3 3 Cape Cod & Islands Multiple Listing Service, Inc. Guidelines for Broker Reciprocity Sharing Listings Online 1. What is Broker Reciprocity - Sharing Listings Online? Broker Reciprocity - Sharing Listings Online (referred to as BR from this point on) is the Cape Cod & Islands Multiple Listing Service, Inc. s (CC&IMLS) Internet Listing Data Exchange Program. The CC&IMLS is required by the National Association of REALTORS mandate (see Addendum A ) to make available to all CC&IMLS Participants all the current active listing data for the purpose of display on the Brokers /Companies or Agents real estate websites. This will allow Companies and their Agents/Associates to gather listing data from the CC&I Multiple Listing Service and place it on their individual websites in order to assist clients/consumers in searching for Real Estate on the Internet. This will be a great marketing tool for our Participants, and will provide easy access for the general public to search a large database of Cape Cod & Islands MLS Real Estate listings. There are two possible options a Participant may use to enhance their websites so that a consumer may view CC&IMLS listings: the Public Access Website, which provides information to all consumers with no registration requirements, and the Virtual Office Website (VOW), which requires consumers to sign into system to gain information. A.) B.) Public Access Website: The public does not need to register to obtain data from these sites. Website owners, or their webmasters, are responsible for the design, data update, and maintenance of these sites and must comply with the attached CC&IMLS guidelines. Any listing that is displayed must include sufficient information referencing the listing company so that the consumer can clearly identify the listing company. Virtual Office Website (VOW): Using the same process that is used when a consumer enters a REALTOR s office, once the consumer registers or pre-qualifies themselves with a REALTOR they are given access via a password onto that REALTOR s website. The consumer can then view any and all listings that REALTOR makes available via the MLS he/she is a member of. The listing company s name may or may not be made available and all inquiries are directed to the REALTOR who is making the information available to the registered consumer. Virtual Office Websites can be provided by CC&IMLS registered 3 rd party vendors or by individual company s webmasters, and who may also provide a number of additional services to the Company/Agent, such as a contact database and automatic s to consumers. The attached guidelines DO NOT APPLY to Virtual Office Websites. This document will provide the guidelines necessary for implementation of the Public Access Websites by our members. The guidelines set forth in this document are a culmination of many months of research, discussion, and interpretation of the NAR guidelines, by the Broker Reciprocity Committee, an entity of the MLS task force, and have been adopted by the Cape Cod & Islands Multiple Listing Service, Inc. s Board of Directors.

4 4 2. Who gets Broker Reciprocity A. Who Qualifies? a. Only Participants of the CC&IMLS who are actively listing and/or selling Real Estate. b. Member must hold a valid Real Estate Brokerage license (DR), or be a member of a firm (Agent/Associate) with a current Real Estate Brokerage license. c. CC&IMLS Members (DR s) will be responsible for the compliance and monitoring of their personal websites and their firm s Agent/Associate personal websites to the guidelines for BR set forth by the CC&IMLS. d. Members will not be required to carry a listing inventory to be included. B. Who is included and how is this accomplished? a. Every participant of the CC&IMLS will be automatically included in this program. This means that their listings will automatically be available to all other Participants for inclusion on their websites. b. Participants will not have the ability to determine which CC&IMLS Participants can, or cannot, view their listings, exclusion from this system is Member wide and is a blanket authorization. c. For any Participant (DR) who wishes to have their complete listing inventory excluded from this system, they must choose to Opt-out. Members who are Opting-out their complete listing inventory, may NOT include any BR listings, only their own company s listings, on their own websites. 1. To Opt-out the member (DR) must deliver a signed written notice to Henry J. DiGiacomo, CEO, at the Cape Cod & Islands Multiple Listing Service Inc. s office at 22 Mid-Tech Drive, West Yarmouth, MA Also, the member must indicate NO in the Broker Reciprocity field on the Advertising Page when each listing is entered in the Multiple Listing Service system. 