DISTRICT UNDER IN THE MATTER OF A Section 214, Te Ture Whenua Maori Act 1993 Hanakawhi Bonnington Poi HANAKAWHI BONNINGTON POI Applicant Hearing: Judgment: 4 September 2006 (Heard at Ruatoria) 3 October 2006 RESERVED DECISION OF C L FOX Introduction [1] On 3 October 2005, the Maori Land Court received an application from Hanakawhi Bonnington Poi to constitute a Whanau Trust to be known as the Hanakawhi Bonnington Poi Whanau Trust. The applicant was to be the sole trustee. Hearings and Amended Application [2] The matter first came before the Maori Land Court on 5 December 2005 and it was adjourned on that date for succession to the applicant's mother to be completed. (See 71 RUA ) The application was adjourned again on 6 April 2006 at 72 RUA 131 after the Court was advised that the applicant and her brothers and sisters wanted to set up a joint Whanau Trust. She requested more time to file a new application with supporting consents. [3] The original application to constitute the Hanakawhi Bonnington Poi Whanau Trust was called again on 7 June 2006 before His Honour Judge Harvey who

(See 73 RUA 239) The application was back before the Court on 4 September On that date the applicant filed consents to the establishment of a whanau trust from 7 of her siblings and their children. [4] She advised after questioning from the Court that the name of the trust should be the Hiria Kiekei Grant and Te Urikore or Jury Poi Whanau Trust and it should cover the Maori land interests of the following people ifthey consent: 1. The Court will not include the interests of those siblings who are deceased and! or who do not consent. Orders [7] The Court makes orders pursuant to Te Ture Whenua Maori Act 1993: (a) Section 71 amending the original application to an application to constitute the Hiria Kiekei Grant and Te Urikore or Jury Poi Whanau Trust. (b) Sections 214 and 219 constituting the Hiria Kiekei Grant and Te Urikore or Jury Poi Whanau Trust and declaring the terms of the trust in accordance with the standard Tairawhiti draft trust order now approved by the Court.
