2 Aledo Parks & Community Center Reservation Guidelines Use of Community Center and Aledo Park Facilities Sec. 1.1 Generally (c) (d) (e) (f) The City of Aledo Community Center and Park area is available for private or public group events and for individual use by the citizens and visitors of Aledo for the purpose of the promotion of the arts, music, leisure, educational, recreational, civic, or social activities when these activities do not conflict with City use or with this policy. Notwithstanding the above, in case of emergencies or disasters, the City Administrator may authorize the use of the Community Center and Park area facilities by civil defense, health, or emergency service authorities. In the Park area, including the playground, picnic areas, volleyball court and basketball court may be used without a fee on a first come, first served basis. No reservation is required for use of Park area facilities. All users must remove any trash or debris they bring in and should report all damage or broken equipment to the Community Event Planner or Center Coordinator at City Hall as soon as possible. The Community Center and Park area, when used, must be left in the condition it is found in, which includes removing and cleaning any trash or debris. If any damage to equipment or property occurs, the Community Event Planner or Center Coordinator should be notified within twenty-four (24) hours. Failure to report damage may result in assumed liability, forfeiture of your deposit, and incurred repair expenses. The Community Center and Park area closes at 12:00 midnight for all users. Views expressed by users or renters of the Community Center or users of the Park are not necessarily those of the City of Aledo and the City of Aledo is not responsible for any advertising of events, classes or meetings held at the Community Center or Park unless expressly stated. Sec. 1.2 Rules and Regulations Driving and Parking (1) It shall be unlawful for any person to drive or park a motor vehicle or an off-road vehicle upon public park property within the City in an area other than one designated for driving or parking. Commercial delivery and vending vehicles delivering goods for the operation of the park and park maintenance vehicles shall be exempted from the requirements of this subsection. (2) The City Administrator shall cause appropriate signs to be placed giving reasonable notice to Community Center and Park area patrons that no motor vehicle shall be driven or parked other than in areas designated for driving or parking. (3) The speed limit on the City Parking lot is 5 miles per hour. (4) Users of the Community Center and Park area should avoid parking in a manner which blocks neighboring businesses, residents, garages and drives. Noise and Amplifiers (1) Users shall comply with applicable city ordinances and other applicable rules or laws regulating noise, including amplified sound. 3 (2) The City reserves the right to terminate any use or Event if a Community Center or Park area user continues to exceed these limits after one warning from City authorities. (c) Glass Containers Glass containers are prohibited in the Aledo Park. (d) Animals and Pets (1) No pets or domestic animals shall be permitted in the Community Center facilities unless the animal is an aide to persons with disabilities or needed for emergency or medical purposes. (2) Domestic pets are permitted in the Park area so long as they are on a leash and under the control and supervision of their owner or other responsible party. (3) It shall be the owner s responsibility to remove pet waste from all facilities. (4) It shall be unlawful to ride or have horses within the Aledo Park. (5) There shall be NO animals for purposes of entertainment (e.g., petting zoo, pony rides, etc.) within the Community Center building or on the Parks properties in conjunction with any facility rental. (e) Alcoholic Beverages, Smoking, Narcotics It shall be unlawful to knowingly possess, consume or sell alcoholic beverages, illegal drugs, and tobacco products in the Community Center, its parking lot, and Park area. Tobacco products and e-cigarettes may be used in the Community Center parking lot only. All smoking products must be away from the Park area and Community Center entrance doors, and extinguished and disposed of in the proper receptacle prior to entering either. Throwing extinguished cigarettes on the ground and not disposing of them in the proper trash receptacle is considered littering and may be subject to a fine. (f) Projectiles and Firearms No person shall possess, fire, or discharge a device capable of propelling a projectile, including without limitation, any air