IN THE COUNCIL ROOM AT ROBINSON CITY HALL, 111 WEST LYNDALE, ROBINSON, TEXAS TO CONSIDER AND ACT ON THE ITEMS ON THE FOLLOWING AGENDA. 1. Call to order 2. Invocation. 3. Roll Call. 4. 6 MINUTES OF CITY COUNCIL MEETING AUGUST 1, Call to order. Meeting was called to order at 6:00 P.M. by Mayor Bert Echterling. 2. Invocation. Jimmy Rogers provided the Invocation. 3. Roll Call. Councilmembers present: Jimmy Rogers, Jeremy Stivener, Vernon Leuschner, Bert Echterling, Jim Mastergeorge, Steve Janics, and Steven Tindell. 4. Approve Minutes from: July 11, 2017 Meeting: Councilmember Jeremy Stivener motioned to approve the minutes from the July 11, 2017 meeting as written. Councilmember Jimmy Rogers seconded this motion. Voting in favor; Rogers, Stivener, Leuschner, Mastergeorge, Janics, Tindell, and Echterling. There were no opposing votes and motion carried unanimously. 5. Citizen Comments. Sue Loth, 459 Pompano Park, Robinson, Texas 76706, spoke regarding the status of the former Youngblood Church property now owned by the City. 6. PUBLIC HEARING: Conduct a public hearing, consider and take possible action on Ordinance regarding a zoning change from R-1 to SF-3 for 15.7 acres out of the Carlos O Campo Tract C3, located at the end of W. Karnes St. and behind Dogwood St. in Robinson, Texas. Mayor Bert Echterling stated this Public Hearing was a continuation from the July 11, 2017 City Council Meeting. Mayor Echterling said the citizens who spoke at the July 11 th meeting would not be allowed to speak again tonight. Nancy Barron, 809 Dogwood, Robinson, Texas 76706; Brandy Swank, 709 W Karnes Drive, Robinson, Texas 76706; Nancy Armes, 802 Dogwood, Robinson, Texas 76706; Mary Felkner, 710 W Karnes, Robinson, Texas 76706; Richard Wood, 800 Dogwood, Robinson, Texas 76706; Janille Ritchie, 718 Dogwood, Robinson, Texas 76706; Alice Daws, 810 Dogwood, Robinson, Texas 76706; Marcelino Medina, 803 Dayton, Robinson, Texas 76706; and Janie Wood, 906 Dogwood, Robinson, Texas 76706, all spoke in opposition of the zoning change voicing concerns regarding drainage, flooding problems, sewage concerns, traffic, existing infrastructure, smaller lot sizes, and a higher concentration of homes in a small area. After no further discussion, the Public Hearing was closed at 6:27 PM. City Manager Craig Lemin reminded Council the Planning and Zoning Commission recommended approval at the June 20, 2017 meeting by a vote of 5-0. Mr. Lemin stated the proposed zoning change is compatible with the Comprehensive Master Land Use Plan for the City of Robinson and the proposed zoning change is in keeping with adjacent land uses, but does create smaller lots than the surrounding properties. Mr. Lemin stated the owners of surrounding property opposing the zoning change make up over 20% of the ownership of the surrounding property; therefore, a supermajority vote of the council will be required to approve the zoning change. Councilmember Jimmy Rogers felt the existing issues needed to be addressed before allowing more homes in this area. Councilmember Jeremy Stivener addressed the existing issues as well, and stated the citizen concerns needed to be taken into consideration because we as the Council represent them. Councilmember Vernon Leuschner asked for City Council Meeting Minutes August 1, 2017 Page 1 of 5

7 clarification of a previous zoning change that was denied for this same property. Mr. Lemin stated that zoning change would have allowed for multi-family dwellings. Councilmember Leuschner also stated this area was not conducive for smaller lot sizes, had concerns regarding the drainage as well, and asked who does the responsibility lie with along the creek. City Manager Craig Lemin stated unless an easement is granted, the creek belongs to the property owner. Mayor Pro Tem Jim Mastergeorge stated this was such a confined area, and felt the existing issues need to be addressed. Councilmember Steve Janics did not want to compound the issues by adding more homes to this area. Councilmember Steven Tindell felt the existing issues needed to be addressed as well. Mayor Bert Echterling stated the current property is currently zoned R-1, and the property owner can proceed tomorrow with new construction, and although the existing concerns need to be addressed, he reminded Council the zoning change request before Council tonight needs to be disconnected from those issues. After no further discussion, Councilmember Jeremy Stivener made a motion to deny the zoning change from R-1 to SF-3. Councilmember Jimmy Rogers seconded this motion. Voting in favor; Rogers, Stivener, Leuschner, Mastergeorge, Janics, Tindell, and Echterling. There were no opposing votes and the motion to deny carried unanimously. 