eating and beverage establishment, and shall provide menus containing an assortment of foods and beverages typically offered in such establishments. 6. The owner or designee shall obey all rules, regulations and conditions imposed upon the project through, but not limited to, the Alcoholic Beverage Control (ABC) and relevant State laws. Revocation of, or sale of said ABC license to another person at another location, shall render any City approved CUP for alcohol service at the Page 2

Prior to any sale of the ABC license, the owner or designee shall notify the Community Development Department of the sale. 7. The owner or designee shall be responsible for ensuring that all required employees receive Responsible Alcoholic Beverage Service training as offered through programs established by the Orange County Health Care Agency and Alcoholic Beverage Control of the State of California. Evidence of such training and the training records of all employees shall be maintained on-site during the business hours, and made available for inspection upon request. 8. No live entertainment, including live music bands, performance acts, pool tables, video games, dancing, karaoke or other amusement devices, shall be permitted without first obtaining an Entertainment Permit approved by the Community Development Department and Police Department detailing permissible entertainment types and any requirements for security in accordance with the provisions of Chapter 5.24 of the Buena Park Municipal Code prior to commencing any entertainment on the premises. 9. Amplified music, except for special approved outdoor events, shall not be permitted outdoors, except background music that complements a dining experience. Such amplified music shall be at a level that does not impede normal conversation. 10. Special outdoor events and promotions, which may include outdoor amplified music and entertainment, shall require approval of a Temporary Use Permit. Special event Temporary Use Permits may include events, conditions and operational restrictions different from this Conditional Use Permit. 11. Outdoor areas for alcoholic beverage consumption shall be enclosed with a min. 3.5 ft. high decorative fence. Entry/exit to outdoor areas for alcoholic beverage consumption shall be directly from within the interior of the eating/beverage establishment. 12. The front windows of the fast-casual dining and beverage facility shall remain sufficiently uncovered to allow unobstructed view into the establishment from the exterior, except that mini-blinds or shades may be used during daytime hours for sun shielding. 13. The restaurant/beverage establishment shall maintain a business license as required by the Buena Park City Code. 14. All required new utility services shall be underground. All required utility services and equipment, including transformers, gas meter, J boxes, and similar devices shall be located below grade or shall be screened from view by ornamental masonry walls. The placement and treatment of all screening devices shall be subject to review and approval of the Planning Division. In addition to said walls, landscaping may also be required as a solution for screening. A preliminary electrical equipment plan which is prepared by the Southern California Edison Company shall be reviewed and approved by the City Planning Division prior to the issuance of building permits. The applicant is required to return City approved red line prints to the Southern California Page 3

15 Resolution No. Conditional Use Permit No. CU August 23, 2017 Edison Company Planning Department, for preparation of final construction drawings. The location of other utility companies appurtenances and meters shall be submitted to the City Planning Division for review and approval prior to installation. 15. No roof-mounted mechanical equipment shall be permitted unless such equipment is not visible from adjacent and surrounding properties and streets from height of five (5) feet above ground level. The installation and screening of air conditioning and similar equipment shall comply with existing design criteria and Section of the City Code. 16. The project and/or use authorized by this approval shall at all times comply with all applicable local, state, and federal ordinances, statutes, standards, codes, laws, policies and regulations. There shall be no smoking within 20 ft. of building entrances. 17. This Conditional Use Permit for on-site sale and consumption of beer and wine with outdoor dining and live entertainment shall be in accordance with the operation of the fast-casual dining and beverage business. Any violation of or noncompliance with conditions of approval associated with these businesses shall jeopardize the right to sell beer and wine for on-site consumption approved under this Conditional Use Permit. 18. The use authorized by this Conditional Use Permit shall be started within one (1) year of the expiration of the appeal period. 19. The development shall conform to the plan as finally approved by the City as conditioned herein. Final plans shall incorporate all changes as conditioned herein and shall recognize all easements or deed restrictions pertaining to the subject property. Any appreciable modification shall require the prior approval of the Planning Commission. 20. Prior to commencement of the approved use, these conditions and all improvements shall be completed to the satisfaction of the City. 21. 21 Attachment 4 Restaurant/Community Room Parking Plan The restaurant/community room at Clark Commons will have a total of 80 parking spaces available to patrons. The space allocation is as follows: Parking Onsite: 17 Spaces o This includes 16 standard stalls and 1 accessible space. The 16 standard spaces will be reserved exclusively for use by the restaurant/community room users and patrons at all times. (See exhibit). 4 spaces will have no time limits, 4 spaces will be two hour time limit enforced, 7 spaces will be one hour time limit enforced, and 1 space will be To go - pick up only. Enforced times will be 6am - 10pm, seven days per week. Signs will be posted. Street Parking: 10 Spaces o There are 10 parallel spaces located on Ackerman adjacent to the restaurant community space. These will be available exclusively for use by the restaurant/community space users and patrons for two hour enforced time frames between 9am - 9pm seven days per week. Clark Commons residents will be permitted to park in these spaces with a permit between 9pm - 9am. (See exhibit). Signs will be posted.
