The site is developed with a single family home. The property abuts the Merrick Canal to the east and has an estimated 191 feet of water frontage. At the property location, the Merrick Canal has a width of 200 feet; therefore the maximum allowable projection of a marine improvement would be limited to 30 feet. Improvements on the subject property include a seawall and a 1,200 sq. ft. dock that includes two boat lifts and a tiki hut. The applicant is requesting a deviation of 641 sq. ft. that will include a Captain s Walk, an additional deck area, and an additional dock area to support a third boat lift. LUDR, Section D.1 states: For parcels with more than 40 feet of water frontage, the maximum deck surface area coverage shall be calculated as follows: the linear feet of water frontage of the parcel minus 20 feet times one-half times the linear feet of the maximum projection into the waterway (25% of the calculated width of the waterway or 30 feet, whichever is less). However, the maximum deck surface area allowed under this section shall not exceed 1,200 square feet for marine improvements which project from parcels utilized for single-family residential dwelling units in R-1, RD, RE, and/or RX zoning districts Given the equation below set forth in LUDR, Section 3.16 and length of water frontage associated with the subject property, the maximum square footage is calculated as: 190 (water frontage) 20 x ½ x 30 (allowed projection) = 2,565 sq. ft. However, as stated in the LUDR, Section D.1, the maximum square footage for a property s marine improvement may not exceed 1,200 sq. ft.

6 September 11, 2014 DE Page 3 Applicable Regulations: LUDR, Section C.2 states: All other deviations from the provisions of this section may be approved by the Board of Zoning Adjustment and Appeals provided that the deviation will not be contrary to the public interest and will be in harmony with the general intent and purpose of this section and where conditions exist that are not the result of the applicant and which are such that a literal enforcement of the regulations involved would result in unnecessary or undue hardship. In determining whether a particular deviation request should be approved, factors the Board of Zoning Adjustment and Appeals shall consider include, but are not limited to, the following: the effect the proposed deviation would have on the navigability of the waterway involved; the design, size, and proposed location of the marine improvement for which deviation is sought; the effect, if any, that the proposed deviation would have on any extant marine improvements in the subject waterway. Subject to these standards and criteria, the Board of Zoning Adjustment and Appeals shall approve only the minimum deviation from the provisions of this section necessary to avoid the unnecessary or undue hardship required herein. Analysis: Planning staff has reviewed this application regarding the proposed marine improvement deviation using the guidelines set forth within LUDR, Section Section C.2 of the LUDR states: All other deviations from the provisions of this section may be approved by the Board of Zoning Adjustment and Appeals provided that the deviation will not be contrary to the public interest and will be in harmony with the general intent and purpose of this section... - This section identifies the factors the Board of Zoning Adjustment and Appeals may consider when evaluating a deviation request that include the following: the relative impact on the navigability of the waterway, including size, design, and location of the marine improvement, as well as the effect that the proposed deviation would have on other future and existing future marine improvements on the waterway. The water frontage of the subject parcel is approximately 191 feet that is significantly greater than most platted two-lot home sites in Cape Coral. The improvement proposed by the applicant is within the maximum projection of 30 feet into the canal that is allowed by City regulations. Merrick Canal, the waterway where the proposed marine improvement is located, is 200 feet wide allows a maximum projection of 30 feet into the canal.

7 September 11, 2014 DE Page 4 With the dimensions previously described, the property may support a marine improvement above the 1,200 sq. ft. maximum allowed by the LUDR. Should the requested expansion be approved, the marine improvement will not interfere with neighboring views of the waterway nor will navigability of the waterway be adversely affected. As a result, staff finds this request is in harmony with the general intent of this section. Section C.2 of the LUDR, in regards to marine improvement deviations, also states: where conditions exist that are not the result of the applicant and which are such that a literal enforcement of the regulations involved would result in unnecessary or undue hardship. - At 191 linear feet along the Merrick Canal, the applicant s property has water frontage greater than most platted two-lot home sites. Staff finds that because of the site s water frontage, this property can support a larger marine improvement compared to smaller homesites without affecting the design standards set forth in the LUDR. Section C.2 of the LUDR, in regards to marine improvement deviations, also states: Subject to these standards and criteria, the Board of Zoning Adjustment and Appeals shall approve only the minimum deviation from the provisions of this section necessary to avoid the unnecessary or undue hardship required herein. - The dimensions of the improvements to support the third boat lift and the Captain s Walk constitute the minimum deviation for these improvements. Recommendation Based upon the above analysis, and the characteristics of the waterway for which the deviation is proposed, staff finds that the requested deviation is not in conflict with the public interest and will be in harmony with the intent of LUDR, Section Therefore, Planning staff recommends approval of the requested deviation with the following condition. Condition: 1. The applicant s scope of work shall be consistent with the scaled drawings originally submitted with the deviation application provided by Tropical Marine Construction on August 5, 2014.

Ft. from the marine improvement areas as specified in Section 3.16.N.l of the City of Cape Coral Land Use and Development Regulation. The deviation requested is to allow the property owner to continue the dock to the south property line and north property line, including a 3 rd boat lift to be used for a kayak. Allow safe access for the family along the entire length ofthe property. This property owner has 191 ft. of frontage & based on Cape Coral's calculation they should be allowed to have up to 2,565 sq. ft of dock. The issuance of this deviation will not give special privileges because there are other residences on the canal with boat docks & lifts and the proposed dock is in accordance with the setbacks and max water projection. Granting of this deviation would be within the purpose of the ordinance because it would not be injurious to the area or otherwise detrimental to the public welfare.