gun, air pistol, paintball guns or devices, bow and arrow, cross bow, or sling shot in the Park or Community Center. (g) Prohibited Materials & Damage (1) NOTHING shall be PINNED, STAPLED or TAPED to FABRIC PANELS or INTERIOR WALLS of the Community Center. Furthermore, no event decorations or other decorative materials shall be nailed, tacked, screwed or otherwise physically attached to any part of the Community Center s walls, ceiling fans, light fixtures, or floors, or within the Park area without written permission from the Community Event Planner or Center Coordinator. (2) No tape or adhesive of any kind shall be placed on the floors or walls for any reason. For décor purposes, we recommend limiting décor to table centerpieces. (3) There shall be NO use of glitter, foil confetti, glue or paste, permanent markers, oils or acidic compounds, or paint of any kind. Aledo Parks & Community Center Rental Page 3

4 (4) No burning of incense or lighted candles (with the exception of birthday cake candles and gel fuel/canned heat [Sterno] as used for catering). (5) No use of products or foods that create or produce noxious scents or strong, lingering odors within the Community Center. (6) No use of hay, straw, grass, or similar vegitation within the Community Center building. (7) All individuals and groups using the Community Center and its facilities shall be responsible for the cost of repairing or replacing any equipment, facilities, or grounds, including trees and vegetation, damaged during their use. (8) No person shall remove, destroy, mutilate, or deface any structure, monument, equipment or other property located in the Park Area or Community Center. No person shall cut, break, deface, injure, or remove the trees, shrubs, plants, grasses, or turf within the Park area. (9) Renter s failure to adhere to any of these rules will result in a minimum of Renter s forfeiture of Security Deposit. (h) Overnight Camping Overnight camping shall not be permitted in the Park area. (i) Water Features and Bodies of Water (1) It shall be unlawful to discharge or otherwise place any substance, matter, liquid, solid or otherwise which may cause pollution, into any fountain, pond, lake stream, tributary, storm sewer, drain or other body of water. (2) It shall be unlawful to swim, wade, boat, or canoe in any area unless such area is designated for that purpose, provided, however, that the Community Center coordinator may permit the temporary occurrence of such activities for special programs and events. This section will not bar the above described activities for instances of emergencies. (3) No use of water slides or air-inflated water slide bounce houses are permitted in conjunction with the rental of the Community Center or Parks properties; Air-inflated bounce houses without water are permitted. (j) Erecting Structures (1) No person shall place or erect any structure in the Park area without City approval. (2) No person shall attach to any tree, shrub, fence, railing, post, or structure within the Park, any sign, bulletin board, or other advertising device of any kind. (k) General Conduct (1) All individuals and groups shall comply with all federal, state and local laws, including but not limited to all ordinances of the City of Aledo, and all rules, regulations and requirements of the Community Center Guidelines and Police and Fire Departments. (2) Users, their agents or employees, shall not discriminate against any person on account of age, race, color, religion, sex or national origin, regarding use of the Community Center or Park area facilities. 5 (3) Users of all Community Center and Park area facilities shall conduct their business in an orderly manner. (4) Users programs, events, performances, exhibitions or other uses of the Community Center or Park Area, including any facility, will not violate or infringe upon any copyright, patent, right of privacy or other statutory or common law right of any person, firm or corporation. All programs, performances, concerts, and other events to be performed in the Community Center or Park area involving works protected by statutory or common law copyrights or other proprietary law have been duly licensed or otherwise authorized by the owners of such works or legal representatives thereof. (5) Inappropriate conduct, such as but not limited to profanity, abusive language, or any act of violence toward anyone, will not be tolerated, and will be considered grounds for immediate removal and loss of rental fee and deposit. This may also result in permanent suspension from future usage of the Community Center and Park facilities. Reserving Facilities Sec. 2.1 Generally The Community Center