3. Virtual Office Websites and inclusion in Realtor.com are excluded from the Opting-out rule, this means that a Participant may choose to have their listings omitted from Public Access websites, however the listing will still be included in the Virtual Office Websites databases and on Realtor.com, therefore their listings will still be viewable on the Internet. 4. The Member is not required to obtain the Seller s initials in the Opting-Out clause contained in the CC&IMLS Listing Contract, nor are they required to discuss this option with the Seller. d. For any Seller who wishes to have their own property listing excluded from the Broker Reciprocity database, they must choose to Opt-out for that specific listing. Members who are Opting-out a single listing only may include any or all BR listings on their website. 1. Opt-out by obtaining the Broker Reciprocity Addendum to Listing Agreement (Opt-out) Form, located on the website and obtain signature from your Seller. Sellers signature will indicate that they have been informed by their agent on the terms of the Opting-out rule. 2. Fax copy of the Broker Reciprocity Addendum to Listing Agreement (Opt-out) to CC&IMLS with listing contract for verification purposes using the fax attached documents function in the CC&IMLS system. 3. Also the Participant must indicate NO in the Publish to Internet (Broker Reciprocity) field on the Advertising Page when listing the property in the CC&IMLS. 4. Virtual Office Websites, Realtor.com and Home Advisor are excluded from the Opting-out rule, which means that a member may choose to have their listings

5 5 omitted from Public Access Sites, however the listing will still be included in Virtual Office Websites databases, on Realtor.com and Home Advisor, therefore their listings will still be viewable on the Internet. e. Any Participant (DR) found to have an inordinate amount of singly opted-out listings will have their listing inventory reviewed by the BR Coordinator. The BR Committee will then review the results found by the BR Coordinator, and said member (DR) will risk the possibility of being asked to remove the CC&IMLS inventory from their website, if it is determined they have been using the Opting-out rule incorrectly. f. Any Participants choosing to Opt-out for BR, will however still have the ability to continue their Realtor.com display of that listing. The Realtor.com function is a separate system in MLS and is governed by the field Publish to Realtor.com on the Advertising Page when entering a listing. g. The purpose of the BR system is for the viewing of real estate listings by a bona fide consumer/client. Participants may not provide any BR information to any outside 3 rd party or non-consumer entities for any purpose whatsoever. Compliance on this issue is mandatory and finable for non-compliance. 3. How will we get Broker Reciprocity - Sharing Listings Online? A. What Options are available to our members? There are a number of options available for CC&IMLS Participants to incorporate BR listings into their personal websites (see Addendum B for detailed options). Some options will require Participants to work with their own Webmaster(s), some options will be available through our current CC&IMLS vendor (Rapattoni MLS) or other companies, and yet others will be made available directly to the Participant. We have options that will require the Agent to have technical knowledge and others will not require any. Some will provide Customer Support, while others will not. We have options involving annual costs to the vendor associated with them, others will require the services and costs associated with your own Webmaster, while some options that will have no cost except for your own time and effort. Members will want to choose their options based on their skill level, affordability, and availability of time and effort they will have to initiate and monitor the system. Participants will want to review and choose their options carefully as there are serious responsibilities that accompany this program and, by participating in this program, the Company/Agent accepts and agrees to those responsibilities. 4. If I choose to subscribe to a vendor-produced system (Virtual Office Websites), what will I have to do to begin and use the program? A. Will I need to make changes to my personal website? a. You will most likely have to make some changes to your personal website, but they will not be significant in choosing this option. You should review your website with your Webmaster and the Virtual Office Websites vendor. b. No restrictions will be placed on Participant s personal websites in regards to Banner Advertisements from 3rd party vendors, advertisers, etc. c. Virtual Office Websites vendors must be registered with the Cape Cod & Islands Multiple Listing Service, Inc. d. Participant and/or their Agents/Associates will need to register with the CC&IMLS prior to activation of a website with the Virtual Office Website. Registrant should use the Broker Reciprocity Agent Registration form - Addendum E.

