1 Vrydag 29 Mei 2009 VOLUME 38 NO. 21 R3.00 incl. Chamber celebrates 50 successful years THE Tzaneen Chamber of Commerce celebrated their 50th birthday on Saturday. The Gatsby event produced much initiative and creativity, in both the costume and décor departments. The evening would not have been possible without the generous sponsorships from various individuals and entities, front: Fonnie Mushwana, wife of Mayor Mushwana, and Conrad Kruger, President of the Tzaneen Chamber of Commerce. Back: Prof Alwyn Louw, President of the South African Chambers of Commerce and Industries, and his wife Anet, sponsors Ephraim and Suzan Mahayi of Tzaneen Guest House, main sponsors Anza and Manie Coetzer of Blue Dot Printers and WMC Sheet Metal, guest of honour Mayor OJ Mushwana, and Christina Kruger, wife of Conrad. Watch the LETABA HERALD for the Tzaneen Chamber of Commerce supplement, and learn more about the event and its sponsors. Please take note THE GTM is holding a public participation meeting today (Thursday) regarding the 2009/2010 proposed budget. The meeting will be held at Tzaneen Primary and starts at 18:00.

2 PAGE 2 LETABA HERALD - Friday 29 May 2009 NEWS Dr. Nick Gilliliand (83). Two year old dies in fire A two year old boy burned to death after his family failed to rescue him. Ndzalama Austin Makhubele was amongst the nine people who were caught in a blaze and the only one who lost his life. The incident occurred at Mavalani outside Giyani. It is alleged that the Ngobeni family used a candle as an alternative after electricity was cut off in most areas on May 19. It was at about 23:00 when the eldest sister realised that the rondavel, which she was sleeping in with eight other people, was on fire. After she screamed, the police said, everyone ran outside and forgot to take the two year old. It is alleged that, after they heard the baby's cry, the mother of the child and grandmother tried to rescue him but were too late as the blaze intensified. The mother of the child, grandmother, and four other family members sustained burn wounds and were treated at a local hospital. Police are pleading with community members to always snuff out candles before they fall asleep, as it could burn furniture, or worse, people. Inspector Thomas Makhubela said investigations continue.

No quorum at meeting THE GTM held a public participation meeting regarding the 2009/2010 proposed budget last Thursday. However, due to lack of advertisement and no sufficient notice of the meeting, the turnout proved appalling. Last Thursday was Ascension Day, and another reason why so few people attended the meeting. The meeting commenced with eight people in attendance, and grew to no more than 15 people half an hour into the meeting. It was decided to postpone the meeting, as those few in attendance cannot be considered representative of the GTM comm u n i t y. The next meeting will be held today (Thursday) at Tzaneen Primary at 18:00. 10 PAGE 10 LETABA HERALD - Friday 29 May 2009 LETTERS Strang up in arms over GTM services INEFFICIENCY in the GTM has Ken Strang from Haenerstburg up in arms. According to Strang he personally delivered a letter concerning his electricity bill to the Tzaneen Municipal Manager's secretary. To date Strang has not even received an acknowledgement of receipt, let alone a r e p l y. Below is the letter Stang wrote. He said he knows there are many of them on farms in the Haenertsburg area that have the same problem. His concerns are twofold: Inefficiency in the municipality and absolutely no return on his rates paid, not even the rubbish dumping f a c i l i t y. He would like to ask the question as to why Haenertsburg dumping site was privatised and for what reason? To send a rubbish truck all the way from Tzaneen, just to collect the domestic waste from Haenertsburg residents, and then take it all the way back to Tzaneen is not a really good and profitable business practice. The old method was far more cost effective, according to Stang. The letter read as follows: Att: M. F. Mangena. Municipal Manager. Re: Account Numbers 63508, and With reference to the above, herewith please receive my submission. On 24/11/2008 I queried the fact that I was charged R for private dumping at the Haenertsburg dump site. I was referred to a Mavis, at phone number , and this person told me that the dump was run by a private company and they could do nothing about municipal charges. I again queried this charge at your accounts department and was told, very aggressively, that I had to pay whatever the municipality thought fit. I was charged R1-06 and 93c interest on outstanding balances, whereas I had never received a previous account and I have been informed that your invoice dated 31/10/2008 was the first invoices generated for farm rates and taxes. I cannot pay interest on an amount I had never been billed for. If your accounts department is inefficient, the consumer cannot be held responsible. This interest will not be paid. I was charged R33-63 on both my accounts for a Friendly Reminder. This was not a friendly reminder, but a demand for payment and I see no reason to pay such a ridiculous amount for a letter you choose to send out as a business practise. This charge will not be paid. On the 03/12/2008 I did pay my rates and taxes, but unfortunately included the payment with my electricity payment and the whole amount was credited against my electricity account. This, I accept, was my fault and I will accept interest charged. I have, once again, been charged for private dumping in my electricity accounts dated 30/11/2008 and 28/02/2009. I pay rates and taxes without any benefits accruing to me from the municipality and would like you to inform me as to where I can dump my domestic waste, which is one black refuse bag per week, as no-one in the municipal offices is able to inform me of this. Please could you reconcile my accounts accordingly. K. P. Strang. The response from the Municipal Manager, Mabakane