may be reserved by citizens and visitors of the City of Aledo. The use must be for the promotion of the arts, music, leisure, educational, recreational, civic, or social activities and may not conflict with City use or with this policy. The facilities are generally available for rent by any individual or group on a firstcome, first-served basis. Reservations may be made up to twelve (12) months in advance. Rental of the Community Center includes use of City-owned on-site folding banquet tables (approximately 45) and chairs (approximately 200) found in left rear storage room. (1) Renter will be responsible for removal of tables and chairs from storage room, proper set-up of tables and chairs, and proper cleaning and replacement of tables and chairs to storage room. DO NOT DRAG TABLES ALONG THE FLOOR; please pick them up to move them to avoid scratching of the flooring. (Note: Set-up time should be included in Renter s overall Rental Time ) (2) Renter must exercise proper care and function of on-site tables and chairs, and both must be returned in the same condition in which they were found. Failure to abide by these rules may result in loss of Security Deposit and equipment replacement expenses. (3) All tables and chairs must remain indoors, within the rented room only. (c) The City reserves the right to refuse or limit the privilege of any individual or group to rent any of the facilities on the following basis: (1) The individual or group has previously damaged or destroyed City property or other public property or has otherwise violated policies regarding rental or use of City facilities or property. (2) The Applicant s intended use is likely to damage the Community Center or violate applicable federal, state, or local laws, regulations, or ordinances. (3) The Applicant has rented or requests to rent the Community Center with such frequency that the Renter s use reasonably deprives others of the opportunity to use the Facility. (d) (e) The Community Center Parking Lot is reserved for an Event only if the Community Center building is rented, and the Rental Fees and Security Deposit are paid per the rental schedule. The Community Center parking lot cannot be reserved separately for setting up a booth or table for an Event or soliciting without also reserving the Community Center building and paying the appropriate fees. The Renter agrees that in the event the Renter or any invitee or guest of the Renter violates this Rental Policy, Community Center Guidelines or engages in illegal conduct or other activity in the Community Center that the City staff determines is detrimental to the City or its property, the City may immediately revoke the Renter s authority to use the Community Center and order the Renter and the Renter s guests and invitees to leave the premises immediately. The City reserves all legal rights to enforce these policies. Aledo Parks & Community Center Rental Page 5

6 Sec. 2.2 Rental Process Individuals or groups that want to apply for exclusive, reserved use of the Community Center must comply with the following procedures: (4) All Rental Agreements for the Aledo Park and Community Center must be made by a person who represents the entity or organization seeking to use the facilities and who is at least 21 years of age or older. (5) Applicants shall submit an executed Aledo Parks & Community Center Rental Application located at the end of this document, with all applicable Rental Fees and Deposit Fees described on Table A at the time of Application. (6) Submit the aforementioned documents and payments to Aledo City Hall, located at 200 Old Annetta Road, Aledo, Texas during City business days, between the hours of 8:00 a.m. to 5:00 p.m. Reservations will be confirmed and held only upon the City s receipt, availability, and approval of the aforementioned in Sec. 2.2 (2). Rentals that are canceled due to inclement weather or other unforeseeable problems that directly and substantially impair use of the Community Center or Park, e.g., utility outage, prior damage to the facilities, etc., as solely determined by the City, may be re-scheduled, provided the existing reservation is paid in full and the rescheduled date is available, by contacting the Community Event Planner or Aledo City Hall within three (3) working days. Sec. 2.3 Revenue Generating Events and Advertising (c) (d) Renters using the facilities to generate income or for fundraisers must notify the Community Event Planner or Center Coordinator at the time of application. Renters may charge a fee for tickets to enter events held at the Community Center, however, the number of tickets sold may not exceed the occupancy limits of the