These Rules and Regulations have been developed by the Board of Directors as an attempt to simplify the Homeowners understanding of the information contained in the HAILE FOREST Master Declaration of Covenants, Conditions and Restrictions that each homeowner received and agreed to upon purchase of his/her dwelling unit. This document does not supercede, change, alter or replace the Master Declaration of Covenants, Conditions and Restriction. Any conflict between the two (2) documents will be resolved by referring to the Master Declaration of Covenants, Conditions and Restriction, however, the Covenants authorize the Board of Directors to implement additions or changes as needed. OBJECTIVE: In order to preserve and enhance the property values and amenities of the properties, the common property, and all landscaping and drainage, and other improvements now or hereafter built or installed thereon shall at all times be maintained in good repair and condition and shall be operated in accordance with high standards.

ARCHITECTURAL CONTROL: Fences, decks and other structures. Written plans must be submitted in writing to the Architectural Control Committee, (submit to Association Manager). No construction is to be started prior to receiving approval, in writing, from this committee. The Board of Directors reserves the right to make a homeowner remove any exterior addition that has been made with out prior approval. (Please allow 30 days for approval). Exterior Appearance*. The paint, coating, stain and other exterior finishing colors on all buildings, fences, and outbuildings may be maintained as that originally installed, but prior approval of the Architectural Control Committee, in writing, shall be necessary before any such exterior finishing color is changed. Landscaping*. The Board of Directors has the responsibility to oversee the maintenance of the residential landscaping. If the homeowner fails to provide the necessary maintenance of their lot, the Board of Directors will provide that service and bill the homeowner accordingly. All lots must be sodded. Flowerbeds, landscape islands, and shrubs are permitted but must be maintained in a neat and orderly appearance.

Term of Approval. Approval by the Architectural Control committee shall be effective for the period of time stated in the approval letter from the ACC to the homeowner. *Approval to add fencing that will connect to or adjoin to existing fencing will be approved only if the new fencing is the same height and style as the existing fencing. All fences must be maintained and in good repair at all times. No fence shall be constructed in the front yard of any residence. That is, no closer than 3 feet from the edge of the house closest to the street, at any point. *Swing sets and other recreational equipment, lawn equipment etc. are permitted. The approval for such items will be based on whether or not, in the opinion of the committee, the request is aesthetically pleasing to the community. * All shrubs, and fill plants must be properly trimmed and kept up. Lugustrums, boxwoods, and other landscape shrubbery must not grow higher that 6 feet if up against your home.

Pets: ALACHUA COUNTY ORDINANCE FOR DOGS Sec. 72.12 Physical control of dogs off owner s property. (a) (b) An owner shall have physical control of a dog at all times when off the owner s property, unless the property owner or designee or lessee consents to the removal of the physical control. Off the owners property means on any public or private property including but not limited to streets, sidewalks, schools, parks, or private property of others. For property owned or controlled by a government entity, it is presumed that is not given unless posted. Dogs which are exempt from this section include: 1. A police dog, fire dog, or SAR dog, as defined in F.S. 843.19, when the dog is operation in its official capacity, as defined in said section; or 2. A dog that is a trained and certified animal service dog used to assist persons with disabilities when it is performing those services; or 3. A dog involved in organized training or exhibiting including obedience trials, conformation shows, field trials, hunting trials, and herding trials; or 4. A dog involved in any legal hunt in an authorized area, and when the owner possesses a valid hunting license. (Ord. No 99-20 s 1, 11-23-99) Sec. 72.13 Removal of dog excreta. The owner of a dog shall remove any excreta deposited by the dog on any property other than the owner s, including but not limited to public property, streets, sidewalks, schools, parks, and private property. the owner of a dog shall carry adequate waste removal devices or disposal bags while off of the owner s property, unless the waste removal devices are provided. (Ord. No 99-20 s 1, 11-23-99) Owners may call Alachua County Animal Control, 955.2333 to register complaints.