6 6 5. If I do NOT choose to subscribe to a vendor produced system (Virtual Office Websites), what will I have to do to begin and use the program? A. Will I need to make changes to my personal website? 1. Most likely you will have to make a few changes to your personal website. Depending on which option you choose, some functionality of the site may have to be added. You may need to add a database, search engines, and page formats for listing sheets, or you might simply want to establish frame set from your Company s site who will provide you with the program. You should review your website and this document with your Webmaster and DR if you are unsure. 2. In order to keep listings current, the BR database requires that the data on the personal website must be updated a minimum of every 7 days. 3. Additional changes you may choose to include might be modifications of home pages, adding disclaimers, display formats for search results and listing sheets. 4. For detailed instructions on requirements of your personal website for the BR program see Addendum C. 5. No restrictions will be placed on Participant s personal websites in regards to Banner Advertisements for 3rd party vendors. 6. No restrictions will be placed on Participant s personal websites in regards to 3 rd party websites linking into the real estate member s personal site. B. What will the Consumer be able to view? Only Active listings will be included in the BR system. Once the listing becomes Pending in the CC&IMLS system it will be purged from the BR system. 1. BR will consist of all Exclusive Right to Sell and Exclusive Agency listings that have been included in the CC&IMLS system. 2. Any Listing displayed in the BR system must be identified as such with the CC&IMLS BR logo (provided) as specified in this document in Addendum C. The only exception would be if the listing belongs to the website owner, it may then be identified with the listing agents logo. 3. The consumer/client will be able to search the BR database based on certain parameters. They will then see a search result listing of properties available through the BR system with limited information about each property. They will then be able to view additional information on each property going to (clicking on) a full listing sheet (option). 4. CC&IMLS Participants may Co-Mingle or mix listings from different MLS s on the search result page as long as the CC&IMLS listings are clearly identified in compliance with the BR guidelines. 5. CC&IMLS Participants may NOT Co-Mingle or mix their office, pocket, or open listings with those listings included in the BR system. 6. CC&IMLS Participants may choose to display a subset of the BR system, based on their own target market parameters, rather than displaying the entire CC&IMLS database, again provided that the appropriate disclosures accompany the search results. For example: a member may choose to display only new construction homes, only commercial listings, only condo listings, only waterfront properties, or only properties in certain towns or villages, etc. 7. Participants will NOT be allowed in any way to alter, change, or omit any required or available data pertaining to any listings in the BR system with the exception of their own listings.

7 7 8. Participants may choose the order in which to display the search results to the consumer/ client. For Example: a Participant may choose to design their search results in a way that displays listings by price order, or by village, or perhaps to display their own firm s listings first. 9. Participants search results systems may only display a maximum of 25 listings per search results page, and a maximum of 200 listings per search effort. This is a safety measure (to prevent unauthorized scraping) and one designed to protect our system from 3 rd parties attempting to extract data illegally. Compliance on this issue is mandatory and finable for non-compliance. C. How will CC&IMLS be managing this system? CC&IMLS Members/Participants are not required to participate in the BR program, however, if the Participant chooses to include this system onto their own website, all rules and regulations as illustrated in this document will apply. As the NAR requires the CC&IMLS and its Participant s personal websites to comply with their mandated guidelines and those adopted by the Cape Cod & Islands Multiple Listing Service, Inc., there will be fines and/or penalties for non-compliance. The Cape Cod & Islands MLS will provide only the basic technical assistance for integrating BR onto Participants personal websites. Only the Principal (DR), or the person designated by the DR to administer their Company s or Agents website should contact: CC&IMLS Webmaster/Information Technology Administrator at Webmaster@cciaor.com For Questions and Information on registration, or the CC&IMLS BR guidelines you may contact the Broker Reciprocity Coordinator at BR@cciaor.com. 1. Participants websites will be self-policed, as well as reviewed by the Broker Reciprocity Coordinator, which means that any CC&IMLS Members finding other Member s websites with violations of the above set forth rules and regulations are asked to report these issues to the Broker Reciprocity Coordinator at (508) or via at br@cciaor.com. Participating BR websites and their associated agents websites will be reviewed by the Broker Reciprocity Coordinator periodically 2. It is to the benefit of all CC&IMLS Participants to report such indiscretions in order to protect the credibility of the entire CC&IMLS system. 