Guidelines Relative to Residing at Bay Pointe at Cortez If you are a new Owner or a new Tenant we take this opportunity to welcome you to Bay Pointe at Cortez and trust you will enjoy your time here. Bay Pointe at Cortez is a Condominium Association formed under Florida Statute 718, and as such its operation is governed by various condominium documents which include the Condominium Declaration, the Articles, the By-laws and the Rules and Regulations. These documents can be found and downloaded from the following website, http://www.argusmgmt.com. Owners can contact Jennifer Johnson for the website password. Call941927-6464, Ext. 142, or emailjennifer atjennifer@argusmgmt. com.tenants can retrieve applicable documents from the website without password protection. Click on theassociation Forms & Documentstab across the top,then click on the Select Property down-arrow,and thenclick onbay Pointe at Cortez. Below we have highlighted some key rules that we feel you should be made aware of before you occupy your unit. At your earliest convenience we recommend you familiarize yourself with all the Associations documents. These rules are meant to ensure the enjoyment of your property and the safety of all of our residents. If you have any concerns or questions that you need answered then you should contact our Community Manager, Jennifer Johnson. 1. If as an Owner you are considering leasing your unit, you should make yourself familiar with the various rules and requirements covering leasing. All leases are required to receive the prior approval of the Board. Tenants are required to have background checks completed and their application approved before a unit is occupied by the tenant. The Lease Application forms can be found on the Argus website.a lease may be for no less than 3 months. If a lease is renewed, thenjennifer Johnson needs to be advised of the new expiration date. 2. The total number of permitted occupants of a Unit is the number of bedrooms times two. For example, a 2 bedroom unit may have a maximum of 4 occupants of all ages. Any person staying in a unit for more than 2 nights is defined as an occupant. 1
Occupancy is limited to the names of those listed on the application form except that persons staying two nights or less are guests. Guests are limited to 2 persons per unit. 3. Tenants who wish or choose to co-share their unit must have the Owners permission and the co-share occupants must complete the lease application form and be approved. 4. Tenants are NOT allowed to have Pets. 5. Owners are allowed two (2) pets, each with a maximum weight limit of 25 lbs. Pets are to be exercised on leashes and pet waste has to be picked up and disposed of by the owner in the pet waste stations provided. No pets that are listed on the American Kennel Clubs Dangerous Breed list are allowed. Pets are not a right but a privilege and if they become a nuisance the owners can be asked to remove the pet. 6. If there is a need for an "ACCOMMODATION ANIMAL the purchaser needs be familiar with Bay Pointe s ACCOMMODATION ANIMAL POLICY, and fill out an: ACCOMMODATION ANIMAL POLICY ACCOMMODATION ANIMAL APPLICATION, plus a MEDICAL RELEASE and REQUEST FOR INFORMATION FORM All forms are available as downloads on the Argus website www.argusmgmt.com. As a resident you are responsible for disposing of your household trash/garbage in the trash compactor located at the 51st Street West entrance to the Village at Cortez Apartments. You are not allowed to store any items at any time outside the unit. Nor can anything be placed in the water heater closets serving each unit; this would be a Fire Department code violation. 9. The Owner should be in possession of keys for their unit, their mailbox and the front pedestrian gate and pool access key. If leasing a unit, the owners or their agent must ensure the tenants are provided with the appropriate sets of keys. Gate codes are 2
not an acceptable alternative. Replacement or additional gate access cards or fobs can be purchased from Argus Management. The gate system computer should have current resident details and phone number contacts added by the Manager of the Village at Cortez Apartment Office or via email to Jennifer Johnson who will arrange the same. If you have a 941 area code you can open the gates from your landline phone to allow your guests access. 10. Commercial vehicles, trailers, boats and recreational vehicles are not allowed to be parked on the Bay Pointe property overnight. Private cars with advertising on them are classed as commercial vehicles. Pick-up trucks without advertising are allowed but nothing must be stowed in the back. Contractor s vehicles are allowed to be parked on the property while the driver is carrying out his work assignment. 11. All Units are assigned one parking space which is identified by the unit number being painted on the bumper strip and floor. Some units, but not all, have a carport. Carports are privately owned and are included within the Title of a unit.parking in other than your own carport, if your unit has one, may result in your vehicle being towed without warning.parking in other than your assigned space can also result in your vehicle being towed. If you or your visitors and guests require additional parking you must use one of the many spaces marked VISITOR. 12. Maintenance of vehicles that involves oil changes, dismantling or painting are not allowed on the Bay Pointe property. All vehicles must be kept in a good state of repair. Vehicles are required to have current tags. Vehicle owners are required to have the vehicles insured and hold the Association harmless from all claims. Parking on the Bay Pointe property is at the owner s risk. Drivers of vehicles must have a current driver s license. 13. Swimming Pool Area. The swimming pool area is for Bay Pointe residents only; i.e. only those who actually reside at Bay Pointe Residents and their Guests use the pool at their own risk since there is no lifeguard on duty. All children must be accompanied and supervised by a parent or guardian at all times. 3

If residents observe people gaining unauthorized access they should report this by sending a text to 941 321-0543 Police may be called and unauthorized persons charged with trespassing NO pets are allowed in the pool area NO bikes, skate boards, etc. are allowed in the pool area NO food, beverages or alcohol are allowed in the pool or in the pool area NO glass containers of any kind in the pool area NO smoking, including E-cigarettes, in the pool or in the pool area NO diving, running, rough-housing or ball playing in the pool area NO persons with open cuts or skin infections may enter or remain in the pool NO incontinent (unable to control bladder or bowels) persons in the pool NO cut-off jeans or shorts used as substitute for swimwear NO surfboards or rafts (flotation devices as swimming aids are permitted ) NO nudity Children that are not toilet trained must wear tight fitting rubber briefs Audio equipment only allowed with the use of headphones ID cards are required at all times and must be shown upon request by authorized representatives of the association Any activities which unreasonably disturb the peaceful enjoyment of the pool area by other persons are prohibited The pool is closed during severe weather Care of the pool area Use of the deck furniture is on a first come first serve basis. No reserving of this furniture is permitted and unattended items found on chairs will be removed Deck furniture should be returned to their original positions after use and must not be removed from the pool area Deck furniture must remain at least 4 feet from the edge of the pool All persons should shower to remove lotions, sand, etc. before entering the water No substance such as soap or shampoo may be used in the pool area Violations of these rules may result in removal of the offending party from the pool area 4
14. Pest Control Service is provided by PestShield Services.Please call them directly at 941 342-7378to make arrangements for treatment. 15. Barbeque grills are not to be stored in the unit or in the water heater closet. Gas bottles and liquid fuels are not to be stored in the unit or on the property at any time. Barbeque grills are not to be used within 12 feet of the nearest point of the building structure. This normally would be the support post of the Porch roof. This is a Fire Department requirement. 16. Bike racks are available for the use of all residents. Bikes are not to be chained to porches or any outside elements other than bike racks. Use Bike racks at your own risk. The association is not responsible for personal property in Common Areas. 17. If you smoke outside, you must have a receptacle for cigarette butts outside your unit. Please keep these butt receptacles and surrounding areas clean and tidy. 18. Please be a good neighbor and report any crimes you witness at Bay Pointe.To report crimes anonymously call Crime Stoppers at 1-866-634-8477 (TIPS).