7. PUBLIC HEARING: Conduct a public hearing, consider and take possible action on Ordinance regarding a zoning change from R-1 to MF-1 for property located at 402 S Old Robinson Road, Robinson, Texas. The Public Hearing was opened at 6:49 p.m. City Manager Craig Lemin provided an overview of the zoning change as presented. Mr. Lemin stated the Planning and Zoning Commission met on July 18, 2017, and recommended approval by a vote of 5-0. Mr. Lemin stated staff has received six notices, including Robinson ISD, of opposition from surrounding property owners. These property owners represent more than 20 percent of the land area within 200 feet of the subject site, thus requiring a three-fourths vote of the City Council to approve the zoning change. Doye Baker, 302 N Old Robinson Road, Robinson, Texas 76706, stated the biggest concern voiced at the Planning and Zoning meeting was traffic, and Mr. Baker felt since these were senior cottages, the small amount of traffic volume added would not be an issue, and respectfully requested approval. Caleb Grisham, 405 S Strauss, Robinson, Texas 76706; and Jean Kettler, 108 W Tate, Robinson, Texas spoke in opposition of the zoning change voicing concerns regarding the lot size, traffic, and the proposed use would not compatible with the surrounding properties. After no additional comments, the Public Hearing was closed at 7:00 PM. Mayor Pro Tem Jim Mastergeorge asked for clarification regarding the size of the proposed homes, the maximum number of homes on the property, who would be allowed to rent the homes, and who would be the care take of the property. City Manager Craig Lemin reminded Council that Mr. Baker was not bound to the proposal of 4 Senior Cottages, as this lot could be allowed up to 10 units. Mayor Pro Tem Jim Mastergeorge felt traffic would not be an issue and thought this was a good use of the property because of its close proximity to necessities. Councilmember Jimmy Rogers stated although affordable housing for seniors is needed in Robinson, he didn t feel this was the best use for this property. Councilmember Jeremy Stivener did have concerns regarding traffic due to the heavily traveled area coming from the school, and did not feel this was the best use City Council Meeting Minutes August 1, 2017 Page 2 of 5

8 for the property. Councilmember Stivener said the citizen concerns needed to be taken to heart as we are the voice for them. Councilmember Vernon Leuschner felt this proposed zoning was suitable for this type of client and did not have concerns regarding the traffic. Councilmember Steve Janics was not comfortable with the requesting zoning and would like to see something more compatible with the surround properties. Councilmember Steve Tindell did not feel this was the best use of the property, and if approved, the property owner could not be held to the proposed layout provided. After no additional discussion, Councilmember Jeremy Stivener motioned to deny the zoning change from R-1 to MF-1. Councilmember Steve Janics seconded this motion. Voting in favor: Rogers, Stivener, Janics, Tindell, and Echterling. The motion to deny carried by a vote of 5-2 with Mayor Pro Tem Jim Mastergeorge, and Councilmember Vernon Leuschner voting in opposition of the denial. 