Swimming Pool: No children under 12 allowed without adult supervision No tents/canopies permitted in pool area or parking lot Only residents and their guests are allowed at the pool (maximum number of guests is 10 per lot) No glass containers allowed on the pool deck No pets allowed in the fenced pool area Keep gate closed at all times No lifeguard on duty, swim at your own risk No diving allowed No running around the pool Pool hours are: 9 am. - 10 pm. The Board of Directors has the authority to close the pool at anytime for any reason without notice. Food and beverages allowed on pool deck (no eating or drinking in the pool) trash and cigarette butts must be disposed of properly Do not play with safety or maintenance equipment Please wipe down pool chairs after use

Use Restrictions: Residential use: Each lot and dwelling unit shall be used as a residence for a single family and for no other purpose. Signs: No sign of any kind shall be displayed to the public view on the properties except signs installed by the developer or approved by the Architectural Committee. The sole exception is that one (1) Real Estate sign no larger than 18 X 24 may be placed on a lot during the period in which said lot is for sale. Temporary signs may be displayed for periods not to exceed 7 days (garage sale, etc.) Political signs cannot exceed 30 days. Garbage Disposal: No garbage, refuse, trash, rubbish or other waste material shall be kept or permitted on any lot or dwelling unit except in county approved containers. All containers shall be shielded from view by a wall or similar enclosure or enclosed garage. Drying Areas: No clothing, laundry or wash shall be aired or dried on any portion of a lot or dwelling unit exposed to view from any other lot or dwelling unit or from any portion of the common areas. Reflective Materials: No building shall have any aluminum foil (Reflective tint) placed in any window or glass door or any reflective substance placed on any glass.

Commercial Trucks/Vans, trailers, campers and boats: All commercial vehicles, campers, mobile homes, motor homes, boats, boat trailers, atv s, wet bikes, jet ski s etc. house trailers or trailers of every other description must be parked or stored in a fully enclosed garage or an area completely screened from view from any other lot or dwelling unit or common area. Parking. Parking of everyday use vehicles must be in improved parking space; driveway or garage. Parking on the street is permitted but please be aware that you may be blocking emergency vehicles and garbage trucks. Please only use the street when absolutely necessary. Noise: No loud noise or offensive activity. Residents are responsible for their guests. Excessive noise, including: yelling, music, car alarms or horns that become offensive are strictly prohibited. Continued violations of the noise rules will result in a written warning and will be reported to proper authorities.

Assessments: Homeowner s association assessments are billed semiannually, in January and July. Make checks payable to: Hickory Forest Owners Association and mail to Action Real Estate Services. A $20 late fee will be assessed if not paid by the 30 th of the month billed. Accounts will be sent to collections and additional fees incurred if not paid within 30 days from date of late notice. Other Trash: Please do not place trash receptacle, recycle bin, etc. at curb on or before 5:00 PM on the day before pickup and please return receptacle to garage as soon as possible after pickup. Pool Keys: 1 Key for the pool will be issued to new owners. Additional keys are available from the Manager s office for $10. Tennis Courts: Only residents and their guests are permitted to use the tennis courts. Please keep gates closed at all times.

Clubhouse: The clubhouse is available for your personal use. It must be reserved, in advance. A rental fee of $50.00 per day is required, as well as a damage deposit of $100.00. Rentals cannot exceed 10pm. The deposit is refundable if the clubhouse is returned in a clean and orderly condition with no damage. This includes: removing all trash, garbage, etc. To reserve the clubhouse contact Action Real Estate Services, 331.1133. HICKORY FOREST EXTERIOR APPEARANCE GUIDELINES. Exterior Appearance*. The paint, coating, stain and other exterior finishing colors on all buildings, fences, and outbuildings may be maintained as that originally installed, but prior approval of the Board of Directors, in writing, shall be necessary before any such exterior finishing color is changed. Owners are required to submit/perform the following before any request for exterior color change will be reviewed.

