1 RESOLUTION NO R A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF OSCEOLA COUNTY, FLORIDA, ESTABLISHING CERTAIN BUILDING PERMIT AND RELATED FEES, COMMUNITY DEVELOPMENT FEES, OSCEOLA COUNTY PARK AND CONSERVATION AREA FEES, AUSTIN TINDALL REGIONAL PARK FEES, 'OSCEOLA HERITAGE PARK STADIUM FEES, OSCEOLA COUNTY SOFTBALL COMPLEX FEES, EVENT SPONSORSHIP BANNER FEES, OSCEOLA COUNTY LIBRARY FEES, EMERGENCY 911 ADDRESSING FEES, EMERGENCY MEDICAL SERVICES FEES, FIRE MARSHAL INSPECTION FEES, ANIMAL SERVICES FEES, CORRECTIONS FEES AND PUBLIC RECORDS FEES; SUPERSEDING THE FEES PREVIOUSLY ESTABLISHED; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR EFFECTIVE DATE. WHEREAS, the Osceola County Board of County Commissioners (the "Board") regulates various activities related to health, safety and welfare, resulting in the provision of services by county departments; and WHEREAS, the Board imposes fees for provision of these services, generally setting rates at levels sufficient to fund the full cost of providing the services funded from such fees; and WHEREAS, the Board desires to approve increased rates for certain of these fees that will become effective on October 1,2014; and WHEREAS, the Board will review and update the fees for future fiscal years through the annual budget process; and NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF OSCEOLA COUNTY, FLORIDA: SECTION 1. BUILDING PERMIT AND RELATED FEES. The Board hereby adopts the building permit and related fees listed in Appendix A, which is attached hereto and made a part hereof by reference. These fees shall be collected from all persons, or entities, requesting the enumerated services, provided however, that all or part of these fees may be waived by the Board when in its judgment the circumstances so warrant. Proceeds of the fees will be applied to the cost of providing building permit and related services. SECTION 2. COMMUNITY DEVELOPMENT FEES. The Board hereby adopts the Community Development fees listed in Appendix B, which is attached hereto and made a part hereof by reference. These fees shall be collected from all persons, or entities, requesting the enumerated services, provided however, that all or part of these fees may be waived by the Board when in its judgment the circumstances so warrant. Proceeds of the fees will be applied to the cost of providing community development services. Currently, a subsidy from general revenues is needed to provide adequate levels of service in these areas. SECTION 3. OSCEOLA COUNTY PARK AND CONSERVATION AREA FEES. The Board hereby adopts the standard fees listed in Appendix C, which is attached hereto and made part of by reference.

2 SECTION 4. AUSTIN TINDALL REGIONAL PARK FEES. The Board hereby adopts the standard fees listed in Appendix D, which is attached hereto and made a part hereof by reference, for use of the Austin Tindall Regional Park. These fees are negotiable if the proposed event will generate a required minimum number of room nights within Osceola County. SECTION 5.. OSCEOLA HERITAGE PARK STADIUM FEES. The Board hereby adopts the standard fees listed in Appendix E, which is attached hereto and made a part hereof by reference, for use of the baseball stadium at Osceola Heritage Park. These fees are negotiable if the proposed event will generate a required minimum number of room nights within Osceola County. SECTION 6. OSCEOLA COUNTY SOFTBALL COMPLEX FEES. The Board hereby adopts the standard fees listed in Appendix F, which is attached hereto and made a part hereof by reference, for use of the Osceola County Softball Complex. These fees are negotiable if the proposed event will generate a required minimum number of room nights within Osceola County. SECTION 7. EVENT SPONSORSHIP BANNER FEES. The terms and conditions for licensing event sponsorship banners at Austin Tindall Park, the Osceola County Softball Complex and Osceola County Stadium have been established by the Board in Resolution No R. The Board hereby adopts the event sponsorship banner fees listed in Appendix G, which is attached hereto and made a part hereof by reference. SECTION 8. OSCEOLA COUNTY LIBRARY SYSTEM FEES. The Board hereby adopts the Osceola County Library System fees listed in Appendix H, which is attached hereto and made a part hereof by reference. SECTION 9. EMERGENCY 911 ADDRESSING FEES. The Board hereby adopts the emergency 911 addressing fees listed in Appendix I, which is attached hereto and made a part hereof by reference. These fees shall be collected from builders, developers, and other persons platting property, provided however, that all or part of these fees may be waived by the Board when in its judgment the circumstances so warrant. SECTION 10. EMERGENCY MEDICAL SERVICES (EMS) FEES. The Board hereby ratifies the emergency medical services fees listed in Appendix J, which is attached hereto and made a part