The property is currently zoned Single Family Residential (R-1-8 AG). The city acquired the property in 2006 for the purpose of drilling a water well; however the well is not functional. The applicant is proposing to purchase the property from the city. The applicant, after receiving approval to consider selling the property will proceed with the acquisition process. During this process the applicant will order a title report, appraisal for valuation for the site, and provide a written offer to purchase the property. Questar gas will be improving the utility service for the residents and businesses in the area. If the property is purchased, the site will go through a conditional use permit review.
Questar Purchase Page 2 ORDINANCE COMPLIANCE 3-1-9 DISPOSAL OF CITY PROPERTY A. Petition: Department heads shall petition the city administrator and mayor to declare property surplus, obsolete or unusable. B. Advertise: Any property thus classified with resale value shall be advertised for sale by the city recorder. C. No Resale Value: Property not deemed to have any resale value shall be disposed of by the department head in the manner deemed to be in the best interest of the public and approved by the city administrator. D. List; Bid Refusal: The department head shall provide the finance director with a list of all such property disposed of so that it may be removed from the list of city assets. The city may refuse any or all bids on items offered for sale. E. Alternative Disposition: In accordance with the terms of Utah Code Annotated section 10-8-2, the city may make a finding that a use or disposition of certain city property provides for the safety, health, prosperity, moral well being, peace, order, comfort or convenience of the inhabitants of the city, in which case the city council may authorize the purchase, receipt, holding, selling, leasing, conveying and other disposition of real and personal property for the benefit of the city, whether the property is within or without the city's corporate boundaries and under the terms of such a finding is not obligated to sell such property at bid but may improve, protect, and do any other thing in relation to this property that an individual could do. CITY COUNCIL CONSIDERATIONS Does the City Council want to entertain selling this property? STAFF RECOMMENDATION If the City Council determines that this property should be sold; then staff will process the appropriate advertisement and receive offers for purchase. The proposed site is owned by North Ogden City. Questar improvements to be made at the site will comply with City requirements including, but not limited to: landscaping, setbacks, fencing and accesses as required by Ordinance 11-10- 15 for a public utility substation. Please review the attached site plan and provide approval to Questar, and its contracted agents, to proceed with the acquisition process. Upon approval, Questar, or its agent, will order a title report and an appraisal valuation of the site to establish market value, provide a written offer to purchase, and obtain necessary permits for construction. Per our discussions and your review of the attached submittal, we anticipate that this request will be included on the Agenda for the City Council meeting on September 8, 2015 for further review and approval.
