The subject property is located at nd St. NW and consists of three parcels: North Parcel -- The north parcel (identified in red below) is 50 x 125 (6,250 sq. ft.) and is vacant. It is the intent of the B-1 district to provide for the establishment of commercial and service activities which draw from and serve customers from the entire community or region. The uses and structures within this district shall be designed for effective pedestrian movement. Efforts should be made by both the city and developers to protect the historic character of the downtown area. Draft Findings of Fact: The following draft findings of fact are in support of the rezoning request. 1. The request is to rezone three parcels from R-1, Single and Two Family Residential to B-1, Central Business District. 2. The subject property is described as: The subject property is located at nd St. NW and described as 1) Lot 1 Block 13 of Park Division to the Town Of Crosby (PIN ) 2) Lot 2 Block 13 of Park Division to the Town Of Crosby (PIN ) and 3) Lots 1 and 2 and w ly 4.55 ft of lot 3 of Block 18 of Park Division to the Town Of Crosby (PIN Z009). 15 3. The north parcel (PIN Z009) is 50 x 125 (6,250 sq. ft.) and is vacant. It is adjacent to property zoned R-1, Single and Two Family Residential (north/south/east/west). 4. The south parcels (PINs & ) consist of a 20 x 125 (2,500 sq. ft.) parcel and a 25 x 125 (3,125 sq. ft.) parcel. They contain an approximately 3,300 sq. ft. principal structure. The parcels are adjacent to property zoned R-1, Single and Two Family Residential (north/east) and B-1, Central Business District (west/south). 5. The subject properties meet the minimum lot size and width requirements of the B-1, Central Business District. 6. The subject property is adjacent to the public sewer and water systems. 7. The subject properties are suitable for development in general conformance with the land use standards of the B-1, Central Business District. 8. The request is in conformance with several goals and action items contained in the Comprehensive Plan: a. Capitalize on opportunities provided by being located on the Highway 6/210 corridors, including the large volume of traffic passing by daily, to bring new dollars into the community. (pg. 30) b. Work to promote and grow existing businesses on the Highway 6/210 corridor & downtown areas. (pg. 31) c. Leverage highway transportation network to grow existing businesses and attract new businesses. (pg. 31) d. Attract new businesses and support existing businesses, which provide employment opportunities. (pg. 38) 9. The future land use map identifies the properties as Commercial. The request to rezone the property to B-1, Central Business District is consistent with the comprehensive plan/future land use map. 10. The reclassification will not be detrimental to uses or property in the immediate vicinity of the subject property. 11. The reclassification will not be detrimental to the health, safety and general welfare of the public. Planning Commission Direction: The Planning Commission may recommend approval denial of the application. The application may also be tabled if additional information is needed to make a decision. If the motion is for approval or denial, findings of fact should be cited. Staff Recommendation: The subject properties meet the minimum requirements of the proposed zoning district. The property is adjacent to other property zoned B-1 and the request is consistent with the comprehensive plan. Staff recommend the application be approved without conditions. 21 ORDINANCE NO., AN ORDINANCE AMENDING CHAPTER 13 OF THE CITY CODE REGARDING COMMERCIAL RECREATIONAL USES IN THE RECREATIONAL ZONE CITY OF CROSBY COUNTY OF CROW WING STATE OF MINNESOTA The City Council of the City of Crosby does ordain as follows: Purpose and Intent: The purpose of this ordinance amendment is to amend Chapter 13 of the Crosby City Code to allow Commercial Recreational Uses with a conditional use permit in the Recreational Zone. Amendment: Chapter 13, Section 5, Definitions and Section 17, Lot standards chart. 5 Definitions. The following words, terms and phrases, when used in this chapter, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning: Tourist/Visitor & Recreation Service: Businesses primarily engaged in providing food, lodging, recreation and other leisure time activities for tourists and visitors, as well as local residents. 18 Land use categories chart. Amendment: Chapter 13, Section 5, Definitions and Section 17, Lot standards chart. 5 Definitions. 27 MINUTES CROSBY PLANNING COMMISSION/BOARD OF ADJUSTMENT REGULAR MEETING December 18, CALL TO ORDER The meeting was called to order by Mr. Burslie (no chairperson present) at 6:00 PM. 2. ROLL CALL PRESENT: NaDeen Rider, Jon Hunter, Chris Ryan, Joanna Lattery, and Ronald Martin (alternate) Council: Robyn Wolfe Staff: Scott Sadusky, Building Inspector and Justin Burslie, Zoning Administrator (NJPA) COMMISSIONER RIDER NOMINATED COMMISSIONER RYAN AS TEMPORARY CHAIRPERSON. NO OTHER NOMINATIONS. ALL VOTED IN FAVOR. 