facilities. Renters will not publicly advertise or publicly announce the venue for the event or sell tickets to the event prior to the City s final acceptance of the User s Reserved Rental Application. See Table A for additional Rental Fee specifications. Sec 2.4 Discrimination Prohibited The City prohibits discrimination on the basis of race, sex, color, national origin, age, or disability in its programs and activities. Complaints or concerns on alleged discrimination can be filed with the City of Aledo or Office of Equal Opportunity, U.S. Department of the Interior, Washington, D.C., Sec. 2.5 Clean-up and Repairs The City does not provide janitorial services for the Community Center or Parks. Each Renter is responsible for leaving the facilities in a clean and orderly manner. Please see Community Center Cleaning Checklist attached. (c) In the Community Center, all interior lights, ceiling fans, kitchen stove and oven must be turned off. Any electrical items that were not plugged in upon arrival must be unplugged and all trash must be removed when leaving. All windows and outside doors must be closed and locked. The door key shall be returned to the Aledo City Hall by 8:00 a.m. the next day. Key may be dropped in the Night Deposit Box in front of Aledo City Hall. In the event that the cost to design, repair, replace or pay for any property damage that occurs during the Renter s use of the Community Center or Parks exceeds the amount of the Renter s Security Deposit, the City reserves the right to pursue all legal remedies against Renter, attendees, or other persons responsible. (d) All tables and chairs must be returned to the storage area and stacked. Decorations must be removed and no holes or damage to the walls or woodwork is permitted. 7 (e) After an event, the Community Event Planner or Center Coordinator shall inspect the facilities, bathrooms, kitchen, furniture, equipment and Park for cleanliness and needed repairs. (f) Upon departure of the facility, all thermostats must be set to 78 o in the warmer months when the AIR CONDITIONING is in use, and 68 o in the cooler months when the HEAT is in use. (g) If the facilities used are not properly cleaned, the Renter will forfeit his/her Security Deposit and may be charged a minimum amount of an additional $125 fee for cleaning services. Sec 2.6 Indemnification & Liability In renting a Facility, each Renter agrees to release, hold harmless, and indemnify the City, its officials, employees, and agents from any and all claims, fees, expenses, and costs, including legal fees, incurred by the City, its officials, employees, or agents, including but not limited to any claims of personal injury by any person or damage to or loss of real or personal property, arising out of the Renter s use, possession, or occupancy of the Facility. Renter does hereby assume all risk liability and responsibility for bodily injuries, claims, or suits for damages to persons or property of whatsoever kind of character, whether real or asserted, occurring in connection with the use of the Facility and its premises by the lessee regardless of whether such claim or damage is caused, in whole or in part, by the negligence of the City, its officers, agents, servants, employees, contractors, or sub-contactors. The City of Aledo assumes no responsibility for any property placed by Renter or any person present on the Facility during the Rental Period. Fee Information Sec. 3.1 Generally The City charges a Rental Fee per Hour (2-hour minimum) and a Kitchen Use Fee. Refer to Table A. Currently there are non-profit and election officials using the Community Center, free of charge. This arrangement (no charge for the rooms and kitchen) will continue ONLY for the non-profit organizations and election officials on the original written list when the Community Center was donated to the City. However, if a new activity is added by a non-profit who was on the original written list when the Center was donated to the City, then the non-profit organization will be charged the Non-Profit Fee for rooms and/or kitchen, as specified on Table A, for the new activity. If a fundraising event is held by the non-profit organizations currently using the Community Center free of charge, then $50 or 5% of the proceeds (net dollar amount) from the fundraising event must be paid to the Community Center Fund. An authorized representative of the non-profit organization must certify, in writing, the dollar amount of the net proceeds from the fund-raising event. Sec 3.2 Payment of Fees and Security Deposit A Security/Damage deposit shall be equal to the cost of the rental fee. The City requires that a separate check equal to the cost