1 Clubhouse, Chickee Hut and Recreational Facilities The Clubhouse, Chickee Hut and Recreational Facilities are common elements of the Homeowners' Association for the use and enjoyment of the residents. Activities may be planned to use these facilities at no charge if the entire commmunity is invited to partake in those Activities. The Clubhouse and/or Chickee Hut may be rented for private affairs for a fee. Rental of the Clubhouse and/or Chickee Hut reserves the structure(s) for exclusive use by the renter. During private affairs, the recreational facilities other than the reserved structure(s) will remain accessible to all residents as well as attendees of the private affair. In all cases, posted rules must be obeyed. General Guidelines 1. The Secretary of the Activities Committee will schedule Community Activities and will notify the Management Company. The Manager will keep the Clubhouse Calendar up to date. An updated calendar of Community Activities and reserved parties will be posted on the Community Activity Bulletin Board at the Clubhouse. Residents may also schedule Community Activities. 2. Residents can schedule Private Parties directly with the Manager. 3. Community Activities and Private Parties must sign and agree to the appropriate Agreement for Use of the Clubhouse and/or Chickee Hut which may be obtained from the Management Company and sign the Checklist for Use of the Clubhouse and/or Chickee Hut. Said agreements will be kept on file in the office. and monies collected will be handled by the management company. 4. Keys to the Clubhouse will only be issued to those Groups/Clubs that have an agreement on file and who meet on a regular and continuing basis. They must have a designated individual who will be responsible for and sign for the key. Keys to individuals hosting private parties will be issued on an as needed basis and returned no later than the next day after the function. 5. Any committee or individual hosting an event must be responsible for non-residents access to the Waterways Community via directory or monitoring the gate only. 6. Any committee using the Clubhouse for any event is for the benefit of Waterways residents. From time to time a resident may be allowed to come to the event with a guest but said event must be made up of at least 75% of residents. 7. The person reserving the Clubhouse and/or Chickee Hut must be present for the entire duration of the event.

Also attached is a check in the sum of $ that will serve as a deposit for any damages or loss occurring because of my/our use of the Clubhouse and/or Chickee Hut, it being my/our understanding that the Waterways of Naples Clubhouse and Chickee Hut are for the use and benefit of all Waterways of Naples residents. It is my/our understanding that I/we will have the Clubhouse and/or Chickee Hut cleaned and ready for other residents by: time on date in accordance with the attached and signed checklist to be sent in with my agreement. In the event it is necessary for you to clean the Clubhouse and/or Chickee Hut, you shall have the right to deduct the cost of cleaning from my/our deposit. It is also understood that should damages be in excess of the amount deposited, which will be at the sole determination of Waterways of Naples HOA, the undersigned agrees to be liable to Waterways of Naples HOA to the extent of all additional damages, expenses, or loss and agrees to fully indemnify and hold Waterways of Naples HOA harmless for any expense or claims by anyone made because of the undersigned s use. Waterways of Naples HOA, in determining damages, at its discretion, shall not be abusive nor shall it be unreasonable. It is my/our understanding that it is the responsibility of the undersigned to make certain that the Waterways of Naples Clubhouse and/or Chickee Hut be vacated no later than time on date.i/we further agree that the following shall be a part of our right to use the Clubhouse and/or Chickee Hut under permission granted herein: Residents must disclose the type of party they are to have and the undersigned must be in attendance through the duration of the proposed function/party Waterways of Naples HOA reserves the right to approve or disapprove any function. There will be a maximum of 55 people in the clubhouse per fire department occupancy limit. I/We agree to control the parking of cars of my/our guests so as not to disturb the other residents, I/We agree that the recreational facilities including the pool and the pool area are not included in this rental and WILL NOT be closed to other residents of Waterways of Naples. I/We agree not to: allow an open flame under any HOA roof including the Chickee Hut, with the exception of small birthday cake candles. hang balloons or other items from the fans. tape anything on walls or ceilings. use glitter in the Clubhouse or Chickee Hut. It is my/our understanding that anything stored in the kitchen is to be used for Community activities only. I/We understand that paper products, utensils and the like must be supplied by the person/persons signing this agreement. It is agreed that this function is being given by the resident(s) signing