8. PUBLIC HEARING: Conduct a public hearing, consider and take possible action on the Final Plat for Liberty Ranch PUD, Phase III. Mayor Bert Echterling recused himself from this item and exited the Council Chambers. The Public Hearing was opened at 7:16 PM. City Manager Craig Lemin provided an overview of the Final Plat as presented. Mr. Lemin stated the Planning and Zoning Commission met on July 18, 2017, and recommended disapproval of the plat until compliance with specific conditions and requirements. Mr. Lemin stated these specific conditions and requirements have been met. After no further discussion, the Public Hearing was closed at 7:21 PM. Councilmember Jimmy Rogers asked for clarification regarding the recommendation by the Planning and Zoning Commission. Mr. Lemin noted the current Zoning Ordinance requires the commission to disapprove the plat pending compliance. This would allow the plat to move forward to the City Council without delay, and if the issues were addressed, then Council can approve the plat. Councilmember Vernon Leuschner requested staff to be diligent in providing adequate signage re-routing heaver traffic out of the existing subdivision. After no further discussion, Councilmember Jeremy Stivener motioned to approve the Final Plat as presented. Councilmember Steve Janics seconded this motion. Voting in favor: Rogers, Stivener, Leuschner, Mastergeorge, Janics, and Tindell. The motion carried by a vote of 6-0 with one abstention. 9. Consider and possible action on Ordinance amending Article IV, Smoking, of the Code of Ordinances of the City of Robinson, Texas. Mayor Bert Echterling stated at the May 2, 2017, City Council Meeting, he requested discussion regarding the current smoking ordinance for the City of Robinson. Discussion was conducted on this item at the June 6, 2017 City Council Meeting. Council requested City Attorney Mike Dixon prepare a draft Ordinance with Council s recommended changes for consideration. Councilmember Jimmy Rogers asked for clarification on the types of tobacco prohibited. City manager Craig Lemin stated this was an amendment to the Smoking Ordinance only, and smokeless tobacco was not prohibited. Councilmember Vernon Leuschner felt this should include all tobacco, and asked for clarification regarding the current City Policy in place regarding tobacco. Mr. Lemin stated the current Smoking Ordinance has certain restrictions regarding smoking near an entrance, and smoking near a ventilation system. The City Policy prohibits smoking in any city owned building or vehicle. Mayor Bert City Council Meeting Minutes August 1, 2017 Page 3 of 5

9 Echterling stated he brought this forward to address second hand smoke, and it was not his intent to prohibit smokeless tobacco products. Councilmember Jimmy Rogers requested staff to see how other cities enforce prohibiting all tobacco products. After no additional discussion, Mayor Pro Tem Jim Mastergeorge motioned to approve Ordinance as presented. Mayor Bert Echterling seconded this motion. Voting in favor: Rogers, Stivener, Leuschner, Mastergeorge, Janics, Tindell, and Echterling. Motion carried unanimously. 10. Consider and possible action awarding the proposal for annual Audit Services for the City of Robinson, Texas. City Manager Craig Lemin presented this item and stated staff engaged Valley View Consulting, L.L.C. to assist us with the selection process, and a request for proposals was prepared and sent out to interested firms. Mr. Lemin stated three firms submitted proposals. They were Belt Harris Pechacek, L.L.L.P., Park, Fowler & Company and Patillo, Brown & Hill, L.L.P. Mr. Lemin said after reviewing the proposals, we narrowed down the list to two, eliminating Park, Fowler & Company, and interviewed each firm and contacted references for each firm. Mr. Lemin said after taking into consideration the proposals, interviews and reference checks, staff feels that at this time Belt Harris Pechacek, L.L.L.P. is the best choice to meet our current needs. While their annual fee is a little bit more, they appear best suited for where we are today. They only audit governmental entities and have numerous smaller city clients. They understand the challenges we face and we believe will be best able to assist us as we work to improve our accounting practices including updating of internal controls. Councilmember Vernon Leuschner asked if their location was a concern to the City. Both City Manager Craig Lemin and Bill Koch with Valley View Consulting, who was also present, did not see this as a concern. Councilmember Jeremy Stivener stated this was a great move for the City and motioned to award the bid to Belt Harris Pechacek, L.L.L.P. as presented. Councilmember Steve Janics seconded this motion. Voting in favor: Rogers, Stivener, Leuschner, Mastergeorge, Janics, Tindell, and Echterling. 