3. Fines will be assessed only after notification has been given by certified mail to the Participating Member (DR) and the BR participant, and the issue has remained unresolved after a reasonable period of time. In severe compliance issues, the issue may be referred to a disciplinary committee. 4. As all CC&IMLS Participants (DR s) are required to supervise their own Agents/Associates websites, all fines and any disciplinary action or issues will be addressed directly to the CC&IMLS Participant (DR). 5. 8 8 ADDENDUM A NAR Mandate Updated July 2001 Associations of REALTORS and their Multiple Listing Services are encouraged to immediately, and must by January 1, 2002, enable MLS Participants to display on Participants' public websites aggregated MLS active listing information subject to the requirements of state law and regulation. To comply with this requirement MLS s must, if requested by a Participant, promptly provide basic "downloading" of current listing information. Associations and MLS s can also offer alternative display options including framing of Board, MLS, or other publicly-accessible sites displaying Participants' listings (with permission of the framed site). For purposes of this policy, "downloading" means electronic transmission of data from MLS servers to Participants' servers. This policy does not require associations or MLS s to establish publicly accessible sites displaying Participants' listings. Unless state law requires prior written consent from listing brokers, listing brokers' consent for such display may be presumed unless a listing broker affirmatively notifies the MLS that the listing broker refuses to permit display (either on a blanket or on a listing-by-listing basis). If a Participant refuses on a blanket basis to permit the display of that Participant's listings, then that Participant may not download or frame the aggregated MLS data of other Participants. Access to MLS databases of current listing information, or any part of such databases, may not be provided to any person or entity not expressly authorized such access under the MLS rules.

9 ADDENDUM B 9 Options available for populating websites with CC&IMLS listings Participants may use as many of these options as they wish. BR Options All participants must register with CC&IMLS to display Broker Reciprocity on their personal or office websites. CSV SOLUTIONS 1. All Members have the option of downloading the listing information they wish to use onto their websites by using the CSV function in the InternetMLS system. This will allow member participants to download the chosen fields into an Excel format on your hardrive, then by exporting your data from Excel into your website database, you can populate your website. You will also need to take a second step in order to download the CC&IMLS listing photos through the photo export function. The CC&IMLS does not recommend this option as a viable solution to Broker Reciprocity. 2. This option requires a certain amount of technological know-how. 3. This option is labor intensive for the CC&IMLS Participant to maintain since Rapattoni MLS only allows a download of 500 records at a time and that data will need to be updated a minimum of every 7 days. Also those selecting this option must personally make sure to eliminate any listings by Companies or Agents who have chosen to opt-out and must comply with the stated Rules and Regulations. An opt-out field has been added into the current MLS system for the purpose of identifying these opted-out listings. 4. Costs associated with this option are Webmaster related and their continued labor costs used to maintain the website. 5. Neither the CC&IMLS nor Rapattoni MLS will provide any technical support for this function. 6. All CSV Exports must be initiated and executed by a registered Cape Cod & Islands Multiple Listings Service Participant with a valid user log in and password. This activity is a manual process which must be performed by a human being. Any automated process performed by a machine is strictly prohibited. Non-Participant involvement is strictly forbidden. Under no circumstances may any non-member request any CC&IMLS Participant to disclose his/her user name and/or password. AGENT SOLUTIONS (Recommended by CC&IMLS) 1. Agent users should link to, or frame a searchable view of their Company or Office website. 2. This will allow the Agent s website to access the same interface system that the Company/Office is using on their website. The consumer will see either a link, or separate frame within the Company s website. This will allow the same functions as the Company website uses. 3. This option requires a Webmaster or the Agent themselves to set up the initial link, or map the frameable pages, and from that point forward, very little skill and basically no labor is needed to maintain the Agents website listings. 4. An annual cost for this option will be determined by the individual Company or Office, and all Agents MUST have the permission of their DR to use this method. 5. Any technical support necessary will be the sole responsibility of the Agent. MLS VENDOR SUPPORTED SOLUTIONS participants must register with CC&IMLS to receive. SOLUTION 1 DIRECT DOWNLOAD FROM FTP SITE

