The Health Protection Division provides services and initiatives which include supporting the regulatory and health promotion activities of Environmental Health Officers and other health protection professionals. HOME BASED BUSINESS INFORMATION Home based business or home occupation means the accessory use of a dwelling unit for a business by a resident who resides on the premises, provided that the business is secondary to the residential use of the lot and that it does not change the residential character of the lot. I will have the general public entering the above noted business location: Yes Where a Home Occupation is permitted within a Residential zone, the following regulations shall apply: 1. The Home Occupation shall be accessory to the principal use of the premises for residential purposes; 2. The Home Occupation must be carried out wholly within the dwelling unit or within an accessory building; 3. The character and appearance of the dwelling unit or the accessory building must remain residential; 4. Only persons residing in the dwelling unit shall be employed in the Home Occupation; 5. The Home Occupation shall not generate more than two client visits at a time to the site from which the business is being operated; 6. The maximum floor area for a Home Occupation located on the property is 25 % of the total floor area of the principal dwelling to a maximum of 45 m²; 7. Signage for the Home Occupation shall be as permitted by the Sign Bylaw currently in effect. 8. A food catering business operating lawfully within a dwelling may establish one additional kitchen provided that its installation is required by the Health Authority and that the kitchen must be removed should that Home Occupation cease. 9. No nuisance from noise, vibration, smoke, dust, odours, heat, glare, electrical or radio disturbance shall be produced by the Home Occupation; 10. Regulations contained in Section 6 Parking and Loading of the Zoning Bylaw 1770, shall apply. Prohibited Activities for home based businesses: 1. Exterior storage; 2. Business activities outside the principal or accessory use building; 3. The sale or display of any goods, wares, merchandise or foodstuffs which are not produced or made on the premises, except for mail order sales, telephone sales, or goods where the customer does not enter the premises to inspect or pick up the goods, or products incidental to the service provided; 4. Serving and consumption of foodstuffs; 5. On site parking of commercial vehicles larger than 7000 kg gross vehicle weight; and 6. On site parking of heavy industrial equipment. I do not require a space in a commercial building to carry on this business and wish to use my place of residence as my business address. If I am not the owner of the dwelling unit, I have discussed and received permission to operate the home based business from the property owner/manager. I understand that the statutory building schemes and/or strata bylaws may restrict or prohibit home based business use of my property. I understand and agree to the above noted terms, regulations and conditions. Excerpts from City of Armstrong Business Licensing and Regulation Bylaw No. 1637 "Mobile Vendor" means any person who, from a motor vehicle, trailer or cycle, as defined and licensed under the Motor Vehicle Act, sells, or offers for sale food, merchandise or a service, or who advertises or takes orders for goods or services. Business License Transfers 25. No person shall: a) Carry on a business upon any premises other than those described in the initial Business License application; or b) Carry on a business upon purchasing the business or a controlling interest in any business from any person licensed under this bylaw; or c) Change the type of business upon which the Business License is based without first advising the City of Armstrong that a transfer of the original Business License is required. Mobile Vendor 34. No mobile vendor shall operate within the City of Armstrong: (a) (b) Without first having obtained a City of Armstrong Business License; During the period of time that the Interior Provincial Exhibition and Stampede (IPE) is operating within the City of Armstrong. 35. Where food is being sold, the mobile vending unit (vehicle/trailer/cycle) must have a valid permit as required by the Province of British Columbia. 36. No mobile vendor shall operate on or from any municipally owned property, boulevards or highways unless and until the applicant has provided evidence of: (a) (b) Motor Vehicle Liability Insurance with a minimum coverage of$2,000,000; Comprehensive Public Liability and Property Damage Insurance for $2,000,000 inclusive, with the City of Armstrong as an additionally named insured. 37. Every person who operates a mobile vending unit shall be responsible to provide suitable garbage collection containers, and to keep the area around the vending location free of any waste material originating from the vendor's business. 38. Mobile vending units must be attended (staffed) at all times when on a site, and must be removed from the location when not staffed. 39. No mobile vendor shall operate within the City of Armstrong, except for the following conditions: (a) (b) (c) (d) When the zoning on privately owned property allows a mobile vendor; By first obtaining written consent from the City of Armstrong for City owned property, boulevards, and highways; By first obtaining written consent from Armstrong Spallumcheen Parks and Recreation for municipally owned parks, playgrounds and the like; By first obtaining written consent from the School District for government owned school grounds. 40. Where a mobile vendor is catering to or delivering to a residential site, business or construction site, such units shall not park or stop on the traveled portion of a highway, and shall not be stopped at one location longer than is necessary to serve customers, and at no time shall remain stopped for longer than twenty (20) minutes at any one location.