1. Complete and submit the Request for Exterior Change form. 2. Submit 6 samples of the proposed new body paint color. (must be commercially available paint chips) 3. Submit 6 samples of the proposed new trim paint color. (trim must be a lighter shade than the body color) 4. Paint a test area on the front or side (visible from the street) of the house with the new paint color, not less than 3 feet by 3 feet in size. 5. Garage doors must be painted white or the same color as the house body. Upon completion of the above items, the Board of Directors will review the proposal and notify the owner, in writing, of the approval or denial. If all three requirements are not fulfilled, the request will not be processed. Owners who begin work before receiving such written approval will be notified of their failure to follow association rules and the matter will be turned over to the association attorney, without further notice, for the purposes of requiring the property to be repainted to its original color. All costs associated with this process will be charged to the owner. These rules do not apply to owners wishing to repaint their house using the same color as currently exists.

HICKORY FOREST LAWN MAINTENANCE ENFORCEMENT POLICY 1. Upon notice from the landscape committee, the Board will notify the owner of non-compliance issue and given 30 days to correct the violation. 2. Owners not bringing property into compliance within the 30- day period will be notified, via certified mail, that failure to come into compliance within a second 30-day period will be sent to attorney to pursue legal remedy. 3. If the violation is related only to the mowing of grass, the notice will specify a 14-day compliance period, after which, the Board will have the grass cut and bill the owner directly, by the current lawn maintenance company. Once forwarded to the attorney, a small claims action will be initiated. The owner will be responsible for any and all costs associated with this process. In addition, the manager will no longer have any direct contact with the owner. All correspondence will be with the attorney. Adopted 6.1.09

Hickory Forest Homeowners Association, Inc. Clubhouse Rules and Rental Agreement Homeowner shall indemnify and hold the Association harmless from any and all damages caused to persons or property during the Homeowner s use of the facilities. In case of emergency please call 352-331-1133. If you call after hours the message will give you an emergency phone number. Fees are as follows: 1. $50.00 non-refundable rental fee. $25.00 must be put down with this form in order to hold the date of your reservation. The date will not be reserved until funds are received. The other $25.00 may be paid at any time prior to picking up keys. 2. $100.00 refundable deposit. This can also be paid any time prior to picking up keys. ** The rental fee and deposit must be paid with separate checks or money orders. We do not accept cash. ** You may mail your check to our office at: Action Real Estate Services 6110-B NW 1 st Place Gainesville, FL 32607 You may also drop your check off at the same address using the drop box at the bottom left of the front door.

Keys: Any damages incurred to the clubhouse by the homeowner or function guests will result in a delay of your deposit being returned until all necessary repairs are made. If repairs exceed $100.00 the homeowner will be responsible for paying the difference to make the repairs. Failure to return the clubhouse clean will result in your deposit being deducted $50.00 for cleaning. NO EXCEPTIONS. Please call Action Real Estate Services at 352-331-1133 or email camaction1@gmail.com to arrange pick-up. Keys may be picked up on a weekday the day of or before your function. If your function is on a weekend keys may be picked up on the Friday before. You are solely responsible for picking up the key. We will not deliver the key nor extend office hours for pickup. No refunds will be issued for failure to pick up the clubhouse key. KEYS MUST BE RETUNRED TO ACTION REAL ESTATE WITHIN 24 HOURS FOLLOWING YOUR RESERVATION DATE. Failure to do so may result in a late fee charge of $10.00 per day. There is a drop box at the office if you want to drop the keys off during non-business hours.

** Please do not enter the clubhouse before or after your assigned time or you may be charged an additional days rent. ** Rental Regulations 1 The facility must be left in the same condition as it was when it was received (i.e. floors swept and mopped, bathrooms cleaned, door and windows cleaned). Cleaning supplies are not provided. All trash must be removed and placed in dumpsters outside the facility. The small silver key unlocks the dumpster. Please remember to re-lock when done. 2. A/C and Heat must be turned off. 3. All lights must be turned off. 4. All doors must be locked. Homeowner will be held responsible for any damages caused as a result of not locking the door. 5. All food and beverages must be removed. Alcohol must be kept inside of the clubhouse during the function. 6. All pool rules must be followed at all times. Renting the clubhouse does not allow exclusive use of the pool. All homeowners must be allowed to use the pool at all times.