10 10 1. Enables CC&IMLS participants and/or designated Vendors to receive data from the CC&IMLS system in ASCII (data) and JPG (photos) format so that the CC&IMLS data can be incorporated into the CC&IMLS Members Websites for BR purposes. 2. Data may be downloaded to participants site daily or as needed. 3. The site that the data is being downloaded to must be a secure site requiring a user name and password to access. 4. Participants must register with the Broker Reciprocity Coordinator and complete the 2 page Registration Information and Signature Form. (Addendum E) 5. Participants must have their webmaster/consultant, and/or 3 rd party Vendor complete the required documents. (Addendum F & G) 6. All 3 rd Party Vendors, will be charged a $1,000 fee for data access. The fee must be paid at registration. Participants directly accessing the Direct Download solution for purpose of supporting their own in house produced Broker Reciprocity or VOW website will be considered to be their own 3 rd Party Vendor, and said fee will apply. 7. Participant must follow the registration procedures, providing the Broker Reciprocity Coordinator with the correct information to ensure a smooth operation. (Addendum H) 8. Participants must keep the Broker Reciprocity Coordinator advised of any changes to data reception site. SOLUTION 2 SMART FRAME 1. Rapattoni has an Office or Agent Smart Frame solution enabling CC&IMLS Participants and their associated agents to use as a link on their websites to allow consumers to search the CC&IMLS. Enables CC&IMLS participants and their associated agents to Frame the CC&IMLS Public Database. 2. Data on CC&IMLS smart frame site will be updated daily. 3. Participants are asked to make sure that their webmaster/consultant, and/or 3 rd party Vendor complete the required documents for registration or have previously registered and are listed on the Approved Webmaster/Consultant or 3 rd Party Vendor lists. (Addenda F & G) 4. Participant must follow the registration procedures, providing the Broker Reciprocity Coordinator with the correct information to ensure a smooth operation. (Addendum H) 5. Participants must keep the Broker Reciprocity Coordinator advised of any changes to data reception site. SMART FRAME OPT- IN/OPT-OUT 1. In order for any Participant or their associated agents to access the Smart Frame link, the Participant must be Opted-In for Broker Reciprocity. (Follow registration and activation process noted on Addendum H) PARTICIPANT RESPONSIBILITIES 1. Opting In is not assumed in the Smart Frame function, Participants must complete the Designated Realtor Opt In/Out IDX Registration Form (Addendum H) and fax to the Broker Reciprocity (BR) Coordinator. 2. If an office wishes to Opt out of IDX completely, they will complete this form and select the Opt Out choice, this will alert the BR Coordinator not to activate the Smart Frame function. 3. Once Registration is received, BR Coordinator will activate link function for the Participant. 4. Once link function is activated for Participant, they may activate the function for their associated agents who wish to use the link on their websites. 5. Participant is responsible for providing IDX access to their associated agents through the Admin module in the Manage Member IDX Access function. Participant should review

11 11 associated agents website for Broker Reciprocity Guideline compliance before providing their agent with access to the Smart Frame link. 6. As all CC&IMLS Participants (DR s) are required to supervise their own Agents/Associates websites, all fines and any disciplinary action or issues will be addressed directly to the CC&IMLS Participant (DR). 7. A complete procedure and explanation for this process is located in this document in Addendum PARTICIPANT SOLUTION 1. Smart Frame solution for the Participant includes links found in the Admin module of the CC&IMLS system and provides a URL linking address that the Participant may copy then either add to their office website or provide to their Webmaster. 2. Smart Frame links for the following are provided for the Participant s use on their Office Website: See Our Listings See Our Open Houses See Our Company Listings See Our Company Open Houses See Our Office Information Hyperlink for IDX Framed Solution ASSOCIATED AGENT SOLUTION 1. Smart Frame solution for the Associated Agent once activated by the Participant includes links found in the Admin module of the CC&IMLS system and provides a URL linking address that the Agent may copy then either add to their personal website or provide to their Webmaster. 