this agreement and that said resident(s) will be present during the entire time of the function. Should it be determined, prior to the date of this function, the Waterways of Naples Clubhouse and/or Chickee Hut is being rented for the use of a nonresident, the reservation will be canceled and the deposit forfeited. Should it be determined by Waterways of Naples HOA in its sole discretion, at any time during the party, that I/we are in violation of any of the above rules, the party will be terminated. All guests will be required to leave immediately, and the deposit forfeited. Waterways of Naples HOA shall reserve the right to use the deposit to pay for any monies owed by the undersigned resident to Waterways of Naples HOA at the time of the Clubhouse or Chickee Hut rental. 3 925 Grand Rapids Blvd Naples, FL Phone: Fax: Guidelines for Rental of Waterways of Naples Clubhouse and/or Chickee Hut The following guidelines shall be adhered to for rental of the Waterways of Naples Clubhouse or Chickee Hut for private use. While these guidelines are written specifically for rental of the Clubhouse and/or Chickee Hut for private use, this does not preclude the Board of Directors from utilizing them in regard to use for community activities. 1. AVAILABILITY Should a resident wish to rent the Clubhouse and/or Chickee Hut for a private party they should contact the office during office hours to see if the date the rental is to occur is available. 2. CONTRACTS AND FEES If the date is available a contract will be executed between the resident renting the Clubhouse or Chickee Hut and Waterways of Naples BOD or its agent. The contract will outline the rate the resident is being charged for the rental, as well as the conditions that govern the rental. A checklist for be performed at the conclusion of the rental will accompany the contract. Security Deposit...$ only one Security Deposit is necessary even if renting both the Clubhouse and the Chickee Hut. The rates for rental of the Waterways of Naples Clubhouse shall be as follows: 0-5 Hours...$75.00 Each additional hour (or portion of) over 5 hours...$15.00 Key Delivery Charge...$10.00 Late Key Return...$50.00 The rates for rental of the Waterways of Naples Chickee Hut shall be as follows: 0-5 Hours...$25.00 Each additional hour (or portion of) over 5 hours...$5.00

KEY ISSUANCE (Clubhouse Rental only) Upon receiving a signed contract and two checks payable to Waterways of Naples Homeowners Association, one in the amount of the $ security deposit and the other in the applicable amount for the rental and services, a key will be issued to the resident renting the facility. Keys will be issued only upon confirmation of receipt of an executed contract and the two checks previously described. Keys will be issued at the clubhouse office during office hours. Any other arrangements for key delivery will require a charge of $10.00, which will be subtracted from the security deposit. 4. KEY RETURN (Clubhouse Rental only) All keys should be returned to the clubhouse office as follows: Rentals occurring Thursday Sunday... Rentals occurring Monday Wednesday... return keys Monday 10 AM 1PM return keys Thursday 10 AM 1PM Failure to return keys as outlined will result in a $50.00 late fee being subtracted from the resident s security deposit. 5. SECURITY DEPOSIT FORFEITURE (both for the Clubhouse and the Chickee Hut) Total or partial forfeiture of a resident s security deposit could occur for any of the following reasons: *Failure to adhere to the aforementioned guidelines *Failure to clean the clubhouse after usage *Failure to comply with the attached checklist *Destruction of or damage to any Association property This is your property. 5 WATERWAYS OF NAPLES HOMEOWNERS ASSOCIATION CLUBHOUSE Clubhouse Chickee Hut CHECKLIST FOR USE OF THE CLUBHOUSE: or CHICKEE HUT Wipe any food from tables and seats. If any furnitures has been moved, return it to its original position. If your guests used the swimming pool or other recreational facilities, makes sure these areas are restored to their original condition. Sweep the floors Check microwave for any food splatters and clean. Wipe counters in kitchen. Extinguish all fires in the community grills by dosing with water. Check that no heat remains in ashes. If the bathrooms were used, check restrooms for neatness. Pick up any trash and place in trash receptables. If the bathrooms were used, check that the windows are locked. Lock interior doors to men s and ladies bathroom. Open window blinds between main room and exercise room and to outside. Turn off TV. Remove all garbage inside and out and put in Waste Management trash cans outside. Do not use any other receptacles for garbage. If trash cans are full, take the extra trash with you. This is necessary due to wildlife getting into trash that is not properly secured. Leave light on in vestibule (by the front door) on and over the microwave Leave A/C door ajar for ventilation. Take one last look that everything is in place and ready for the next use of the Clubhouse Lock all exterior doors. After locking check doors from outside to make sure they are secure.
