Members not present: Roger Zimmerman, Arnold Schlei Also present: Lane Loveland, Teal Fyksen, Cindy Kraeger, Rebecca Frisch, Dominque Swangstu, Larry Krueger, Keith Maahs, Jack Sondergard, Lisa Ort-Sondergard, Rick Seefeldt. Called to order at 9:00 a.m., 210 River Drive, Wausau by Chairman Lawson, who explained the rules of the hearing and the reason for the establishment of the Board of Adjustment. 1. Approve April 26, 2018 minutes Motion / second by Piel / Servi to approve April 26, 2018 minutes as distributed. Motion carried by voice vote, no dissent. Lawson appointed Jim Servi as Acting Secretary. 2. The application of Jack & Lisa Sondergard on behalf of JLM & M Properties, LLC for a conditional use permit per 17.205.03 of the General Code of Ordinances for Marathon County Chapter 17 Zoning Code to construct a Business Service Establishment (Central Concrete Cutting) within the G-A General Agriculture district. The parcel is described as part of the NE ¼, SE ¼, Section 33, T28N, R4E, Town of Wien, further described as PIN# 084.2804.334.0974 and a property address of W719 Leroy Street, Edgar WI 54426. Teal Fyksen was sworn in, asked the Board to use the distributed determination worksheets in their decisions and cited the provisions of law which apply. He explained on the public hearing notice the code section was listed incorrectly and should read 17.203.05. Exhibit 1 Staff report: Town of Wien has adopted county zoning. Fyksen discussed Ordinance Section 17.203.05 related to business service establishments. Fyksen discussed the nature of this request is to store trailer and trucks, office area for training purposes and a bathroom for employees and lockers. Servi questioned the proposed parking standards of parallel parking space dimensions of 10 ft. x 20 ft. One handicapped accessible space is required which will be met. Loveland stated the board has to apply the standards the way the code is written. Piel questioned the distance to the nearest driveways and clarification as to if there were any concerns related to traffic or nearby driveways. Staff stated the existing driveway will be used for the business and if any driveway changes were to occur it would be a town issue. Jack Sondergard was sworn in. He stated the parking space dimension will not be an issue due to adjacent land to allow the additional parking space requirements. Sondergard verbally amended his application to meet the 9 x 23 feet parallel parking space dimension as required in Marathon County Chapter 17 Zoning Code. Sondergard explained the business repairs joints on highways, hospitals, and schools. No work is done on site therefore traffic will be minimal. Applicant will meet any other required applicable regulations. Chair Lawson asked for any additional testimony. There was no additional testimony in favor, opposed, or as interest may appear. Testimony portion of the hearing closed at 9:30 a.m. Motion / second by Piel / Servi to grant the Conditional Use application request of Jack and Lisa Sondergard JLM & M Properties as submitted to construct a Business Service Establishment (Central Concrete Cutting) with the verbal amendment to meet the parking space dimensions. Code allows for 1800 square feet of floor area, 14 side walls, 24 overall height, 12 overhead garage doors. This application is for 2,376 square feet of floor area. Applicant will meet any other required applicable regulations. A parcel combination is in process. Lawson discussed if the size is substantial or unusual in the general area. The town did not have any concerns listed on the resolution. Piel commented the proposed accessory structure is similar in size to the other structures located on the property. Krueger was sworn in and is the owner of the parcel. The detached garage will be used for his collection of cars. Seefeldt was sworn in and is the County Board Supervisor in the area. He is in favor of the detached accessory structure. The building will not be highly visible and neighbors will not be affected. There was no additional testimony in favor, opposed, or as interest may appear. Testimony portion of the hearing closed at 9:50 a.m. Motion / second by Servi / Piel to grant the conditional use request. Motion carried by unanimous roll call vote. 4.