11. Conduct a vote by the City Council to place a proposal to adopt a tax rate of $ on Tuesday, August 29, 2017, and call for two public hearings on a proposed tax rate to be held on Tuesday, August 15, 2017, and Tuesday, August 22, 2017, at 6:00 p.m. at Robinson City Hall, 111 W Lyndale Ave, Robinson, Texas City Manager Craig Lemin presented this item, and stated the proposed tax rate will exceed the effective tax rate requiring two public hearings and recommend approval to place a proposal to adopt a tax rate of $ on Tuesday, August 29, 2017, and call for two public hearings on a proposed tax rate to be held on Tuesday, August 15, 2017 and Tuesday, August 22, 2017 as presented. Councilmember Steve Janics motioned to place a proposal to adopt a tax rate of $ on Tuesday, August 29, 2017, and call for two public hearings on a proposed tax rate to be held on Tuesday, August 15, 2017, and Tuesday, August 22, Mayor Bert Echterling seconded this motion. 11 MINUTES OF SPECIAL CALLED CITY COUNCIL MEETING AUGUST 5, Call to order. Breakfast was served at 8:00 A.M. and the meeting was called to order at 8:30 A.M. by Mayor Pro Tem Jim Mastergeorge. 2. Invocation. Jimmy Rogers provided the Invocation. 3. Roll Call. Councilmembers present: Jimmy Rogers, Vernon Leuschner, Jim Mastergeorge, and Steve Janics. Mayor Bert Echterling, Councilmember Jeremy Stivener, and Councilmember Steve Tindell were absent. 4. Budget Workshop: Discussion regarding proposed budget for FY City Manager Craig Lemin provided the proposed budget for FY Mr. Lemin provided a brief overview of the budget message, budget information and policies, and budget summaries to include a combined summary of revenue and expenditures for FY Council and Staff began discussion with the General Fund Budget, going over revenues and expenditures, and department s request. Council and Staff continued discussions regarding the Debt Service Fund, where Mr. Lemin provided a summary of revenues and expenditures, and a description of accounts. Discussion continued with the Water Fund Budget, outlining the revenues and expenses, and department s requests. The Wastewater Fund Budget was presented also outlining the revenues and expenses, and department s requests. Mr. Lemin wrapped up with a summary regarding Special Purpose Funds, and an overview of capital projects. Council directed staff to amend the proposed budget as discussed. No action was taken. 5. Consider and possible action on Ordinance adopting a budget and making appropriations for the support of the City of Robinson for Fiscal Year City Manager Craig Lemin presented this item and gave a brief overview of the budget summary. Following discussion, Mayor Pro Tem Jim Mastergeorge motioned to approve Ordinance adopting the budget as presented. Councilmember Steve Janics seconded this motion. Voting in favor: Rogers, Stivener, Mastergeorge, Janics, Tindell and Echterling. Motion carried by a vote of Consider and possible action on Ordinance adopting tax rate and levying property taxes for City Manager Craig Lemin presented this item. Following discussion, Jimmy Rogers motioned that the property tax rate be increased by the adoption of a tax rate of $ , which is effectively a 5.60 percent increase in the tax rate. Jeremy Stivener seconded this motion. Voting in favor: Rogers, Stivener, Mastergeorge, Janics, Tindell, and Echterling. Motion carried by a vote of Consider and possible action to ratify the property tax increase reflected by the adoption of the budget which requires raising more revenue from property taxes than in the previous year. City Manager Craig Lemin presented