Use of personal identification of another; identity fraud; (a) For purposes of this section, the following words shall have the following meanings:-- Harass, willfully and maliciously engage in an act directed at a specific person or persons, which act seriously alarms or annoys such person or persons and would cause a reasonable person to suffer substantial emotional distress. Personal identifying information, any name or number that may be used, alone or in conjunction with any other information, to assume the identity of an individual, including any name, address,, place of employment, Pose, to falsely represent oneself, directly or indirectly, as another person or persons. (b) Whoever, with intent to defraud, poses as another person without the express authorization of that person and uses such person s personal identifying information to obtain or to attempt to obtain anything of value or to harass another shall be guilty of identity fraud. Notes of Decisions (2) Purpose of law The primary, but not sole, focus of identity fraud statute is to criminalize the unauthorized use of someone else s personal identifying information to obtain fraudulently anything of value while posing as such other person ; statute also criminalizes the misappropriation of such information to harass another. (Mass. 2006) Presumptions and burden of proof The Commonwealth must prove beyond a reasonable doubt the following four elements to support a conviction for identity fraud: specifically, that a defendant (1) posed as another person; (2) did so without that person s express authorization; (3) used the other person s identifying information to obtain, or attempt to obtain, something of value [or to harass another]; and (4) did so with the intent to defraud.
