Chair Norvold called the meeting to order. A roll call was taken of members present and a quorum was met. Approval of Minutes October 10, 2013 Public Comments Financials None The board reviewed the financial reports for the following: - As of Sept. 30, 2013 Street assessments were paid due to an error in the system. - As of October 31,2013 Includes turnover costs for 2334 Elianna which had a tenant move out. - Project Update 3 rd Quarter Street assessments were down from last year. The HRA discussed more intensive marketing of the program for next year s projects. - Rental Property Update:3 rd Quarter Carpet was replaced and a tree removed at 517 Washington Street. - CDBG Balances: 1 st Quarter, Federal Fiscal Year 2013 (July 2013-June 2014) A motion was made by K. Vohs and seconded by K. Fink to approve the October 10, 2013 minutes. All in favor. Motion carried. Page 1

3 Action/Discussion Items Approve CDBG FY 2014 Application Approve Online Homebuyer Course TIF Update: Presidential Commons Work Plan Review None Staff noted the CDBG allotment for 2014 is estimated to be $65, which is a 10% decrease from the FY 2013 amount of $72, She suggested the following breakdown: - Downpayment Assistance - $20,000 - Residential Rehab - $45,315 Chair Norvold felt it is important to discuss options for mobile home ownership. She suggested inviting Paul Smith to speak at the January meeting about the continuum of mobile home parks. Staff was also asked to research mobile park options used by other cities such as the one in Cannon Falls. E. Zweifel reported on a mobile home park presentation she had viewed and offered to the presentation to the board members. Chair Norvold and E. Zweifel reported on the online version called Framework which could replace the Homestretch classes required by first time homebuyers. They had a chance to preview the program and found it to be acceptable. One concern was that you could not fast forward through the program if need be. Staff also noted lenders such as Wells Fargo, Bremer Bank, U.S. Bank and Minnesota Housing have accepted this form of education. Staff noted a $40,000 payment gap in the TIF financing for the Presidential Commons townhomes due to a decrease in the townhome housing market. The City Council will be discussing it at their December 10 th meeting. They have the option to do an inter-fund loan transfer from TIF #4 (up 40 $250,000) or may require the HRA to utilize fund balance dollars to cover the shortfall. HRA members agreed they would like to fund a portion of this shortfall since it relates to housing. A discussion ensued regarding the amount of fund balance dollars to contribute and whether the full amount should come from the HRA or TIF #4 or a combination of both. Below is a list of scenarios in order of priority they would support: - TIF #4 financing of $250,000-50% TIF #4/50% HRA Fund Balance - $40,000 from HRA Fund Balance Staff requested the HRA consider adding the following items to their work plan: - Emphasize Mobile Home Park Ownership - Research VISTA Program for assistance in Housing/Economic Development areas - Consideration of platting the balance of the Southbridge Property - Consideration of additional land acquisition She noted additional land is available for purchase at a very reasonable price in the Southbridge area. A motion was made by K. Fink and seconded by E. Zweifel to approve a FY 2014 CDBG funding breakdown of $20,000 for Downpayment Assistance and $45,315 for Residential Rehab. All in favor. Motion carried. A motion was made by E. Zweifel and seconded by K. Vohs to accept the online option (Framework) as a replacement for the Home Stretch classes for individuals receiving downpayment assistance funding. All in favor. Motion carried. A motion was made by K. Fink and seconded by K. Vohs to approve the following recommendations, in order of priority, to fund the TIF shortfall at Presidential Commons: 1. $250,000 from TIF # % TIF #4/50% HRA Fund Balance up to $50,000 maximum 3. $40,000 from HRA Fund Balance All in favor. Motion carried. A motion was made by K. Vohs and seconded by K. Fink the approve the following additions to the work plan: - Emphasize Mobile Home Park Ownership - Research VISTA Program for assistance in Housing & Economic Development areas - Consideration of platting Page 2

Heinemann suggested adding energy efficient partnering with Xcel Energy and also focusing on workforce housing and rental incentives. the balance of the Southbridge Property - Consideration of additional land acquisition All in favor. Updates Staff reported the following program updates: Spring Creek Townhomes Units are complete and exceeded deadline by one month Elianna Townhomes Empty unit has been painted and cleaned and is ready for new tenant. HRA Term Limits Chair s Report Next Meetings Adjourn Adjourn the meeting Veterans Park There are signed contract agreements on two properties. Four are in the process of weatherization checks. Engineering will work with sump pump and storm sewer issues at another property. K. Fink notified staff he will not be reapplying for his board position. The HRA thanked him for his years of service. Staff noted the City will be advertising open vacancies on all boards in the coming weeks. The HRA is being asked to review and approve the new rents for BACKGROUND INFORMATION: Fair Market Rate should be the cost of rent and utilities for a unit per month. Federal Fiscal Year 2013 Fair Market Rates for Rice County are: Efficiency One Bedroom Two Bedroom Three Bedroom Four Bedroom $492 $611 $827 $1199 $1205 Current rent at 517 Washington (2 bedroom units) is $827 per unit, per month. The HRA pays all utilities for this unit. Rent at 2330 and 2334 Elianna (4 bedroom units) is $920 per unit, per month. The tenants pay their own utilities at the Elianna units. Average utilities for those units is approximately $250/month, which is why rent charged is approximately $250 less. Utility estimates are provided by the Section 8 program in Rice County. Fair Market Rates for FY 2014 were released in November 2013 and have changed: Three Four Efficiency One Bedroom Two Bedroom Bedroom Bedroom $505 $628 $849 $1231 $1237 ACTION REQUESTED: Staff is requesting the HRA to approve calendar year 2014 rents as follows: 517 Washington Street units: $849/unit/month As the 517 Washington Street units are part of the Transitional Housing program funded with federal McKinney-Vento funds (HUD funds), the rent amount does not stray from the HUD rates. 