1 Purpose/About the Course The purpose of this course is to provide a working knowledge of conservation easements as a land-use control. It provides guidance on drafting conservation easement agreements to achieve landowner goals for their property. Land Trusts discuss their philosophy of land use protection and what they can offer landowners. This course offers a comprehensive overview of legal, appraisal, base line information, tax incentives, and other inputs needed for a successful conservation easement agreement. Objectives The objective is to provide guidance for attendees in reaching a sustainable agreement for protecting forest land. A framework is offered for analyzing protection goals for reaching a successful agreement in the context of legal constraints and tax incentives. You will learn How easements affect land use The advantages/disadvantages of easements Which agencies and organizations can accept easements Tax aspects of easements How to plan for an easement Who Will Benefit? Landowners with an interest in protecting their forest property from development or other exploitation should attend. Foresters, accountants, attorneys, appraisers, and wildlife resource managers who work with landowners will benefit. Instructors Katherine Eddins Executive Director Georgia-Alabama Land Trust, Inc. Katherine Eddins has served as executive director of our organizations for more than thirteen years. Katherine graduated from the University of Alabama, School of Law with a Juris Doctorate, and subsequently received a master's degree in forestry from Auburn University, graduating summa cum laude. She has been published in the Journal of Forestry and has practiced law and natural resource management. Katherine is the chairman of the advisory committee for Auburn University School of Forestry and Wildlife Sciences, member of the Leadership Council for the Land Trust Alliance, co-chair of the Choccolocco Creek Watershed Alliance, board member for the Longleaf Alliance, and secretary of the board of the Holy Comforter Episcopal Day School. J. Carl Schultz, Jr., MAI Carl Schultz is the Executive Vice President, Valuation & Advisory, Southeast Region for Newmark Knight Frank, formerly Integra Realty Resources - Atlanta/Savannah. Carl has been exclusively engaged in real estate consulting and valuation for over 40 years and was a Partner in Wight, Couch and Schultz, and Vice President of Landauer, a national appraisal and consulting firm. Carl is a graduate of the University of Georgia where he received BBA degree with a major if Real estate. He has attended numerous courses and taught appraisal courses nationally for the American Institute of Real Estate Appraisers, the Society of Real Estate Appraisers, and the Appraisal Institute. He developed the initial National Professional Appraisal Standards course the Appraisal Foundation. Dr. Yanshu Li, F Forest Economics & Taxation Outreach Specialist Warnell School of Forestry and Natural Resources, University of Georgia Dr. Li focuses on federal and state forest taxation, economic issues related to forest investment and management, forest products market analysis and the economic benefits of forests. Among her several degrees are an M.S. in Agricultural Economics from Purdue University, and a Ph.D. in Forest Economics from Auburn University. Timothy Daly Timothy Daly is a native of Atlanta, GA. He has two degrees in Agriculture from the University of Georgia and has been employed with the University of Georgia Extension in Gwinnett County for 12 years. He currently serves as the president of the Georgia Exotic Pest Plant Council, and has served as the secretary and voting delegate for the Georgia Arborist Association.
5 Stephanie Surles Partner, CPA Howard, Moore & McDuffie, Macon GA Stephanie is a graduate of Georgia College and State University and has worked in public accounting since She became a shareholder in Howard, Moore & McDuffie, P.C. in Stephanie s practice focuses on accounting, planning and income tax preparation for individuals, farmers, construction contractors, real estate development entities and small businesses. Stephanie has developed a niche in conservation easements for farmers and land owners. She has established valuable relationships with qualified appraisers, attorneys, and management of land trusts within Georgia. She has also developed expertise in issues related to estate taxes; helping individuals save estate taxes with appropriate planning and assisting executors with estate administration. David Aughtry (B.A., The Citadel, 1975; M., Acctcy. and J.D., University of South Carolina, 1978; LL.M., Taxation, Emory University, 1982). David is the managing partner in the Atlanta Office of Chamberlain, Hrdlicka, White, Williams & Aughtry. His practice focuses upon trial of federal civil tax disputes. David has argued more tax cases than any lawyer in America. In his prior life, he served as a trial attorney and Tax Shelter Coordinator for the Office of Chief Counsel, Internal Revenue Service ( ) where he tried, among other valuation sensitive cases, Brannen v. Commissioner, 78 T.C. 471 (1982), aff d, 722 F.2d 695 (11th Cir. 1984) (valuation of film rights); Bizub v. Commissioner, T.C. Memo (same); Walker v. Commissioner, T.C. Memo (determination of hypothetical development highest and best use for charitable contribution of marsh land) before joining Chamberlain, Hrdlicka. In defending citizens since then, his most significant estate, gift, charitable, and other valuation cases include Commissioner v. Estate of Hubert, 520 U.S. 93 (1997) (no reduction in value of marital or charitable estate tax deduction for Form 1041 administrative expenses); Caracci v. Commissioner, 456 F.3d 444 (5th Cir. 2000) (shifting burden of proof to IRS on valuation in first intermediate sanction case; Daubert rejection of IRS expert; $380 million in deficiencies and penalties rejected for failure of proof); Estate of Lassiter v. Commissioner, T.C. Memo (disclaim 50 percent marital deduction into full marital deduction); Butler v. Commissioner, T.C. Memo (shifting valuation burden to IRS in conservation easement case); Estate of Rogers v. Commissioner, T.C. Memo (special use valuation for timberland); Barnes v. Commissioner, T.C. Memo (enterprise and discount value of closely-held stock based on pattern of actual dividends). David taught tax controversy as an Adjunct Professor at Emory University School of Law ( , , 2003), and served as an instructor for the National Institute for Trial Advocacy, Litigating before the United States Tax Court program ( ). He is a Fellow in the International Society of Barristers and in the American College of Tax Counsel. David served as president of the 2010 and 2011 Southern Federal Tax Institute.