of the rental fee be submitted by the renter at time the Rental Application is submitted. Security/Damage deposits will also be required for non-profit organizations with proof of their non-profit status (recognized as non-profit by the IRS) and government organizations. The Security/Damage deposit shall be used by the City to pay: (1) the reasonable costs to design, repair, replace or otherwise pay for any property damage that occurs during the Renter s use of the Community Center, either by the Renter or any guest or participant at the Renter s Event or use of the Community Center or Park; (2) The extra hourly rental charge incurred if the Renter fails to surrender possession of the facilities at the time agreed; (3) The actual cost to the City to clean the facilities rented in the event that the Renter fails to do so before surrendering possession. In the event that the security deposit is insufficient to cover items (1) (3) above, the Renter will pay the City that additional cost upon demand. The City reserves all rights to collect any amounts unpaid after Aledo Parks & Community Center Rental Page 7

8 demand. (c) The Rental Fee(s) and Security Deposit, as applicable, must be paid at Aledo City Hall when the Rental Application is submitted. The reservation will not be secured without payment of these applicable fees. Rental Fees and Security Deposits may be applied or refunded on the following basis: (1) If the Renter cancels the event more than six (6) weeks before the event, the City will refund all Rental Fees and Security Deposits paid. If the Renter cancels the event six (6) weeks or less before the event, the City may deduct a $75 Cancellation Fee from the Security Deposit. The City reserves the right to waive or reduce the cancellation fee based on individual circumstances. (2) If the Community Center has been damaged or not adequately cleaned after the Event, the City may withhold all or part of the Security Deposit, at the discretion of the City, in order to determine the full extent of damages and to make all repairs and cleaning. The City will destroy the deposit check by shredding it or mail a full refund of the unused Security Deposit to the Renter within ten (10) City business days after the Event, upon the following conditions: (i) (ii) All terms of the Rental Agreement have been met; and The Community Center is left clean and in good condition. (3) If Renter exceeds his/her rental period, Renter will be charged applicable hourly fee, taken from his/her Security Deposit and/or invoiced, for the amount of time over the reserved rental. (4) If reserved rental exceeds reserved time and interferes with a secondary rental, Renter will forfeit entire Security Deposit, will be invoiced for additional rental time, and charged a $75 penalty fee. Sec. 3.3 Key Retrieval & Return (c) Renter may pick up the key to the Community Center from Aledo City Hall within one (1) normal business day before the scheduled Event, between the hours of 8:30 a.m. to 4:30 p.m. Please be aware of government holidays when determining your key retrieval. If someone other than the Renter is picking up the key, the alternate person is assumed authorization by Renter and Renter assumes full liability. Renter must deposit Community Center Key in Night Deposit Box at City Hall or physically deliver key to City Hall staff upon scheduled surrender time. Sec. 3.4 Cancellation Fee If reservations are cancelled at or more than six (6) weeks prior to the event, all rental fees and security deposit will be refunded. If reservations are cancelled less than six (6) weeks prior to the event, there will be a $75 fee for processing. The remaining amount paid for rental fees and security deposit shall be refunded. Security/Damage Deposit The Security/Damage Deposit shall be equal to the cost of the Rental Fee, and is due at the time of the reservation. Security/Damage Deposits will be required for non-profit organizations with proof of their non-profit status (recognized as non-profit by the IRS), and government organizations. Cancellation Fee If reservations are cancelled less than six (6) weeks prior to the event, a $75 processing fee may be retained, with the remainder refunded. 