2330/2334 Elianna Drive units: $920/unit/month Staff is suggesting NO increase for the Elianna Drive units. Staff has discussed utility rates at length with the tenants and other residents of the Elianna units. The units are not exceptionally energy efficient and the utility rates paid by the tenants are higher than the HUD average. Resolution Rules of forfeiture 3. Parcel Information SUMMARY REPORT: Staff was alerted by the Rice County Auditor that a parcel is in tax forfeiture for non-payment of property taxes, and as required under MS , Rice County is requesting the City Council to approve the parcel for public auction, or auction to adjacent owners, or the City may request a conveyance to the City for public use. The parcel in forfeiture is Parcel (2007 Hidden Valley Road), located near Jefferson Road and Heritage Drive. This is a townhome property that may be an appropriate property for the HRA to utilize as an affordable rental property. If the HRA is interested in this acquisition, a recommendation would be made to the City Council to pass a resolution indicating an interest in purchasing the property. If approved by the City Council, the City would request acquisition of the parcel under Remove blight/provide affordable housing. These means are summarized below: MS (d) Nonconservation tax-forfeited lands may be sold by the county board to an organized or incorporated governmental subdivision of the state or state agency for less than their market value if: (1) the county board determines that a sale at a reduced price is in the public interest because a reduced price is necessary to provide an incentive to correct the blighted conditions that make the lands undesirable in the open market, or the reduced price will lead to the development of affordable housing; and (2) the governmental subdivision or state agency has documented its specific plans for correcting the blighted conditions or developing affordable housing, and the specific law or laws that empower it to acquire real property in furtherance of the plans. If the sale under this paragraph is to a governmental subdivision of the state, the commissioner of revenue must convey the property on behalf of the state by quit claim deed. If the sale under this paragraph is to a state agency, the commissioner must issue a conveyance document that releases the property from the trust in favor of the taxing districts. Page 1 of 2

10 Meeting Date: January 9, 2014 Item No. 6c The HRA would have to utilize this property for affordable rental property. A household income level and set rent amount would be placed on the unit. The City may acquire this parcel for less than fair market value. Current market value, according to the Rice County Assessor s Office, is $116,300. Staff recommends requesting a purchase price starting at $34,800. At this price, it would take four years of monthly rent at $725 (affordable at 60% area median income) before the HRA breaks even with the upfront costs, not including ongoing taxes. Staff also recommends setting a not to exceed purchase price of $80,000. This is still below fair market value; it should also be assumed that the property will need some basic maintenance, repairs or upgrades before it may be rented to a household. ACTION REQUESTED: The City of Northfield must indicate its intent by February 17, The HRA must make a recommendation to the City Council, who then makes a recommendation to the Rice County Commissioners. The Rice County Commissioners then make a recommendation to the State of Minnesota. The HRA is requested to pass Resolution , recommending the Council to approve the request for acquisition of 2007 Hidden Valley Road through the tax forfeiture process. 11 RESOLUTION NO HOUSING AND REDEVELOPMENT AUTHORITY A RESOLUTION BY THE HOUSING AND REDEVELOPMENT AUTHORITY OF THE CITY OF NORTHFIELD, MINNESOTA RECOMMENDING THE NORTHFIELD CITY COUNCIL TO REQUEST ACQUISITION OF PARCEL FROM THE STATE OF MINNESOTA TRUST BY THE CITY OF NORTHFIELD FOR AFFORDABLE HOUSING WHEREAS, the City of Northfield through the Rice County Auditor was notified on December 19, 2013 regarding the opportunity to request conveyance of parcel for affordable housing under M.S ; and, WHEREAS, authorization to request conveyance of parcel requires resolution from City Council; and, WHEREAS, the Northfield Housing and Redevelopment Authority has reviewed this parcel and has determined that acquisition would be appropriate under the HRA s continued goal of providing affordable housing; and, WHEREAS, the HRA would rent the unit to income-qualified households at an amount that meets the affordable housing guidelines; and, NOW THEREFORE BE IT RESOLVED that the Northfield Housing and Redevelopment Authority recommends the City Council request acquisition of parcel from the State of Minnesota Trust for the purpose of affordable housing. 