The applicant is requesting that the four variances to reduce minimum front, rear and flanking yard setbacks be granted, as shown in the proposed plan of subdivision attached to this report as Appendix "A": The application is being presented to the Committee for a recommendation to Council relative to authorizing the issuance of the Development Variance Permit. 2. Developments Ltd Background The subject property is subject to an application for subdivision (Subdivision Application No ) to create 18 "fee-simple" lots for the development of single-family dwellings. Purpose It is desired by the owner to subdivide the subject property into 18 "fee simple" lots, two of which would (proposed lots "16" and "17", as shown in the proposed plan of subdivision attached to this report as Appendix "A") require the following requested variances to the Land Use Bylaw (No. 151): i. Variance to s (1) to reduce for the minimum setback to the Front Lot Line of Lot 16 from 7.5 m to 6.0 m; ii. Hi. iv. Variance to s (2)(b) to reduce the minimum setback to the Flanking Lot Line of Lot 16 from 6.0 m to 2.25 m; Variance to s ( 1) to reduce the minimum setback to the Front Lot Line of Lot 17 from 7.5 m to 6.0 m; and Variance to s (5) to reduce minimum setback to the Rear Lot Line of Lot 17 from 7.5 m to 6.0 m. Site Context The subject property is currently in the process of being developed as a proposed 18-lot subdivision under the Residential 1 (R1) zoning designation. Single-family residential uses exist on the neighbouring properties surrounding the subject property. Discussion The proposed variances are expected to have minimal impact on the neighboring properties and future of the subdivision. However, staff have identified the need to identify where on-site parking will be accommodated on proposed Lot "16", as driveway access to this lot would be accommodated via Demel Place because of the topography of the site. The requested variance would allow future construction on proposed lot "16" to be within 2.25 m of Demel Place. Such a configuration would not accommodate driveway parking, as the minimum length of a 90 degree parking stall under section of the Land Use Bylaw is 5.8 m. Therefore, Council may wish to consider making it a condition of the requested development variance permit that a minimum setback of 5.8 m be required between any garage door face and the flanking lot line of Lot "16". Chief Building Inspector's Comments: No objections. Page Page 20 of 30

Developments Ltd City Engineer's Comments: No objections, subject to a condition of variance that requires sufficient on-site parking to be accommodated on proposed Lot "16". OPTIONS In regard to Development Variance Committee may: Permit Application No. DVP-16-12, the a) Recommend to Council that DVP be authorized for issuance, subject to conditions; b) Recommend to Council that DVP be authorized for issuance without conditions; c) Defer the application for further information; OR d) Recommend to Council that the application be denied. 4. RECOMMENDATION That Council authorize Development Variance Permit DVP for issuance with the following variances: a. Variance to s (1) to reduce for the minimum setback to the Front Lot Line of Lot 16 from 7.5 m to 6.0 m; b. Variance to s (2)(b) to reduce the minimum setback to the Flanking Lot Line of Lot 16 from 6.0 m to 2.25 m; c. K. Developments Ltd.) 1. SUMMARY A request has been submitted on behalf of F. K. Developments Ltd. for approval of either the name "Robson Crescent" (first choice) or "Robson Place" (second choice) for the new road in the 18-lot subdivision of Lot 'A, Section 73, Metchosin District, Plan 38960, and Lot 'A', Sections 63 and 64, Esquimalt District, Plan (3430 Karger Terrace). The application is being presented to the Committee for a recommendation to Council regarding the processing of a road naming bylaw pursuant to Section 39 (a) of the Community Charter. 2. OVERVIEW 2.1 Purpose A subdivision application creating 18 single-family residential lots is nearing the final approval stage at 3430 Karger Terrace. The subdivision will create one new dedicated municipal road shown as "Road A - A" on the map attached to this report as Appendix'1'. The proposed name "Robson" is taken from the name of one-time Colwood resident Mr. Robby Robson who was born in November, 1924 in Manitoba. Mr. Robson served as a Sergeant in the 1st Canadian Parachute Battalion and over the course of 12 years in the military, saw service in both World War II and the Korean War. According to our records, Mr. Robson was the first person to build a house on Fulton Road. He purchased a large piece of property in 1959 and cleared a roadway (which later became Karger Terrace) from Fulton to the building site in City of Colwood 3300 Wishart Road Colwood BC V9C1R1 P: F: E: planninq(5)colwood.ca Web: Page 27 of 30
28 Proposed New Road Name Karger Terrace Subdivision Page In 1961, he ran power up from Sooke Road to the site, enabling him to begin construction of a house in September of that year and move into the home in February, Mr. Robson also acted as Chairman of the first Water Board for the Triangle Mountain Improvement District. The suggested street name has been cleared as being "unique" within the road network covered by the local 911 emergency response system and staff have no objections to its use. In order to better fit with the naming practices associated with similar cul-de-sac roads in Colwood, it is recommended that the term "Place" be used rather than "Crescent". The "crescent" designation is more commonly applied to streets which have a looping configuration and linkage with another road at both ends. 2.2 Background A Development Variance Permit (DVP-02-11) was authorized for issuance by Council resolution on June 27, 2011 and issued on July 7, 2011 for the purpose of varying the design standards for the subject road. The approved variances included the following: Reduction ofthe required road right of way width from 15m to 10m; Reduction of the minimum vertical curve lengths on three sections of the new road; and, Reduction of the minimum vertical curve K-values on two sections of the new road. 3. OPTIONS The Committee may: a) Recommend to Council that a bylaw be processed which applies the name "Robson Place" to the new public road to be dedicated in the subdivision at 3430 Karger Terrace OR b) Postpone a decision for further information and/or alternative names; OR c) Recommend to Council that the proposed street name be rejected; AND/OR d) Recommend an alternate name to Council. 4. FINANCIAL IMPLICATIONS There are no financial implications associated with this road naming proposal Page 28 of 30

COMMUNICATION Referrals for comments were forwarded to City departments on August 13 th and August 23 rd, The only concern expressed in responses related to the use of the term "Crescent" in the developer's first choice. RECOMMENDATION The following recommendation is offered for consideration: That Council process a bylaw for the purpose of naming the new public road to be dedicated in the subdivision at 3430 Karger Terrace "Robson Place".