10 ALEDO COMMUNITY CENTER KEY RETRIEVAL & DOOR LOCK INSTRUCTIONS Thank you for renting the Aledo Community Center! We greatly appreciate your use and care of this facility. KEY RETRIEVAL & RETURN Prior to your Event at the Community Center, the Renter may pick up the key from Aledo City Hall within one (1) normal business day before the scheduled Event, between the hours of 8:30 a.m. to 4:30 p.m. Please be aware of government holidays when determining your key retrieval. If someone other than the Renter is picking up the key, the alternate person is assumed to be authorized by Renter, and Renter assumes full liability and responsibility. If City personnel is required to unlock the facility for you, either for failure to pick up the key during normal business hours or due to a lock-out, a $25 after-hours charge will be assessed, $75 if during a holiday or holiday weekend. Upon completion of your Event, Renter must return the Aledo Community Center key to Aledo City Hall at or before your scheduled time of departure from the Center. Renter may either physically deliver the key to Aledo City Hall staff upon scheduled surrender time or, if after hours, deposit the key into the Night Deposit Box at Aledo City Hall upon departure from Community Center. DOOR LOCK INSTRUCTIONS Please note, as you are entering & exiting the Community Center for set-up: the front doors at will close and lock behind you. KEEP THE KEY WITH YOU! For the two front glass doors, the first priority is to set the automatic locking device in non-functioning mode. To accomplish this: 1. Acquire the hex-key tool (located above the main doors on the hook on the right side, inside of the building). 2. Push the push bar in on each door separately and hold them. 3. Insert the hex-key tool into the hold on the side of the door near the push bar. Use the hex-key tool for both front doors. 4. Turn the hex-key tool, locking the push bar in open mode. The above steps will prevent you from being locked out of the Community Center. Upon leaving the facility, please repeat the above steps to secure and reset the automatic locks on both front doors of the Aledo Community Center. In case of emergency assistance, or if the doors are accidentally locked, please call the Community Event Planner, Toni Fisher at or the City s On-Call number: (wait for the instructions to enter your information). City staff will respond to your needs as quickly as possible. If City personnel is required to unlock the facility for you, either for failure to pick up the key during normal business hours or due to a lock-out, a $25 after-hours charge will be assessed, $75 if during a holiday or holiday weekend. 11 ALEDO COMMUNITY CENTER - RENTER S CLEANING CHECKLIST Upon your departure of the Community Center, it should look the same as you received it. You will be held liable for any and all of the below conditions deemed unsatisfactory by the City of Aledo. Your failure to comply to proper cleaning and care of this facility will result in a minimum of forfeiture of your Security Deposit, and the possible assessment of an additional charge of at least $125 cleaning fee, and/or additional fees for broken/missing items to be properly repaired or replaced. RENTED ROOM(S) & RESTROOMS: REMOVE ALL OF YOUR DÉCOR. ANYTHING PINNED, STAPLED OR TAPED TO FABRIC PANELS ON THE WALLS, FANS OR FLOORS WILL RESULT IN A MINIMUM OF FORFEITURE OF YOUR SECURITY DEPOSIT! CLEAN ALL used tables and chairs before storing them WIPE UP any spills on the floor. No water, soft drinks, juice, or any other wet or sticky residue should be or remain on any floor. (You may use a reasonable amount of paper towels and floor spot cleaner in the entry closet for cleaning; please dispose of trash properly) SWEEP all floors in rented room. (There is a push broom in the entry closet) REMOVE all trash from ALL cans that were used, including restrooms (There are trash bags stored either at the bottom of the trash can, or in the entry closet). DEPOSIT TRASH in fenced Dumpster at the rear of the parking lot. REMOVE ANY & ALL RENTED ITEMS FROM AN OUTSIDE SOURCE! We are not responsible for items left in the Community Center, and do not allow linen vendors, caterers, etc. to re-enter facility to retrieve items that day or the following business day. KITCHEN: WIPE DOWN ALL kitchen counters and appliances used; be sure Oven & Stove are OFF! WASH all used dishes, small appliances, etc.; return to cabinets from which they were found. Missing/unclean items will result in a minimum of forfeiture of Renter s Security Deposit. REMOVE trash from ALL cans that were used (trash bags are either at the bottom of the can, or in the entry closet). DEPOSIT TRASH in fenced Dumpster at the rear of the parking lot. 12 UPON YOUR DEPARTURE: REMOVE ALL PERSONAL ITEMS FROM THE FACILITY. ANY ITEMS LEFT IN THE FACILITY WILL BECOME PROPERTY OF THE CITY OF ALEDO AND WILL BE RETURNED ONLY UPON IDENTIFICATION OF SUCH ITEMS! CHECK THAT ALL DOORS ARE SECURELY LOCKED; ALL LIGHTS & FANS ARE OFF; ALL THERMOSTATS ARE SET TO: 78 o for AIR CONDITIONING; 68 o for HEAT. REPORT DAMAGES INCURRED BY YOU OR YOUR GUESTS to the City of Aledo.