12 Instructions for Applying for a State Deed State Deed Application Form and Conditional Use Deed Supplement The State Deed Application Form is required for all applications for state deeds issued by the Department of Revenue previous forms will no longer be accepted. All applications are required to be accompanied by a Wetland Certification Form. Any application for a conditional use deed also requires a completed Conditional Use Deed Supplement (discussed later in these instructions). Application for State Deed for Tax-Forfeited Land (State Deed Application Form) When completing the State Deed Application Form, the sections labeled with a solid grey box are required for all applications, while the sections labeled with a white box are only required as directed. Name of County Enter the name of the county where the taxforfeited property is located in the space provided under the title of the form. Type of Acquisition Please select the type(s) of acquisition (In most cases, this will be only one. However, it may be appropriate to select more than one when a statute or special law outside of Minnesota Statutes, Chapter 282, authorizes the acquisition): Purchase should be selected for all purchases at market value regardless of the method of sale (public sale under Minn. Stat , subd. par. 4 or 5, private sale under Minn. Stat , subd. 7a, or acquisition by a governmental subdivision under Minn. Stat , subd. 1a, par. (b)), except those parcels released from the trust in favor of the taxing districts to a state agency (see Release below). Remove Blight/Affordable Housing should be selected only for those parcels of tax-forfeited land acquired under Minn. Stat , subd. 1a, par. (d). Acquisition Authorized by other statute or Special Law should be selected when the acquisition was authorized by a statute other than one of the listed options or a special law (in some situations it will be appropriate to select his box along with a listed type of acquisition). The citation of the special law is also required. Attach a copy of any necessary certification as well. Correction Is this application intended to correct a previous deed? If this application is to correct a previously issued state deed that contains an error(s), check Yes and complete the Corrections section of the form. Otherwise, check No, skip this section, and proceed to the Applicant section of the form. State deed number of the original deed Enter the state deed number of the original deed that is being corrected. Information being corrected The most common errors being corrected will be either the grantee s name or the legal description. If an error that is different than one of these occurred, select other and list the error in detail. If there is more than one error, select all that apply. Was this state deed recorded? If the previous state deed was not recorded, then it must be returned with the new application. However, if the previous state deed was recorded, then you must provide the recording information requested on the application. Applicant Name of Applicant Enter the name of the applicant, as it should appear on the state deed. If the applicant is a governmental subdivision (county, school district, city, town, or special taxing district), enter the legal name of this entity. (Examples of special taxing districts include the Metropolitan Council, MCDA, housing and redevelopment authorities (HRA s), economic development authorities (EDA s), port authorities, regional development commissions (RDC s), hospital districts, and watershed districts.) Mailing Address Enter the mailing address of the applicant on the lines provided. Enter the address, city, state and zip code. This should be the address used for the regular delivery of U.S. mail. Property Information Ownership Please check the box that corresponds with the appropriate type of ownership. If there is coownership, please be certain to differentiate between joint tenancy and tenancy in common. Rev. 09/12 2

14 Date of Auditor s Certificate of Forfeiture On the line provided, enter the date that the requested property was forfeited to the state. Enter the month, day, and year. This information should reflect the date on the auditor s certificate of forfeiture. Sale Information (if applicable) As applicable, enter the date the tax-forfeited land was sold, the date the purchase price was paid in full, and the amount of the purchase price. Purchase Price It is important that the amount of the purchase price is filled in (when applicable) and that this information is accurate. When this amount is between $501 and $1,000, the following statement will appear on the face of the deed: THE MONETARY CONSIDERATION FOR THIS DEED IS $1,000 OR LESS. When the amount is $500 or less, the following statement will appear on the face of the deed: THE MONETARY CONSIDERATION FOR THIS DEED IS $500 OR LESS. Legal Description In the box provided, enter the complete legal description of the requested tax-forfeited property. (Please do not use an abbreviated legal description used for tax statement or other purposes.) Attach additional sheet(s) if necessary to accommodate the legal description. Disclosure of Location of Wells State law (M.S. 103I.235) requires the disclosure of wells on tax-forfeited land being conveyed. The face of the deed will indicate wells information for the property as indicated below. It is the county auditor s (or land commissioner s) responsibility to check the appropriate box on the application form indicating whether: a) There are one or more wells on this property Selecting this box will cause an X to be marked on the face of the deed indicating A well disclosure certificate accompanies this document. (If electronically