hereof by reference. SECTION 11. FIRE MARSHAL INSPECTION FEES. Fees have previously been established for Fire Marshal inspection services. The Board hereby adopts the Fire Marshal inspection fees listed in Appendix K, which is attached hereto and made a part hereof by reference. SECTION 12. ANIMAL SERVICES FEES. Animal services fees have been established through the adoption of Resolution No R. The Board hereby ratifies the animal control fees listed in Appendix L, Which is'attached hereto and made a part hereof by reference. SECTION 13. CORRECTIONS FEES. The Board hereby adopts the corrections fees listed in Appendix M, which is attached hereto and made a part hereof by reference. The following fees are governed, in whole or in part, by statute or administrative order: subsistence fees (section , Florida Statutes); medical program fees (section , Florida Statutes); work release program fees (section , Florida Statutes); felony drug court testing fees (Ninth Judicial Circuit Court Administrative Order No ); misdemeanor drug court testing fees (Ninth Judicial Circuit Court Administrative Order No ). SECTION 14. PUBLIC RECORDS FEES. Fees have previously been established for Public Records in Resolution #09-107R. The following fees are governed, in whole or part, by Florida

3 Statutes, Chapter 119. The Board hereby ratifies the Public Records fees listed in Appendix N, which is attached hereto and made a part hereof by reference. SECTION 14. CONFLICTS. The fees adopted pursuant to this Resolution supersede any fees previously adopted by the Board for the same services. Any resolution, or part thereof, in conflict with this Resolution, or any part hereof, is hereby repealed to the extent of such conflict. SECTION 15. SEVERABILITY. If any clause, section or provision of this Resolution shall be declared unconstitutional or invalid for any reason or cause, the remaining portion of said Resolution shall be in full force and effect and be valid as if such invalid portion thereof had not been incorporated herein. SECTION 16. EFFECTIVE DATE. 4 APPENDIX A BUILDING PERMIT AND RELATED FEES Nothing contained herein shall relieve any person of the responsibility for obtaining any permits and paying any other fees which may be required by other codes adopted by Osceola County or by the State of Florida, but which may not be part of this resolution. All permit fees shall be paid in full prior to issuance of any permit and prior to commencement of the work authorized by said permit. Description.:. The purpose of this fee is to offset the costs associated to the State of Florida mandated Records Retention and Records Management requirements. On large projects, exceeding $1,000, in contract costs, the amount of this fee will be determined on a case by case basis. On Master Filed Multifamily or Commercial projects this fee may also be negotiated. Change in Contractor Requests shall be made on a "Notice of Contractor Change" form as provided by the Osceola County Building Department. All requirements of that form shall be met and the above fee shall be charged. Change in Subcontractor Requests shall be made on a "Notice of Subcontractor Change" form as provided by the Osceola County Building Department. All requirements of that form shall be met and the above fee shall be charged. Change of Use/Occupancy Permit Required for any Commercial Occupancy where the owner, tenant or use of that building or unit is changed. This permit is required to be produced to the Tax Collector's Office at the time of Business Tax Receipt Application. The permit holder will need to call for a general inspection of 2

6 the premises. Any work to be done to modify or to make the repairs to the building, necessary as a result of the general inspection, shall be permitted separately. No occupancy of the building will be allowed until all violations are corrected and a new Certificate of Occupancy has been issued. Computer Reports Includes information on contractors, permits, inspections, certificate of occupancy, etc. Copy Charges Will be charged based on paper size. Plans will be charged at the going rate paid directly to our private vendor. Failure to Obtain a Permii Failure to obtain a permit prior to commencement of work will result in the above penalty. Permit Application Extensions Shall be requested in writing on a "Permit Application Extension" form provided by the Osceola County Building Department with justifiable cause given (see note in "Permit Extensions"), and signed by the contractor. Extensions shall be made prior to the expiration of the application, which is six (6) months from the date of application and shall be limited to two (2) 90 day extensions. Permit Extensions Shall be requested in writing on a "Permit Extension Request" form provided by the Osceola County Building Department with justifiable cause of the extension given, and