this item. Following discussion, Councilmember Steve Janics motioned to ratify the property tax revenue increase reflected in the FY budget. Mayor Pro Tem Jim Mastergeorge seconded this motion. Voting in favor: Rogers, Stivener, Mastergeorge, Janics, Tindell and Echterling. Motion carried by a vote of Consider and possible action on Ordinance adopting Chapter 20, Management and Regulation of Rights-of-Way, adding said Chapter to the City of Robinson Code of Ordinances which includes adopting the Design Manual for Network Nodes, Transport Facilities & Node Support Poles, approval of the Application for Right-of-Way Permit form and approval of the Pole Attachment Agreement. City Manager Craig Lemin opened this item, and City Attorney Mike Dixon provided an explanation of the ordinance as written. Following discussion, Councilmember Jimmy Rogers motioned to approve Ordinance adopting Chapter 20, Management and Regulation of Rights-of-Way, adding said Chapter to the City of Robinson Code of Ordinances which includes adopting the Design Manual for Special Called City Council Meeting Minutes August 29, 2017 Page 1 of 2

16 Network Nodes, Transport Facilities & Node Support Poles, approval of the Application for Right-of-Way Permit form and approval of the Pole Attachment Agreement as presented. Motion carried by a vote of Consider and possible action on Resolution R amending, reviewing and approving the written investment policy. City Manager Craig Lemin presented this item providing a brief overview of the amendments to the Investment Policy. Following discussion, Councilmember Jeremy Stivener motioned to approve Resolution R as presented. Councilmember Steven Tindell seconded this motion. Voting in favor: Rogers, Stivener, Mastergeorge, Janics, Tindell and Echterling. Motion carried by a vote of Adjourn. ITEM SUMMARY: The attached ordinance establishes the filming guidelines, which regulates commercial filming, and the use of City property in Robinson, TX. The film friendly ordinance, guidelines, fees, and application provides production companies, and other entities, with clear regulations to follow and removes any unexpected barriers to filming. The adoption of these items create a program that promotes economic development activity within Robinson while protecting the personal and property rights of Robinson, Texas residents and businesses, and promotes public health, safety and welfare. 22 ORDINANCE AN ORDINANCE OF THE CITY OF ROBINSON, TEXAS ADOPTING FILMING GUIDELINES; MAKING VIOLATION AN OFFENSE PUNISHABLE BY A FINE NOT TO EXCEED $500.00; PROVIDING FOR REPEALING AND SEVERABILITY CLAUSES; PROVIDING FOR AN EFFECTIVE DATE; AND DIRECTING PUBLICATION OF CAPTION WHEREAS, to become recognized as a filming-friendly city it is important for a city to adopt guidelines on filming that provide production companies and other entities with clear regulations to follow and that remove unexpected barriers to filming; and WHEREAS, the City Council has determined that it would be advantageous to the image of Robinson to become a filming friendly city; and WHEREAS, Robinson adopts certain Filming Guidelines by this Ordinance in order to strive to become recognized as a filming friendly city. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ROBINSON, TEXAS: 1. That the foregoing recitals are adopted and made findings by incorporation herein. 2. The Robinson Filming Guidelines attached hereto as Exhibit A are hereby ADOPTED as the regulations for commercial filming and use of City property for filming in Robinson, Texas. 3. The term City Property used in the Filming Guidelines includes all streets and right-of-ways, whether or not owned in fee by the City. 4. The City Manager may make changes to the application form or other documents as the City Manager deems necessary, but the Filming Guidelines may only be amended by the City Council. 5. Violation of the regulations adopted by this Ordinance is an offense (misdemeanor) punishable by a fine not to exceed $ Each day of violation shall be a separate offense. 6. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section.

