10 Why does the City annex enclaves? To promote sustainable development by Facilitating the efficient delivery of municipal services, Ensuring timely police, fire and emergency response, Allowing all residents using City facilities to contribute their fair share to the operation and maintenance costs, Assessing transportation impact fees for developments using City arterials for access, and Applying appropriate land use regulations, development standards, gas drilling standards, property maintenance standards, fire codes, construction codes and environmental regulations. 10

11 Annexation Policy: Fiscal Impact Analysis General Fund revenues based on existing and proposed land uses and population estimate General Fund expenditures based on transitional costs and anticipated service response calls 10-year analysis timeframe 11

12 Annexation Program The annexation program is a general guide for making decisions about annexation. Areas are identified within Fort Worth s ETJ that the City might wish to consider for annexation during the next five years. The annexation program is not legally binding: Inclusion of an area in the annexation program does not obligate the City to annex that area. Omission of an area from the annexation program does not prevent the City from annexing that area. 12

14 Annexation Plan The annexation plan is a State-mandated document for considering annexation of areas with 100 or more residential parcels. Areas may only be annexed three years after the plan is adopted. The annexation plan is legally binding: Inclusion of an area in the annexation plan does obligate the City to annex that area. Removal of an area from the annexation plan may prevent the City from annexing that area for five years. 14

15 Development Agreements in Lieu of Annexation State law requires cities to offer a development agreement in lieu of annexation to parcels with an agricultural exemption from the appraisal district. If the development agreement is accepted by the property owner, the area cannot be annexed for a specified time period, typically five years. The development agreement requires the property owner to continue the agricultural uses and follow certain City regulations. 15

31 How does annexation affect the use of land? Existing land uses may continue after annexation, even if inconsistent with City of Fort Worth zoning applied to the property. The uses become nonconforming, aka grandfathered. Existing water wells and septic systems may be used. New development and redevelopment must comply with all City codes. 31