signed by the contractor. (Note: The simple desire to delay the progress of the project is not considered justifiable.) Extensions shall be made prior to the expiration of the permit and shall be limited to two (2) 90 day extensions. Permits are valid for a period of one (1) year provided and inspection is passed within the first six (6) months and there is no lapse between inspections of more than six (6) months. Permit Fee A minimum permit fee will apply to all permits unless otherwise noted. Permit Research Fee Payable at the time of request and is not refundable. Plan Review Fees Are paid at the time of submittal and are non-refundable. Plan Revisions The initial review fee includes one set of revisions to address initial plan review comments. All subsequent revisions and all those submitted after permit issuance will be charged at the above rate. Refunds Will not be granted on permits of less than $ Refund requests shall be made on a "Permit Refund Request form, as provided by Osceola County, with the original permit and plans attached, signed by both the owner and the contractor, and notarized. Refunds will only be considered if requested within 30 days of the issue date of the permit and provided no inspections have been made by the Building Department. Refund amounts are limited to 75% of the original permit fee in excess of $ Re-inspection Fees For all types of permits, shall be charged for re-inspections made a s result of work not being ready on the date or at the time inspection was requested, work rejected due to failure to meet the applicable code requirements, where there was a failure to call for a required inspection, and when inspections are canceled after the inspection cut-off time established by the department. The first re-inspection fees apply to a code violation or to work not being ready. Subsequent failures of the same code violation and/or work not being ready will be charged a fee equal to four (4) times the initial fee. All re-inspection fees shall be paid in full prior to scheduling the final inspection, prior to permanent power release, and prior to the issuance of a Certificate of Occupancy. Technology Fee Shall be charged the above rate on all building permit fees, including all subcontractor permits. The purpose of this fee is to offset the costs associated to technology related items, such as computer purchases, software purchase, inspector technology aides, and any other electronic devices used to provide a greater degree of customer service and reduce response time in providing permits and inspections. 3

7 RESIDENTIAL BUILDING PERMIT FEES The following fees are for residential construction (single family; duplex and town home construction and their related appurtenances). The total area is based on total square footage of the building under roof. The following fees include initial construction of the principal building and all attached appurtenances under finished roof. Swimming Pools The above 'fee includes initial construction of pool or spa, and all related electrical, plumbing and concrete work. COMMERCIAL AND MISCELLANEOUS RESIDENTIAL PERMITS AND PERMITS BASED ON CONSTRUCTION VALUE Construction valuation shall include all labor and material costs needed to construct a building or structure from unimproved property through to completion and/or issuance of a Certificate of Occupancy. Valuation shall be determined using one of the following methods: (a) Copy of the signed construction contract; (b) Detailed cost estimate; (c) Using the latest published Building Valuation Data as provided by the International Code Council, assuming good or average construction and the Orlando area modifier. The following permit fees will apply to residential and commercial solar permits. 11 Commercial Master Filing of Plans The initial review fee includes one set of revisions to address initial plan review comments. All subsequent revisions and all those submitted after permit issuance will be charged at the above rate. Commercial Permits Include all permits not covered under "Residential Building Permits" above. These permits shall be charged underthe fee schedule contained herein. Miscellaneous Residential Permits, Additions and Renovations If not specifically named under "Residential Building Permits" above, shall be charged based on valuation in accordance with the fee schedule contained herein. Permits Based on Valuation Are for building permits only. All other sub trades are permitted individually. Note: Fees contained herein do not include fees required by other Counties or State Agencies. Plan Review Fees Shall be payable at time of application and may be adjusted if total valuation is modified during the plan review process. Residential is considered Duplex, Single Family, Town House, or Associated Structures. All other than Residential Related Structures are considered Commercial.