3. PUBLIC HEARINGS a. Rezoning Application to rezone a 40.1 ac tract from "Light Industrial" to "Recreational. The subject property is located at Co Rd 31 and described as: NE1/4 OF SE1/4 SEC 1 TWP 46 RGE 29. Property Owner: Glen Kompelien. Applicant: Vern Lewis. Burslie reviewed the staff report. Chair Ryan opened the public hearing. Jerome Anderson, Crosby, MN- questioned whether or not the property is adequate for a private sewage treatment system since they can t be placed in/on tailings piles. Mr. Lewis stated a site evaluation has been conducted and there is sufficient suitable area. Josh Shippler- stated he owns 37 acres on the south side of the subject property. Requested that if the property is developed with a mountain biking-related use the owner put measures in place that do not allow guests to enter adjacent private property. Chair Ryan closed the public hearing. Commissioner Hunter asked about potential future uses allowed. Burslie review the land use matrix. 28 Mr. Lewis stated he does not intent to develop immediately but he would like it rezoned so it is ready to be developed when the time comes. MOTION BY COMMISSIONER HUNTER, SECONDED BY COMMISSIONER RYAN TO RECOMMEND APPROVAL OF REZONING APPLICATION BASED ON THE FOLLOWING FINDINGS OF FACT AND NO CONDITIONS OF APPROVAL: 1. THE REQUEST IS TO REZONE A 40.1 ACRE TRACT FROM LIGHT INDUSTRIAL TO RECREATIONAL. 2. THE SUBJECT PROPERTY IS LOCATED AT CO RD 31 AND DESCRIBED AS: NE1/4 OF SE1/4 SEC 1 TWP 46 RGE 29 (PIN A0X009). 3. Tattoo business in CBD, Discussion- Ms. Rasinski was present to discuss the possibility of starting a tattoo/body piercing studio in the B-1 Zone. The use is not currently allowed by ordinance. Ms. Rasinski review the purpose/intent of the B-1 Zone and provided handouts. The proposed business will be located at 5 2 nd Ave SW. Chair Ryan asked about State Regulations. Ms. Rasinksi stated that permits are required through the state which includes multiple inspections of the facility. Mr. Sadusky confirmed the use is regulated by the State of Minnesota. MOTION BY COMMISSIONER RYAN, SECONDED BY COMMISSIONER MARTIN TO INITIATE AN ORDINANCE AMENDMENT TO ALLOW TATTOO STUDIOS AS A PERMITTED USE IN THE COMMERCIAL ZONES. PASSED UNANIMOUSLY. b. Minimum Dwelling Width, Discussion- Burslie reviewed the item. Stated the ordinance is not clear as to whether or not there is a minimum building width for permanent dwellings. Manufactured dwellings do have a minimum width requirement. Commissioner Lattery stated the minimum width requirement was implemented to prevent single wide mobile homes. Commissioner Ryan stated smaller homes should be able to be constructed on small lots. Mr. Sadusky stated most cities do have minimum dwelling width requirements. Homes need to be large enough to furnaces, air exchangers, mechanical equipment, etc. as well as storage for other equipment. MINUTES 3 Crosby Planning Commission December 18, 2017

30 Commissioner Hunted stated the city should be encouraging the rehabilitation of old homes rather than building new ones. MOTION BY COMMISSIONER MARTIN, SECONDED BY COMMISSIONER RYAN TO LEAVE ORDINANCE AS IS AND NOT REQUIRE A MINIMUM DWELLING WIDTH REQUIREMENT FOR PERMANENT HOMES. MOTION CARRIED 4-1 (HUNTER OPPOSED). c. Hostel Business in CBD, Discussion- Burslie stated they are currently not included in the ordinance. Could fit the definition of a hotel. Mr. Sadusky stated they regulated the same a hotels by the building code. New ones will not proper sprinkling. Commissioner Rider questioned potential parking issues. Councilor Wolfe stated they would be a great option for the downtown. Stated the parking situation is horrible but allowing them would promote good business for the city. They would bring more people to the city. Commissioner Rider suggested they be allowed as a conditional use. Commissioner Martin stated the city would be able to review the plans in detail with the CUP. Commissioner Hunter stated he would like to see it as a permitted use. Councilor Wolfe stated potential hostel business owners may be more likely to locate their business in Crosby if there are fewer permitting barriers. Chair Ryan called for a straw poll- All commissioners voted to allow the use a permitted. MOTION BY COMMISSIONER RYAN TO INITIATE AN ORDINANCE AMENDMENT TO ALLOW HOSTELS AS A PERMITTED USE IN THE COMMERCIAL ZONES, SECONDED BY COMMISSIONER RIDER, PASSED UNANIMOUSLY. d. Bike Rental/Touring Business, Discussion- Mr. Burslie stated the owners of True North Basecamp would like to offer bike rental and touring at their location in the Recreational Zone. Stated it is a commercial use that is not currently allowed. Commissioner Hunter stated he would like to see commercial uses in the B-1. Commissioner Ryan stated it would be a good location with the proximity to the trails. Commissioner Lattery stated she doesn t believe with the type of business in the Recreational Zone. 31 Commissioner Ryan suggested operating the rental portion of the business in a downtowns storefront. General consensus to leave ordinance as is. e.