Mangena, is as follows: It is so unfortunate that we have to respond to these unnecessary demands brought forward by your newspaper on behalf of the resident of Ward 16, in Haenertsburg. Firstly, it must be made clear from the onset that his letter of complaint never reached my office. Though, I strongly feel that the issues raised in the letter are not necessarily genuine, I would however take some time to clarify our valued client's query. Secondly, it must be indicated to you that the 'dumping site' referred to in the letter existed prior the Transitional Local Council, and it was illegal. There was no permit from the Department of Environmental Affairs for its operation, hence it had to close down. What we did as a municipality, was to establish a drop-centre (public off-loading site) for that community in order for them to go and offload their refuse there. However, the operation of that drop-off centre cannot be free of charge as you would expect, but with the exception refuse generated from garden work. Council approved the rates, services charge and sundry tariffs. The current rate for offloading refuse at the drop-off centres (Public off-loading sites) is R88 per light delivery van or trailer load not exceeding one ton, R220 per lorry load not exceeding three tons but exceeding one ton, R660 per lorry load not exceeding six tons but exceeding three tons, R990 per lorry load not exceeding ten tons, but exceeding six tons, R1 650 per lorry load exceeding ten tons. Residential service per month is currently at R70-39, wherein we do refuse removal weekly. The resident is further challenging the R33-63 charge for the reminder notice, and the R1-06 and 93c interests charged on his account. But in all fairness, anyone would agree with me that if you skip payment, whether it is at a retail shop or a "bounced" debit at the bank, there would be a charge for that. We do not derive pleasure by charging residents this amount, but there has to be some control measures around this issue of defaulting. The resident is further saying that he is paying rates and taxes without benefits accruing to him. It is very important that the resident be informed that the municipality is in charge of the operation of the landfill site, which accommodates all refuse (waste) generated in the whole of Greater Tzaneen, his included and this is at a cost of close to R5 million every y e a r. The streets that he uses every day to go shopping have to be repaired. These are just a few services that I can mention to you right now that the municipality, in a co-operative governance, offers to its communities. The question then would be at whose cost?

11 BRIEWE Katryn visits orphans MISS Limpopo Teen, Katryn Barwise writes: I visited the Abraham Kriel Children s Home in Modimolle last weekend. It was my first big charity project as Miss Limpopo Teen 08 for this year, and I enjoyed it a lot. I gave three classes, with 15 children per class, where every child learnt something new. In the first class I taught the children how to make beaded jewellery. The girls made beautiful beaded charm bracelets and the boys made key rings. Every child received a box full of beads to continue practicing their new skills as a jeweller. I would like to thank Bead Bazaar for the beads and Boulevard Cycles for the boxes. The second class was on modeling and scrapbooking. I taught all the girls ramp skills and I gave them each a manual that contains all the modeling tips and information they need. After I told them about photographic modeling, they each had a photo shoot with a professional p h o t o g r a p h e r. We printed out their photos and they scrapbooked their own photographs. The scrapbooking was lots of fun! Thank you to Waltons and Sakara for making it possible for me to give every child a bag full of scrapbooking goodies. I would also like to thank Coca-Cola and Fruit & Veg City for the beverages and fruit. The third class was for all the vocalists. We practiced with a vocal coach CD and I taught them some basic techniques. We also practiced a song together which they sang with me on stage at a concert that Saturday evening. I left them the vocal coach CD and I am going to visit them soon to see how they are progressing. The children also received a certificate, which says that they successfully completed the vocal training. The children are very interested in the classes named above and they enjoyed it a lot. There are 170 children at the Children s Home. If you want to sponsor beads or scrapbooking goods, please feel free to contact me and I will take it to them: butterfly@katryn.co.za. I made plenty of new friends at Abraham Kriel Children s Home and I can t wait to visit them again. They all received me with open arms and they made me feel welcome. The children are all very loving and good mannered and we had a splendid time together. I became really fond of the kids and I was sad to leave, but I promised them to come again soon. 12 PAGE 12 LETABA HERALD - Friday 29 May 2009 LETTERS Katryn visits Abraham Kriel KATRYN Barwise, Miss Teen Limpopo, visited Abraham Kriel Children s Home in Modimolle. A LITTLE while or so ago on the TV News, a Police officer proudly showed us firearms which had once belonged to law-abiding South Africans being dumped into a smelter in Gauteng where they were reduced to a puddle of molten steel. About that time, too, the newspapers carried a story of a most feared rapist in KwaZulu Natal who had been shot dead while carrying a previously licensed handgun which had been surrendered to the police by its law-abiding owner during the firearms amnesty period which ended at midnight on March 31 this y e a r. Now we are given a story by the proponents of Gun Free South Africa (GFSA) that the Firearms Control Act is to reduce the number of firearms-related crimes in South Africa and, Instant freak out when I handed in my two disarmed hand guns hopefully, to keep the weapons from falling into the hands of