2. Smart Frame links for the following are provided for the Agent s use on their Personal Website: See My Listings See Agent Information Hyperlink for IDX Framed Solution Virtual Office Websites or NON-BR Options VIRTUAL OFFICE WEBSITES (VOW) OR PRIVATELY ACCESSED WEBSITES Many third party vendors and individual Webmasters have or will provide systems that will allow you to populate websites with CC&IMLS listings other than the Agents /Companys own. Before contracting with a third party vendor for this service, you should check with the CC&IMLS to verify that this vendor has been registered by the CC&IMLS to offer this service. NO Agent or Company is permitted to give out their user name and password to these companies or to anyone else for any reason. (See Fines and Penalties Addendum D for further details). Any registered or non-registered company requesting this information should be immediately referred to the CC&MLS. Virtual Office Websites are available in many levels. Each vendor should be investigated by the Member to determine which service will best suit their wants and needs. Programs may be as involved as allowing the user the download the data in a ASC11 and JPEG format from a FTP server, to then import into their website, (requires assistance through a webmaster, or skilled user). Or it can be as simple as using an enhanced product that not only provides a searchable MLS database, but also provides the member with a contact database that will automatically send s to the client for new properties, and these products will require a minimal amount of skill, and provide technical support services for the member. The cost of these products varies, and all options should be investigated by the CC&IMLS participant before contracting these vendors or Webmaster s services. An updated list of registered

12 12 vendors will be provided on the CC&IMLS website in the Members Only page in the Broker Reciprocity section.

13 ADDENDUM C 13 Website Design Rules & Regulations for CC&IMLS BR Compliance Publicly Accessed Websites: Homepage: 1. Websites must include: Listing Company name regardless of whether the site is a Company s website or an Agent s website. 2. Search functions must provide a separate CC&IMLS search to prevent the co-mingling non- CC&IMLS listings with CC&IMLS BR listings. 3. Agent s websites must identify their parent Company name on their homepage in a style and font size consistent with the majority of information displayed on the page. Search Page: 1. Search functions must provide for a separate CC&IMLS search to prevent the co-mingling of non- CC&IMLS listings with CC&IMLS BR listings. There will be no restriction placed on comingling multiple MLS organizations listings as long as CC&IMLS listings are clearly identified as such. 2. At the bottom of the search page the following disclaimer, or the full disclosure must be displayed in a style and font size consistent with the majority of text on the page: (logo to be provided) The data relating to real estate for sale on this site comes from the Broker Reciprocity (BR) of the Cape Cod & Islands Multiple Listing Service, Inc. Summary or thumbnail real estate listings held by brokerage firms other than [your firm s name] are marked with the BR Logo and detailed information about them includes the name of the listing broker. Neither the listing broker nor {Your Firm s Name} shall be responsible for any typographical errors, misinformation, or misprints and shall be held totally harmless. 3. The search page must display in a style and font size consistent with the majority of text on the page either the following disclosure or the full disclosure. The date field in this disclaimer must be updated each time the database has been updated. This site was last updated [Mo./Day/Year]. All properties are subject to prior sale, changes, or withdrawal. 4. If you choose not to include the entire CC&IMLS database on the website you will need to display at the bottom of the search page the following disclaimer in a style and font size consistent with the majority of text on the page. [Your Firm s Name] has chosen to display only certain towns and/or types or styles of properties. This site may not show all listings that are available through the Cape Cod & Islands Multiple Listing Service, Inc. Search Results Page: 1. Search Results may be displayed in any order. 2. BR database must be updated a minimum of every 7 days to keep data current. Those member participants who are using Data Download or Data Extract options solutions need to be especially compliant with this requirement.

14 14 3. All BR listings are required to include the CC&IMLS BR logo displayed prominently on the same line of the search result information for that listing. 4. Participants may choose to identify their own listings only with their company logo or Company name replacing the BR logo. 5.
