MOECC Conditions of Approval 1. The Proponents shall minimize environmental impacts within the Sassafras-Waterdown Woods Provincial Life Science Area of Natural and Scientific Interest (ANSI) by carrying out monitoring studies and mitigation for species at risk during all phases of construction as outlined in the ESR and implement construction best practices to ensure that potential impacts to species at risk are mitigated. 2. The Proponents shall consult with Ministry of Natural Resources and Forestry and Conservation Halton (CH) and implement recommendations that ensure impacts are minimized wherever possible and that any unavoidable impacts to the Sassafras- Waterdown Woods Provincial Life Science ANSI are mitigated. The proponents shall also explore opportunities to enhance the ANSI. 4

MOECC Conditions of Approval 3. The Proponents shall ensure that all activities requiring authorization under the Endangered Species Act, 2007, will not commence until necessary authorizations are in place. 4. During detailed design the Proponents shall consult with CH to determine wildlife road crossing safety measures to be implemented as part of the project. A Wildlife Road Crossing Safety Plan for this project shall be developed by the proponents and submitted to CH for information prior to construction. 5

Proposed Works The proposed works will include: Road widening to accommodate an ultimate 4 lane cross section. The road will be marked as a 3 lane cross section with on-road bike lanes initially until traffic volumes increase; Installation of curb and gutter, a multi-use pathway on the west side and sidewalk placement in certain sections along the east side; Storm sewer installation; New traffic signal at Waterdown Road and Mountain Brow Road; New street lighting; Watermain replacement including replacement on Flatt Road and Ireson Road. Extensive boulevard tree plantings and other revegetation; and, Other utility relocations as required (e.g. Bell, Hydro, gas etc.). 6

Property Acquisition A representative from either the City of Burlington or the City of Hamilton Real Estate Division will contact the affected land owner (ALO) to arrange a meeting in late 2016/early 2017 once detailed design is 90% complete and property requirements are known. A representative from either the City of Burlington or the City of Hamilton Real Estate Division will advise the ALO of the appraiser retained to prepare an appraisal report valuing the property interest the City is looking to acquire. The appraiser will contact the ALO to arrange a mutually convenient time to inspect the ALO property. The ALO will be provided with the appraisal report. The ALO may choose to retain your own appraiser to review the report. 8

Property Acquisition The City of Burlington or the City of Hamilton (depending on jurisdiction) will pay reasonable legal, appraisal and other costs the ALO incurs in determining the compensation, including compensation for replacement of lost landscaping. The City of Burlington and the City of Hamilton s desire is to purchase the property needed for the project. Note, the City of Hamilton s Real Estate staff will need to be comfortable with any agreement that s negotiated, since Hamilton is funding the majority of the costs associated with this Project on an amicable basis. 9