filed, insert WDC number: ). (If you have an electronic WDC number, please list it for inclusion in the deed.) PLEASE NOTE: The county is responsible for providing the well disclosure certificate at the time of recording; b) There are no wells on this property Selecting this box will cause an X to be marked on the face of the deed indicating The Seller certifies that the Seller does not know of any wells on the described real property. ; or c) No change since last well certificate Selecting this box will cause an X to be marked on the face of the deed indicating I am familiar with the property described in this instrument and I certify that the status and number of wells on the described real property have not changed since the last previously filed well disclosure certificate. Wetland Certification A Wetland Certification Form must be completed and attached to each state deed application form. This is needed by the Department of Revenue to determine whether or not a restrictive covenant must be inserted into the state deed. It is the county auditor s (or land commissioner s) responsibility to ensure that it is completed properly. Replacement The applicant is: grantee/grantee s successor Check the appropriate box selecting whether the applicant is the grantee named in the original deed or the grantee s successor. Rev. 09/12 3

15 Name of original grantee If the applicant is the grantee s successor, please state the name of the grantee on the original deed. Otherwise this line can be left blank. Original deed information Please provide the original date that unrecorded date was issued along with the state deed number (if known). Attach a statement Attach a statement of reasons in support of allegation that said deed has been lost or destroyed before it was recorded (please be specific). If it appears that the facts stated in the petition are true, a new deed will be issued with like effect as the original deed. (State Deed Application Form Page 2) Certification Some applications will also require a certification to be made. Please provide the information as it corresponds to the type of acquisition selected on the front of the form. Signature(s) All applications require the signature of the county auditor. Market Value of Requested Property Please provide the market value of the requested property, from the records of the county assessor. If the most recent market value of the property occurred in the last six years, a new assessment is not required. (Please Note: This is not the same as the market value determined by the County Board for the purposes of a sale of the property. Total Acreage of Requested Property List the total acreage of the requested property. This will be reviewed to determine if the size of the requested property is appropriate for the requested public use. Forfeiture Recorder/Registrar Information As applicable, list the date of recording of the auditor s certificate of forfeiture and the document number as assigned by the county recorder or registrar of titles. Public Use Multiple Uses and Multiple Parcels There will be only one use granted per application (and therefore only one use listed on a deed). Multiple parcels will be allowed, but only if they are all being put to a single use and only if the entirety of the multiple parcels constitutes a contiguous property (land mass). Authorized Public Use Minn. Stat , subd. 1a, par. (e) limits the authorized public uses for use deeds to: (1) a road, or right-of-way for a road; (2) a park that is both available to, and accessible by, the public that contains amenities such as campgrounds, playgrounds, athletic fields, trails, or shelters; (3) trails for walking, bicycling, snowmobiling, or other recreational purposes, along with a reasonable amount of surrounding land maintained in its natural state; (4) transit facilities for buses, light rail transit, commuter rail or passenger rail, including transit ways, park-and-ride lots, transit stations, maintenance and garage facilities, and other facilities related to a public transit system; (5) public beaches or boat launches; (6) public parking; (7) civic recreation or conference facilities; and (8) public service facilities such as fire halls, police stations, lift stations, water towers, sanitation facilities, water treatment facilities, and administrative offices. In the space provided, describe in detail the intended authorized public use to be made of the tax-forfeited property. You must be specific. If more room is needed, use attachments. Park Use Conditional use deed applications for park use require additional information to be provided on the application. As indicated above, the law states that a park must be available to, and accessible by, the public that contains amenities. When referring to the park, park means the whole park including a pre-existing park that is being expanded by the property in the application. It is this meaning of park that is meant to be considered when answering the park use questions on the Conditional Use Deed Supplement form. Public Service Facilities Using the space provided, please indicate the type of facility that is planned. Establishing the proposed use Minn. Stat , subd. 1d requires that property conveyed by conditional use deed has been put to the proposed use within three years of conveyance. However, it should be noted that there is no failure to put the land to the use if a formal plan of the governmental subdivision shows an intended future use of the property for the proposed use. Please indicate if you anticipate establishing the proposed use within 3 years, and if not when you anticipate the use being established. Enclosures Fee Required Minn.
