5 Annexation Policy: Criteria A. Full-Purpose Annexation Area to meet one or more of the following conditions: 1. Enclave a. Enclave within City s ETJ b. Ability to provide municipal services 2. Urban Development a. Development activity of an urban nature b. Ability to provide municipal services c. Positive fiscal impact analysis 3. Growth Center a. Designated growth center b. 6 B. Annexation Policy: Criteria (cont.) Limited-Purpose Annexation Area must meet one or more of the five conditions for full-purpose annexation and either of the following conditions: 1. Populated Area 2. Long-Term Development 6
7 Why does the City annex enclaves? To promote sustainable development by Facilitating the efficient delivery of municipal services, Ensuring timely police, fire and emergency response, Allowing all residents using City facilities to contribute their fair share to the operation and maintenance costs, Assessing transportation impact fees for developments using City arterials for access, and Applying appropriate land use regulations, development standards, gas drilling standards, property maintenance standards, fire codes, construction codes and environmental regulations. Areas are identified within s ETJ that the City might wish to consider for annexation during the next five years. The annexation program is not legally binding: Inclusion of an area in the annexation program does not obligate the City to annex that area. Omission of an area from the annexation program does not prevent the City from annexing that area. 9 Annexation Plan The annexation plan is a State-mandated document for considering annexation of areas with 100 or more residential parcels. Areas may only be annexed three years after the plan is adopted. The annexation plan is legally binding: Inclusion of an area in the annexation plan does obligate the City to annex that area. Removal of an area from the annexation plan would prevent the City from annexing that area for four to five years. Lakeside Lake Worth 38 Lake Worth 9
10 Development Agreements in Lieu of Annexation State law requires offer of development agreement in lieu of annexation to parcels with an agricultural exemption. If owner accepts agreement, area cannot be annexed for typically five years. Agreement requires owner to continue agricultural use and follow certain City regulations. There are currently 59 executed development agreements. 10
