Just a few neighborhood reminders from our H.O.A. 1) There is NO Parking allowed on the Grass or any Common Areas. All 4 wheels must be on the concrete drive or the asphalt. You are Responsible for your lot and guests. 2) We do allow for occasional parking on the street during Holidays, and Visitation of occasional Guests when your driveway is full. It is your responsibility to inform your guests of our parking rules. 2) Please don't forget that as Rer our Covenants, our Common Areas are not for Pet use, Article VI, Section 15. You must also clean up behind your pets as you walk them through the neighborhood....it's a Polk County Law, as well as a violation of our Neighborhood Covenances. 3) Please remind your children and guest to be mindful of someone else's property and not to trespass. The only access to the large pond is on the Pebblebrooke Dr. side where we have trees planted. The rest is someone's private property... Please do not trespass on their property if you do not have written permission to do so.... 4) We must remove grass clippings from the streets after mowing lawns to prevent problems with our drainage as per Southwest Florida Water I Waste Management. 6) Don't forget to remove your trash cans by Monday evening after pickup. They must be stored either in your garage, or behind a large shrub/bush or behind the Air. Conditioner unit and not in front of garage or house. 7) A reminder that if you plan on Painting, installing a Fence or having any construction to the exterior of your house, you must first get approval in writing 30 days in advance. We require a sample of all colors and a Painting Request Form filled out, and a copy of any construction. Our approved color list can be seen upon written request to the board. 8) We allow fishing at the pond for homeowners only. All guests of a homeowner must have the homeowner present while fishing. Remember, this is a Catch n' Release pond Only. 9) If you walk around our pond or outside of the neighborhood, PLEASE carry a small bag and pick up any trash. We have enclosed these changes. Please read and place with your Bylaw Booklet. This is also notification that you have till MARCH 31, 2011 to make the necessary changes to your property to comply with said changes that were voted in. This letter is also to notify you that all ponds have the following restrictions. (1.) No Trespassing (2.) No Swimming (3.) No Wading (4.) Catch and Release Fishing only. ' These rules are being enforced for Liability concerns as well as recent Trespassing concerns. At no times should anyone be fishing at any of the ponds without a member being with them. No member has the Authority to allow a Non-Member permission to fish without a Member being present. Also be advised that any property needing to be communicated to by means of Certified Mail will be charged a $25.00 Administrative Fee per letter. PEBBLEBROOKE ESTATES SPECIALASSESMENTS FOR BYLAW VIOLATIONS 1.) When you purchased your property you signed a PUD agreement at the lawyers office that you would abide by all Association Bylaws. 2.) Our fine structure is within the Florida State Statue 720.305. FIRST NOTICE ------- Warning Letter notice to correct violation. SECOND NOTICE --- $50.00 FINE with 30 days to pay Voting rights removed until paid. THIRD NOTICE AND ALL OTHER NOTICES FOR SAME VIOLATION -- - $100.00 per day with 30 days to pay and loss of voting rights for calendar year. After 30 days of 3 rd notice and payment is not received. It will be turned over to our Legal Department where you will also be responsible for any attorney fees and could eventually result in Home Foreclosure. Your rights to appeal --- H you feel that you should of not been fine and you were within Association bylaws, you can request a hearing within 14 days of receipt of violation letter. The board will appoint 3 members from association that are not Board Members and are not related to any Board Members. In the hearing the three members will review all documents related to your case and will make a decision based on the facts of the case. That decision will be final.