23 7. All ordinances or portions thereof in conflict with this Ordinance regarding the subject matter of this Ordinance are repealed. 8. This ordinance shall become effective upon passage and publication of its caption. The City Secretary is directed to publish the caption of this Ordinance in the Official Newspaper of the City. 9. It is found and declared that the City Council meeting at which this Ordinance has been adopted was open to the public and was noticed and held in accordance with Chapter 551 of the Government Code. 25 Guidelines for Filming in Robinson, Texas I. PURPOSE The Guidelines contained in this policy are intended to create a program for promoting economic development activity within Robinson and the vicinity of the City. The following Guidelines are also intended to protect the personal and property rights of Robinson, Texas residents and businesses, and to promote the public health, safety and welfare. The City Manager reserves the right to impose additional regulations in the interest of public health, safety and welfare, or if otherwise deemed appropriate by the City Manager. These Guidelines cover requests for commercial use of City-owned property (including but not limited to streets, rights-of-way, parks, and/or public buildings), commercial use of private property which may affect adjacent public or private property, and the use of City equipment and personnel in all types of motion picture production, including, but not limited to, feature films, television programs, commercials, music videos and corporate films. II. CITY CONTROL/CITY MANAGER AUTHORITY The City Manager may authorize the use of any street, right-of-way, park, or public building, equipment or personnel for commercial uses in the filming or taping of movies, television programs, commercials, or training films and related activities. In conjunction with these uses, the City Manager may require that any or all of the conditions and/or remuneration herein and as specified on the application be met as a prerequisite to that use. The Applicant agrees that the City of Robinson shall have exclusive authority to grant the Applicant the use of public streets, rights-of-way, parks and public buildings of the City, as well as authority to regulate the hours of production and the general location of the production. The City reserves the full and absolute right to prohibit all filming or to order cessation of filming in order to promote the public health, safety or welfare. The Applicant shall allow City departments (e.g., Police, Fire, Building) to inspect all structures, property, devices and equipment to be used in connection with the filming and taping, as deemed appropriate by the City Manager. III. PERMIT REQUIREMENTS Before filing an application for filming in Robinson, the Office of the City Manager must be contacted to discuss the production's specific filming requirements and the feasibility of filming in Robinson, TX. Any commercial producer who desires to undertake a commercial production in Robinson is required to complete and return the attached application for filming to the Office of the City Manager, within the time frames below: Commercials or episodic television: a minimum of two (2) business days prior to the commencement of filming or any substantial activity related to the project. Feature films: a minimum of five (5) business days prior to the commencement of filming or any substantial activity related to the project. IV. APPLICATON FEE An application processing fee of $25.00 should accompany each application for filming in Robinson. The City Manager may waive this fee upon proof of an organization s non-profit status or for any other reason deemed appropriate by the City Manager. V. USE OF CITY EQUIPMENT AND PERSONNEL The Applicant shall pay for all costs of any Police, Fire, Public Works, or other City personnel assigned to the project (whether or not specifically requested by the production). Remuneration rates for the use of any City equipment, including police cars and fire equipment, will be established on a case-by-case basis as determined by the City Manager. The Applicant shall pay all costs in full within ten (10) days after 2

26 receipt of an invoice for said costs. The City Manager may, at his/her discretion, require an advance deposit for all costs related City personnel and/or the use of City equipment. The City Manager, in consultation with the Chief of Police and/or Fire Chief, shall have the authority to stipulate additional fire or police requirements and level of staffing for same, at any time during a film project if it is determined to be in the best interest of public health, safety and welfare, which cost shall be borne entirely by the Applicant. Off-duty police officers and firefighters shall be paid by the production company at a rate no less than one and one-half times their hourly rate. VI. USE OF CITY-OWNED REAL ESTATE The City Manager may authorize the use of any street, right-of-way, park or public building, use of Robinson, Texas name, trademark or logo and/or use of City equipment and/or personnel for commercial uses in motion picture production. In conjunction with these uses, the City Manager may require that any or all of the conditions and/or remuneration as specified herein and on the application be met as a prerequisite to that use. A security or damage deposit may be required within the discretion of the City Manager. The Applicant shall reimburse the City for inconveniences when using public property. Following is the rate schedule: Activity Cost per calendar day maximum of 8 hours/day Total or disruptive use (regular operating hours) of a public building, park, right-of-way, or public area Partial, non-disruptive use of a public building, park, right-of-way, or public area Total closure or obstruction of public street or right-of-way, including parking lots and on-street parking Partial closure or obstruction of