- 2 - GENERAL REMARKS AND STIPULATIONS (Which shall be deemed to form part of the Conditions of Sale) 1. SITUATION AND GENERAL - Hobbs Lot Farm has been farmed by the Butt Family for three generations. Mr. J. Butt, who has farmed under the style of A. & J. Butt, has now decided to retire from farming and it is for this reason that Hobbs Lot Farm comes onto the market. Cultivations and cropping of the Farm will continue whilst marketing takes place and a Tenant Right Valuation will take place as appropriate. The land is situate approximately 2 miles north of March and 6 miles south west of Wisbech. Access is over a right of way from Wisbech Road, close to Hobb's Lot Bridge. The Vendor currently resides at Hobbs Lot Farmhouse, which he is retaining for the time being, together with the farmyard and a small area of land, as staked on site, the whole containing approximately 4.8 acres. METHOD OF SALE - The Farm is offered for sale by private treaty and prospective purchasers are invited to make contact with Maxey Grounds & Co., 20-24 Market Place, March, PE15 9JH, to discuss their interest at an early date. 3. EXCHANGE OF CONTRACTS AND COMPLETION - Exchange of contracts will take place 21 days after receipt by the Purchaser(s) Solicitor of the draft contract with completion as soon as possible thereafter. A deposit of 10% of the purchase price will be payable on exchange of contracts. 4. POSSESSION - Vacant Possession will be given upon completion of the purchase. Early entry may be permitted, upon payment of a double deposit, in order that the purchaser can carry out cultivations, etc., at his own risk. 5. TENANT RIGHT - All unexhausted manurial values and lime residues are included in the sale. In addition to the purchase price, the purchaser will be required to pay for cultivations carried out, seeds drilled, manures and sprays applied since the 2014 harvest. LAND CLASSIFICATION - The land is shown as Grade 1 on the Agricultural Land Classification Map of England and Wales (Sheet 124). 7. NITRATE VULNERABLE ZONE - The Farm lies within a Nitrate Vulnerable Zone. 8. SINGLE PAYMENT SCHEME & BASIC PAYMENT SCHEME - The arable land has been registered with the Rural Payments Agency under the Single Payment Scheme and Entitlements have been established. It is intended that Entitlements will be transferred to the Purchaser (or his nominee) following completion of the sale. The R.P.A. have been asked to confirm the eligible areas of each field and estimates have been included in these particulars, pending their reply. The Vendor will retain all payments in respect of the 2014 claim year.
- 3-9. ENTRY LEVEL STEWARDSHIP - The land is currently entered into an Entry Level Stewardship Scheme. The scheme runs until 30 th June 2016. The Purchaser will be required to take over the obligations of the E.L.S. Scheme, subject to the rules and regulations of Natural England. A copy of the existing Entry Level Stewardship Options Map is available from the Agents. Prospective Purchasers are advised to satisfy themselves relating to all Natural England requirements in regard to the transfer of the land (Natural England, Eastbrook, Shaftesbury Road, Cambridge, CB2 8DR, telephone: 0300 060 1114 or fax: 0300 060 2070). 10. UNDERDRAINAGE - The majority of the land been underdrained in past years and some plans are available. 11. SUGAR BEET CONTRACT - Messrs. A. & J. Butt have a Sugar Beet Contract for 2014 of 428 tonnes. They have opted not to grow sugar beet in 2015 under the British Sugar Scheme, but they will assist in the transfer of an appropriate proportion to the Purchaser, subject to British Sugar Rules and Regulations. 12. SERVICES - There are no services connected to the land. 13. OUTGOINGS - Such of the outgoings as are known are mentioned in these particulars, but no guarantee is given that the amounts stated are accurate or that all outgoings appear. 14. SPORTING RIGHTS - The sporting rights are NOT included in the sale, and are being retained by the Vendor, for the time being. 15. MINERAL RIGHTS - The minerals, so far as they are owned, are included in the sale. 16. BOUNDARIES - The Vendor will not be bound to determine the ownership of boundaries. The Purchasers must satisfy themselves as to the ownership of all boundaries. 17. RIGHTS OF WAY AND EASEMENTS - The land is offered for sale with the benefit of and subject to all rights of way, water and other rights and to all easements and wayleaves for electric cables, wires, pylons, stays and transformers (if any) also all telephone poles and wires at present erected on or passing over or under land and to all agreements or pending agreements in regard thereto. Access to the land being sold is over the existing farm roadway, which also gives access to Hobbs Lot Farmhouse. The Purchaser will be granted a right of way over the roadway, which has a made up width of approximately 3 to 3½ metres, plus an overhang, then through the yard. The overall width of the legal right of way will be 10 metres, although it must be appreciated that vehicles should remain on the hardened area wherever possible. The right of way is for agricultural purposes only and runs from Wisbech Road, shown A to B and coloured brown on the plan. An overhead electricity line crosses the Farm and there is a single pylon in field O.S. 8980.
- 4 - There is a land drainage pipe in O.S. 8980, which drains the garden of Hobbs Lot Farmhouse, also a soak away from the cesspit. The right is reserved for these arrangements to continue. The Middle Level Commissioners have a byelaw width along the Twenty Foot River to allow for maintenance and other works. This byelaw width is 20 metres from the landward toe of the embankment and it is necessary to obtain the Commissioners' consent for activities within this distance. There is also a 9 metre byelaw width along the Sixth District Drain which is administered by the March Sixth District Drainage Commissioners.