criminals. Well, maybe. But many of us suspect that another, more subtle, reason is to disarm South Africans who may become gatvol with the machinations of the present government, stage a rising and shoot a few of our current masters. A precedent for this was set during World War Two, when the then South African government had a similar fear of a rising by Nazi sympathisers and the populace had to hand in their guns. In other words they were disarmed to prevent such a possibility. And again, reading the newspapers of today, have we had a reduction in firearm-related crimes? Hardly. Every day there are stories of an armed robbery there and a killing with guns there! Any self-respecting crook knows how to get himself an AK 47 or whatever his preferred weapon. They move these days in large gangs of up 20 or so force armoured vehicles carrying cash off the roads and all carry guns! It can be argued statistically that the incidence of crime in South Africa is moving up and that criminals are becoming more audacious and inventive in their methods. Meanwhile, the clamp-down on law-abiding gun owners has been made tougher than ever. As I recall, it all started about five years ago and after a couple of extended amnesties we were given until midnight of March 31 this year to either re-licence our firearms or surrender them to the police for destruction in one of those smelters we were shown on the TV news. And don t think that it s just a matter of re-applying for a licence. A friend of mine, who has been a hunter all his life, grew up on a farm, has his own game farm, and served in two armies (Rhodesian and South African) has had to get a certificate of competence to handle a firearm, prove that he has no criminal convictions, get a testimonial that he is of good character, and prove by means of photographs of him posing with animals that he has shot that he is a dedicated hunter. All, of course, plus substantial fees for each hunting rifle or shotgun that he wished to licence! And, I think, the licences have to be renewed periodically. Then I saw a letter in a newspaper from a couple in their seventies who live on a farm and now face the prospect of having nothing with which to defend themselves if they are invaded one night by a couple of those brave thugs who prey on elderly farm people. And if they do have a gun and shoot and kill their attackers, they will probably have a lot of explaining to do. Criminals also have human rights, don t you know, and you can t just go around shooting them without a good reason! Let me end with a story of my own experience. When this GFSA business first started, I had a couple of handguns which were kept in a safe. I had read about a gun which had been handed in to the police at Messina some weeks previously being used in an armed robbery. So I thought, no way is this going to happen to mine. So I took an angle grinder and cut the barrels. Then I took them to the local police station and handed them in. There was instant freak out! I was told that every gun handed in was fired and ballisticaly examined to determine if it had ever been used in a crime. I was told I could be prosecuted for defeating the ends of justice! Anyway, I was granted amnesty and no action was taken against me. For the record, I later saw an assurance by the police that those guns in the smelter had been forensically tested. And, incidentally, the gun found on the KwaZulu Natal rapist was found to have been handed in at the Jeppe police station. So how did it find its way down to a rapist in KwaZulu Natal?

THE latest report of the National Credit Regulator indicates that over 6 million consumers cannot pay their monthly installments and are at least two months in arrears. There are basically five options for a consumer struggeling with debt, says Mr. Boltman, an Attorney and Debt Counselor of Debt Help Nationwide: a) Voluntary distribution - an arrangement is made with all debtors that you pay a smaller, agreed amount. This seldom works as all the credit providers must agree on the amount and also not take to legal action. There is nothing preventing a credit provider to take further legal action. b) Sequestration (backruptcy). All that you have is sold and shared equally between the credit providers. The benefit is that afterwards, you don't have further debt. The downside is that you lose all you have. Not all qualify for sequestration, as there must be a benefit for creditors in you being sequestrated. c) Administration - to qualify you need to owe less than R You pay the amount available after your reasonable expenses are deducted from your income. The money is collected by the administrator and is distributed to the creditors every 3 months. The downside is that few consumers owe less than R Crooked administrators that charged excessive fees and didn't make payments as they should have, gave the industry a bad name. d) Debt Review - in terms of the new National Credit Act a Debt Counselor can help you, if you are over indebted, by reducing your monthly installments to an amount that you can afford. The process stops legal action and you keep the assets that you have. There is no limit to the amount of your debt. Debt Review is only available for natural persons and not for legal entities. The downside is that you will take longer to settle your debt, as you pay smaller monthly payments. e) If you do not use any of the above options, the law will take its course. Summons will be issued, judgment given and first your movable and then immovable property will be sold. A financial enquiry will be held and the court will give an order as to what amount you must pay to your creditors monthly. As all do not take action at the same time, it may mean many days in court and high stress levels as collectors and attorneys pressurise you to pay their clients. All the options have intricate legal and other implications and this short summary is just an effort to make the options clearer to you as consumer.