public street or right-of-way, including parking lots and on-street parking Use of City parking lots, parking areas, and City streets (for the purpose of parking film trailers, buses, catering trucks, and other large vehicles) $500 per day $250 per day $50 per block, per day $25 per block, per day $50 per block or lot, per day The Applicant acknowledges and agrees that the City of Robinson, Texas, possesses and retains exclusive authority to grant the Applicant a revocable license for the use of its name, trademark, and logo, public streets, rights-of-way, parks and buildings of the City as well as control over the hours of production and the general location of the production. The City reserves the full and absolute right to prohibit all filming or to order cessation of filming activity in order to promote the public health, safety and/or welfare. VII. VEHICLES AND EQUIPMENT The Applicant shall provide a report listing the number of vehicles and types of equipment to be used during the filming, including proposed hours of use and proposed parking locations. Such locations will need to be specifically approved by the City Manager. On-street parking or use of public parking lots is subject to City approval. 3

27 The use of exterior lighting, power generators, or any other noise- or light-producing equipment requires on-site approval of the City Manager. VIII. HOURS OF FILMING Unless express written permission has been obtained from the City Manager in advance, and affected property owners, tenants and residents have been notified, filming will be limited to the following hours: Monday through Friday: Saturday, Sunday and holidays: 7:00 a.m. to 9:00 p.m. 8:00 a.m. to 8:00 p.m. IX. NOTIFICATION OF NEIGHBORS The Applicant shall provide a short written description, approved by the City Manager, of the schedule for the proposed production to the owners, tenants and residents of each property in the affected neighborhood(s). The Applicant, or his or her designee, shall make a good faith effort to notify each owner, tenant and resident of all such property, and shall submit, as part of this application, a report noting owners, tenants and/or residents comments, along with their signatures, addresses and phone numbers. Based upon this community feedback, and other appropriate factors considered by the City Manager, the City Manager may grant or deny the filming application. X. CERTIFICATE OF INSURANCE The Applicant shall attach a valid certificate of insurance, issued by a company authorized to conduct business in the state of Texas, naming the City of Robinson and its agents, officers, elected officials, employees and assigns, as additional insured, in an amount not less than $1,000,000 general liability, including bodily injury and property damage with a $5,000,000 umbrella; and automobile liability (if applicable) in an amount not less than $1,000,000 including bodily injury and property damage. XI. DAMAGE TO PUBLIC OR PRIVATE PROPERTY The Applicant shall pay in full, within ten (10) days of receipt of an invoice, the costs of repair for any and all damage to public or private property, resulting from or in connection with, the production, and restore the property to its original condition prior to the production, or to better than original condition. 4

HOLD HARMLESS AGREEMENT The Applicant shall sign the following Hold Harmless Agreement holding the City harmless from any claim that may arise from their use of designated public property, right-of-way, or equipment in conjunction with the permitted use: I certify that I represent the firm which will be performing the filming/taping at the locations specified on the attached permit application. I further certify that I and my firm will perform in accordance with the directions and specifications of The City of Robinson, Texas, and that I and my firm will indemnify and hold harmless the City of Robinson, Texas and its elected officials, officers, servants, employees, successors, agents, departments and assigns from any and all losses, damages, expenses, costs and/or claims of every nature and kind arising out of or in connection with the filming/taping and other related activities engaged in pursuant to this Application. I further certify that the information provided on this Application is true and correct to the best of my knowledge, and that I possess the authority to sign this and other contracts and agreements with the City of Robinson, Texas on behalf of the firm. STAFF RECOMMENDATION: Recommend awarding the bid to Santa Clara Construction, Ltd. at a total cost of $432,877. ITEM SUMMARY: We recently went out for bids for the project to abandon the Lyndale lift station and install a new sewer line from that location to the WMARSS interceptor along Flat Creek. This project is the first step in re-routing flows from the South Pond lift station and increasing capacity to the central area of the City. Seven bids were received ranging from a low $432,877 to a high of $765, The engineer s opinion of probable cost for the project was $477,486. Walker Partners has previously checked references of Santa Clara Construction. Santa Clara Construction is currently working on a City of Waco project designed by Walker Partners. Walker Partners has received a positive response from the City of Waco on that project as well. Santa Clara Construction met all the bid requirements and no reason has been found to disqualify them, so staff concurs with Walker Partners recommendation. Due to the unfamiliarity of the Contractor prior to the City of Waco project, Walker Partners contacted references that were submitted by the Contractor as part of the bid package. After contacting multiple references in which the Contractor completed various types of jobs, Walker Partners found Santa Clara Construction, Ltd. to be an acceptable and reliable contractor. Walker Partners has since received a positive response from the City of Waco as well.
